$1 Million Bail for Man Who Allegedly Shot Deputy

BOSTON, Aug. 6, 2013—A man who was shot after he took possession of a deputy sheriff’s firearm was arraigned from his hospital bed this afternoon, Suffolk County District Attorney Daniel F. Conley said.

RAYMOND WALLACE (D.O.B. 5/5/77) of Marblehead was arraigned from his hospital bed in Massachusetts General Hospital this afternoon on charges of unlawful possession of a firearm, assault and battery by means of a dangerous weapon, assault and battery on a public employee, and escape.

At the request of Assistant District Attorney Lynn Feigenbaum of the DA’s Senior Trial Team, Boston Municipal Court Judge Jonathan Tynes set bail in the amount of $1 million.  This amount is in addition to bail set in separate cases in Essex County.

According to prosecutors, Wallace, a pretrial detainee on the Essex County offenses, was in the custody of two Middlesex Sheriff’s Office deputies who had escorted him to the Massachusetts Eye and Ear Infirmary in Boston on Wednesday for treatment of an eye injury sustained in an altercation at the jail.  Wallace’s handcuffs were removed to allow him to use a restroom, however his leg restraints remained in place, prosecutors said.

While in the restroom, Wallace was able to free himself from the restraints and attempted to make his way toward an emergency room exit, pushing one deputy against a wall in the process, prosecutors said.

As the other deputy attempted to stop Wallace, the defendant grabbed at that deputy’s firearm, prosecutors said.  Wallace discharged the firearm during the course of the struggle, striking the deputy in the leg.

The uninjured deputy at that time gave numerous commands to put down the weapon, of which Wallace had gained control.  The deputy then fired his service weapon, striking Wallace three times before he released control of the weapon.

Wallace was represented by attorney David Grimaldi.  He is expected to appear in Boston Municipal Court on Sept. 4.
