BOSTON, Dec. 31, 2012—A South End man was charged with armed robbery today after he allegedly stole a hair dryer, condoms, cologne, and other items from a man he’d met online, Suffolk County District Attorney Daniel F. Conley said.

MARCUS JACKSON (D.O.B. 8/17/87) was arraigned in West Roxbury District Court today in connection with yesterday evening’s incident. Assistant District Attorney Kristina Kerwin recommended that he be held on $10,000 cash bail and Judge Ernest Sarason set bail at $1,000. more »

BOSTON, Dec. 27, 2012—Three men from Cambridge were arraigned in Boston today after a handgun was recovered from their car, which matched the description of a vehicle from which shots were fired in Chinatown early this morning, Suffolk County District Attorney Daniel F. Conley said.

DARIO SANTOS, Jr. (D.O.B. 5/9/89); ERIC SMALL, Jr. (D.O.B. 8/21/90); and KADEEM WINSPEARE (D.O.B. 3/14/90) were all charged in the Boston Municipal Court with unlawful possession of a firearm, unlawful possession of ammunition, unlawfully carrying a loaded firearm, discharging a firearm within 500’ of a building, and possession of a Class D substance with intent to distribute. more »

BOSTON, Dec. 27, 2012—Two Dorchester men were arraigned this week for allegedly robbing a man at gunpoint on Christmas Eve, District Attorney Daniel F. Conley said.

At proceedings yesterday in Dorchester District Court, JOHN CESAR (D.O.B. 3/13/92) and ANTIOWANE DAVIS (D.O.B. 8/30/93) were arraigned on charges of armed robbery and unlawful possession of a firearm; Davis was additionally arraigned on a breaking and entering charge.  Assistant District Attorney Michael DiStefano requested Cesar’s bail be set at $25,000 and Davis’ at $50,000.  Judge Robert N. Tochka ordered $5,000 bail for Cesar at $10,000 for Davis. more »

BOSTON, Dec. 24, 2012—A Christmas season traveler was held on high bail today after State Police and Homeland Security officials found almost four kilograms of cocaine in the tires of a wheelchair he was using for no apparent medical purpose, Suffolk County District Attorney Daniel F. Conley said.

Arrested Friday at Logan International Airport, EMMANUELLI ROJAS-MORAZA (D.O.B. 3/25/79) of Carolina, Puerto Rico, was arraigned today in East Boston District Court on one count of trafficking in more than 200 grams of cocaine. Judge Tracy-Lee Lyons set his bail at $45,000 cash. more »

Boston, Dec. 20, 2012 — A Brighton man was held without bail at his arraignment on charges of murder and armed robbery in the November shooting death of Leroy Cooper, Suffolk County District Attorney Daniel F. Conley said today.

Boston, Dec. 20, 2012 – An Everett man pleaded guilty yesterday to hitting a woman in the head with a Louisville Slugger baseball bat on Halloween two years ago, District Attorney Daniel F. Conley said today.

CARMEN PICARDI (D.O.B. 1/17/71) pleaded guilty to a charge of aggravated assault and battery with a dangerous weapon for the 2010 attack on a 21-year-old Medford woman. Assistant District Attorney Nicholas Walsh recommended a sentence of three to five years in state prison. Suffolk Superior Court Judge Carol S. Ball sentenced Picardi to two to three years. more »

Boston, Dec. 19, 2012 – A former union official has been found guilty in the theft and misuse of more than $100,000 in union funds, District Attorney Daniel F. Conley said today.

A Suffolk Superior Court jury deliberated for only two and a half hours before finding JOHN HORAN (D.O.B. 7/16/64) of Spencer guilty of two counts of larceny over $250 by scheme. Sentencing will take place in January. more »

Boston, Dec. 19, 2012 – A man convicted yesterday of beating and strangling Frederick Allen of Chelsea received a mandatory sentence of life in prison, District Attorney Daniel F. Conley said.

MARIO CRUZADO (D.O.B. 7/10/73) was sentenced by Suffolk Superior Court Judge Linda Giles in the 2010 murder of 56-year-old Frederick Allen of Chelsea inside the victim’s Bellingham Street apartment.  A jury deliberated for half a day before finding Cruzado guilty of first-degree murder, which carries an automatic life sentence. more »

BOSTON, Dec. 18, 2012—The man who beat and strangled 56-year-old Frederick Allen in his Chelsea apartment two years ago was convicted of first-degree murder late today, Suffolk County District Attorney Daniel F. Conley said.

BOSTON, Dec. 17, 2012—A Mattapan man will spend the rest of his life in prison for the murders of Amanihotep Smith, Eyanna Flonory, Lavaughan Washum-Garrsion, and Simba Martin after a home invasion and robbery two years ago, Suffolk County District Attorney Daniel F. Conley said.

DWAYNE MOORE (D.O.B. 6/25/77) was convicted of four counts of first-degree murder and single counts of armed robbery and home invasion in the Sept. 28, 2010, massacre near the intersection of Woolson and Wildwood streets in Mattapan. The jury, drawn from a panel of Worcester County residents on a motion by Moore’s attorney, acquitted him of three additional charges related to the non-fatal shooting of a fifth victim. more »

BOSTON, Dec. 13, 2011—Two men were arraigned today for allegedly beating a Chelsea man in the head with a tire jack in a dispute that may have arisen over a pair of stolen sneakers, District Attorney Daniel F. Conley said.

ALEXANDER GUEVARA (D.O.B. 2/23/91) of Chelsea and ANTONIO RIVERA (D.O.B. 10/2/91) of Boston were formally charged in Chelsea District Court after their arrests last night by Chelsea Police for the Sunday afternoon incident. Rivera was charged with assault with a dangerous weapon, assault and battery, and possession of a class B substance. Guevara faced a single count of assault and battery with a dangerous weapon for allegedly wielding a tire jack during the attack. more »

BOSTON, Dec. 10, 2011—A Roxbury man freed from a five-year prison term amid an ongoing probe of the state’s former drug testing facility was back in court today after allegedly supplying crack cocaine to a drug dealer, Suffolk County District Attorney Daniel F. Conley said today.

LOUIS ANTHONY WILLIAMS (D.O.B. 11/12/82) was arraigned in the Boston Municipal Court today on a charge of distributing a Class B substance as a second or subsequent offense. The charge follows four prior drug distribution convictions, including one in Suffolk Superior Court for which he was sentenced to five years in state prison but was released because the chemist who tested the drugs is now under investigation. more »

BOSTON, Dec. 10, 2012—Two men were sentenced to prison in recent weeks after admitting their guilt in cases of sexual violence involving family members, Suffolk County District Attorney Daniel F. Conley said.

On Nov. 29, PEDRO ALVAREZ (D.O.B. 12/3/64) of Boston’s South End pleaded guilty to multiple counts of rape of a child and indecent assault and battery for assaults on two young girls and one young boy in his extended family. Assistant District Attorney Alissa Goldhaber recommended that he serve eight to 10 years in state prison, followed by 10 years of probation upon his release. more »

BOSTON, Dec. 7, 2012—A member of the state’s second-highest court today joined Suffolk County District Attorney Daniel F. Conley’s senior staff during a day-long training for district court prosecutors.

Associate Justice Joseph A. Grasso, Jr., of the Massachusetts Appeals Court spoke for an hour and a half on a variety of topics faced by prosecutors in what is often their first assignment – the fast-paced world of district and municipal court. Grasso focused his remarks primarily on matters of search and seizure, the subject of his 2011 book, Suppression Matters under Massachusetts Law. more »

BOSTON, Dec. 6, 2012—Suffolk County District Attorney Daniel F. Conley is joining former state senator Jarrett Barrios and Jane Doe Inc. in an annual call for men to help stop violence against women.

Conley was selected to co-chair the sixth annual Massachusetts White Ribbon Day Campaign, which remembers the 1989 massacre of 14 women on a Montreal college campus. The campaign was created to urge men to make a pledge not to commit, condone, or remain silent on violence against women. more »

BOSTON, Nov. 30, 2012—Two men were held on high bail today following their arraignments for a Brighton housebreak that investigators believe was intended to be a drug robbery, Suffolk County District Attorney Daniel F. Conley said.

Acting on a request by Assistant District Attorney Luke Goldworm, Brighton District Court Judge David T. Donnelly imposed bail of $100,000 on RICARDO DELICE (D.O.B. 5/25/94) of Brockton and LEON McKOY (D.O.B. 10/8/93) of Dorchester. BOSTON, Nov. 29, 2012—A Hyde Park man was sentenced to jail time this week after Suffolk prosecutors proved he possessed a stolen box of toys intended as Christmas gifts for a young boy, District Attorney Daniel F. Conley announced.

A West Roxbury District Court jury on Tuesday convicted ERNEST POLITE (D.O.B. 10/4/72) of receiving stolen property for the Dec. 24, 2011, theft of a parcel from in front of a Jamaica Plain home. A judge ruled that the evidence was not sufficient to support an additional charge of trespassing. more »

BOSTON, Nov. 27, 2012—A Suffolk Superior Court jury late today found two Dorchester men guilty of their roles in the 2010 shooting death of Toneika Jones, 24, in the foyer of a Dorchester apartment building, Suffolk County District Attorney Daniel F. Conley said.

Jurors deliberated for about a day and a half before convicting KADEEM FOREMAN (D.O.B. 8/6/89) guilty of second-degree murder for shooting Jones to death. Jurors also convicted him of assault and battery with a dangerous weapon and firearms offenses for the non-fatal shooting of a second victim who survived his injuries. Jurors also convicted TERRELL RAINEY (D.O.B. 8/14/89) of involuntary manslaughter for his role in the slaying, but acquitted him of firearms offenses and charges related to the second victim. more »

BOSTON, Nov. 20, 2012—The man who allegedly gunned down 22-year-old DeAndre Russ was out on bail for an earlier gun arrest at Ashmont Station, Suffolk County District Attorney Daniel F. Conley said today.

DANIEL YARDE (D.O.B. 9/16/90) of Dorchester was arraigned today on a murder charge stemming from Russ’ shooting death outside a Tremont Street apartment building late last month. Assistant District Attorney Julie Higgins recommended that he be held without bail on that case and that his open bail on a 2010 gun case be revoked. BOSTON, Nov. 19, 2012—A Roxbury man already on probation for conspiring to distribute methamphetamine was arraigned today after he received an Express Mail package containing a large amount of the illicit stimulant, District Attorney Daniel F. Conley said.

RICHARD SWANSON (D.O.B. 2/10/60) of Roxbury was arraigned on a charge of trafficking in methamphetamine at his arraignment today in Roxbury District Court. Assistant District Attorney Ashley Wirth requested Swanson’s bail be set at $75,000 bail. Judge Pamela M. Dashiell did not impose bail, but Swanson was held on a probation detainer based on a 2010 conviction out of Roxbury for conspiracy to violate the state’s drug laws in a case that also involved the distribution of methamphetamine. more »

BOSTON, Nov. 19, 2012—Two former Roxbury men already detained on other matters have been indicted for the 2010 daytime murder of 18-year-old Terrence Kelley in the Grove Hall neighborhood, Suffolk County District Attorney Daniel F. Conley said.

The Suffolk County Grand Jury on Nov. 14 returned indictments charging DARIUS GIBSON (D.O.B. 8/16/90) with murder, unlawful possession of a firearm, and witness intimidation. JAMES AUSTIN (D.O.B. 3/14/88) was indicted Oct. 17 for misleading Boston Police investigating the case and being an accessory after the fact to Kelley’s murder.  He was held on $100,000 bail at his arraignment. more »

BOSTON, Nov. 16, 2012—A Brighton woman used her knowledge of the American legal system and position at the Registry of Motor Vehicles to scam illegal immigrants out of thousands of dollars, then threatened to have them deported when they demanded their money back, Suffolk County District Attorney Daniel F. Conley said today.

ADRIANA FERREIRA (D.O.B. 6/28/64) of Brighton was arraigned today on a 27-count indictment charging five counts of larceny by false pretense, four counts of attempted larceny by false pretense, four counts of conspiracy to falsely make or obtain a Massachusetts driver’s license, and 14 counts of bribery under two separate statutes. The indictments, returned on Nov. 13, are the result of a long-term investigation by U.S. Immigration and Customs Enforcement’s Homeland Security Investigations agents, Massachusetts State Police, and Suffolk County fraud prosecutors. more »

BOSTON, Nov. 16, 2012—A Nevada woman missed her arraignment on drug trafficking charges yesterday because she was busy being arrested for allegedly beating her tiny dog, District Attorney Daniel F. Conley said today.

ANA PRADO (D.O.B. 3/12/86) of Henderson, Nevada, was arraigned in Superior Court this morning on an indictment handed down on Oct. 15 charging her with trafficking in oxycodone over 200 grams. The indictment moves her case from East Boston District Court, where she had previously been charged, to Suffolk Superior Court, where it will be adjudicated. Prado had been expected in court yesterday on that charge but missed it because MBTA Transit Police arrested her on an animal cruelty charge at Boston’s South Station. more »

BOSTON, Nov. 15, 2012—As part of an ongoing effort to reduce child fatalities in Boston and Suffolk County, District Attorney Daniel F. Conley will speak about infant safe sleep practices with a group of expectant mothers, health workers, and community members in Roxbury next week.

Sudden Infant Death Syndrome is the leading cause of death of infants between 1 month and 12 months of age. Half of all sudden, unexpected infant deaths are attributed to SIDS, with even higher rates seen among some minority groups. While the cause of SIDS is still unknown, health experts recommend using safe sleep practices in efforts to reduce SIDS and other sleep-related infant deaths. more »

Boston, Nov. 13, 2012—A Dorchester who recently won an early release from a three-year prison sentence amid a crisis at the state drug lab today found himself back in court after he was arrested once again on a new drug distribution case, Suffolk County District Attorney Daniel F. Conley said.

Assistant District Attorney Larry Bates recommended that TORRIE HAYNES (D.O.B. 9/14/82) be held on $10,000 bail at his arraignment on charges of distribution of a Class B substance as a subsequent offense, resisting arrest, and two counts of assault and battery on a police officer. Bates also asked that his bail out of Suffolk Superior Court, where a judge stayed his earlier sentence last month, be revoked. more »

BOSTON, Nov. 9, 2012—A Boston paramedic was arraigned today on a 73-count indictment charging him with the theft of prescription drugs intended for the sick and injured, mainly from ambulances serving the City of Boston, Suffolk County District Attorney Daniel F. Conley said today.

The indictments, returned by the Suffolk County Grand Jury on Oct. 31, charge BRIAN BENOIT (D.O.B. 7/28/72) of South Boston with one count of larceny by scheme and 26 counts of larceny of a controlled substance for allegedly stealing prescription painkillers and sedatives from more than 100 vials and syringes; 24 counts of creating a counterfeit substance for allegedly replacing some of those medications with other clear liquids; and 22 counts of manufacturing Class B, Class C, and Class E controlled substances for allegedly replacing some of those medications with different liquids, transforming the contents into different or diluted controlled substances. more »

BOSTON, Nov. 8, 2012—A convicted drug dealer was arraigned today as an armed career criminal after Boston Police recovered two loaded firearms from a room occupied moments earlier by a child, Suffolk County District Attorney Daniel F. Conley said.

MAGNETIC TOM (D.O.B. 1/28/82), a.k.a. TOM MAGNETIC, was charged with two counts each of unlawful possession of a firearm, improper storage of a firearm, and unlawful possession of ammunition. BOSTON, Nov. 1, 2012—Boston, state, and federal officials today announced the seizure of a massive amount of heroin in East Boston and the arraignment of two men arrested in connection with it.

Suffolk County District Attorney Daniel F. Conley’s office today arraigned MIGUEL ANTONIO RIVERA (D.O.B. 9/30/77) of Chelsea on charges of trafficking in more than 200 grams of a Class A substance in a school zone for the 19 kilograms of heroin recovered yesterday afternoon. East Boston District Court Judge Kenneth Fiandaca imposed $200,000 cash bail and ordered that Rivera wear a GPS monitoring device, surrender his passport, and remain within 10 miles of Boston if he posts that amount. more »

Boston, Nov. 1, 2012—A man charged with stealing an East Boston girl’s cell phone at knifepoint was caught after he inadvertently used it to upload self-portraits to the victim’s Facebook page, District Attorney Daniel F. Conley said today.

WILMER VELASQUEZ (D.O.B. 3/27/93), who claims addresses in both East Boston and South Boston, was arraigned yesterday in East Boston District Court on a charge of armed robbery. Judge Kenneth Fiandaca set bail at $5,000, the amount requested by Assistant District Attorney Janine D’Amico. If he makes bail, Velasquez must wear a GPS monitoring bracelet and abide by a curfew of 9:00 p.m. to 6:00 a.m. more »

BOSTON, Oct. 28, 2012–State Police detectives assigned to the Suffolk DA’s office and Chelsea Police are investigating a fatal shooting on Clark Avenue last night.

Chelsea Police responded to a call for shots fired in the area of 48 Clark Ave. at about 7:30 p.m. On arrival they found a 35-year-old man suffering from what appeared to be fatal gunshot wounds.  The man was transported to Massachusetts General Hospital, where he was pronounced dead of his injuries a short time later.  The man’s identity is being withheld until his family is notified. more »

BOSTON, Oct. 26—A Roslindale man already facing one cocaine trafficking charge was arraigned today on another after a joint local and federal task force recovered just under a pound of cocaine from his residence, Suffolk County District Attorney Daniel F. Conley said.

ENRIQUE CAMILO (D.O.B. 6/17/74) was arraigned today on charges of trafficking in cocaine as a second or subsequent offense. Assistant District Attorney Evandro Carvalho recommended bail of $1,000,000 in the Suffolk case, revocation of the defendant’s bail in the earlier case, and surrender of the defendant’s passport; Judge Ernest Sarason imposed $100,000 cash bail, declined to revoke the open bail, and ordered that Camilo surrender his passport. more »

BOSTON, Oct. 26, 2012—The Suffolk County Grand Jury today returned an indictment charging a Boston Police officer with crashing into another car while driving drunk off-duty, leaving the other driver severely injured, District Attorney Daniel F. Conley announced.

The indictment moves the case against RICHARD JEANETTI (D.O.B. 8/27/76) of Hyde Park from West Roxbury District Court, where he was initially charged with the May 24 collision, to Suffolk Superior Court, where the case will ultimately be adjudicated. Conley Names Fourth Prosecutor to Lab Crisis Task Force

BOSTON, Oct. 22, 2012—A man currently under indictment for murder is among the defendants whose cases will be heard in Suffolk Superior Court this week for specialized post-conviction sessions related to a former Department of Health drug lab chemist accused of mishandling evidence.

ANTHONY THAMES (D.O.B. 2/22/83) is charged with first-degree murder and unlawful possession of a firearm for allegedly shooting Raymond Lamar to death in Boston’s South End on the morning of Aug. 6, 2011. Shortly after his arrest on that offense, Thames pleaded guilty to possession of a Class B substance as a second or subsequent offense and distribution of a Class B substance as a second or subsequent offense. He is currently serving a five-year state prison term for that conviction. more »

BOSTON, Oct. 19, 2012—A Dorchester man convicted of sexually assaulting two young children was sentenced yesterday to three to five years in state prison, District Attorney Daniel F. Conley said.

After five days of testimony, a Suffolk Superior Court jury deliberated for just an hour and a half on Wednesday before convicting HAK WONG (D.O.B. 3/3/54) of one count of rape of a child and three counts of indecent assault and battery on a child under 14. Wong assaulted the children on various dates between January and May of 2011. The victims in this case were two young children known to the defendant but not related to him; prosecutors are not releasing the location of the assaults or the children’s ages to protect their privacy. The abuse came to light after one victim’s mother noticed that the child appeared to be afraid of Wong. more »

BOSTON, Oct. 18, 2012—A dead man identified as a suspect in one 1970s murder is now believed to have committed a second based on DNA evidence unavailable at the time of the crimes, Suffolk County District Attorney Daniel F. Conley and Boston Police Commissioner Edward Davis said today.

Conley and Davis today identified MICHAEL SUMPTER (D.O.B. 9/26/47) as the assailant in the Dec. 12, 1973, homicide and sexual assault of 24-year-old Mary Lee McClain in her Beacon Hill apartment. The investigation at the time revealed that an unknown perpetrator had gained access to the Mount Vernon Street apartment she shared with two roommates, raped her, and strangled her to death. Though Boston Police homicide detectives seized evidence from the scene and conducted several interviews, no suspect was identified until a grant-funded cold case investigation led to Sumpter in May of this year. more »

JORGE MERINO (D.O.B. 11/8/80) admitted his guilt yesterday in the homicide of Jose Joaquin Ramirez, a 33-year-old laborer from Honduras, pleading guilty to the crime of voluntary manslaughter before Suffolk Superior Court Judge Edward Liebensperger. Merino accepted a 17- to 20-year prison sentence and forewent any appeal of his conviction rather than face trial on the indicted charge of first-degree murder. more »

BOSTON, Oct. 15, 2012—A Charlestown man was held on $20,000 cash bail at his arraignment on charges that he possessed child pornography on his laptop computer and a portable flash drive, Suffolk County District Attorney Daniel F. Conley said.

The bail imposed by Charlestown District Court Judge Lawrence McCormick was less than the $100,000 recommended by Assistant District Attorney Gloriann Moroney, chief of Conley’s Child Protection Unit. BOSTON, Oct. 10, 2012—Five men were arraigned and a warrant issued for a sixth after their arrests by Boston Police in a sting targeting the demand for sexual services from girls under 18, Suffolk County District Attorney Daniel F. Conley said.

The following defendants were arrested throughout yesterday afternoon and evening by Boston Police detectives assigned to the Human Trafficking Division and other specialized units. Each is charged with seeking sex for a fee, which carries a maximum of one year in a house of correction, and enticement of a person under 18, which carries up to five years in state prison. BOSTON, Oct. 5, 2012— A Boston Municipal Court judge today stayed further execution of sentences for two Boston men after Suffolk County District Attorney Daniel F. Conley’s office determined that the drug evidence in both cases was handled by a former chemist now accused of obstruction of justice.

Today’s proceedings took place in a special session intended to address district court cases affected by a chemist accused of tampering with drug evidence at a Department of Public Health drug-testing facility. A total of 19 cases were selected by the court; on further review by prosecutors, however, only five were affected by the crisis at the now-closed lab. Of those five, three either rejected a stay of their sentences for procedural reasons related to concurrent sentences in other jurisdictions or had already completed the sentences at issue. more »

BOSTON, Oct. 3, 2012—A single justice of the Massachusetts Supreme Judicial Court this week ruled that the remaining post-conviction motions pertaining to the 1986 murders of Frank Chiuchiolo and Joseph Bottari in Boston’s North End will be addressed by the judge who heard presided over the two killers’ second trial, Suffolk County District Attorney Daniel F. Conley said.

In a ruling entered late Monday, Justice Francis X. Spina remanded the case against LOUIS COSTA back to Chief Justice for Administration and Management Robert Mulligan, who presided over Costa’s 1994 trial and conviction as a Superior Court judge. Revere police and firefighters responded to 52 Rose St. at about 9:20 p.m. after a smoke alarm activation. On arrival, they found an adult male unresponsive inside the residence. The deceased, a man in his 50s, has been identified but authorities are not releasing his name until his family can be located and identified. Conley’s office this week asked that one drug defendant be released without monetary bail but urged a judge to keep another held on high bail as Boston’s prosecutors assess the effects of an investigation at a state drug laboratory on thousands of their cases.

At a previously scheduled pre-trial appearance for EDWARD DANCY (D.O.B. 9/15/70), Assistant District Attorney Macy Lee, chief of the DA’s Narcotics Unit, on Wednesday recommended that Suffolk Superior Court Judge Christine Roach reduce Dancy’s bail from $30,000 to personal recognizance. ROBERT MCTERNAN (D.O.B. 7/8/87) of Newbridge, Ireland, was arraigned in Boston Municipal Court today on a single count of armed robbery. MARVIN VEIGA (D.O.B. 2/15/89) of Quincy pleaded guilty today to unlawful possession of a rifle, unlawful possession of a large-capacity weapon, carrying a loaded firearm, and unlawful possession of a large-capacity feeding device for the Colt .223 Sporter rifle he possessed on the night of Jan. 8, 2011. He also pleaded guilty to resisting arrest and two counts of assault with a dangerous weapon for pointing it at pursuing Boston Police officers. South Boston District Court Judge Michael Bolden yesterday ordered the case against MATTHEW BERKOWITZ, 32, continued without a finding for a period of two years. Four Students’ Cases Still Pending

Nonprofits Invited to Seek Money Seized from Drug Dealers 

BOSTON, June 26, 2012—Suffolk County District Attorney Daniel F. Conley today invited area non-profit organizations that work with kids and teens to apply for his annual series of free cash awards to provide the young people of Boston, Chelsea, Revere, and Winthrop with constructive alternatives to crime and drug use.

The annual grants, which this year total an estimated $50,000, are disbursed from Conley’s Asset Forfeiture Community Reinvestment Program, which takes cash and assets seized from drug dealers and awards them to Suffolk County organizations that work to help young people. more »

Both convicted of first-degree murder yesterday, JOSHUA FERNANDES (D.O.B. 8/8/93) and CRISOSTOMO LOPES (D.O.B. 2/27/90) faced the mandatory term for that offense this morning. Rebecca Payne, a 22-year-old student at Boston’s Northeastern University, was shot dead in her Mission Hill apartment in the early morning hours of May 20, 2008; four years later, Suffolk County District Attorney Daniel F. Conley announced indictments charging a convicted drug dealer with murdering her in a case of mistaken identity and a customer of that man with lying to the Suffolk County Grand Jury during the course of the investigation.

After four years of investigation, CORNELL SMITH (D.O.B. 12/19/81) was indicted April 27 for first-degree murder, armed assault in a dwelling, and unlawful possession of a firearm, all in connection with the May 20, 2008, slaying. BOSTON, June 17, 2012—Suffolk County District Attorney Daniel F. Conley’s office has filed paperwork seeking a new sentence for a violent serial rapist after the Massachusetts Appeals Court reversed the man’s earlier convictions on an unrelated home invasion, potentially putting him on the street decades earlier than the sentencing judge anticipated.

Conley’s office on Friday moved for a hearing at which prosecutors would once again seek their original recommended sentence of life plus 40 years for MICHAEL JOHNSON (D.O.B. 4/9/69) on two counts of aggravated rape and one count of attempted rape for which he was convicted in 2010. Those convictions stem from anApril 10, 1990, assault on a 23-year-old woman in her Wellington Street home; aMay 7, 1990, assault on a 24-year-old woman in her West Concord Street home; and an assault on that woman’s 30-year-old roommate on the same date. In those cases, Johnson broke into the victims’ residences, cut their telephone lines, attacked and forced himself on them, and fled with money or valuables. more »

LEROY MARTIN (D.O.B. 9/27/77) was arraigned in Chelsea District Court today on a total of 10 offenses including unlawful possession of a firearm, improper sale of a firearm, unlicensed sale of ammunition, and being a Level III armed career criminal. Suffolk Superior Court Judge Regina Quinlan last week sentenced KAMAL OLIVER (D.O.B. 8/19/63) to a term of eight to 10 years in state prison following Oliver’s guilty plea to the crimes of armed assault with intent to murder, aggravated assault and battery with a dangerous weapon, and unlawful possession of a firearm. Quinlan additionally ordered him to serve three years of probation upon his release. Varieur died at Massachusetts General Hospital without regaining consciousness, and authorities consider his death suspicious.

“At about 2:20 pm on Monday, May 21, State Police assigned to Troop H discovered an unconscious adult male here at the fishing pier near Paul Revere Park.  The man was unresponsive when troopers found him, and he was transported to Massachusetts General Hospital with a serious head injury. Based on medical, forensic, and other evidence developed thus far, we believe he sustained that injury on Sunday, May 20, during the afternoon or evening.  more »

State troopers assigned to the Boston Barracks discovered the 45-year-old male victim, who is believed to be homeless, on the fishing pier at Paul Revere Park on Monday afternoon. He had suffered a head injury and was transported to Massachusetts General Hospital. The investigation thus far suggests he had been assaulted the night before. BOSTON, May 9, 2012—A Mission Hill woman will serve at least a year behind bars for stabbing her former neighbor during a dispute sparked by a prior conflict over a parking space the victim had shoveled out, Suffolk County District Attorney Daniel F. Conley said today.

BOSTON, May 9, 2012—Suffolk County District Attorney Daniel F. Conley joined first graders at Boston’s Marshall Elementary School today, reading for the kids, bringing books for every student, and urging public officials to do the same.

Members of Conley’s staff have joined the first graders of Karline Beazer’s class every Wednesday since November of last year, reading to them and with them to demonstrate the importance of literacy. He joined those staff members for today’s trip, bringing two dozen books from Mary Pope Osborne’s Magic Tree House series for the students to bring home. more »

CRISTIAN SANTA (D.O.B. 10/10/91) was arraigned this morning in East Boston District Court on a single count of murder for Barrientos’ slaying in the early morning hours of May 4. Investigators believe Barrientos was killed in the basement of his Chelsea Street apartment building sometime around 5:00 a.m., then dragged outside to an alleyway, where his remains were found about an hour later, Conley said. more »

CRISTIAN RODRIGUEZ (D.O.B. 7/19/76) was arraigned today on a murder charge stemming from Harris’ Feb. 9, 2012, homicide inside the Tremont Street apartment they shared. Boston Police and Suffolk prosecutors identified Rodriguez as a suspect early in the investigation and obtained a warrant for his arrest on March 7; they soon learned that Rodriguez had been arrested in Bedford shortly after the homicide and was in already custody. more »

ELVYN RAFAEL GARCIA (D.O.B. 10/3/80) was arraigned yesterday in Roxbury District Court on charges of trafficking in more than 200 grams of cocaine, violating the state’s drug laws in a school zone, and various civil motor vehicle infractions. Assistant District Attorney Joseph Roseme recommended that he be held on $1 million cash bail; Judge David Weingarten set bail at $30,000 and ordered that Garcia surrender his US passport if he has one. more »

BOSTON, April 26, 2012—Suffolk County District Attorney Daniel F. Conley this week delivered $5,000 to a Dorchester program that diverts certain juvenile defendants from incarceration by connecting them with services, supervision, and advocacy.

Conley delivered the funds – drawn from cash and assets seized from drug traffickers in Suffolk County narcotics prosecutions – on April 24 to the Detention Diversion Advocacy Program, an initiative undertaken by the Robert F. Kennedy Children’s Action Corps.

JEAN TORRES VARGAS (D.O.B. 2/2/81), more commonly known as “Tyson,” has been indicted for first-degree murder in Costa’s death late last year. He stands about 5’5” tall, weighs about 175 lbs., and has brown eyes and brown hair. He has a large and distinctive tattoo on his left shoulder and upper arm, as well as a series of parallel scars on his right forearm.

The Supreme Judicial Court of Massachusetts late last week denied a twice-convicted murderer any further hearings on the 1995 stabbing death of Sharliee Banks, 33, in her Washington Avenue apartment, Suffolk County District Attorney Daniel F. Conley said.

The state’s highest court on Friday notified Conley’s office and counsel for WILLIAM LAPAGE (D.O.B. 8/20/52) that it had denied Lapage’s request for further review of a Jan. 31, 2012, decision by the Massachusetts Appeals Court affirming his most recent murder conviction.

“For the families left behind, an appeal can reopen wounds that never fully heal,” Conley said. “In a case like this, tried to two convictions but still active with motions for new trials and appellate review, loved ones might ask themselves when it will ever end. At last, we can say with confidence: it ends here.”

The man who stabbed 24-year-old West Roxbury resident Gregory Phillips to death near an Allston bar was sentenced to life in prison today after jurors convicted him of murder, Suffolk County District Attorney Daniel F. Conley said.

Jurors found COREY PATTERSON (D.O.B. 11/5/86) of Dorchester guilty of second-degree murder and three counts of assault and battery on a public employee after three weeks of trial and about three days of deliberations. About 20 minutes before returning their verdicts, jurors sent a note to Judge Raymond Brassard asking if they could infer malice – a key element of murder – from the use of a dangerous weapon; Brassard told them that they were permitted to make that inference. more »

Suffolk County District Attorney Daniel F. Conley last week delivered $5,000 in seized drug money to an agency that keeps Revere kids off drugs, away from gangs, and on the right track for success.

Conley delivered the check to Community Action Projects Inter-City, Inc., or CAPIC, on March 27 as part of his annual Asset Forfeiture Reinvestment Program, which takes cash and assets seized during narcotics prosecutions and puts them back into the community through agencies that work to keep kids and teens safe.

In addition to providing a broad array of social services to North Shore communities, CAPIC works with the young members of the Revere Police Athletic League and gives presentations on substance abuse and gang violence to school-age youth. The funds delivered by Conley will help maintain the league throughout the year, providing those young people with a safe, positive, and structured environment.

A Suffolk Superior Court judge today scheduled an October retrial for the Mattapan man accused of a 2010 multiple shooting on Woolson Street, killing four – including a toddler – and leaving a fifth paralyzed from the shoulders down, District Attorney Daniel F. Conley said.

Judge Jeffrey Locke scheduled empanelment in the retrial of DWAYNE MOORE (D.O.B. 6/25/77) for October 11.  Moore faces four counts of first-degree murder for the shooting deaths of Eyanna Flonory, 21; her 2-year-old son, Amanihotep Smith; Simba Martin, 21; and Levaughn Washum-Garrison, 22. The man who pulled a knife and stabbed a Chelsea resident who refused his request for spare change will serve up to seven years in state prison, Suffolk County District Attorney Daniel F. Conley said today.

Assistant District Attorney Nick Walsh recommended that MANUEL ARZOLA (D.O.B. 9/25/68) of Everett serve six to eight years for his conviction on a count of assault and battery with a dangerous weapon followed by three years of probation for his conviction on a count of assault and battery. Walsh recommended that Arzola be ordered to stay away from the victim, complete an anger management program, undergo an evaluation for drug dependence, take part in any treatment deemed necessary, and submit to random urine screens. more »

Authorities are renewing their call for caution along the Esplanade today after a report of a sexual assault early Friday morning.

State Police detectives assigned to Troop H and the Suffolk DA’s office responded to a local college Friday evening after a student reported to her campus police department that she had been assaulted at about 1:00 Friday morning in the area of the Silber Way footbridge. A Dorchester man will serve up to three decades in state prison for raping two young family friends over a period of years, Suffolk County District Attorney Daniel F. Conley said today.

At a sentencing hearing yesterday, Assistant District Attorney Leora Joseph, chief of Conley’s Child Protection Unit, recommended that KENNETH WARD (D.O.B. 3/6/68) serve 30 to 40 years behind bars. Suffolk County District Attorney Daniel F. Conley this month awarded $20,000 in seized drug money to four Boston non-profit organizations as part of his annual Asset Forfeiture Reinvestment Program, funding groups that prevent young people from becoming involved in drugs, gangs and violence.

Conley presented a check in the amount of $5,000 to each of the following organizations: Teen Empowerment, Children’s Services of Roxbury, Dorchester Youth Collaborative, and Codman Academy.

On March 1, Conley visited Teen Empowerment’s headquarters in Roxbury to spend time with the agency’s young members and staff. The funds provided by Conley’s office will be used to support a youth organizing initiative in the Warren Gardens neighborhood of Roxbury allowing the group to hold a peer-led series of anti-violence and substance abuse discussions. more »

The indictments move his case to Suffolk Superior Court, where he will be arraigned at a later date. The Suffolk County Grand Jury today returned a six-count indictment charging a former teacher with sexually assaulting two children and recording the abuse, District Attorney Daniel F. Conley announced.

Specifically, the indictments charge DAVID ETTLINGER (D.O.B. 7/6/77) of Brighton with two counts each of aggravated assault and battery on a child under 14, posing a child in a state of nudity, and secretly photographing a nude or semi-nude person. ROGER PARON, Jr. (D.O.B. 4/30/59), pleaded guilty to voluntary manslaughter for the Sept. 4, 2010, slaying of 39-year-old Victoria Paron. A Dorchester man will serve up to 20 years in state prison for shooting four people outside a Blue Hill Avenue tavern in 2009, Suffolk County District Attorney Daniel F. Conley said today.

Suffolk Superior Court Judge Patrick Brady sentenced CHARKEEM HYATT (D.O.B. 12/10/89) to three concurrent terms of 12 to 15 years in state prison, each for a count of aggravated assault and battery with a dangerous weapon for which Hyatt was convicted last week. Brady imposed a consecutive five-year term for his conviction for possessing a firearm in the commission of a felony. In addition to setting concurrent sentences for assault and battery with a dangerous weapon and unlawful possession of a firearm, Brady additionally ordered Hyatt to serve two years of probation upon his release for unlawful possession of ammunition. more »

A Dorchester man received a 10-year prison sentence today after a Suffolk Superior Court jury found him guilty of assault charges for a shooting incident that claimed the life of 18-year-old Guiliardo Rodrigues.

Judge Regina Quinlan imposed upon MANUEL DASILVA (D.O.B. 10/28/87) the sentences recommended by Assistant District Attorney Mark Hallal on two convictions for assault by means of a dangerous weapon: two terms of four to five years in state prison, with those terms to run back to back. Assistant District Attorney Joseph Pagliarulo recommended that he be held on $100,000 cash bail and recommended an order barring him from using a computer and having any contact with children under 16. State Police detectives assigned to Suffolk County District Attorney Daniel F. Conley’s office and Revere Police are investigating a collision in Revere Sunday night that left two people injured, and they are asking witnesses to the incident to come forward.

The state’s highest court today affirmed a former Cambridge resident’s two first-degree murder convictions for the 2006 slayings of Julio Ceus and Natalie Sumner during a robbery in Allston, Suffolk County District Attorney Daniel F. Conley said.

The decision means CRAIG SMITH (D.O.B. 2/10/69) will continue to serve the back-to-back life terms imposed following his 2007 trial, Conley said. A Roxbury youth has been committed to the Department of Youth Services for six years for bringing a loaded handgun into a Boston school last fall, Suffolk County District Attorney Daniel F. Conley said today.

DANTE HECTOR (D.O.B. 11/27/95) was 14 when he brought the firearm into the West Roxbury Educational Complex on the morning of Oct. 25, 2011. Hector pleaded guilty today to that offense and was sentenced by Juvenile Court Judge Terry Craven to DYS commitment to the age of 21. more »

The suspect in a robbery last month that targeted a pizza deliveryman was sent for a mental health evaluation at his arraignment today, Suffolk County District Attorney Daniel F. Conley said.

JOSE MARTINEZ (D.O.B. 4/9/91) of Dorchester was arraigned in Dorchester District Court on charges of armed robbery, unlawful possession of a firearm, and assault with a dangerous weapon. After a court clinician found Martinez not competent to assist in his own defense, Judge Michael Coyne ordered the defendant to undergo a 20-day evaluation at Taunton State Hospital. more »

Two Dorchester men are behind bars on high bail today after their indictments for allegedly making threats relative to the shooting death of 16-year-old Jaivon Blake and the near-fatal shooting of a younger teen last year, Suffolk County District Attorney Daniel F. Conley said.

The Suffolk County Grand Jury last month indicted MATTHEW MITTON (D.O.B. 9/8/90) and MICHAEL TAVARES (D.O.B. 12/1/87) on multiple counts of witness intimidation, with Mitton facing four counts and Tavares facing three. more »

A Newton man with a long history of driving offenses was arraigned this morning on charges stemming from the death of Francis McInerney on VFW Parkway this summer, Suffolk County District Attorney Daniel F. Conley announced.

ZYOMA VASSERMAN (D.O.B. 3/5/63) is charged with motor vehicle homicide, negligent operation of a motor vehicle, and the civil infraction of speeding, all in connection with the 17-year-old West Roxbury youth’s death on the night of June 14, 2010. more »

The state’s highest court today upheld a Roxbury man’s conviction for the slaying of 18-year-old Waymond G. Pearson on Cambridge Street nine years ago, rejecting an argument that four stab wounds and eight additional lacerations didn’t constitute extreme atrocity or cruelty, Suffolk County District Attorney Daniel F. Conley announced.

The Supreme Judicial Court affirmed the first-degree murder conviction of VICTOR YOUNG (D.O.B. 6/16/80) in connection with Pearson’s Sept. 14, 2003, stabbing death during an early-morning brawl on Cambridge Street. Young was convicted of that offense based on the theories of deliberate premeditation and extreme atrocity or cruelty after a week-long trial in 2006. He was also found guilty of armed assault with intent to murder for stabbing another victim who survived. more »
