BOSTON, Dec. 30, 2014— Seven teenagers ranging from 13 to 19 years old were arraigned today for allegedly attacking two Boston Police officers attempting to serve arrest warrants on one of them, Suffolk County District Attorney Daniel F. Conley said today.

LORCEN MORISSET (D.O.B. 11/9/96) and WOOBENSON MORISSET (D.O.B. 2/1/95), both of Roxbury, were arraigned in Roxbury Municipal Court on two counts each of assault and battery on a police officer. Woobenson Morisset was additionally charged with resisting arrest. A Roxbury court clerk declined to issue complaints charging both men with assault and battery with a dangerous weapon – a shod foot – and Lorcen Morisset with resisting arrest; authorities will re-apply for those complaints at a later date. more »

BOSTON, Dec. 29, 2014—A Hyde Park man was held without bail today at his arraignment on a murder charge for allegedly stabbing Rafael Guzman to death at a party on Blue Hill Avenue, Suffolk County District Attorney Daniel F. Conley said.

AQUILES PEREZ (D.O.B. 9/7/81) was arrested late this morning by Boston Police homicide detectives investigating Guzman’s death early on Dec. 21. He was arraigned today in Roxbury Municipal Court. more »

BOSTON, Dec. 29, 2014—A Dorchester man on probation for unlawfully possessing a firearm was held on high bail after his arraignment on a new gun case, Suffolk County District Attorney Daniel F. Conley said.

DAQUANE MITCHELL (D.O.B. 4/6/90) was arraigned today in Roxbury Municipal Court on charges of unlawful possession of a firearm as a second offense, unlawful possession of ammunition as a second offense, and trespassing. Mitchell was additionally charged as an armed career criminal in light of his conviction in a 2011 shooting on Humboldt Avenue. He served a three-year state prison sentence for armed assault with intent to murder in that case and is currently on probation for unlawful possession of a firearm.

Assistant District Attorney Caitlin Fitzgerald recommended that he be held on $50,000 cash bail and be ordered to stay away from Homestead Street. Judge David Weingarten set bail at $25,000 and ordered that he stay away from 115 Homestead St., the scene of his arrest. more »

BOSTON, Dec. 29, 2014—In a withering, 24-page decision, the chief justice of the Superior Court denied a new trial for a man who murdered his own mother almost 15 years ago, finding that the lone witness to opine that he was incompetent to assist in his trial defense “essentially eviscerated” his own determination under cross-examination by Suffolk prosecutors. more »

BOSTON, Dec. 26, 2014—The state’s highest court today affirmed a murder conviction against the man who beat 18-year-old Elsie “Yolanda” Hernandes to death 30 years ago almost to the day, Suffolk County District Attorney Daniel F. Conley said.

The Supreme Judicial Court rejected an appeal by SULTAN OMAR CHEZULU (D.O.B. 10/2/48), ruling that his 2010 trial was fair. Chezulu, who changed his name from ROBERT LOUIS SCOTT in 1997, was found guilty of Hernandes’ Dec. 28, 1984, murder under all three theories of first-degree murder – deliberate premeditation, extreme atrocity or cruelty, and felony murder. Chezulu’s homicide conviction is at least the 12th in Suffolk County to be affirmed by the SJC this year. more »

BOSTON, Dec. 23, 2014—In an emotionally-charged impact statement, a Boston Police officer today expressed forgiveness for the man who tried to murder him during a foot chase in South Boston last year, Suffolk County District Attorney Daniel F. Conley said.

PAUL ERIC LOUIS-JEUNE (D.O.B. 9/1/91) of Braintree pleaded guilty to charges of armed assault with intent to murder, assault with a dangerous weapon, unlawful possession of a firearm, and unlawfully carrying a loaded firearm for the July 16, 2013, incident in the Old Harbor housing development.  more »

BOSTON, Dec. 23, 2014—The man who murdered Shakora Gaines, Chantal Palmer, and Anthony Peoples five years ago was sentenced to three life sentences today, with two of those terms to be served back-to-back, Suffolk County District Attorney Daniel F. Conley said.

At today’s sentencing for KERON PIERRE (D.O.B. 11/26/85), Assistant District Attorney Mark T. Lee recommended a 19- to 20-year prison term for the attempted murder of a 23-year-old who miraculously survived the defendant’s unprovoked attack, followed by three consecutive life terms for the murder victims who, he said, were “far closer to children than to adults.” more »

CRAIG PARSONS (D.O.B. 4/24/91) pleaded guilty to aggravated assault and battery, aggravated assault and battery with a dangerous weapon, and witness intimidation – all the charges against him – for the January beating of a 50-year-old man who had been panhandling on Allston Street. more »

BOSTON, Dec. 19, 2014—A Suffolk Superior Court Jury has convicted a former Mattapan man of all charges in the unprovoked murders of Shakora Gaines, Chantal Palmer, and Anthony Peoples in Dorchester, Suffolk County District Attorney Daniel F. Conley said today.

Jurors convicted KERON PIERRE (D.O.B. 11/26/85) of three counts of first-degree murder, finding that he acted with extreme atrocity or cruelty in all three slayings and with deliberate premeditation in Palmer’s killing. Jurors also convicted him of armed assault with intent to murder for shooting at a fourth occupant of the car, a young woman who escaped with her life – but watched her best friends die. more »

BOSTON, Dec. 19, 2014—A man was arraigned yesterday on charges he violated the civil rights of a Green Line passenger he harassed, punched, and attempted to rob at an MBTA station, Suffolk County District Attorney Daniel F. Conley said.

MATTHEW FRANKLIN (D.O.B. 12/30/86), who claimed a downtown homeless shelter as his address, was arraigned yesterday in Boston Municipal Court on charges of unarmed assault with intent to rob, assault and battery, and violating his victim’s civil rights.  Assistant District Attorney Matthew Fitzgerald requested bail of $2,000; Judge Thomas Horgan imposed $1,000 bail. more »

BOSTON, Dec. 18, 2014—A Dorchester man was convicted yesterday of possessing child pornography and trading it using an online file-sharing service, Suffolk County District Attorney Daniel F. Conley said.

A West Roxbury Municipal Court jury found FRANCISCO RIVERA-YORRO (D.O.B. 3/3/62) guilty of possession of child pornography and dissemination of obscene images.  At the request of Assistant District Attorney Christina Miller, Conley’s Chief of District Courts, Judge Mary Ann Driscoll sentenced Rivera-Yorro to two and a half years in the house of correction. more »

BOSTON, Dec. 17, 2014—The suspect in a double shooting that left Javier Ortiz dead and another man with a gunshot wound to the chest was held without bail today after his arraignment in Chelsea District Court, Suffolk county District Attorney Daniel F. Conley said.

HECTOR ENAMORADO (D.O.B. 10/22/78) of Chelsea was arraigned on single counts of murder and armed assault with intent to murder for allegedly shooting Ortiz, age 29, and the surviving victim, age 34, inside a Chester Avenue apartment early Sunday morning. more »

BOSTON, Dec. 15, 2014— The state’s highest court today rejected an appeal by the man who murdered retired Cambridge Police Officer Myles “Tony” Lawton and tried to kill a second man, Suffolk County District Attorney Daniel F. Conley said.

In a 32-page decision authored by Chief Justice Ralph Gants, the Supreme Judicial Court affirmed the 2009 convictions of MICHAEL COLLINS (D.O.B. 11/5/79) for second-degree murder, armed assault with intent to murder, and unlawful possession of a firearm for the fatal shooting death of Lawton, 62, and the non-fatal shooting of a second man. more »

BOSTON, Dec. 15, 2014— A Suffolk Superior Court jury today convicted Roosevelt Harris’ killer of first-degree murder, rejecting his claim that he was so mentally ill that he was not criminally responsible for beating the 50-year-old to death with a baseball bat, Suffolk County District Attorney Daniel F. Conley said.

Shortly after the jury’s verdict, Judge Peter Muse sentenced CRISTIAN RODRIGUEZ (D.O.B. 7/19/76) to life in prison without the possibility of parole, the mandatory sentence for murder one. more »

BOSTON, Dec. 15, 2014— A Lowell man was sentenced to prison today after he admitted that he shook his son, 9-week-old William Berry, to death last year, Suffolk County District Attorney Daniel F. Conley said.

CHRISTOPHER BERRY (D.O.B. 5/14/90) today pleaded guilty to manslaughter in connection with his son’s 2013 death in Lowell last year.  At the request of Assistant District Attorney Gloriann Moroney, chief of Conley’s Child Protection Unit, Middlesex Superior Court Judge Marita Hopkins sentenced Berry to 12 to 16 years in prison. more »

BOSTON, Dec. 15, 2014—Eight defendants face arraignment this week for their alleged roles in a nationwide scam that drained hundreds of thousands of dollars from the victims’ home equity lines of credit, just weeks after a Cambridge woman was ordered to reimburse a California bank for funds stolen in a similar scheme, Suffolk County District Attorney Daniel F. Conley said.

BOSTON, Dec. 12, 2014—Suffolk County District Attorney Daniel F. Conley last week hosted a psychology professor and a veteran police investigator for a two-day training in cutting-edge interview techniques as part of his ongoing continuing education program.

The training, led by Prof. Brent Snook of the Memorial University of Newfoundland and Constable Todd Barron of the Royal Newfoundland Constabulary, introduced Suffolk prosecutors to the interview method known as PEACE – for Preparation and Planning, Engage and Explain, Account, Closure, and Evaluation. JOHN MONTEIRO (D.O.B. 4/6/83) was arraigned today on charges of unlawful possession of a firearm, unlawful possession of ammunition, and carrying a loaded firearm.  He was additionally charged with unlawful possession of a firearm as a subsequent offense and as a Level I armed career criminal based on convictions for armed assault with intent to rob and firearm possession. more »

JOHNNIE BONNIE (D.O.B. 6/28/92) of Jamaica Plain was arraigned in Suffolk Superior Court today on charges of first-degree murder, unlawful possession of a firearm, unlawful possession of ammunition, and unlawfully carrying a loaded firearm, all in connection Archer’s shooting death.  He was also arraigned on a separate, unrelated case charging unlawful possession of a firearm, unlawful possession of ammunition, carrying a loaded firearm, and receiving a firearm with a defaced serial number. more »

BOSTON, Dec. 8, 2014—The state’s highest court has ruled that a man who took part in the 1991 murder of Timothy Bond in Jamaica Plain will not receive a new trial, Suffolk County District Attorney Daniel F. Conley said today.

The Supreme Judicial Court in a decision authored by Justice Robert Cordy today affirmed a lower court’s order denying PEDRO VALENTIN a new trial more than two decades after he was convicted of first-degree murder for his role as a joint venturer in Bond’s July 15, 1991, murder.  The same court affirmed Valentin’s conviction in 1995; today’s decision came in response to Valentin’s appeal of a Suffolk Superior Court judge’s denial of his 2012 motion for a new trial. more »

BOSTON, Dec. 5, 2014—A Mattapan man convicted yesterday of a Roslindale burglary this summer will serve the maximum penalty for breaking and entering, Suffolk County District Attorney Daniel F. Conley said.

A West Roxbury Municipal Court jury yesterday found MARCKENLEY CASIMIR (D.O.B. 8/1/90) guilty of breaking and entering, possession of burglarious tools, and receiving stolen property.  Judge Mary Ann Driscoll imposed a sentence of two and a half years in a house of correction. more »

BOSTON, Dec. 3, 2014—Two years and a day after 25-year-old Alexander Callahan was brutally beaten to death inside the Suffolk County House of Correction, his killer was sentenced to spend the next 20 years in prison, Suffolk County District Attorney Daniel F. Conley said today.

A Suffolk Superior Court jury last month convicted LESLEY JURCZUK (D.O.B. 10/15/61) of voluntary manslaughter in Callahan’s beating death.  Judge Charles Hely today imposed sentenced Jurczuk to 18 to 20 years in prison – the maximum sentence allowed under the law and that recommended by First Assistant District Attorney Patrick Haggan.  Jurczuk’s attorney sought a sentence of four to seven years. more »

BOSTON, Dec. 2, 2014—The man who allegedly stabbed two park rangers when they asked him to put out a cigarette was held on $1 million bail at his Superior Court arraignment today, Suffolk County District Attorney Daniel F. Conley said.

BODIO HUTCHINSON (D.O.B. 8/6/80) was arraigned on two counts of armed assault with intent to murder and single counts of assault and battery and aggravated assault and battery.  Clerk Magistrate Anne Kaczmarek imposed $1 million bail at the request of Assistant District Attorney Lynn Feigenbaum of the DA’s Senior Trial Unit. BOSTON, Dec. 2, 2014—A Hyde Park man was arraigned yesterday for human trafficking and other charges after he allegedly threatened a woman he advertised on a web site linked to prostitution, Suffolk County District Attorney Daniel F. Conley said.

RICHARD HOLMES (D.O.B. 1/3/91) was arraigned in West Roxbury Municipal Court on charges of trafficking of a person for sexual servitude, deriving support from prostitution, maintaining a house of prostitution, and making threats to commit a crime.  Assistant District Attorney Michelle Slade requested that Holmes be held on $30,000 bail and be ordered to stay away and have no contact with the 25-year-old victim and be fitted for a GPS monitor in the event that he were to be released on bail.  Judge Kathleen Coffey imposed $10,000 bail and the requested conditions of release but denied a motion to revoke Holmes’ bail in an open case charging him with operating a motor vehicle with a suspended license. more »

BOSTON, Nov. 28, 2014— The Suffolk County Grand Jury this week indicted a Quincy man has for first-degree murder for fatally stabbing 31-year-old Gerald Williamson as he attempted to walk away from their verbal confrontation, District Attorney Daniel F. Conley announced today.

The first-degree murder indictment was returned Wednesday against EDGARDO CLARK (D.O.B. 5/25/85). Clark has been held without bail since his Oct. 21 arraignment in Dorchester Municipal Court in connection with Williamson’s murder. more »

BOSTON, Nov. 28, 2014—A Revere man was held on high bail today after he was arrested for firing shots during a confrontation over a parking spot, Suffolk County District Attorney Daniel F. Conley said.

JEFFREY MORENO (D.O.B. 1/13/86) was arraigned in Chelsea District Court on four counts of assault with a dangerous weapon, two counts of making threats to commit a crime, and one count each of unlawful possession of a firearm, unlawful possession of ammunition, discharging a firearm within 500 feet of a building, and possessing a firearm during the commission of a felony. more »

BOSTON, Nov. 26, 2014—Two men pleaded guilty this week to their roles in unrelated homicides in Boston and Chelsea, Suffolk County District Attorney Daniel F. Conley said.

On Monday, ANDRE McNEIL (D.O.B. 10/25/89) of Brockton pleaded guilty to manslaughter for the Nov. 14, 2007, shooting death of 17-year-old David Jones. At the request of Assistant District Attorney Mark Zanini, Judge Jeffrey Locke sentenced McNeil to 12 years in state prison. more »

BOSTON, Nov. 26, 2014—About 40 men and women arrested during overnight protests in Boston had their criminal charges converted to civil infractions and resolved today, meaning that the low-level offenses will not appear on their records, Suffolk County District Attorney Daniel F. Conley said.

In the Central Division of the Boston Municipal Court, Suffolk prosecutors affirmatively moved to amend criminal complaints against 18 arrestees to civil infractions prior to arraignment, then dismissed them.  Those individuals ranged in age from 19 to 32.  Twelve were from Boston and the remaining six were from Cambridge, Los Angeles, Newton, Quincy, and Somerville. Twelve were charged with disorderly conduct, four were charged with disturbing the peace, and two were charged with disorderly conduct and trespassing. more »

BOSTON, Nov. 25, 2014—Eighteen years after a child rape defendant fled his indictment and one week after his arrest out of state, the former Dorchester resident was held on high bail at his arraignment today in Suffolk Superior Court, District Attorney Daniel F. Conley said.

LENS CHAPPELL (D.O.B. 5/20/48) was arraigned today on eight counts of rape of a child, three counts of indecent assault and battery on a child, and two counts of indecent assault and battery. Assistant District Attorney Gloriann Moroney, chief of the DA’s Child Protection Unit, recommended that he be held on $750,000 cash bail.  Clerk Anne Kaczmarek imposed that amount. more »

BOSTON, Nov. 24, 2014— The man who fatally shot 21-year-old Steven Jones in the course of a fistfight Jones was trying to break up pleaded guilty today as his trial was set to begin, Suffolk County District Attorney Daniel F. Conley said.

PABLO FLORES, Jr. (D.O.B. 2/17/93) of Charlestown today pleaded guilty to voluntary manslaughter, unlawful possession of a firearm, carrying a loaded firearm, and two counts of assault with a dangerous weapon.  He was initially charged with second-degree murder. At the recommendation of Assistant District Attorney Nicholas Walsh, Suffolk Superior Court Judge Charles Hely sentenced Flores to eight to 12 years in prison followed by three years of probation. more »

BOSTON, Nov. 24, 2014— An East Boston man was held on high bail today after Boston Police who arrested him for attempted rape and other charges linked him to an earlier, similar sexual assault, District Attorney Daniel F. Conley said.

EDUARDO SELVAN HERNANDEZ-ORTIZ (D.O.B. 2/5/94) appeared in East Boston Municipal Court on charges of assault with intent to rape, armed robbery, indecent assault and battery of a person over 14, open and gross lewdness, and receiving stolen property under $250 in connection with an assault that occurred Saturday and charges of aggravated rape and armed robbery for an assault that occurred Nov. 1. more »

BOSTON, Nov. 20, 2014—A Roslindale man who represented himself as a pastor will serve up to 12 years in state prison for sexual assaults on a girl in her young teens, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury on Nov. 5 convicted EPIPHANE LAZARRE (D.O.B. 5/27/73) of two counts of aggravated rape of a child under 14 and one count of indecent assault and battery on a child under 14 for the 2012 assaults. At a sentencing hearing yesterday, Assistant District Attorney Laura Montgomery recommended that he serve a term of 15 to 20 years in state prison followed by 10 years of probation. Judge Christopher Muse sentenced him to 10 to 12 years in prison and the recommended probationary term upon his release. more »

BOSTON, Nov. 19, 2014—A repeat drunk driver who crashed into a car with three children in it was held pending a hearing to determine whether he poses too great a threat to the public to be granted bail pending trial, Suffolk County District Attorney Daniel F. Conley said.

JOHN SFERRAZZA (D.O.B. 5/21/65) of South Boston was arraigned today in Roxbury Municipal Court on charges of operating under the influence as a fourth or subsequent offense, operating a motor vehicle with a suspended license, larceny of a motor vehicle, receiving a stolen motor vehicle, and assault and battery on a police officer for yesterday’s incident in the South End. more »

BOSTON, Nov. 18, 2014—Boston Police and Suffolk prosecutors have identified suspects in two open homicide cases from this year, gathering evidence that led to their indictments Friday by the Suffolk County Grand Jury, District Attorney Daniel F. Conley and Police Commissioner William B. Evans said.

Members of the Boston Police Fugitive Unit today arrested ROGER MORRIS (D.O.B. 6/23/61), who is homeless, on a warrant stemming from his indictment for manslaughter, aggravated assault and battery, and assault with a dangerous weapon in the death of Edward Lawn. Authorities say Morris and Lawn were engaged in an altercation downtown on the afternoon of June 20 when Morris punched Lawn so hard that Lawn fell backward and hit his head on the sidewalk. He died of that injury on June 24. more »

BOSTON, Nov. 17, 2014—A Suffolk Superior Court jury today convicted the man who beat 25-year-old Alexander Callahan to death at the Suffolk County House of Correction, Suffolk County District Attorney Daniel F. Conley said.

Jurors convicted LESLEY JURCZUK (D.O.B. 10/15/61) of voluntary manslaughter for beating Callahan so badly in the cell they shared that Callahan died of fatal injuries to his head and neck. Jurczuk had been indicted for second-degree murder. more »

BOSTON, Nov. 17, 2014—The woman who stabbed her abusive boyfriend to death this summer was acting in self-defense and will not face criminal charges, Suffolk County District Attorney Daniel F. Conley announced today.

Prosecutors’ decision not to charge the 26-year-old Dorchester resident came after a three-month investigation into the July 31 stabbing of Emmanuel Jeudi inside the victim’s Washington Street apartment. That investigation – which included witness interviews, forensic analysis of evidence at the scene, the opinion of state pathologists, a review of prior allegations of domestic violence involving Jeudi, and legal analysis by Suffolk homicide prosecutors – revealed that the woman acted reasonably and lawfully to defend herself, Conley said. BOSTON, Oct. 31, 2014—The drunk driver who killed cyclist Doan Bui as Bui rode home from a night of fishing will serve 18 months in a house of correction rather than the state prison term recommended by Suffolk County District Attorney Daniel F. Conley’s office.

Assistant District Attorney Gregory Henning of the DA’s Major Felony Bureau today recommended a term of six to eight years in state prison for MICHAEL AHERN (D.O.B. 12/23/65) of Dorchester following Ahern’s Oct. 14 conviction for felony motor vehicle homicide. That recommendation exceeded the sentencing guidelines of 40 to 60 months, Henning said, because Ahern was travelling about 20 miles above the speed limit when he killed Bui, had been drinking for hours before doing so, and had a lengthy driving record: his license has been suspended 12 times, he has incurred more than 30 moving violations, and was deemed a habitual traffic offender. more »

BOSTON, Oct. 27, 2014—A Chelsea man will spend up to 15 years in prison for fatally shooting 35-year-old Christopher Powell during a drug deal gone bad, Suffolk County District Attorney Daniel F. Conley said.

MIGUEL FANTAUZZI (D.O.B. 7/89) was convicted Oct. 14 of voluntary manslaughter and unlawful possession of a firearm for Powell’s 2012 slaying.  At his sentencing hearing today, Assistant District Attorney Amy Galatis of the DA’s Homicide Unit requested a sentence of 17 to 20 years, and relatives of Powell implored the court to impose the maximum, a 20-year term. Judge Christine Roach imposed a prison term of 12 to 15 years for the conviction of manslaughter and a concurrent sentence of three to five years for unlawfully possessing the firearm used to kill the Dedham man.  more »

BOSTON, Oct. 28, 2014—A child enticement investigation that began in Winthrop this summer has led to a Malden man’s indictment for child rape and human trafficking of a minor, Suffolk County District Attorney Daniel F. Conley and Winthrop Police Chief Terence Delehanty announced.

The indictments, returned on Oct. 22, charge THOMAS VINCENT ROSE (D.O.B. 2/9/52) with two counts of enticement of a child, two counts of human trafficking of a minor, and single counts of rape of a child and aggravated rape of a child. Because of prior convictions in Norfolk and Suffolk counties for which he is a Level III sex offender, Rose was additionally indicted as a habitual offender. more »

After three days of testimony and about two hours of deliberations, jurors found WILLIAM BRADSHAW (D.O.B. 4/19/82) of Roxbury to be sexually dangerous under Ch. 123A of the Massachusetts General Laws. HECTOR RAMIRES (D.O.B. 10/23/93) was arraigned in Chelsea District Court on a murder charge stemming from Gomez’ homicide this weekend. At the request of Assistant District Attorney David Fredette, Judge Matthew Nestor also revoked Ramires’ bail on two unrelated street robberies he allegedly committed with others earlier this year.

Catherine Gomez, 35, was inside a Shawmut Street residence when she was struck by a bullet fired outside the building at about 12:05 on Saturday morning. She died at the scene. Based on the evidence developed thus far, investigators do not believe she was the intended target but was struck by an errant round fired during an altercation between two groups on the street. more »

Jurors convicted MICHAEL AHERN (D.O.B. 12/23/65) of felony motor vehicle homicide for the Sept. 14, 2012, collision that killed Bui, 63, as Bui rode his bicycle home from a late night fishing trip. In reaching that verdict, jurors found that Ahern was impaired and negligent when he struck and killed Bui, rejecting the opportunity to convict the defendant of the lesser offense of misdemeanor motor vehicle homicide or find him guilty of driving drunk but not guilty of causing Bui’s death. more »

BOSTON, Oct. 15, 2014—The man who allegedly stabbed two park rangers in the Boston Common yesterday was held on $1 million cash bail at his arraignment on attempted murder and related charges, Suffolk County District Attorney Daniel F. Conley said.

Boston Municipal Court Judge Robert McKenna imposed that bail on BODIO HUTCHINSON (D.O.B. 8/6/80) at the request of Assistant District Attorney Lynn Feigenbaum. McKenna additionally ordered Hutchinson held without bail on warrants sought by probation officers when the defendant allegedly violated probationary terms imposed along with incarceration on prior convictions. more »

BOSTON, Oct. 14, 2014—Two dozen men and women have been charged with drug distribution offenses after a months-long undercover operation by Chelsea Police and State troopers targeting drug activity in Bellingham Square, Suffolk County District Attorney Daniel F. Conley said.

The charges came as the result of Operation Crackdown – a three-month undercover investigation conducted by Chelsea Police, Everett Police, and State Police assigned to the Suffolk County District Attorney’s Office on the street and by Suffolk prosecutors in the Grand Jury to address residents’ concerns over street-level drug dealing and associated quality-of-life issues.  Prosecutors assigned to the DA’s Narcotics Unit continued the investigation in the Grand Jury, securing indictments last week against several of the defendants. more »

BOSTON, Oct. 14, 2014—Six-year-old Destin Marcelin died after he was forcibly asphyxiated and the evidence points to his father, who committed suicide two days later, as the sole perpetrator, Boston Police Commissioner William B. Evans and Suffolk County District Attorney Daniel F. Conley said today.

The Office of the Chief Medical Examiner has declared the child’s Sept. 4 death to be the result of “homicidal asphyxia” by smothering, pressure on his neck or chest, or some combination of the two. After a thorough review of the evidence gathered since that time, police and prosecutors believe his father, Patrick Marcelin, 49, of Mattapan was responsible. BOSTON, Oct. 14, 2014—Two Brighton women already charged with stealing more than $450,000 from a disabled, elderly neighbor have now been indicted for the theft of nearly $200,000 in Social Security and Medicare benefits, Suffolk County District Attorney Daniel F. Conley said.

The indictments, returned late last month, charge RANDI BERKOWITZ (D.O.B. 12/11/50) and PATRICIA DiGIACOMO (D.O.B. 1/18/56) with two counts each of larceny by continuing scheme over $250 and one count each of receiving stolen property by continuing scheme.  The charges reflect the payment of Social Security Disability Insurance and Medicare benefits based upon a false application filed by the two women in one of their names.  It also reflects the payment of Supplemental Security Income benefits to both women for periods when neither was eligible. more »

BOSTON, Oct. 14, 2014—A Suffolk Superior Court jury today convicted the man who shot and killed 35-year-old Christopher Powell during a Chelsea drug robbery two years ago, Suffolk County District Attorney Daniel F. Conley said.

Jurors convicted MIGUEL FANTAUZZI (D.O.B. 7/89) of voluntary manslaughter and unlawful possession of a firearm for shooting Powell repeatedly inside a vehicle on Clark Avenue just after 6:30 p.m. on Oct. 27, 2012. Fantauzzi had been indicted for second-degree murder; jurors acquitted him of shooting at a second man, causing only a minor injury to that victim. more »

DERRICK WOOD (D.O.B. 1/10/82) of Dorchester was arraigned in Suffolk Superior Court on charges of first-degree murder, unlawful possession of a firearm, and unlawful possession of ammunition.  Wood has been held on $250,000 bail since his June 9 arraignment in Roxbury District Court on firearm charges; the firearm he was charged with possessing later proved to be a ballistic match to the one used to kill Marriro.  Wood was ordered held without bail at the request of Assistant District Attorney David Bradley. more »

BOSTON, Oct. 2, 2014—A Chicago man was sentenced to a year behind bars and must pay restitution to the MBTA after he was convicted yesterday of more than a dozen counts of vandalism targeting MBTA property, Suffolk County District Attorney Daniel F. Conley said.

A Brighton Municipal Court jury yesterday convicted JOHN BIESIOT (D.O.B. 6/17/78) of 15 counts of vandalism in the three tagging incidents, which occurred in 2008 and 2010 at Codman Yard in Dorchester, Reservoir Yard in Brighton, and Alewife in Cambridge. He was found not guilty of vandalism charges stemming from additional incidents at Forest Hills and Orient Heights stations. Though the incidents occurred in various locations in Boston and surrounding cities, the cases were joined and tried together in Brighton court. more »

JEAN (D.O.B. 8/3/90) of Hyde Park, and  YAMILEY MATHURIN (D.O.B. 2/25/93) of Mattapan were sentenced today in Suffolk Superior Court, one day after a jury found Gallett and St. Jean guilty of first-degree murder, armed robbery, and breaking and entering with intent to commit a felony.  Mathurin, who was 17 and thus a juvenile at the time of the murder, pleaded guilty to the crime of manslaughter for her role in setting up the crime, as well as armed robbery and breaking and entering with intent to commit a felony on Sept. 8 as jury selection for their trial was underway. more »

JONATHAN CASTRO (D.O.B. 7/30/90), a.k.a. JONATHAN CASTRO SOLA, a.k.a. MANUEL JONATHAN CASTRO MENJIVAR, today pleaded guilty to second-degree murder in Morales’ March 5, 2013, shooting death; armed assault with intent to murder for firing upon a second man in the same incident; unlawful possession of a firearm, and carrying a loaded firearm.  At the recommendation of Assistant District Attorney Mark Zanini, Suffolk Superior Court Judge Thomas Connors imposed the mandatory term for second-degree murder of life in prison with the eligibility for parole after 15 years, with concurrent sentences of 10 to 12 years for armed assault with intent to murder, four to five years for unlawfully possessing the firearm he used in the murder, and 2 ½ years in the house of correction for carrying a loaded firearm. more »

BOSTON, Aug. 29, 2014—A year and a half after the Massachusetts Appeals Court affirmed a murder conviction in the 2006 slaying of Dominique Samuels, the Supreme Judicial Court reached the same conclusion and denied her killer’s efforts to reverse it, Suffolk County District Attorney Daniel F. The 26-page decision authored by Justice Barbara Lenk is expected to end any further appeals by RODRICK JAMES TAYLOR (D.O.B. 5/15/71), who was found guilty of second-degree murder for strangling the 19-year-old Milton High School graduate to death in the early morning hours of April 28, 2006, then setting her remains on fire in Franklin Park to destroy any forensic evidence that might incriminate him. BOSTON, Aug. 8, 2014—State Police are investigating a sexual assault on the Esplanade shortly before 12:30 this morning.

Uniformed troopers, detectives from Troop H, and the Suffolk County State Police Detective Unit responded to the area of the Harvard Bridge spanning the Charles River at Massachusetts Avenue and spoke with a 22-year-old woman who reported that a man on a bicycle had assaulted her after a brief verbal encounter. The woman ran and sought help from another cyclist who called 911. A search of the area by numerous State Police assets did not turn up the suspect. more »

HENRY PEARL BROWN, Jr. (D.O.B. 1/26/42), formerly of Boston and more recently of Westbrook, Maine, pleaded guilty yesterday to rape of a child and indecent assault and battery on a child under 14.  Suffolk Superior Court Judge Garry Inge sentenced him to eight to 10 years in prison. Brown was additionally sentenced to 10 years of probation upon his release and may be held even longer under the state’s Sexually Dangerous Person statute. more »

BOSTON, Aug. 4, 2014—The operator of a Boston Department of Public Works truck was arraigned today on charges he sold drugs out of the vehicle, Suffolk County District Attorney Daniel F. Conley said.

KENNETH CLARK (D.O.B. 7/14/65) of Dorchester was arraigned today in Dorchester District Court on a charge of distribution of a Class A substance as a subsequent offense.  That charge was brought in light of a 1999 Suffolk Superior Court conviction for distributing a Class A substance and possession with intent to distribute a Class A substance. BOSTON, Aug. 1, 2014—A Malden man has been arrested and held on high bail for allegedly trying to lure a 15-year-old child into sexual activity, Winthrop Police Chief Terence Delehanty and Suffolk County District Attorney Daniel F. Conley said.

THOMAS VINCENT ROSE (D.O.B. 2/9/52) was arrested on one count of enticement of a child last night by Winthrop Police and arraigned today in East Boston Municipal Court. Assistant District Attorney Kaushal Rana recommended that he be held on $150,000 cash bail. Judge John McDonald imposed $50,000. Rana recommended orders that Rose wear a GPS device and have no contact with any witnesses in the case if he posts that amount; McDonald imposed those conditions. more »

BOSTON, July 31, 2014—A Hyde Park man was held without bail on a murder charge today following his arrest for allegedly shooting his co-worker, 23-year-old Daniel P. Taylor, to death in Dorchester earlier this year, Suffolk County District Attorney Daniel F. Conley said.

MARQUIS SMITH (D.O.B. 9/27/90) was formally charged in South Boston Municipal Court today with Taylor’s Feb. 23 homicide near the intersection of Boston and Howell streets. BOSTON, July 26, 2014—State and Revere Police are investigating a shooting that left two people injured near Revere Beach early this morning, Suffolk County District Attorney Daniel F. Conley said.

Revere Police, the Suffolk County State Police Detective Unit, uniformed State troopers, and specialized State Police units responded to Revere Beach Boulevard following an incident shortly before 2:15 a.m. A 33-year-old man and 36-year-old woman sustained gunshot injuries that were not deemed life-threatening. Both were transported to Massachusetts General Hospital and are expected to survive. more »

BOSTON, July 25, 2014—An appellate court today found that the twin brother of a man charged with killing 67-year-old Barbara Coyne must comply with a judge’s order to provide a DNA sample that could help prove that only one of the two could have left behind DNA found at the murder scene, Suffolk County District Attorney Daniel F. Conley said.

In a decision authored by Justice Mark V. Green, the Massachusetts Appeals Court affirmed a Suffolk Superior Court judge’s finding that the twin brother of TIMOTHY KOSTKA (D.O.B.4/28/85) was in contempt of an order to produce a DNA sample.  He had been ordered to provide a DNA sample that would be used to prove conclusively whether Kostka and his brother are fraternal twins – each of whom has a unique DNA profile – or identical twins with matching DNA.  more »

BOSTON, July 25, 2014—The driver of a sport-utility vehicle that struck and killed 48-year-old Walter Harris in Mattapan last year was arraigned in Suffolk Superior Court today following his indictment for manslaughter, Suffolk County District Attorney Daniel F. Conley said.

The Suffolk County Grand Jury on July 1 returned indictments charging DERVIN HIBBERT (D.O.B. 1/6/61) of Mattapan with manslaughter by motor vehicle and motor vehicle homicide while operating under the influence. BOSTON, July 25, 2014—The Suffolk County District Attorney’s independent review of the fatal shooting of Ross Batista by Boston Police revealed that Batista possessed two handguns, had earlier exchanged shots with a rival, and had just fired on responding officers during the encounter on Willowwood Street.

District Attorney Daniel F. Conley notified Boston Police Commissioner William Evans and the public of his findings after prosecutors met with Batista’s family to explain the results of the investigation and inform them that the evidence did not support criminal charges against either of the involved officers. BOSTON, July 22, 2014—An East Boston couple was arraigned yesterday on charges they beat and robbed a cab driver who refused to break traffic laws in order to get them to their destination, Suffolk County District Attorney Daniel F. Conley said.

BOSTON, July 22, 2014—A Cambridge man has been sentenced to a year and a half behind bars after a jury found him guilty of possessing a loaded firearm in Boston’s Theater District, Suffolk County District Attorney Daniel F. Conley said.

STEVEN BELIZAIRE (D.O.B. 1/27/87) of Cambridge was convicted Thursday of unlawful possession of a firearm and carrying a loaded firearm after a jury trial in the Suffolk County Gun Court.  Assistant District Attorney Caitlin Grasso of the DA’s Gun Prosecution Task Force recommended a sentence of two years in the house of correction for unlawfully possessing the firearm. Granting a request by the defendant, Judge Tracy-Lee Lyons imposed the minimum mandatory term of 18 months in the house of correction. more »

JOHN ROGARIS (D.O.B. 5/13/70), who lists addresses in New York and Weston, was arraigned in Suffolk Superior Court today on charges of withholding evidence during the course of a criminal investigation, witness intimidation, and two counts of misleading an investigator. Prosecutors, who sought but were denied an arrest warrant after his July 3 indictment, did not request monetary bail after Rogaris walked into court this morning but did ask that the defendant be ordered to provide the Probation Department with a Massachusetts address.  Clerk Magistrate Gary Wilson granted the request and released Rogaris on his own recognizance. more »

BOSTON, June 26, 2014—A Suffolk Superior Court jury today acquitted a man of murdering Brenda Pawlowski in Jamaica Plain three years ago, but found him guilty of possessing the weapon with which she was killed.

After about eight days of testimony and two days of deliberations, jurors found LARRY PACK (D.O.B. 5/3/82) of Mattapan not guilty of murder in Pawlowski’s Feb. 8, 2011, shooting death but convicted him of unlawful possession of a .45 caliber semiautomatic handgun ballistically matched to the slaying. Jurors also convicted Pack of possessing a silencer for that handgun, possessing Class A and Class B substances – cocaine and heroin – with intent to distribute, and possessing a firearm in the commission of a felony. more »

BOSTON, June 25, 2014—A Norwood man is the first person in Suffolk County to be charged under the state’s updated “upskirting” statute after a woman gave police photographs she’d taken of a man who pointed his iPad’s camera up her skirt, Suffolk County District Attorney Daniel F. Conley said.

JOSHUA GONSALVES (9/19/90) was arraigned in West Roxbury Municipal Court on a charge of photographing an unsuspecting person in the nude.  The statute was updated earlier this year after the Supreme Judicial Court’s ruled against Suffolk prosecutors and found that the previous version of the statute on the books in Massachusetts did not provide protection against the act of photographing intimate parts of a person’s body otherwise covered by clothing.  The current iteration of the statute, signed into law March 7 at Conley’s urging, closed that loophole. more »

The annual funds, which total $50,000 this year, are disbursed from Conley’s Asset Forfeiture Community Reinvestment Program. BOSTON, May 14, 2014—A Dorchester teen convicted as a youthful offender in the shootings of two men during a botched robbery was sentenced to state prison today, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury in March convicted JOHN GRAHAM (D.O.B. 12/15/94) as a youthful offender on two counts of armed assault with intent to rob and single counts of armed assault with intent to murder, aggravated assault and battery with a dangerous weapon, and firearm offenses for shooting two men on Oct. 30, 2011, but acquitted him of first-degree murder and armed assault with intent to rob in the fatal shooting of 36-year-old Ciaran Conneely three weeks prior to the non-fatal shooting. more »

BOSTON, May 7, 2014—On the day their homicide trial was scheduled to begin, two Boston men today admitted guilt rather than face a jury in the 2011 shooting death of 25-year-old Willie Marquis Turner, Suffolk County District Attorney Daniel F. Conley said.

JOSE MERCADO (D.O.B. 11/11/93) of Jamaica Plain and PRINCE DENIS (D.O.B. 11/7/90) of Dorchester pleaded guilty to charges of manslaughter, unlawful possession of a firearm, and witness intimidation.  The defendants changed their pleas just as they were scheduled to begin selecting a jury for their trial on charges of first-degree murder. Judge Dianne Kottmyer sentenced Mercado to 19 to 20 years in state prison followed by four years of probation and Denis to 15 years in prison followed by four years of probation. more »

BOSTON, May 5, 2014—State Police detectives assigned to Suffolk County District Attorney Daniel F. Conley’s office are seeking the public’s help in identifying a man whose remains washed up on Revere Beach last week.

The conditions of the remains have thus far hindered investigators’ efforts to identify the man or determine his ethnicity, but forensic anthropologists consulted by the Suffolk County State Police Detective Unit have opined that he was an adult between 20 and 40 years old – and likely on the younger end of that range. more »

BOSTON, April 30, 2014—Alfonso “Itto” Rivas was remembered as caring and generous by his heartbroken siblings this morning as the two men convicted of murdering him were sentenced to life in prison, Suffolk County District Attorney Daniel F. Conley said today.

REGINALD HOLLEY (D.O.B. 11/22/89) of Dorchester and OASIS PRITCHETT (D.O.B. 10/5/90) of Roxbury were convicted yesterday of first-degree murder under the theory of felony murder in 23-year-old Rivas’ slaying and this morning appeared before Suffolk Superior Court Judge Patrick Brady to receive the mandatory sentence of life in prison with no possibility of parole.  Brady also sentenced the two to four to five years in prison to be served concurrent to their life sentences on their convictions for unlawful possession of the firearm used to kill Rivas and placed on file the duos convictions for armed robbery – the requisite felony for the felony murder conviction. more »

BOSTON, April 14, 2014—Suffolk County District Attorney Daniel F. Conley today announced the region’s largest known state-level restitution order against a child pornography defendant.

ANDREW MCKINNON (D.O.B. 5/26/68) of Boston’s South End was ordered Friday to pay $30,000 in restitution to the now-adult victim, who had previously been identified by law enforcement officials, after admitting to possessing and distributing images of her abuse. McKinnon did not create the images: rather, he shared them after obtaining them and is not accused of sexual contact with her or any other children. more »

BOSTON, April 10, 2014—A Brockton man was arraigned yesterday for allegedly kicking, punching, and using slurs against a man with cerebral palsy on a subway train after the victim was able to identify him on MBTA surveillance footage, Suffolk County District Attorney Daniel F. Conley said today.

THOMAS KENNEDY (D.O.B. 4/18/51) was arraigned in South Boston Municipal Court on charges of assault and battery on a disabled person, assault and battery with a dangerous weapon, and a civil rights violation.  Assistant District Attorney Elizabeth Burke requested bail be set in the amount of $7,500 and orders that Kennedy undergo an alcohol and mental health evaluations, undergo any treatment deemed necessary, stay away from and have no contact with the victim, and stay away from MBTA property.  Burke also requested that Kennedy’s bail be revoked on an open case out of West Roxbury Municipal Court charging indecent exposure and disorderly conduct.  Judge Michael Bolden set bail at $5,000 and ordered Kennedy to remain alcohol free, submit to an alcohol evaluation and undergo any necessary treatment, and to stay away from the MBTA.  He allowed the motion to revoke Kennedy’s bail. more »

BOSTON, April 9, 2014—Suffolk County prosecutors today terminated the case against a North End man arrested last month in connection with a February sexual assault on Unity Street, citing a continued investigation that developed evidence to suggest he was not the assailant.

The filing, known as a nolle prosequi, ends the prosecution of ROSS CURRIER, 26, three weeks before his first scheduled court date. Metropolitan Police Department, and retired FBI Special Agent Gregg McCrary, formerly of the National Center for the Analysis of Violent Crime, for the seminar, entitled “Witness Interviews: Investigative Processes, Practices, and Pitfalls.” Trainum, who received the 2009 Champion of Justice Award from the Innocence Project, is a frequent presenter on police work, including the causes of false confessions. At about 1:00 on Sunday morning, Chelsea Police responded to the area of 115 Washington St. at for a report of a possible stabbing. Officers found Dominguez suffering from a life-threatening injury for which he was being treated by emergency medical technicians. BOSTON, Feb. 7. 2014—A 14-year-old boy has been charged in the shooting death of his 9-year-old brother this morning, Suffolk County District Attorney Daniel F. Conley said.

The youth, whose name is not being released because of his age, will be arraigned next week on charges of delinquency, to wit: involuntary manslaughter and unlawful possession of a firearm. BOSTON, Feb. 5, 2014—A homeless man with a long and violent record was arraigned last week for his third failure to register as a Level III sex offender, Suffolk County District Attorney Daniel F. Conley said.

CHARLES LEE BUFFORD (D.O.B. 2/18/55) was arrested Jan. 25 at the Pine Street Inn by Boston Police and US Marshals who took him into custody for failure to register as a sex offender as a subsequent offense. At arraignment on Jan. 27, Assistant District Attorney Matthew Fitzgerald recommended that Bufford be held on $1500 cash bail and that his open bail be revoked in an open case charging assault with a dangerous weapon. The 189-count indictment charges 33 men and women targeted during Operation Limehouse, a wiretap-based investigation that began in the summer of 2012 and culminated in more than 20 arrests late last year; about a dozen additional defendants were identified during the course of the grand jury investigation. Flores, 29, was shot dead on Sept. 22, 2011, by KENDRICK CLARK (D.O.B. 3/19/74) on the porch of their Dorchester rooming house. No one saw the shooting, but Flores identified his killer in a dying declaration to residents who came running and relayed his last words to Boston Police homicide detectives. They were arraigned the next day in Chelsea District Court, where Suffolk prosecutors recommended that they be held on $10,000 cash bail each. Judge D. Dunbar Livingston imposed $5,000 each. CEDRICK SLAYDEN (DOB 12/11/95) was arraigned this morning in Dorchester Municipal Court on charges of unlawful possession of a firearm, unlawful possession of ammunition, and carrying a loaded firearm.  At the request of Assistant District Attorney Michael Callahan, Judge James Coffey set bail in the amount of $50,000 and ordered Slayden to wear a GPS monitoring device, abide by a curfew, and stay away from Mattapan in the event that he is released on bail.  Coffey also granted Callahan’s motion to revoke Slayden’s open bail on a 2013 case out of Boston Municipal Court charging him with larceny from a person. more »

MIGUEL VELASQUEZ-MENDOZA (D.O.B. 5/30/93) was arraigned in South Boston District Court on charges of unarmed robbery, assault and battery with a dangerous weapon, and assault and battery on a disabled person.  Assistant District Attorney Elizabeth Burke requested that bail be set at $10,000 and that Velasquez-Mendoza’s bail be revoked in an open case out of Concord District Court charging him with larceny over $250.  Judge Tracy-Lee Lyons imposed $1,500 bail and ordered that he undergo mental health evaluation and any treatment deemed necessary, stay away from South Boston, remain drug-free, and undergo random drug screens.  Lyons declined to revoke the defendant’s open bail. more »

The decision by Justices Peter Agnes, Jr., Judd Carhart, and Ariane Vuono affirms the convictions of NICOLE CHUMINSKI (D.O.B. 5/19/82) on two counts of second-degree murder for the April 6, 2008, homicides of 14-year-old Acia Johnson and her 2-year-old sister, Sophia, in their West 6th Street home. After 10 days of testimony elicited by Suffolk prosecutors, a jury convicted Chuminski of those offenses, as well as one count of arson for setting the blaze and two counts of assault and battery with a dangerous weapon – smoke and flames – for injuries sustained by the girls’ mother and brother, who survived. more »
