Another Defendant Charged with Unrelated Shooting Death in Dorchester

BOSTON, Dec. 31, 2018—The man who allegedly shot 26-year-old Wilfred Peters and 27-year-old Jeffrey Montaque to death earlier this year was arraigned today for their murders after more than five months on the run, Suffolk County District Attorney John P. Pappas said.

NICHOLAS ANTOINE, 20, of Boston’s South End was ordered held without bail in Suffolk Superior Court on indictments charging him with two counts of first-degree murder and firearms offenses for the June 6 incident on Faneuil Street in Brighton.

Assistant District Attorney Julie Higgins of the DA’s Homicide Unit told the court that Antoine was among a small group of people at Peters’ home on the night of June 5 into the morning of June 6. At some point, the evidence suggests, Antoine was asked to leave that small gathering – at which point he allegedly went to his car, retrieved a firearm, and returned. Prosecutors say he opened fire, striking both Peters and Montaque multiple times before fleeing. Both victims were pronounced dead at the scene.

Higgins told the court that ballistics evidence suggests only one firearm was used in the shootings. She said Antoine was identified as the gunman through eyewitness statements, video footage, fingerprints, and other evidence. Investigators obtained a district court complaint charging him with the murders, and the Suffolk County Grand Jury indicted him in August, but he was not apprehended until his arrest earlier this month in Jonesboro, Georgia.

Also arraigned today was JOCELYN VASQUEZ, 32, charged in Dorchester Municipal Court with murder for the fatal shooting of 33-year-old Garfield Thomas in his Mattapan home. She, too, was held without bail.

Assistant District Attorney Mark Lee, deputy chief of the DA’s Homicide Unit, told the court that Vasquez shared Thomas’ third-floor apartment Evelyn Street and shot him in the stomach with a handgun after an altercation on the morning of May 15. She allegedly hid the weapon beneath a mattress and fled the scene. Critically wounded, Thomas made his way to the building’s first floor, where he made statements to another resident and to first responders. Among other evidence, investigators recovered Vasquez’ fingerprints from the firearm as well as video evidence showing her leaving the building shortly after the time of the shooting.

Antoine was represented today by attorney Christopher Belezos and will return to court on Jan. 24. Vasquez was represented by attorney Anthony Ellison and will return to court on Feb. 8.

Totality of Circumstances Remain Under Investigation

BOSTON, Dec. 26, 2018—A Hyde Park man was arraigned today after he allegedly discharged a firearm in his home Monday, injuring a household member, and then lied to first responders about what had happened, Suffolk County District Attorney John P. Pappas said.

KOREY FRANKLIN, 32, who is a Boston Police officer, was arraigned in West Roxbury Municipal Court on charges of assault and battery with a dangerous weapon – under a theory of recklessness – and misleading an investigator for the Christmas Eve incident at his Hyde Park home. more »

BOSTON, Dec. 19, 2018—The man accused of fatally beating 54-year-old Joshua Rivera as he slept in a Charlestown park has been indicted for the homeless man’s murder, Boston Police Commissioner William Gross and Suffolk County District Attorney John P. Pappas announced today.

The Suffolk County Grand Jury yesterday returned an indictment charging CLIFTON MOORE, 30, with first-degree murder in the September attack that claimed Rivera’s life. Moore is already in custody on a separate assault case in Middlesex County. more »

BOSTON, Dec. 13, 2018—The woman who stabbed 34-year-old Sasha Morris to death during an argument two years ago was convicted of voluntary manslaughter today, Suffolk County District Attorney John P. Pappas said.

A Suffolk Superior Court jury returned the verdict convicted ELBA MORALES early on its first full day of deliberations following about a week of testimony. Morales, 49 and a resident of Dorchester, stabbed Morris to death in a friend’s Fayston Street home during an argument. She faces sentencing next week. more »

BOSTON, Dec. 13, 2018—Two-month-old Natasha Nicole Mejia-Rivera has died of injuries she suffered in the motor vehicle crash that earlier claimed the life of her sister, 5-year-old Adrianna Mejia-Rivera, Suffolk County District Attorney John P. Pappas said.

The two children were among a group of five pedestrians struck by a motor vehicle in Revere late Sunday afternoon. Adrianna was pronounced dead at the scene; Natasha was transported to Massachusetts General Hospital with critical injuries that claimed her life in the Pediatric Intensive Care Unit last night. more »

BOSTON, Dec. 12, 2018—A Suffolk Superior Court jury today returned verdicts convicting four former youth workers on 19 indictments charging them with abusing the teenagers they were trusted to care for, District Attorney John P. Pappas said.

After a trial that began nearly a month ago, jurors found JALISE ANDRADE, 37, of Brockton; SILVIO DEPINA, 40, of Brockton; HERMANO JOSEPH, 28, of Taunton; and AINSLEY LaROCHE, 44, of Roxbury guilty of beating, sexually assaulting, and/or threatening four teenage males in ritualized punishments at the Casa Isla residential facility on Long Island between April and August of 2014. The defendants were employed by Volunteers of America, which had at that time contracted with the Department of Youth Services to provide residential treatment to juveniles in DYS custody. more »

BOSTON, Dec. 11, 2018—A Suffolk Superior Court jury today convicted a Dorchester man of murdering 21-year-old Joey DeBarros during a traffic altercation on Gallivan Boulevard last year, District Attorney John P. Pappas said.

On their first full day of deliberations, jurors found DEONARINE GANGA, 31, guilty of first-degree murder and unlawful possession of a firearm in connection with the April 13, 2017, shooting that claimed DeBarros’ life. He faces a mandatory life term when he is sentenced tomorrow. more »

REVERE, Dec. 10, 2018—A Boston woman was arraigned today for the crash in Revere yesterday that claimed the life of 5-year-old Adrianna Mejia-Rivera and left a 2-month-old infant in critical condition, Suffolk County District Attorney John P. Pappas said.

AUTUMN HARRIS, 42, of Beacon Hill was arraigned in Chelsea District Court today on charges of motor vehicle homicide and negligent operation of a motor vehicle for her alleged role in the collision near the intersection of Route 145 and North Shore Road. Judge Matthew Machera set bail at $10,000, the amount recommended by Assistant District Attorney Masai King. Machera further ordered Harris to remain drug- and alcohol-free if she posts that amount. more »

BOSTON, Dec. 6, 2018—The two men who allegedly dragged 18-year-old Kemoni Miller alongside their car, killing him, were formally charged with his homicide today, Suffolk County District Attorney John P. Pappas said.

DEJON BARNES, 18, and KENNETH FORD, 23, were arraigned today on murder charges in connection with the encounter last month that left Miller grievously injured and led to his death at Boston Medical Center. Ford was additionally arraigned on a count of using a motor vehicle without authority, and both men had previously been charged with unarmed robbery. Dorchester Municipal Court Judge Jonathan Tynes ordered both men held without bail. more »

BOSTON, Dec. 5, 2018—A Suffolk Superior Court jury has found two men guilty of murdering 17-year-old Yanuel Viloria in the stairwell of a Ruggles Street apartment building last year, District Attorney John P. Pappas said.

On their fifth day of deliberations, jurors this afternoon convicted MALIK PHILLIPS, 20, of first-degree murder and ROBERT SILVA-PRENTICE, 21, of second-degree murder. Both face life sentences at a hearing next month. Under Massachusetts law, Phillips will not be eligible for parole, while Silva-Prentice will be eligible after a period of at least 15 years to be determined by the court. more »

BOSTON, Dec. 4, 2018–An off-duty police officer from New Jersey today admitted to an unprovoked assault on a stranger inside a Boston pizza shop earlier this year, Suffolk County District Attorney John P. Pappas said.

During an appearance this afternoon in Suffolk Superior Court, DANIEL HUNT, 27, of Barrington, N.J., pleaded guilty to the indicted charge of assault and battery for his role in the January beating that left another man with facial injuries that required surgery. Assistant District Attorney Judith Lyons of the DA’s Major Felony Bureau recommended that the court enter a guilty finding and sentence him to two years of probation with orders that Hunt have no contact with the victim, remain alcohol and drug free, undergo an anger management program, and pay $2,618.67 in restitution for out-of-pocket costs incurred by the victim as a result of the injuries he suffered in the attack. more »

BOSTON, Nov. 28, 2018—Twenty-three-year-old Lodimira DosSantos was shot to death in her Bickford Street home by a former intimate partner in a case of deadly domestic violence, Suffolk County District Attorney John P. Pappas said.

“Domestic violence is about power and domination,” Pappas said. “Lodimira’s murder was committed by a man who could not or would not relinquish control over her, even in the very place she should have been safest – her own home.” more »

BOSTON, November 26, 2018—As jury selection was set to begin today in his Suffolk Superior Court rape trial, a man pleaded guilty to charges he sexually assaulted a female acquaintance, Suffolk County District Attorney John P. Pappas said.

JEROME HAIRSTON, 49, who does not have a fixed address, today pleaded guilty to rape as a subsequent offense and strangulation in connection with the 2016 attack on a woman inside the home of Hairston’s relative. Assistant District Attorney Jillian Hira of the DA’s Domestic Violence and Sexual Assault Unit recommended a term of 18 to 20 years in state prison. Judge Elizabeth Fahey sentenced Hairston to six to eight years in state prison followed by four years of probation during which he must have no contact with the victim, maintain his sex offender registry status, and complete sex offender evaluation and treatment. more »

BOSTON, Nov. 26, 2018—The New Hampshire who allegedly threatened mass shootings in calls to at least two Boston bars earlier this month was arraigned today following his arrest in Seabrook last week, District Attorney John Pappas said.

The 16-year-old juvenile, whose last fixed address was in Hampton, NH, was apprehended by Seabrook Police on Friday night. During a hearing at the 10th Circuit Family Division of Portsmouth Court today, he waived rendition proceedings on Massachusetts complaints charging him with delinquency, to wit: threatening to use deadly weapons, threatening to do bodily harm, and a civil rights violation. He was transported to the Boston Juvenile Court, where Judge Peter Coyne set bail at $1,000. more »

BOSTON, Nov. 23, 2018—The two men who allegedly dragged 18-year-old Kemoni Miller alongside their car during a robbery now face murder charges after the young man died of the injuries they allegedly caused, Suffolk County District Attorney John P. Pappas and State Police Colonel Kelly Gilpin said today.

Miller died at Boston Medical Center Wednesday morning after four days on life support. Later that day, prosecutors approved murder charges against DEJON BARNES, 18, and KENNETH FORD, 23, who had previously been charged with unarmed robbery for the Nov. 16 encounter that left Miller grievously injured.

The investigation, led by State Police assigned to the Suffolk County Detective Unit with the assistance of Troop H detectives and Boston Police, suggests that Miller had negotiated the sale of an iPhone XS to Barnes online. On Friday night, the evidence suggests, he met with Barnes and Ford on Gallivan Boulevard. The defendants allegedly travelled to the scene in a vehicle rented by Ford’s friend. From the passenger’s seat, Barnes allegedly took the phone and closed his window on Miller’s arm as Ford accelerated at a high rate of speed.

Miller was dragged about half a mile and suffered a life-threatening head injury when he fell from the car. He was transported to Boston Medical Center but never regained consciousness.

Utilizing cell phone records, text messages, witness statements, video footage, and other evidence, investigators identified Barnes as the individual who had offered to buy the phone from Miller and Ford as the driver of the vehicle that dragged him. State Police arrested both men at a party in the West End early Sunday morning.

Barnes and Ford were initially charged with unarmed robbery and held on $100,000 cash bail each at their Nov. 19 arraignments. Their arraignments on the murder charges have not yet been scheduled. They are expected to return to court on Dec. 4 with attorneys Jeff Chapdelaine and Jeff Garland.

BOSTON, November 20, 2018— An East Boston woman has been charged with drunk driving in connection with a weekend crash that left a scooter operator critically injured, Suffolk County District Attorney John P. Pappas said.

MARCELLA CASTIELLO, 32, of East Boston was arraigned yesterday in Boston Municipal Court on charges of operating under the influence of liquor causing serious injury, negligent operation of a motor vehicle, and a marked lanes violation. Judge Tracy-Lee Lyons imposed bail of $1,000 – the same amount Castiello had posted following her arrest early Sunday morning – and ordered Castiello not to drive while her case is pending. more »

DA Sought Defendant’s Release on Personal Recognizance Last Week

BOSTON, Nov. 16, 2018—One week after they asked a judge to release him from jail on personal recognizance, Suffolk County prosecutors today filed paperwork withdrawing the murder case against KEVIN WILLIAMS, 21, who was charged last month with the shooting death of 67-year-old Jose Luis Phinn Williams in Dorchester.

Suffolk District Attorney John P. Pappas said the decision was based on a review of the evidence gathered and analyzed since the night of Jose Williams’ homicide and Kevin Williams’ arrest. Pappas said that Boston police and Suffolk prosecutors had jointly agreed the case warranted further investigation and that “the ethical step was to withdraw the charges prior to the first scheduled court date as that investigation continues.” more »

BOSTON, Nov. 9, 2018—Suffolk County prosecutors today asked a Dorchester Municipal Court judge to release on personal recognizance the man charged last month in the fatal shooting of Jose Luis Phinn Williams, citing the continued investigation into the homicide.

KEVIN D. WILLIAMS, 21, is charged with murder and firearms offenses in the Oct. 6 homicide at 528 Washington St. The charges remain in place and Williams is due back in court on Nov. 19, but prosecutors recommended that he be released while they continue to gather facts and evidence through the Suffolk County Grand Jury. more »

BOSTON, Nov. 9, 2018—A tennis coach was arraigned today on charges that he indecently assaulted a student at a lesson this summer, Suffolk County District Attorney John Pappas said.

ERIC ROSALES, 57, of Allston is charged with three counts of indecent assault and battery on a child under 14 for the Aug. 8 incident. Assistant District Attorney Khyati Short recommended $5,000 cash bail and orders that Rosales have no contact with the victim or any child under 16, wear a GPS monitor, and surrender his passport if he is released; Judge Myong Joun released him on his own recognizance, granted the no-contact orders, and declined to impose GPS monitoring. more »

BOSTON, November 8, 2018— Three men who undertook the 2016 murder of 41-year-old Shawn Borden were found guilty of all charges this afternoon, Suffolk County District Attorney John P. Pappas said.

A Suffolk Superior Court jury deliberated for approximately three and a half days before finding TYSHAWN CUMMINGS, 23; TYSHAWN SANDERS, 20; and JAMARI MANNING, 23, guilty of first-degree murder under the theory of deliberate premeditation. Jurors also convicted the three men of unlawful possession of a firearm and carrying a loaded firearm. All of them face a term of life in prison without the possibility of parole – the mandatory term for first-degree murder. more »

Attorneys Maria Janina J. Hidalgo, Czarina May C. Altez-Domingo, and Melissa Christina S. Santos of the Filipino corruption investigation agency Office of the Ombudsman on Friday met with Pappas and members of his Special Prosecutions Unit, which prosecutes white-collar crime and offenses committed by public employees. The visiting attorneys arrived in Boston last week for a month-long International Justice Sector Education Training Fellowship through a program of the American Bar Association Rule of Law Initiative. The program aims to help the group gain the knowledge necessary to help their government develop reforms to enhance the efficiency and impact of corruption prosecutions. more »

BOSTON, Oct. 29, 2018—A man serving a prison sentence for murder in Montana was arraigned today in the fatal beating six years ago of 45-year-old Normand Varieur, Suffolk County District Attorney John P. Pappas said today.

KEVIN LINO, 31, was arraigned today in Suffolk Superior Court on an August indictment charging him with first-degree murder. At the request of Assistant District Attorney Julie Higgins of the DA’s Homicide Unit, Clerk Magistrate Edward Curley ordered that Lino be held without bail. more »

BOSTON, Oct. 15, 2018—Three men have been indicted in connection with the shooting death this summer of 29-year-old Christian Rivera on Homestead Street, and two of them were arraigned today following their arrests late last week, Suffolk County District Attorney John P. Pappas said.

The Suffolk County Grand Jury on Friday returned indictments charging DEMETRIUS BENNETT, 27, and ADNAN TAHLIL, 24, with first-degree murder. Both men were arrested late Friday by Boston Police and arraigned today in Suffolk Superior Court, where Clerk Magistrate Rebeca Figueroa ordered them held without bail. more »

BOSTON, October 10, 2018—A longtime member of Suffolk County District Attorney John P. Pappas’ executive staff was sworn in today as a member of the Restorative Justice Advisory Committee created by statute earlier this year.

Director of Community Engagement Kara Hayes, who has served in the Suffolk DA’s office for 30 years, was sworn in at the Massachusetts State House as a member of the restorative justice panel created through legislation that was passed into law this spring. The committee is tasked with reviewing community-based restorative justice programs across the state and making policy recommendations, including performance measurements and training requirements. more »

Faces Sentencing Tomorrow

BOSTON, Oct. 10, 2018—The driver who struck a pedestrian in Chinatown and dragged her from Chinatown to Route 93 pleaded guilty yesterday and faces sentencing tomorrow, Suffolk County District Attorney John P. Pappas said.

XIAO YING ZHOU, 47, of Sandwich pleaded guilty to the indicted charges of assault and battery with a dangerous weapon causing serious bodily injury, leaving the scene of a collision causing personal injury, and negligent operation of a motor vehicle in connection with the 2016 collision that left the victim, now 51, with life-altering injuries. more »

BOSTON, October 9, 2018—During their separate arraignments today, the men charged in the murders of 19-year-old Terrell White and 63-year-old Jose L. Williams were each ordered held without bail, Suffolk County District Attorney John P. Pappas said.

KEVIN D. WILLIAMS, 21, was arraigned today in Dorchester Municipal Court in Jose Luis Williams’ murder and related firearm charges. Also arraigned today in the same court was KAI HARRIS, 27, in connection with White’s shooting death. Harris is additionally charged with unlawful possession of a firearm and being a Level 2 Armed Career Criminal based on prior convictions for armed robbery and assault with a dangerous weapon. BOSTON, October 5, 2018— An East Boston man was sentenced to prison today for sexually abusing a young boy as the child slept, Suffolk County District Attorney John P. Pappas said.

A Suffolk Superior Court jury last week convicted CELVYN MEJIA, 26, of indecent assault and battery on a child in connection with the 2017 assault; jurors acquitted Mejia of assault with intent to rape. During a sentencing hearing today, Judge Robert Tochka imposed a term of three to five years in state prison. more »

BOSTON, Oct. 2, 2019— Suffolk County District Attorney John P. Pappas this week welcomed a visiting prosecutor from Singapore who will spend the next six months observing some of Suffolk County’s most experienced prosecutors as they work.

Deputy Public Prosecutor Ang Feng Qian of Singapore’s Attorney-General’s Chambers will complete a six-month rotation with Pappas’ office observing criminal proceedings in the District, Superior, and Appellate courts. Qian’s first three months with the office will be spent within the Homicide Unit, followed by three months assigned to the office’s Special Prosecutions Unit, which prosecutes financial and internet-based crimes as well as offenses committed by public employees. more »

BOSTON, Oct. 2, 2019—Suffolk County District Attorney John P. Pappas testified at the State House yesterday in support of a bill filed by Massachusetts Governor Charlie Baker to improve the process by which people are released on bail or held because of their dangerousness.

BOSTON, Sept. 28, 2018—A Suffolk Superior Court jury today convicted an East Boston man of murder and other charges for his role in the 2015 fatal shooting of 18-year-old Andres Jaramillo in Revere, Suffolk County District Attorney John P. Pappas said.

Jurors deliberated for about three days before finding LUIS URBAEZ, 33, guilty of second-degree murder for killing Jaramillo, armed assault with intent to murder for shooting at but not hitting a second teen, and unlawful possession of a firearm. BOSTON, Sept. 28, 2018—A Superior Court jury yesterday convicted a computer technician of possessing child pornography after he left a hard drive with graphic sexual images of children at a Boston job site, Suffolk County District Attorney John P. Pappas said.

MICHAEL KRATHWOHL, 28, of Ipswich was convicted yesterday after five days of trial and about three hours of deliberations. Suffolk Superior Court Judge Hélène Kazanjian ordered him taken into custody following the verdict.

“Child pornography documents sexual violence against children,” Pappas said. “These weren’t pictures a parent might take of a child in the bath. They were precisely what was contemplated when the legislature made possessing child pornography a felony.” more »

BOSTON, Sept. 26, 2018—Outgoing District Attorney Daniel F. Conley administered the oath of office this afternoon to his former chief trial counsel, John P. Pappas, who was appointed as Suffolk County’s 15th district attorney by Massachusetts Governor Charlie Baker earlier this week.

At an emotional ceremony at his downtown office, Conley recalled the day he first walked into office after his own gubernatorial appointment in 2002.

“I knew how the DA’s office worked,” he said. “I’d been a prosecutor for nine years, working in the district courts, the Juvenile Unit, and then Superior Court trial teams. I had some experience in government from my time on the City Council. But I’d never been a DA before, and I knew I was going to need a great team. And I’ve had one – for 16 years, seven months, one week, and one day.” more »

BOSTON, Sept. 25, 2018—A senior member of Suffolk County District Attorney Daniel F. Conley’s executive staff has been named to serve out the remainder of Conley’s term when he steps down tomorrow as the chief law enforcement officer for Boston, Chelsea, Revere, and Winthrop.

Massachusetts Governor Charlie Baker today announced that he had selected Assistant District Attorney John P. Pappas of West Roxbury to lead the Suffolk DA’s office after Conley departs an office he has led for more than 16 years. A Suffolk prosecutor since 1994, Pappas has served as Conley’s chief trial counsel since 2011. more »

BOSTON, September 21, 2018—District Attorney Daniel F. Conley today announced the relaunch of his office’s internet safety training program – now called STOP BLOCK and TALK – designed to ensure kids know how to safely navigate the online world and help parents understand and communicate with their kids about the risks they face online.

Since 2011, Conley’s Director of Youth Safety and Outreach Jacquelyn Lamont has presented the CyberPeace internet safety training she created to kids, parent groups, and professionals who work with young people across Suffolk County. The program has been presented to thousands of students each year since that time. The rebranded program continues to focus on kids’ online safety, but has changed through the years as new risks have emerged with new technology.

BOSTON, Sept. 19, 2018—The New Hampshire man accused of shooting 29-year-old Taquise Johnson to death in East Boston this spring was arraigned today on a murder charge, and his alleged getaway driver has been indicted as an accessory after the fact, Suffolk County District Attorney Daniel F. Conley said.

BOSTON, September 6, 2018— A man was sentenced to prison this afternoon after a jury convicted him of robbing a man with cerebral palsy last summer, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury today found BENJAMIN JOSEY, 59, guilty of armed robbery, assault and battery on a disabled person, and stealing by confinement. Josey, who was residing at a Boston homeless shelter at the time of his arrest last year, faced sentencing this afternoon before Judge Kenneth Salinger. Assistant District Attorney David Wittenberg of the DA’s Elders and Persons with Disabilities Unit requested that Josey be sentenced to five to seven years in state prison followed by two years of probation with conditions mandating that he undergo drug treatment and stay away from the victim during that time. Convicted yesterday of plunging a knife into Dwyer’s heart and then attempting to influence witnesses who cooperated with the investigation, 36-year-old DOMINIC SHINER was sentenced today for voluntary manslaughter and witness intimidation. Assistant District Attorney Julie Higgins recommended the maximum penalties for both offenses – terms of 19 to 20 years and nine to 10 years, respectively, asking the court to impose those sentences consecutively. Chelsea District Court Judge D. Dunbar Livingston found KENNETH LAFAUCI, a.k.a. KENNETH LEFAUSI, guilty of making false statements in an application for a motor vehicle title and removing or altering a vehicle identification number. Livingston sentenced Lafauci to 18 months in a house of correction with six months to serve and the balance suspended for two years. Lafauci, age 61 of Topsfield, must also pay a $500 fine. more »

BOSTON, August 2, 2018— A Hyde Park juvenile was arraigned yesterday in connection with a July assault, the second youth to be charged with a beating that left the victim with life-altering injuries, Suffolk County District Attorney Daniel F. Conley said.

The 17-year-old male was arraigned yesterday in the juvenile session of Dorchester Municipal Court on a charge of assault and battery causing serious bodily injury after surrendering to Boston Police for a July 14 assault on Milton Avenue. At the request of Assistant District Attorney Michael V. Glennon, deputy chief of the DA’s Juvenile Unit, Judge Thomasina Johnson ordered the youth held on $25,000.

The juvenile is the second person to be arraigned in connection with the assault. A 13-year-old female from Mattapan was arraigned July 16 on a charge of assault and battery with a dangerous weapon. The appeal by TAKII RASPBERRY, 39, challenged a judge’s earlier decision denying her motion to suppress a loaded handgun and other evidence from a case pending in Roxbury Municipal Court. Honan Award for Excellence in the Courtroom and Commitment to the Communities We Serve at a ceremony held last month at Suffolk University. BOSTON, July 11, 2018—The Massachusetts Appeals Court today reversed a judge’s decision granting a new trial for the man who caused Kelvin Rowell’s death from an asthma attack, reinstating a Suffolk Superior Court jury’s manslaughter verdict, District Attorney Daniel F. Conley said.

The nine-page decision came after Suffolk prosecutors appealed Judge Edward Liebensperger’s 2017 order granting MICHAEL STALLINGS, 29, a new trial for opening fire on a group of men on the night of Jan. 23, 2012, prompting Rowell to run for his life – and suffer an asthma attack that claimed his life. TOMAS MIKULA, 28, was arraigned today at Massachusetts General Hospital on charges of possession of explosives, possession of an incendiary device, discharge of explosives, possession of a large capacity firearm, carrying a loaded firearm, unattended firearm, unattended ammunition, unlawful possession of ammunition, and three counts of unlawful possession of a firearm as a subsequent offense. BRANDON McCALLOP, 29, of Dorchester was arraigned today in Charlestown Municipal Court on three counts of armed robbery while masked in connection with armed robberies of Charlestown businesses that occurred in March and June. BOSTON, July 3, 2018—State Police narcotics detectives seized three handguns along with heroin and cocaine from the home of an alleged drug dealer already on probation following convictions for firearms offenses, Suffolk County District Attorney Daniel F. Conley said.

SANDY SANTIAGO, 32, who also claims residency in Lowell, was arraigned today in Chelsea District Court for one count of trafficking in 36 or more grams of heroin, one count of trafficking in 18 or more grams of heroin, and three counts of distribution of a Class A substance. BOSTON, June 28, 2018—A Suffolk Superior Court jury today convicted two men of murder in the multiple shooting that killed 17-year-old Raekwon Brown, additionally finding those defendants and a third man guilty of various assault and firearms charges, District Attorney Daniel F. Conley said.

Jurors convicted JADEN WAITERS, 21, of first-degree murder under the theory of deliberate premeditation for his role in Brown’s 2016 homicide near the Jeremiah E. Burke School. Jurors also convicted JONATHAN AGUASVIVAS, 25, of second-degree murder for his role in the same shooting and acquitted BENZY BAIN, 26, of murder charges connected to the homicide. All three were indicted for first-degree murder as joint participants.

Jurors additionally convicted all three defendants of nine indictments each, charging multiple counts of assault and battery by means of a firearm, armed assault with intent to murder, and firearms violations. BOSTON, June 26, 2018—A woman who allegedly threatened a fellow subway passenger with a knife while uttering homophobic slurs after Boston’s Pride Parade will be held without bail for 60 days on a bail revocation, Suffolk County District Attorney Daniel F. Conley said.

DENISE KNOX, 36, of Woburn was arraigned yesterday in Charlestown Municipal Court for assault with a dangerous weapon, threats to commit a crime, and a civil rights violation. At the request of Assistant District Attorney Paul Lewis, Judge Lawrence McCormick set her bail at $5000; ordered her to stay away from the victim, witnesses, and MBTA; and revoked her bail on a pending assault and battery case out of Woburn District Court.

“No matter who you are, you have the right to live and work and travel free from threats and intimidation,” Conley said. “Anyone confronted with disgraceful conduct like this can feel safe, supported, and respected coming forward to report it. Our primary concern will always be for the victim’s safety and wellbeing.”

On the evening of June 9, following Boston’s Pride Parade, Knox allegedly instigated a confrontation on an Orange Line car with a woman who was carrying a multi-colored rainbow flag. After a hostile verbal exchange in which Knox mentioned the parade, used homophobic slurs, and threatened this woman, another passenger intervened and suggested Knox either leave her alone or get off the train.

Knox allegedly produced a folding knife at this time and threatened the passenger who intervened. This man moved to another car and pressed the emergency call button to report the incident. Transit Police officers responded to Community College station, where they were directed to Knox but were unable to locate a victim; their investigation continued in the hours that followed.

Later that night, the victim contacted Transit Police to report the incident. Based on her statements, a follow-up interview with the man Knox allegedly threatened with the knife, and a review of footage from MBTA public safety cameras, Transit Police obtained a warrant for Knox’s arrest.

Knox was represented by attorney Bruce Linson. She will return to court on July 18.

BOSTON, June 8, 2018— A Brockton man has been sentenced to prison more than two decades after he sexually abused three young girls in Boston, Suffolk County District Attorney Daniel F. Conley said.

WILLIAM BRYANT, 69, yesterday pleaded guilty to six counts of rape of a child with force and one count of assault with intent to rape a child. Assistant District Attorney Brenna Flynn of the DA’s Child Protection Unit recommended that Bryant be sentenced to three concurrent terms of seven to nine years in state prison followed by five years of probation. Judge Linda Giles, citing the defendant’s health issues, sentenced Bryant to three years in prison followed by five years of probation, during which time Bryant will be required to complete sex offender treatment, wear a GPS monitor, provide law enforcement with a DNA sample, have no contact with the victims or their families, and have no contact with any child under age 18 unless supervised by the child’s parent or guardian, to whom Bryant must provide a full disclosure of his crimes. Now Faces Sentencing Rather Than Trial Next Month

BOSTON, June 8, 2018—The serial rapist accused of a string of sexual assaults that began more than a decade ago pleaded guilty yesterday as his case approached trial and faces sentencing next month, Suffolk County District Attorney Daniel F. Conley said.

ALEJANDRO DONE, 49, pleaded guilty to indictments charging two counts of aggravated rape, one count of rape, one count of assault with intent to rape, two counts of kidnapping, and one count of armed robbery. Those charges reflect attacks on three women in 2006, 2007, and 2010 that prosecutors were prepared to prove he committed; the victim in a fourth assault returned to her native country shortly after the assault was not expected to be available for trial. Done changed his plea at what had been scheduled for a status hearing in advance of his July 16 trial date.

Done, who is serving a prison term following convictions in Middlesex County, faces sentencing on July 18. Prosecutors will recommend a lengthy state prison sentence on the Suffolk County convictions. more »

BOSTON, June 7, 2018— A Brighton motorist was arraigned today on charges he struck 80-year-old Theodore Schwalb in a crosswalk and drove away, leaving him to die, Suffolk County District Attorney Daniel F. Conley said.

PHOCIAN FITTS, 23, was arraigned today in Brighton Municipal Court on charges of motor vehicle homicide and leaving the scene of a collision causing death. Assistant District Attorney Emily Hamrock of the DA’s Elders and Persons with Disabilities Unit requested bail of $15,000. Judge Myong Joun imposed $10,000 bail and ordered Fitts to submit to GPS monitoring in the event he posts that amount. Joun also ordered Fitts to refrain from driving in light of the Registry of Motor Vehicles’ suspension of his license following yesterday’s fatal crash. more »

BOSTON, June 6, 2018—The man who allegedly stabbed his son, 35-year-old Brendan Tahatdil, to death in Dorchester was apprehended in New York today – exactly one year after the Suffolk County Grand Jury returned an indictment charging him with first-degree murder, District Attorney Daniel F. Conley and Boston Police Commissioner William B. Evans said.

DESMOND TAHATDIL, 56, was indicted on June 6, 2017, for first-degree murder in the March 7, 2017, homicide of Brendan Tahatdil in the home they shared on Hartford Street. He was apprehended early this morning in Brooklyn on an arrest warrant out of Suffolk Superior Court and could return to Boston by next week.

“Fatal family violence like this can be devastating to the loved ones left behind,” Conley said. “Our hearts are with them today. Prosecutors and victim advocates are committed to supporting them as the case transitions from the search to the courtroom.”

“I can’t say enough about the dedication and great work of my officers and the officers in the U.S. Marshals,” Commissioner Evans said. “This lengthy investigation spanned from Boston to four different states and three different countries. It is a great example of how the partnership between the Boston Police and the U.S. Marshal service allows these crucial arrests to be made almost a year and a half after the incident at a location three states away. The efforts, determination, and collaboration of these officers are the reason this dangerous individual is in custody.”

Boston Police responded to the Hartford Street scene at about 7:45 that morning for a report of a person stabbed and found Brendan Tahatdil suffering from multiple stab wounds that ultimately claimed his life. The investigation by Boston Police Homicide detectives and Suffolk prosecutors assigned to the DA’s Homicide Unit revealed that the two men became involved in an argument that morning. In the course of that argument, investigators believe, Desmond Tahatdil stabbed Brendan Tahatdil in the torso. He allegedly made admissions to others in the home before fleeing the scene.

The Boston Police Fugitive Unit undertook exhaustive efforts to locate Tahatdil, both overseas and within the US. They were aided by the BPD Homicide Unit, Suffolk DA’s office, US Marshals, and, most recently, the New York Police Department, leading to today’s arrest.

Tahatdil will be charged in Kings County, New York, as a fugitive from justice; if he waives extradition proceedings then he could be back in Boston by next week.

Police, Prosecutors Seek Help from Public, Body Shops

BOSTON, June 4, 2018—Suffolk County District Attorney Daniel F. Conley today released video clips and images of the vehicle sought in connection with the Mattapan hit-and-run crash that claimed the life of 40-year-old Pierre Desir last month and asked the public – especially auto body shops – for help in identifying the car and its driver.

Based on witness statements, video footage, and the analysis of debris left at the scene, investigators now believe the vehicle that struck Desir was an older model Chrysler 300, dark in color and likely blue or black. The four-door sedan sustained front-end damage, including headlight damage and possibly windshield damage.

Auto body shops that may have worked on such a vehicle since May 26 are asked to contact investigators, as is anyone familiar with such a vehicle that was damaged or has been missing since last week. more »

JOHN MENTOR, 32, was arraigned in West Roxbury Municipal Court today on four counts of assault with a dangerous weapon and a variety of firearms offenses. Judge James Stanton ordered him held pending a hearing next week under Chapter 276, Section 58A, of the Massachusetts General Laws. The statute allows a judge to hold a defendant accused of certain offenses without bail for up to 120 days pending trial upon “clear and convincing evidence that no conditions of release will reasonably assure the safety of any other person or the community.” more »

BOSTON, May 31, 2018—A drunk driver was sentenced to state prison today following his conviction yesterday for killing 25-year-old Marco Salguero-Cruz in Chelsea two years ago, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury yesterday found JOSE DANIEL AREVALO, 35, guilty of motor vehicle homicide while operating under the influence and leaving the scene of a collision causing death in connection with the 2016 collision that claimed Salguero-Cruz’ life on Washington Street.

Assistant District Attorney Michael V. Glennon recommended concurrent terms of five to seven years in state prison. Judge Linda Giles imposed a sentence of three and a half to four years on the motor vehicle homicide conviction and a sentence of two and a half years in a house of correction for leaving the scene, with one year deemed served while awaiting trial and the balance suspended for a four-year probationary term. During that period, she ordered, Arevalo must remain alcohol free and take part in an alcohol abuse program. more »

May 27, 2018, UPDATE: The taxi driver sought as a witness in yesterday morning’s hit-and-run, which killed 40-year-old Pierre Desir, has come forward and spoke with State Police investigators this morning. Based on evidence at the scene, video footage, and witness statements, the vehicle involved in the collision is believed to be a four-door sedan, dark in color, with front end damage that includes a missing headlight. The vehicle may be a Honda Accord, possibly a 1999-2004 model. BOSTON, May 23, 2018—A former hospital employee and several of her personal associates have been indicted for allegedly using stolen prescription forms to allow herself and others to obtain powerful opiate painkillers, Suffolk County District Attorney Daniel F. Conley said.

BOSTON, May 22, 2018—A Dorchester man who allegedly shot a man in the head from the back of a scooter had his bail revoked today on an earlier case in which he allegedly carried a handgun while riding a different scooter, Suffolk County District Attorney Daniel F. Conley said.

KEVIN WOODS, 19, allegedly fired on the 20-year-old victim while his 17-year-old co-defendant operated the scooter. Both are charged with armed assault with intent to murder, armed carjacking, and multiple firearms offenses. The juvenile, a resident of Salem, was additionally charged with leaving the scene of a collision causing injury.

“It’s chilling to think just how easily this could have become a homicide,” Conley said. “The victim could have been killed. BOSTON, May 22, 2018—A Winthrop man who had more than $1 million in cash and bank accounts when he was arrested earlier this year faces arraignment tomorrow following his indictment for money laundering and drug trafficking, District Attorney Daniel F. Conley said.

BOSTON, May 18, 2018—The driver who allegedly caused a devastating crash early on New Year’s Day was travelling at more than double the speed limit just prior to a collision that nearly killed the passenger of another vehicle, Suffolk County prosecutors said today.

BOSTON, May 17, 2018—A 16-year-old juvenile has been charged with shooting another young man in the chest during a rush hour confrontation near Downtown Crossing earlier this month, Suffolk County District Attorney Daniel F. Conley and Boston Police Commissioner William B. Evans said.

The juvenile was apprehended yesterday at the Boston Juvenile Court, where he was scheduled to appear on an unrelated case for which he was being prosecuted. He was arraigned on one count of delinquency, to wit: assault with intent to murder for the May 2 shooting and held on $250,000 cash bail. more »

BOSTON, May 17, 2018—The Massachusetts Appeals Court today affirmed a West Roxbury driver’s conviction for causing a 2013 collision that left one of his passengers in a wheelchair and the driver of a second vehicle with catastrophic injuries that left him unable to walk, talk, or even feed himself until his death last year, Suffolk County District Attorney Daniel F. Conley said.

A Brighton Municipal Court jury convicted NIKOLAS PAPADOPOULOS, 23, of negligent operation of a motor vehicle following a three-day trial in 2015. Papadopoulos was behind the wheel of a 2003 Mazda Tribute and travelling westbound on the Arborway at about 2:00 pm on Sept. 16, 2013. The evidence showed that he was driving well over the 30 mph speed limit when he passed another vehicle on the right, crossed the center line in the area of Saint Joseph Street, struck a concrete barrier, and rolled over, crashing into a 2004 Ford F-150 pickup truck. more »

BOSTON, May 16, 2018— A Swampscott man was arraigned today on charges he sexually assaulted two women at gunpoint last year, Suffolk County District Attorney Daniel F. Conley said.

JOSEPH LOSANO, 51, of Swampscott was arraigned today in Roxbury Municipal Court on four counts of aggravated rape in connection with the two separate attacks. Bail was set in the amount of $50,000 and Losano was ordered to wear a GPS monitor, stay out of the city of Boston, and stay away from the victims in the event he is released on bail. more »

BOSTON, May 14, 2018— A man currently serving an unrelated prison sentence has been indicted on charges he critically injured a man by beating him with a rock at a homeless encampment last year, Suffolk County District Attorney Daniel F. Conley said today.

JACQUES MERVEILLE, 32, has been indicted by a Suffolk County grand jury on charges of assault and battery causing serious bodily injury and armed robbery in connection with the 2017 assault outside Copley Square. BOSTON, May 9, 2018—A man who raped and trafficked a teenaged relative was sentenced to life in prison today following his conviction for what Suffolk County District Attorney Daniel F. Conley called “one of the most disturbing cases I’ve encountered in my career as a prosecutor.”

A Suffolk Superior Court jury on Monday convicted DELACY MORRIS, 46, of one count of trafficking a person under 18 for sexual servitude and three counts each of rape, incest, and indecent assault and battery. Today, Suffolk Superior Court Christopher Muse found that Morris qualified for sentencing enhancements as a repeat offender given his conviction for a 2000 aggravated rape. Morris was sentenced to 15 years in prison on that conviction. more »

BOSTON, May 7, 2018—A Brighton man was held without bail at his arraignment on a murder charge stemming from the fatal shooting of 34-year-old Dwayne Thomas, Suffolk County District Attorney Daniel F. Conley said.

DERRELL RUSSELL, 29, was charged with the shooting that claimed Thomas’ life on Hartford Street in Dorchester late last month. He was arrested late Friday by Boston Police on a warrant issued earlier that day. more »

BOSTON, May 7, 2018—Suffolk County District Attorney Daniel F. Conley today released his entire investigative file on the 2016 gunfight in East Boston that left two Boston Police officers critically injured and the man who shot them fatally injured.

Conley determined that Boston Police Officers Matthew Morris and Eric Schmidt acted in lawful self-defense, defense of each other, and defense of Officer Richard Cintolo when they discharged their weapons at KIRK PATRICK FIGUEROA, 33, on the night of Oct. 12, 2016. Under a voluntary policy of transparency in such investigations, Conley released the evidence on which his decision was based – more than 500 pages of interview transcripts, almost 800 pages of written reports and forensic testing results, over 1800 photographs, and more than three hours of dispatch recordings – to the news media. BOSTON, April 23, 2018— A Chelsea man was sentenced to a decade in prison today after his conviction for sexually assaulting a young child, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury on Thursday found ALVARO CALDERON, 33, of Chelsea guilty of aggravated rape of a child and indecent assault and battery on a child under 14. At his sentencing today, Judge Janet Sanders imposed a term of 10 years in state prison. Upon his release, Calderon will serve an additional two years of probation, during which time he must register as a sex offender, complete sex offender treatment, have no direct or indirect contact with the victim, have no unsupervised contact with any child under 16, and wear a GPS monitor. Assistant District Attorney Audrey Mark, Chief of Conley’s Child Protection Unit, had additionally requested that Calderon be ordered not to hold any employment or volunteer position that would put him in contact with children; however, Sanders declined to impose the requested condition. more »

BOSTON, April 17, 2018—A Suffolk County prosecutor recommended incarceration today for the off-duty police officer convicted of beating a ride-share driver while hurling racial epithets three years ago, District Attorney Daniel F. Conley said.

Jurors convicted MICHAEL COLIN DOHERTY, 43, on April 2 of two counts of assault and battery for striking a 28-year-old Revere man working as an Uber driver in the early morning hours of Jan. 4, 2015. Jurors also convicted Doherty, who was an off-duty Boston Police officer at the time, of assault and battery for purposes of intimidation, reflecting his use of racial and ethnic slurs during the confrontation, and use of a motor vehicle without authority for entering and driving several blocks in the victim’s vehicle. more »

BOSTON, April 16, 2018—Two members of Suffolk County District Attorney Daniel F. Conley’s office have been awarded scholarships to participate in the highest quality workshops, computer labs, and case studies at the thirteenth annual Conference on Crimes Against Women (CCAW) this week.

Assistant District Attorney Judith Lyons, chief of the DA’s Major Felony Bureau, and Deputy Chief of Staff Catherine Rodriguez will join hundreds of police officials, prosecutors, and victim advocates from across the nation who work with female victims of crime. Their attendance was made possible through a CCAW scholarship that provides access to critical training for those who would otherwise be unable to attend due to increasing budget constraints upon their agencies. Presented by Genesis Women’s Shelter & Support and the Dallas Police Department, CCAW is a national clearinghouse for training and best practices regarding the identification, investigation, and prosecution of all types of violent crimes against women, including domestic and dating violence, sexual assault, stalking, and human trafficking. BOSTON, April 12, 2018—More than a decade after he shot and killed off-duty Revere Police Officer Daniel Talbot, a Revere man admitted his guilt rather than face the new trial he was granted when an appellate court reversed his murder conviction, Suffolk County District Attorney Daniel F. ROBERT IACOVIELLO, Jr., 30, pleaded guilty to voluntary manslaughter today and accepted a 14-year prison term rather than proceed to trial on April 30 for second-degree murder – the charge for which a Suffolk Superior Court jury convicted him in 2010, and which the Massachusetts Appeals Court reversed in 2016 after finding flaws in the trial judge’s jury instructions. BOSTON, April 10, 2018—The man who gained access to a Boston University student’s dorm room in 2015 and sexually assaulted her while she slept pleaded guilty today in a hearing that accommodated the survivor’s strong preference not to testify at trial and fulfilled her wishes to put the case behind her with the defendant’s unequivocal admissions of responsibility and remorse, Suffolk County District Attorney Daniel F. Conley said.

SAMSON DONICK, 22, pleaded guilty to indecent assault and battery, assault and battery, and breaking and entering at night with intent to commit a misdemeanor. Suffolk Superior Court Judge Janet Sanders sentenced him to five years of probation, during which time he must perform 1000 hours of community service, undergo sex offender treatment, have no contact with the survivor, and wear a GPS monitor. At the survivor’s request, Sanders further ordered that the defendant make a personal apology to her, which he did from the witness stand. more »

BOSTON, April 9, 2018—Suffolk County District Attorney Daniel F. Conley’s office will appeal a judge’s decision today overturning a jury’s verdict last week in the murder of 26-year-old Chaz Burton, who was stomped, beaten, and shot to death after a party in 2016.

Two men, ABDULLAH YASIN and FABIAN LLANO, went to trial last month on indictments charging both men with first-degree murder and assault and battery with a dangerous weapon in connection with Burton’s homicide. After two weeks of trial and four days of deliberations, jurors on March 26 convicted Yasin of second-degree murder as well as assault and battery with a dangerous weapon for stomping repeatedly on Burton’s head. The jury acquitted Llano of the homicide charges but also convicted him of assault and battery with a dangerous weapon for stomping on Burton’s head.

BOSTON, April 5, 2018—On the same day that he presented $65,000 in free grants to community-based non-profit groups, Suffolk County District Attorney Daniel F. Conley announced today that his office received more than $426,000 in grant funding to support survivors of homicide and victims of gun violence.

Conley’s office has been selected by the Massachusetts Office of Victim Assistance to receive $426,110 in federal Victims of Crime Act funding over the next two fiscal years. At the request of prosecutors, Judge Jean Curran imposed bail of $500,000 and revoked Alphonse’s bail on an open Taunton District Court case charging larceny, identity fraud, and credit card fraud offense. more »

BOSTON, March 27, 2018—A repeat rapist has been sentenced to up to 35 years in prison after a jury convicted him of sexually assaulting a woman less than a year after his release from prison on a similar conviction, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court Jury on Friday found EDUARDO RODRIGUEZ, 32, guilty of two counts of aggravated rape and single counts of kidnapping, unarmed robbery, and indecent assault and battery in connection with the Aug. 22, 2016, assault. Rodriguez’ jury trial was followed by a one-day bench trial held yesterday, during which Judge Maureen Hogan found Rodriguez guilty of aggravated rape as a subsequent offense. That finding – based on Rodriguez’ Suffolk Superior Court rape conviction for a 2007 assault – exposed Rodriguez to an enhanced sentence. more »

BOSTON, March 21, 2018—Suffolk County District Attorney Dan Conley this week welcomed new community partners to an ambitious diversion project, hoping to double the capacity of a program that allows juveniles charged with some serious offenses to get their lives back on track without incurring additional entries on their records.

Conley’s office launched the Juvenile Alternative Resolution pilot project in February 2017 with half a dozen community-based agencies that provide individualized services to Boston’s youth. In May, the partner agencies began accepting juveniles who faced delinquency charges in the Boston Juvenile Court and showed a moderate to high risk of re-offending. And yesterday, Conley welcomed a new batch of agencies to the team.

“Historically, juvenile diversion in Massachusetts has been geared toward first-time and low-level offenders, and it’s been limited in the services available to promote post-diversion success,” Conley said. “We envisioned something more ambitious – something that would re-direct the lives of young people charged with more serious offenses, even high-risk teens. We sought out partners who could offer individualized services for a wide range of needs. And our shared goal across agencies was to divert young adults outward, away from the criminal justice system, instead of upward and deeper into it.” more »

The Suffolk County Grand Jury today returned indictments charging CLEI SANDOVAL-ARIAS, 29, with two counts of identity fraud, four counts of furnishing a false name at arrest, and two counts of larceny over $250 by single scheme. BOSTON, March 7, 2018—The Suffolk County Grand Jury today returned indictments charging an agent assigned to the Boston office of the Internal Revenue Service with rape and other offenses stemming from alleged assaults on a college student last summer, Suffolk County District Attorney Daniel F. The indictments charge JAMES CLARKE, 44, with aggravated rape, rape, indecent assault and battery, strangulation, and assault and battery with a dangerous weapon for an incident on the evening of July 26, 2017, when Clarke allegedly invited the victim for drinks after work and then offered to drive her to South Station to catch a train. more »

BOSTON, March 6, 2018— Suffolk County District Attorney Daniel F. Conley and hundreds of volunteers are preparing to lace up for next month’s Ginormous Climb, the vertical charity run Conley has hosted since 2014 to benefit young survivors of abuse, neglect, and exploitation.

The 5th Annual Ginormous Climb will take place April 7 at 200 Clarendon, formerly the John Hancock Tower and the tallest building in Boston. Volunteers will scale the building’s 60-story stairwell to raise funds to support the Children’s Advocacy Center of Suffolk County, which acts as a hub connecting child victims and their non-offending caregivers with law enforcement, service providers, and other supports. more »

BOSTON, March 6, 2018—At a sentencing hearing in Suffolk Superior Court today, two men confronted the predator who abused them as children and disappeared after he was indicted, living under a false identity in Florida and North Carolina for more than two decades before being apprehended.

Suffolk County District Attorney Daniel F. Conley said JOHN J. HARTIN, 48, was convicted last week of five counts of rape of a child for the assaults on two boys beginning in 1991. Hartin was indicted in 1993 but fled the area, eluding Boston Police, US Marshals, and the FBI until 2016. Jurors convicted him of all charges after a week-long trial that ended Feb. 28. more »

BOSTON, March 5, 2018—A man who remained at large for more than a year after allegedly stabbing a former partner and a family member who rushed to her aid was held on high bail at his Superior Court arraignment today, Suffolk County District Attorney Daniel F. Conley said.

JEFFREY LABATHE, 27, of Hyde Park was arraigned today on indictments charging him with two counts of armed assault with intent to murder for allegedly stabbing the two women during the 2016 incident, as well as single counts of strangulation, assault and battery on a family or household partner, and aggravated burglary.

At prosecutors’ request, Judge Robert Tochka set bail at $250,000 and ordered Labathe to wear a GPS monitor and have no contact with any victims or witnesses if he posts that amount. more »

JUAN CARLOS MATOS FIGUEROA (D.O.B. 5/4/96) of Somerville was arraigned today in Suffolk Superior Court on indictments charging first-degree murder, unlawful possession of a firearm, unlawful possession of a large capacity feeding device, carrying a loaded firearm, assault and battery by discharging a firearm, four counts of attempted assault and battery by discharging a firearm, and five counts of armed assault with intent to murder for opening fire on a group of unarmed teens, killing Vasquez and striking a second victim. BOSTON, Feb. 28, 2018—Suffolk County District Attorney Daniel F. Conley this week hosted local and federal partners for a series of meetings with a prosecutors’ advisory group on as part of an exclusive witness intimidation technical assistance grant that only two other cities have obtained.

Conley’s office and the Boston Police Department applied for the AEquitas Combating Witness Intimidation Initiative grant last year, and Boston was selected to represent one of the pilot cities to receive it. The grant provides resources from to collect data on witness intimidation, develop and implement strategies to overcome the phenomenon, and evaluate their effectiveness. more »

ADERITO MONTEIRO, 28, of Randolph was arraigned in the Boston Municipal Court today on charges of negligent operation of a motor vehicle, failure to stop for police, disorderly conduct, driving an uninsured all-terrain vehicle, and various civil infractions. BOSTON, February 26, 2018— As the man who abducted and raped her more than 13 years ago was sentenced to a lengthy prison term today, one victim declared she is neither victim nor survivor but “a warrior.”

DWAYNE McNAIR (D.O.B. 1/30/81), convicted Jan. 12 of eight counts of aggravated rape and two counts of armed robbery, faced sentencing today before Suffolk Superior Court Judge Linda Giles. Assistant District Attorney David Deakin, chief of District Attorney Daniel F. Conley’s Family Protection and Sexual Assault Bureau, recommended a sentence of 30 to 40 years in state prison. Yesterday, Boston Police arrested MOSES JACOBS (D.O.B. 8/7/97) of Dorchester on a warrant charging him with armed assault with intent to murder, attempted assault and battery by discharging a firearm, and unlawful possession of ammunition for firing at a person in a vehicle on Trotter Court in a different encounter earlier this month. more »

BOSTON, Feb. 21, 2018—A second defendant in the homicide of 21-year-old Shaquille Browder was held without bail at his arraignment today, Suffolk County District Attorney Daniel F. Conley said.

RALPH BROWN (D.O.B. 3/10/74) was apprehended by the Boston Police Fugitive Apprehension Unit in Holbrook this morning on warrants approved by Suffolk prosecutors on Feb. 13. He was transported to Dorchester Municipal Court, where he was formally charged with murder and unlawful possession of a firearm.

Assistant District Attorney Catherine Ham of the DA’s Homicide Unit told the court that Brown participated jointly with KYLE WILLIAMS (D.O.B. 4/14/86) to commit the homicide in broad daylight at a parking lot near Columbia Road and Washington Street – one of the city’s busiest intersections. more »

BOSTON, Feb. 16, 2018—The man who allegedly shot and killed 37-year-old Tarek Mroue on Winthrop Street this week was held without bail at his arraignment in Roxbury Municipal Court today, Suffolk County District Attorney Daniel F. Conley said.

TYRONE WORRELL (D.O.B. 7/5/78) of Dorchester is accused of shooting Mroue, killing him, on the evening of Feb. 14. Boston Police arrested Worrell shortly after the homicide. Early the next morning, he represented that he had swallowed a quantity of heroin. Though his belongings had previously been secured, he was hospitalized for observation in an abundance of caution and then released for arraignment. more »

BOSTON, Feb. 16, 2018—The parents of 17-year-old Ryan Morrissey spoke at a sentencing hearing today for the man convicted of his 2014 murder, mourning the loss of “a giant piece of our lives that can never be replaced.”

JULIO BAEZ (D.O.B. 2/28/91) was sentenced to the mandatory term of life in prison without the possibility of parole following his conviction yesterday for first-degree murder. At the request of Suffolk County District Attorney Daniel F. Conley’s office, Judge Janet Sanders sentenced him to a concurrent term of 18-20 years for the non-fatal shooting of Morrissey’s friend, then 19, during the same incident. more »

BOSTON, Feb. 16, 2018—Chelsea and State police and fire investigators combing the scene of an apparent brush fire found some signs of accidental ignition last night but have not made any final determinations, officials said today.

At about 6:40 pm, the Chelsea Fire Department and State Police assigned to the Revere barracks responded to the area of Route 16 near Webster Avenue for a fire at an unpaved area abutting the roadway. On extinguishing the blaze, firefighters observed what appeared to be a dead body and made the standard notifications for a death investigation. more »

BOSTON, Feb. 14, 2018—A man was sentenced to prison yesterday after admitting that he coerced three Boston-area girls he met online into sending him sexual photographs – the first conviction in Suffolk County for using threats through social media to coerce explicit imagery from a victim, District Attorney Daniel F. HECTOR ACEVEDO (D.O.B. 5/11/90) of Roxbury pleaded guilty yesterday to posing or exhibiting a child in a state of nudity or sexual conduct; possession of child pornography; distributing child pornography; and distributing obscene matter to a minor. Acevedo also pleaded guilty to attempted extortion and human trafficking of a minor, reflecting the use of threats to coerce the underage victims into providing him with nude photos. more »

More Than 77lbs of Fentanyl, Heroin, Cocaine Seized in “Operation High Hopes”

BOSTON, Feb. 8, 2018—Suffolk County District Attorney Daniel F. Conley, Boston Police Superintendent in Chief William Gross, Special Agent in Charge Michael J. Ferguson of the Drug Enforcement Administration’s New England Division, Braintree Police Chief Paul Shastany, and Randolph Police Chief William Pace today announced the results of Operation High Hopes, one of the longest, most far-reaching, and most successful state wiretap investigations in Massachusetts history.

The investigation dismantled two Boston-area drug trafficking organizations and led to the seizure of some 77 pounds of various narcotics – including more than 30 pounds of fentanyl, an opiate so powerful that mere milligrams can be lethal – and some $300,000 in alleged drug money. The fentanyl, heroin, cocaine, and opiate tablets are believed to have come from the Sinaloa Cartel in Mexico. more »

Victim’s Kin “Remember Him Vividly, Miss Him Deeply, and Keep His Spirit Alive”

 

BOSTON,—The Brighton man responsible for the drunk driving crash that killed 24-year-old Dillon Carter and seriously injured a second man was sentenced to a state prison term today, Suffolk County District Attorney Daniel F. Conley said.

CRAIG LAWLOR (D.O.B. 6/4/92) faced sentencing today before Suffolk Superior Court Judge Linda Giles, who during a jury-waived trial last month found Lawlor guilty of manslaughter by motor vehicle, motor vehicle homicide by operating under the influence of alcohol, and operating under the influence of alcohol causing serious bodily injury in connection with the fatal 2016 crash inside the Sumner Tunnel. 

Assistant District Attorney Caitlin Grasso had recommended a sentence of six to eight years in state prison, followed by 2 ½ years in the house of correction with six months to serve and the remainder suspended for two years.  Giles imposed a term of five to six years in state prison followed by 2 ½ years in the house of correction with six months to serve and the remainder suspended for a probationary period of two years.  During that time, Lawlor must remain drug- and alcohol-free, complete a substance abuse program, and perform 100 hours of community service.  more »

BOSTON, Feb. 2, 2018—The threat of gang violence and witness intimidation at a 2006 murder trial represented “exceptional circumstances” warranting the judge’s partial closure of the courtroom, the Supreme Judicial Court ruled today as it affirmed the defendant’s convictions for killing one man and leaving another paralyzed until his death years later, Suffolk County District Attorney Daniel F. Conley said.

The Supreme Judicial Court today upheld ODAIR FERNANDES’ convictions for first-degree murder, armed assault with intent to murder, and multiple firearms charges. Fernandes (D.O.B. 8/16/83) was convicted for his role in the April 28, 2003, shootings that claimed the life of Jose Daveiga, 22, in Boston’s South End and left Christopher Carvalho, then 24, paralyzed until his 2007 death at Lemuel Shattuck Hospital, where he was reliant upon machinery to provide oxygen. more »

BOSTON, Jan. 31, 2018—A year after a divided Supreme Judicial Court reversed his conviction for shooting 28-year-old Senai Williams to death during a fight, a Roxbury man pleaded guilty to the 2010 homicide rather than face a second trial, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury in 2012 convicted JAMES ALLEN (D.O.B. 8/30/88) of second-degree murder, but the state’s highest court reversed that decision last year after a majority of the court found the trial judge’s instruction on defense of another to be flawed. Today, over seven years after Williams’ shooting death on Homestead Street, Allen pleaded guilty to voluntary manslaughter and accepted a sentence of 13 to 17 years in state prison. more »

The Suffolk County Grand Jury on Dec. 20 returned indictments charging GREGG FARMER (D.O.B. 2/25/62) of Wakefield, former president of the Boston Harbor Pilots Association, with larceny over $250 and larceny over $250 by continuing scheme. The Grand Jury also indicted ANDREW HAMMOND (D.O.B. 3/21/64) of Hanover, whom Farmer hired as BHPA executive director, for larceny over $250 by scheme, making false entries in corporate books, forgery, and uttering.  Clerk Lisa Medeiros did not impose monetary bail and released both on their own recognizance after they walked into court today. more »

BOSTON, January 31, 2018— A Dorchester man was arraigned earlier this week on charges of trafficking fentanyl after he made a series of sales to a plan clothes Boston Police officer, Suffolk County District Attorney Daniel F. Conley said.

ZACHARY GODWIN (D.O.B. 1/12/91) was arraigned Monday in Dorchester Municipal Court on single counts of trafficking in fentanyl, trafficking in cocaine, possession with intent to distribute a Class B substance, possession of a firearm in the commission of a felony, unlawful possession of ammunition, two counts of unlawful possession of a firearm, and three counts of distribution of a Class B substance.  Judge James Coffey ordered that Godwin be sent for evaluation at Bridgewater State Hospital. more »

BOSTON, January 30, 2018— A man with a prior firearm conviction was arraigned today for allegedly pointing a loaded handgun at a Boston Police officer during a foot chase in Charlestown, Suffolk County District Attorney Daniel F. Conley said.

CELESTINO VICENTE (D.O.B. 10/22/80) of Dorchester was arraigned today in Charlestown Municipal Court on charges of two counts each of assault and battery on a police officer and assault and battery with a firearm, and single counts of assault with a dangerous weapon, resisting arrest, unlawful possession of a firearm as a subsequent offense, unlawful possession of ammunition as a subsequent offense, carrying a loaded firearm, improper storage of a firearm.  He was also issued citations for an inspection sticker violation and failure to wear a seatbelt.  According to prosecutors, Vicente was previously convicted of firearm and ammunition charges in Suffolk Superior Court in 1999. 

At the request of Assistant District Attorney Paul Lewis, Judge Michael Coyne ordered Vicente held without bail pending a dangerousness hearing under Chapter 276, Section 58A, of the Massachusetts General Laws. The statute allows a judge to hold a defendant accused of certain offenses without bail for up to 120 days pending trial upon “clear and convincing evidence that no conditions of release will reasonably assure the safety of any other person or the community.”  That hearing will be held Friday. more »

BOSTON, Jan. 17, 2018—A Texas man was held on high bail today after his arraignment on a raft of charges stemming from three motor vehicle thefts and six commercial burglaries last year at sites as far north as Woburn and as far south as Brockton, Suffolk County District Attorney Daniel F. FREDRICK D. WILLIAMS (D.O.B. 1/7/89) of Dallas, Texas, was indicted Dec. 20 on six counts each of breaking and entering at night with intent to commit a felony, breaking into a depository, and malicious destruction of property; four counts of larceny over $250; two counts of attempted larceny over $250; three counts of larceny of a motor vehicle; and one count of possession of burglarious instruments.

After being arrested on a fugitive warrant by Texas authorities, Williams was extradited to Massachusetts, where he was arraigned today in Suffolk Superior Court. Clerk Magistrate Lisa Medeiros set bail at $500,000 cash. A second Texan, MATTHEW GALLAGHER (D.O.B. 1/9/86), was identically charged and is expected to face arraignment tomorrow. more »

The Suffolk County Grand Jury on Dec. 20 returned indictments charging MICHAEL BRUZZESE (D.O.B. 5/26/65) with manslaughter and unarmed robbery of a person over 60 in the May 29, 2016, assault that caused Pepe’s death three days later.  The State Police Violent Fugitive Apprehension Section apprehended Bruzzese this morning in Cambridge and he is expected to be arraigned later today in Suffolk Superior Court. more »

SJC Finds Conflict of Interest Claim “Unsupported By the Record”

BOSTON, Jan. 11, 2018—The state’s highest court today vacated a judge’s 2016 order granting a new trial to the man who murdered 10-year-old Trina Persad with a shotgun blast to the face, Suffolk County District Attorney Daniel F. Conley said.

In a 38-page decision, the Supreme Judicial Court vacated Superior Court Judge Janet Sanders’ finding that an attorney for JOSEPH COUSIN (D.O.B. 8/9/84) had performed prior legal work for other clients that presented an actual conflict of interest at the time Cousin, a member of the notorious Magnolia-Intervale-Columbia gang, was convicted of killing Persad during a June 29, 2002, mission to retaliate against rivals at Jermaine Goffigan Park. more »

BOSTON, January 11, 2018—As a Westwood man was sentenced to prison for stalking a woman to her Fenway home and raping her two years ago, the survivor recounted her ordeal and a message of support to others who live through sexual assault.

A Suffolk Superior Court jury on Dec. 20 convicted MICHAEL PURPURA (D.O.B. 6/22/79) of aggravated rape, indecent assault and battery, strangulation or suffocation, unarmed burglary, and larceny over $250.  At his sentencing yesterday afternoon, Suffolk County District Attorney Daniel F. Conley’s office recommended a term of 20 to 25 years in prison to be followed by five years of probation. Judge Peter Muse imposed a term of 15 to 18 years in state prison.  more »

BOSTON, January 10, 2018— Three men were held without bail today for their roles in the murder of Joshua Briggs inside a Boston hotel room, Suffolk County District Attorney Daniel F. Conley said.

JOHN “SPICE” COLLINS (D.O.B. 10/16/93), ERRIN “DUBDUB” CRAWFORD, Jr., (D.O.B. 09/05/88), and MICHAEL “BATS” REYNOLDS (D.O.B. 10/10/93) were arraigned today in Suffolk Superior Court on indictments charging first-degree murder and three counts each of home invasion and armed robbery.   Collins and Reynolds are additionally charged with unlawful possession of a firearm.  At the request of Assistant District Attorney Thomas Flanagan of the DA’s Homicide Unit, Clerk Magistrate Lisa Medeiros ordered all three men held without bail. more »

BOSTON, January 10, 2018— A juvenile who led police on a foot chase was charged as a repeat gun offender after officers found a loaded firearm along his path of flight – and technology developed for firefighters suggested it had recently been tossed, Suffolk County District Attorney Daniel F. Conley said.

A 17-year-old male from Dorchester was arraigned yesterday in the Juvenile Session of Dorchester Municipal Court on charges of delinquency, to wit: unlawful possession of a firearm, unlawful possession of a firearm as a second offense, unlawful possession of ammunition, carrying a loaded firearm, possession of a large capacity firearm, and trespass.  According to prosecutors, the defendant was previously adjudicated delinquent – the equivalent of a guilty finding in the juvenile court – in 2016 and committed to the Department of Youth Services until the age of 18.

Judge Michael Coyne set bail at $25,000 and ordered the juvenile held without bail on a DYS detainer. more »

BOSTON, Jan. 8, 2018—A Roxbury man was held without bail at his arraignment today as the second person charged with murder in the shooting death last month of 17-year-old Philip Demings, Suffolk County District Attorney Daniel F. Conley said.

JAWONE SHEPARD (D.O.B. 4/14/99) was arraigned today in Dorchester Municipal Court today on a charge of murder in connection with Demings’ Dec. 19 homicide.  At the request of Assistant District Attorney Thomas Flanagan of the DA’s Homicide Unit, Judge Thomas Kaplanes ordered Shepard held without bail. more »

Ian Jaffier’s remarks came at a sentencing hearing for WESSON COLAS (D.O.B. 5/25/92) and KEITH WILLIAMS (D.O.B. 7/13/96), both convicted of first-degree murder, armed assault with intent to murder, and assault and battery with a dangerous weapon. Grand Jury Investigation Also Yields Charges in Earlier Shooting

BOSTON, Jan. 8, 2018—The man indicted for allegedly shooting 30-year-old David Cole to death last fall has been apprehended in Rhode Island and likely faces arraignment in Suffolk Superior Court later this week, Suffolk County District Attorney Daniel F. Conley said.

MARQUIS R. MARTIN (D.O.B. 8/1/89) of Roxbury was indicted Dec. 21 for first-degree murder for the Oct. 29 shooting that claimed Cole’s life on Peninsula Place in Dorchester. He was additionally inducted for three counts of armed assault with intent to murder and one count of assault and battery with a dangerous weapon for a non-fatal shooting he allegedly committed earlier that evening. Based on evidence developed in the course of the grand jury investigation, Suffolk prosecutors approved a warrant for Martin’s arrest on Nov. 16. more »

BOSTON, Jan. 3, 2018—The Massachusetts Appeals Court today reversed a lower court’s ruling that would have prevented jurors from hearing certain evidence about a hotel room key found on a human trafficking defendant at a downtown hotel where a suspected victim was found shaking, crying, and visibly afraid, Suffolk County District Attorney Daniel F. Conley said.

In a 12-page decision by Justices Vickie Henry, Eric Neyman, and Peter Rubin, the Appeals Court found that Suffolk Superior Court Judge Kenneth Salinger erred by suppressing a statement by ADERITO BARBOSA (D.O.B. 3/28/84) in which he allegedly admitted that a room key found during his 2015 arrest at the Park Plaza Hotel fit the room to which police had been invited after responding to an advertisement on Backpage.com. more »

BOSTON, Jan. 2, 2018— A Berkeley man faces arraignment tomorrow after he seriously injured a co-worker at a Boston construction site and enlisted a colleague to cover up the assault, Suffolk County District Attorney Daniel F. Conley said.

KEVIN MEDEIROS (D.O.B. 8/19/61) of Berkeley will be arraigned tomorrow in Suffolk Superior Court on charges of aggravated assault and battery, witness intimidation, and tampering with evidence.  His co-defendant, JEAN ROCK BEAULIEU (D.O.B. 6/19/89) of Salem, N.H., will be arraigned in the same court tomorrow on charges of accessory after the fact to aggravated assault and battery and witness intimidation. more »
