BOSTON, Dec. 29, 2016—The death of an East Boston teen whose body was found at the Belle Isle Marsh Reservation earlier this month is being investigated as a homicide, Suffolk County District Attorney Daniel F. Conley said today.

The body of Carlos Villatoro-Nunez, 16, was found in the area of the Bennington Street entrance on Dec. 9, almost a month after his family reported him missing. Though decomposition and other factors initially complicated the death investigation, authorities believe he sustained fatal stab wounds. more »

BOSTON, Dec. 27, 2016—A Roslindale rideshare driver accused of stabbing another woman during a Christmas Day fight over a requested trip was arraigned for attempted murder this morning, Suffolk County District Attorney Daniel F. Conley said.

KIONA THOMAS (D.O.B. 11/17/91) was arraigned in Dorchester Municipal Court this morning on a charge of assault with intent to murder.  Assistant District Attorney Lauren Hatch requested bail of $75,000 with orders that Thomas submit to GPS monitoring, abide by a curfew, not drive for any rideshare service or for profit, and to stay away from the victim, witnesses, and the location of the offense in the event she is to be released on bail.  Judge Thomas Kaplanes imposed $15,000 bail, GPS monitoring, and ordered Thomas to stay away from the victim, witnesses, and location. more »

BOSTON, Dec. 23, 2016—The man who allegedly shot and killed 28-year-old Jeffrey Kelly in Jamaica Plain this summer was held without bail at his arraignment today, Suffolk County District Attorney Daniel F. Conley said.

The Suffolk County Grand Jury on Wednesday returned indictments charging AMOS CARRASQUILLO (D.O.B. 7/5/88) of Dorchester with first-degree murder and unlawful possession of a firearm. Carrasquillo was apprehended that night on an unrelated federal probation warrant and taken into custody on the murder charge yesterday by Boston Police at the John Joseph Moakley Federal Courthouse. more »

BOSTON, Dec. 22, 2016—A Leominster man was held on $1 million cash bail today following his arraignment for allegedly stabbing and nearly killing a 50-year-old man in the victim’s North End apartment, Suffolk County District Attorney Daniel F. Conley said.

ANTHONY SPINELLI (D.O.B. 12/26/71) was arraigned in the Boston Municipal Court on charges of armed assault with intent to murder, assault and battery with a dangerous weapon, and assault and battery for the Tuesday afternoon incident on Fulton Street. more »

BOSTON, Dec. 20, 2016—An argument in a Fayston street apartment escalated to homicide overnight when a Dorchester woman grabbed a kitchen knife and stabbed 34-year-old Sasha Morris to death, Suffolk County District Attorney Daniel F. Conley said.

ELBA MORALES (D.O.B. 8/25/69) was arraigned on one count of murder for the incident on Fayston Street, which claimed Morris’ death at Boston Medical Center. At prosecutors’ request, Judge Lisa Ann Grant held Morales without bail. more »

BOSTON, Dec. 19, 2016—Two men were arraigned today following their arrests Friday for the shooting death of Shawn Borden earlier this year, Suffolk County District Attorney Daniel F. Conley said.

TYSHAWN CUMMINGS (D.O.B. 2/21/95) and JAMARI MANNING (D.O.B. 4/15/95), both of Dorchester, were charged with murder for their roles in the Oct. 18 shooting that claimed the 41-year-old Borden’s life seven days later. At prosecutors’ request, Dorchester Municipal Court Judge James Coffey held both men held without bail. A third defendant, TYSHAWN SANDERS (D.O.B. 1/31/98) of Dorchester, is in custody on unrelated charges and will likely be arraigned tomorrow. more »

BOSTON, Dec. 16, 2016—A Malden man remains held on bail following his indictment on hate crime charges for allegedly beating a man with a brick in a bias-motivated assault, Suffolk County District Attorney Daniel F. Conley said.

STEPHEN FUSCO (D.O.B. 8/28/67) of Malden was arraigned today in Suffolk Superior Court on charges of violating a person’s civil rights, assault and battery with a dangerous weapon, and assault and battery with the intent to intimidate based on nation of origin.  At the request of Assistant District Attorney Christina Miller, Conley’s point prosecutor for civil rights violations, Clerk Magistrate Edward Curley set bail in the amount of $20,000.  more »

BOSTON, Dec. 15, 2016–Suffolk County District Attorney Daniel F. Conley delivered the following remarks this afternoon on a series of arrests based on a long-term wiretap investigation targeting a violent drug ring operating across greater Boston:

“Good afternoon. As you know by now, local, state, and federal law enforcement agencies executed about two dozen search warrants across the greater Boston area this morning, dismantling a major drug trafficking organization.  With me today are Boston Police Commissioner William Evans, Special Agent in Charge Harold Shaw of the FBI’s Boston Division, Watertown Police Chief Michael Lawn, and members of the multiagency South Shore Drug Task Force.

“Together we are announcing Operation Wolfgang, one of the longest and most successful wiretap investigations in modern Suffolk County history. One would have to go back to the days of the Mafia, when the wiretap statute was last updated, to find a more effective use of telephone intercepts to climb the rungs of a criminal ladder. more »

BOSTON, Dec. 14, 2016—The youth whose body was discovered Friday in the Belle Isle Marsh has been positively identified as a 16-year-old East Boston boy, Suffolk County District Attorney Daniel F. Conley said.

Family members late Monday identified the youth, whom relatives reported missing on Nov. 13. Because the Office of the Chief Medical Examiner has not yet ruled on the cause or manner of his death, however, authorities are not releasing his name.  more »

BOSTON, December 14, 2016—The Brighton man accused of speeding drunkenly through the Summer Tunnel, causing a single-vehicle crash that killed 24-year-old Dillon Cohen and severely injured another man, was taken into custody on high bail today, Suffolk County District Attorney Daniel F. Conley said.

CRAIG LAWLOR (D.O.B. 6/4/92) of Brighton was arraigned in Suffolk Superior Court today on charges of manslaughter by motor vehicle, motor vehicle homicide by operating under the influence of alcohol, and operating under the influence of alcohol causing serious bodily injury.  Clerk Magistrate Edward Curley set bail in the amount of $25,000 and ordered Lawlor to remain drug- and alcohol-free while his case is pending, wear a GPS monitor, surrender his passport, and stay away from the family of the deceased victim in the event he is released on bail.  Assistant District Attorney Caitlin Grasso of the DA’s Major Felony Bureau had requested bail of $50,000. more »

BOSTON, December 13, 2016—A Revere man has been convicted of fatally stabbing 50-year-old John Barrientos in his East Boston building and dragging his body into a nearby alley, Suffolk County District Attorney Daniel F. Conley said.

A jury this afternoon found CRISTIAN SANTA (D.O.B. 10/10/91) of Revere guilty of voluntary manslaughter in Barrientos’ 2012 stabbing death.  He had initially been charged with first-degree murder.

Santa faces up to 20 years in state prison at a sentencing hearing Friday morning. more »

BOSTON, Dec. 13, 2016—A former associate chaplain at a Rhode Island school was arraigned today for allegedly assaulting a student in his care during two trips to Boston more than 40 years ago, Suffolk County District Attorney Daniel F. Conley said.

HOWARD “HOWDY” WHITE, Jr. (D.O.B. 6/8/41), of Bedford, Pennsylvania, was arraigned in Suffolk Superior Court this morning on five counts of assault and battery. The indictments, returned Nov. 21, charge White with sexually assaulting the boy during two trips to Boston in 1973, when the victim was between 15 and 16 years old. more »

BOSTON, December 12, 2016— More than six months after the hit-and-run death of Marco Salguero-Cruz in Chelsea, the driver who allegedly struck and killed the 25-year-old victim and then fled the country was ordered held on high bail, Suffolk County District Attorney Daniel F. Conley said.

JOSE DANIEL AREVALO (D.O.B. 8/20/82) of Everett was arraigned in Chelsea District Court today on charges of motor vehicle homicide and leaving the scene of a collision causing death. Judge Ina Howard-Hogan ordered Arevalo held on $150,000 bail and ordered that he wear a GPS monitor, submit to home confinement, and surrender his passport in the event he is released on bail.  Assistant District Attorney Michael V. Glennon had requested bail of $250,000. more »

BOSTON, December 5, 2016—A suspended attorney is expected to be in court today to face charges that he stole funds from clients and opened credit cards in the names of colleagues in order to fund an extravagant lifestyle, including gambling and luxury apartments and vehicles, Suffolk County District Attorney Daniel F. Conley said.

WASSEM AMIN (D.O.B. 2/27/85) is expected to be arraigned in Suffolk Superior Court tomorrow after a grand jury indicted him last month on 26 charges.  Amin is charged with:

  • Six counts of credit card application fraud,
  • Five counts of committing consumer credit violations,
  • Four counts of larceny over $250,
  • Three counts of witness intimidation,
  • Larceny over $250 by scheme,
  • Money laundering,
  • Attempted larceny,
  • Forgery by check,
  • Uttering by check,
  • Common law forgery
  • Common law uttering,
  • And publishing a false statement of financial condition.

BOSTON, December 2, 2016— Chelsea Police Chief Brian Kyes and Suffolk County District Attorney Daniel F. Conley today announced that the man wanted in connection with the June 4 hit-and-run death of 25-year-old Marco Salguero-Cruz has been apprehended as a result of an exhaustive investigation and the public’s help.

JOSE DANIEL AREVALO (D.O.B. 8/20/82) of Everett was taken into custody outside Houston, Texas, by Texas Rangers late yesterday in connection with Salguero-Cruz’s death.  He is expected to be returned to Massachusetts at a later date. more »

BOSTON, November 28, 2016— A Bedford man was arraigned today on charges of breaking into and vandalizing a Downtown church, Suffolk County District Attorney Daniel F. Conley said.

ERIK SWANSON (D.O.B. 1/9/83) of Bedford was arraigned today in Boston Municipal Court on charges of breaking and entering a building in the nighttime with intent to commit a felony, larceny over $250, and malicious destruction of property over $250 in connection with a break-in on Friday morning, as well as charges of trespassing and receiving stolen property stemming from his arrest yesterday. He was additionally arraigned on charges of possession of a Class A substance, possession of a Class A substance as a subsequent offense, and a municipal by-law violation alleging possession of a crack pipe.

Judge Michael Coyne set bail on the cases totaling $3,500 and granted a request by Assistant District Attorney Alyssa Tochka that Swanson’s bail be revoked on two cases out of the same court: one charging breaking and entering a motor vehicle and interfering with a police officer and the other charging attempted breaking and entering of a motor vehicle, trespassing, and receiving stolen property over $250. more »

BOSTON, Nov. 28, 2016—The driver of a sedan that collided with an airport shuttle van, killing two people, had the psychoactive chemical in marijuana in his blood and urine in addition to a blood-alcohol content almost twice the legal limit for driving, Suffolk County District Attorney Daniel F. Conley said.

STEVEN BIRENBAUM (D.O.B. 7/6/89) of Swampscott was arraigned today on indictments charging him with two counts each of manslaughter and motor vehicle homicide while operating under the influence. The indictments stem from the Aug. 31 deaths of Joseph A. Rodriguez, 59, and Sandra L. Arreola, 56, both of El Paso, Texas, on Route 90 in East Boston. more »

Another Driver Charged with OUI in Thanksgiving Collision with State Police Cruiser

BOSTON, Nov. 25, 2016—A man with a revoked driver’s license was arraigned today for allegedly driving into four uniformed Boston Police officers earlier this week as they investigated a call for a person with a gun, Suffolk County District Attorney Daniel F. Conley said.

VINCENT WEAKS (D.O.B. 6/5/82) of Dorchester was arraigned in Dorchester Municipal Court on four counts each of assault and battery with a dangerous weapon and leaving the scene of a collision causing personal injury. Judge Jonathan Tynes set bail at $75,000 and ordered that Weaks wear a GPS monitor and abide by a curfew should he post that amount.

In addition to setting the high bail for the Nov. 23 incident, Tynes ordered Weaks held without bail pending a hearing to determine whether he had violated the terms of his probation on convictions last year for drug and assault charges. more »

BOSTON, November 23, 2016—The family of Karima El-Hakim  said their holidays were “hollow” after her 2013 homicide and acknowledged their grief for the family of Zouaoui Dani-Elkebir, also slain by a gunman who was sentenced to life in prison today for their murders, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury earlier last week found MAURICE MORRISON (D.O.B. 2/19/85) guilty of two counts of second-degree murder and one count of unlawful possession of a firearm for killing El-Hakim, 38, and Dani-Elkebir, 52, in Chelsea.  At his sentencing today, Assistant District Attorney Mark Lee recommended that Morrison serve his two mandatory life terms back to back; Judge Kenneth Salinger ordered that they run concurrent with one another. more »

BOSTON, Nov. 22, 2016— The man who shot and killed 29-year-old Shawn Flores during a 2011 argument will not receive a new trial, Suffolk County District Attorney Daniel F. Conley said.

In a decision released today, the Massachusetts Appeals Court affirmed the second-degree murder conviction of KENDRICK CLARK (D.O.B. 3/19/74) of Mattapan.  A Suffolk Superior Court jury in 2014 found Clark guilty of killing Flores during an altercation inside the Abbott Street rooming house where both men lived. more »

BOSTON, Nov. 14, 2016—The day a driver was arraigned for leaving the scene of a non-fatal hit-and-run in Chelsea, Police Chief Brian Kyes and Suffolk County District Attorney Daniel F. Conley released new images they hope will help detectives investigating a fatal collision earlier this year.

Chelsea Police and the Suffolk County State Police Detective Unit are asking for the public’s help in identifying the operator of a 2007-2009 Toyota Camry SE, silver in color, with a sunroof and fog lights, that struck a pedestrian on the night of June 4 and left the scene. The vehicle is believed to have sustained damage to the front driver’s side during the collision, which took place in the area of 284 Washington St. just after 10:00 pm. The victim, 25-year-old Marco Salguero-Cruz of Chelsea, died of his injuries. more »

BOSTON, Nov. 21, 2016—After Suffolk prosecutors were allowed to use witness’ grand jury testimony at a trial scheduled to start last week, the defendant in a 2014 armed home invasion pleaded guilty and was sentenced to prison time, Suffolk County District Attorney Daniel F. Conley said.

ROBERT HECKSTALL (D.O.B. 3/18/83) was set to face trial in Suffolk Superior Court on Nov. 14, but certain prosecution witnesses were unwilling to testify in light of intimidating text messages they had received from an unknown party. Under a 2005 Supreme Judicial Court’s decision, Assistant District Attorney Stacey Pichardo of the DA’s Gang Unit cited those messages, the defendant’s statements that he would not even contemplate a plea until he saw the witnesses in the courtroom, and a prior conviction for witness intimidation, and moved to introduce those witness’ grand jury testimony even without their physical presence. more »

ANTOIWANE DAVIS (D.O.B. 8/30/93) was arrested by Boston Police this morning and arraigned in Roxbury Municipal Court this afternoon on charges of murder, unlawful possession of a firearm, unlawful possession of ammunition, and unlawfully discharging a firearm within 500 feet of a dwelling. At the request of Assistant District Attorney Amy Galatis of the DA’s Homicide Unit, Judge David Weingarten ordered him held without bail. more »

BOSTON, Nov. 17, 2016—Three juveniles have been arraigned on hate crime charges after they allegedly harassed and assaulted a woman they believed to be an immigrant on an MBTA train last week, Suffolk County District Attorney Daniel F. Conley said.

A 15-year-old female from Mattapan and 15-year-old female from Dorchester were arraigned in the juvenile division of Dorchester Municipal Court on Nov. 9 in connection with the assault two days earlier, while a 15-year-old female from Dorchester was arraigned Monday.  All three are charged with assault and battery with a dangerous weapon and civil rights violation causing injury.  All three juveniles were released to their parents’ custody with orders to stay away from one another, the victim, and witnesses in the case. more »

BOSTON, Nov. 14, 2016—A Chelsea man was convicted of two counts of murder today for shooting Zouaoui Dani-Elkebir, 52, and Karima El-Hakim, 38, to death three years ago, Suffolk County District Attorney Daniel F. Conley said.

Jurors found MAURICE MORRISON (D.O.B. 2/19/85) guilty of two counts of second-degree murder and one count of unlawful possession of a firearm in the May 13, 2013, homicides. Their verdict today followed about six days of deliberations. more »

BOSTON, November 14, 2016— As the deadline for his grant program nears, Suffolk County District Attorney Daniel F. Conley today encouraged non-profits serving Boston, Chelsea, Revere, and Winthrop youth to apply for funding through his Asset Forfeiture Community Reinvestment Grant program.

The deadline for AFCRG applications is 4:00 p.m. on Friday.  The program uses funds and assets seized from drug traffickers in order to provide cash awards to non-profits that keep Suffolk County kids away from drugs, gangs, and dangerous behavior.  Under Conley’s leadership, it has provided funding to dozens of youth groups, community centers, and social service agencies at no cost to taxpayers. more »

BOSTON, Oct. 9, 2016—Nine people have been indicted by the Suffolk County Grand Jury in connection with the March murder of 26-year-old Chaz Burton, four of whom appeared in court today following their arrests by Boston Police, District Attorney Daniel F. Conley Police Commissioner William B. Evans said.

The grand jury yesterday returned indictments charging three people with Burton’s murder and six others with offenses in connection with the fatal attack and attempts to mislead police investigating the homicide. more »

BOSTON, November 4, 2016—The former head of a Boston elder services program this week pleaded guilty to stealing thousands of dollars in grant money that was intended to help Boston seniors and returned a large portion of those funds, Suffolk County District Attorney Daniel F. Conley said.

ALFRED G. DAVIS (D.O.B. 5/20/45) of Lynn on Wednesday pleaded guilty to two counts of larceny over $250 and single counts of forgery and uttering.  At the recommendation of prosecutors and Davis’ attorney, Suffolk Superior Court Judge Rosalind Miller sentenced Davis to one year of probation, during which he must repay $12,500 in restitution.  Davis paid half of that amount at the time of his sentencing, prosecutors said. more »

BOSTON, November 3, 2016—A Boston man pleaded guilty yesterday to posing as a lawyer in order to steal more than $30,000 from his victims, Suffolk County District Attorney Daniel F. Conley said.

DAVID KORACA (D.O.B. 12/1/67) AKA DAVID CORAZZA yesterday pleaded guilty to six counts of unauthorized practice of law, four counts of attempting to commit a crime, three counts of larceny over $250 by scheme, and single counts of larceny over $250, common law forgery, and common law uttering. At prosecutors’ request, Suffolk Superior Court Judge Mary Ames sentenced Koraca to a term of two to three years in state prison followed by three years of probation. more »

BOSTON, Nov. 1, 2016—Nearly two decades after he fled prosecution, a Chelsea man has been found guilty of sexually assaulting a child, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury yesterday convicted MIGUEL RODRIGUEZ (D.O.B. 9/19/62) a.k.a. MIGUEL ANTONIO RODRIGUEZ MONTECINOS of one count of rape of a child and two counts of indecent assault and battery of a child under 14 for assaults that occurred in 1997.  He faces sentencing Tuesday. more »

Conley said today that his office would conduct a “thorough, impartial, independent investigation” into the police-involved shooting death of a man during an early-morning confrontation with emergency medical personnel and police officers.

 

“Senior Suffolk prosecutors were at the scene through the early morning hours and will lead a thorough, impartial, independent investigation into the events that transpired on Shawmut Avenue,” Conley said. “As we have in every such case for more than a decade, we will release our entire investigative file to the family of the deceased and the media upon its conclusion. To my knowledge, this level of transparency in fatal police shootings is unparalleled, and no other district attorney’s office in the country affirmatively releases every report, every interview, every dispatch transmission, and every map and diagram in every case as we do.”

A Suffolk County grand jury today returned the indictment charging LENNY QUINTERO-FLORES (D.O.B. 2/17/89) with manslaughter.  He is expected to face arraignment in Suffolk Superior Court on Nov. 9. more »

BOSTON, Oct. 28, 2016—The Massachusetts Appeals Court yesterday reversed a lower court’s order allowing a man to withdraw his guilty plea for stashing more than a dozen bags of crack cocaine in the shoes of a child who then wore them to school, Suffolk County District Attorney Daniel F. Conley said.

DEMARE GARY (D.O.B. 12/10/90) pleaded guilty in December 2010 to possession of a Class B substance with intent to distribute, possession of a Class B substance with intent to distribute in a school zone, and reckless endangerment of a child for the incident, admitting that he placed 17 individually-packaged rocks of what he knew to be crack cocaine in the 3-year-old girl’s shoes. When the girl complained at her early education program that her foot hurt, a teacher checked her shoes and found the drugs. A supervisor notified the Department of Children and Families, which in turn notified police. more »

BOSTON, Oct. 27, 2016—The South Boston man convicted today in the murder of 29-year-old Edwin Santos faces life in prison during his sentencing tomorrow morning, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury today found ELIAS SANCHEZ (D.O.B. 1/12/70) guilty of second-degree murder in Santos’ 2013 stabbing and beating death.  At his sentencing tomorrow, Judge Jeffrey Locke is expected to impose the mandatory term for second-degree murder of life in prison with the possibility of parole.

BOSTON, Oct. 26, 2016— The second of two men convicted in the drive-by shooting that killed 21-year-old Fausto Sanchez almost a decade ago will remain in prison after the state’s highest court today denied his appeal, Suffolk County District Attorney Daniel F. Conley said.

The Massachusetts Supreme Judicial Court today affirmed the conviction of JOSEPH GOMES (D.O.B. 4/20/67) in the 2007 Roslindale shooting that killed Sanchez.  A jury in 2010 convicted Gomes of first-degree murder, four counts of armed assault with intent to murder, two counts of assault with a dangerous weapon, and single counts of assault and battery with a dangerous weapon and aggravated assault and battery with a dangerous weapon.  He was sentenced to life in prison followed by an additional term of 17 to 18 years. more »

BOSTON, Oct. 24, 2016—A South End man was ordered held without bail following his arrest and arraignment for allegedly beating 50-year-old Stephen Cherup so badly during a street fight that the victim later died, Suffolk County District Attorney Daniel F. Conley said.

PETER McGOWAN, 53, was arraigned in Roxbury Municipal Court on a murder charge stemming from injuries he allegedly inflicted on Cherup Saturday evening. Cherup died the next day.

Assistant District Attorney David Bradley told the court that the two men became involved in a physical confrontation on Massachusetts Avenue at about 5:00 pm on Oct. 22. A witness separated them, but McGowan allegedly re-engaged Cherup and beat him badly. Responding Boston EMS personnel spotted McGowan leaving the scene and, after they rushed Cherup to the Boston Medical Center, recognized him as he sought treatment there and pointed him out to Boston Police. Based on their statements, the statements of other witnesses, and additional physical evidence, Boston Police homicide detectives placed him under arrest. more »

BOSTON, Oct. 24, 2016— Three people charged in connection with the shootout that killed 28-year-old Allex Bryant faced arraignment today, Suffolk County District Attorney Daniel F. Conley said.

NICCOKAWON PLEDGER (D.O.B. 12/20/89) of Quincy was arraigned today in Suffolk Superior Court on charges of first-degree murder, assault with intent to murder, assault and battery with a dangerous weapon, and firearms offenses.  His girlfriend, LISA LEWIS (D.O.B. 10/22/91) of Quincy, was arraigned as an accessory after the fact to the shooting that killed Bryant.  Also arraigned was DAQUON BROWN (D.O.B. 8/29/93), charged with assault with intent to murder, assault and battery with a dangerous weapon, and firearms offenses.

At the request of Assistant District Attorney Craig Iannini of the DA’s Homicide Unit, Clerk Magistrate Lisa Medeiros ordered Pledger held without bail.  Bail for Lewis was set in the amount of $25,000 and $3,000 for Brown – the same amounts that were imposed at their September arraignments in Roxbury Municipal Court. more »

BOSTON, Oct. 21, 2016—The Dorchester man who intentionally drove his car into and killed 20-year-old James A. Taylor will not receive a new trial, Suffolk County District Attorney Daniel F. Conley said.

In an unpublished decision released today, a Massachusetts Appeals Court panel rejected each argument made in an appeal by ANTWAN WATHEY (D.O.B. 9/24/87).  Wathey was convicted of second-degree murder for the Dorchester crash that claimed Taylor’s life; prosecutors had sought a first-degree conviction but the trial judge declined to instruct jurors that they could infer malice – a key element of murder one – from the use of the car as a weapon. more »

BOSTON, October 21, 2016— An East Boston man was sentenced to a lengthy prison term this week after a jury convicted him last month of sexually assaulting children, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury on Sept. 21 convicted OSCAR FLORES (D.O.B. 1/21/59) of three counts of rape of a child and six counts of indecent assault and battery of a child under 14 for assaults against two victims who are now adults; jurors acquitted him of an additional count of indecent assault and battery of a child under 14 and attempt to commit a crime against a third child.  At his sentencing yesterday, Assistant District Attorney Sarah McEvoy of the DA’s Child Protection Unit had recommended a sentence of 20 to 30 years in state prison. Judge Robert Gordon imposed a term of 12 to 16 years in state prison to be followed by five years of probation.  more »

EDGARDO CLARK (D.O.B. 5/25/85) pleaded guilty to voluntary manslaughter during his appearance today in Suffolk Superior Court.  Judge Christine Roach sentenced Clark to 16 to 18 years in state prison. more »

BOSTON, October 19, 2016— A New Hampshire man was arraigned today on charges he endeared himself to women he met online and went on to charge more than $350,000 under their names, Suffolk County District Attorney Daniel F. Conley said.

MICHAEL J. SHIELDS Jr. (D.O.B. 4/20/91) was arraigned today in Suffolk Superior Court on a 45-count indictment charging him with:

  • 21 counts of credit card fraud;
  • 17 counts of use of a stolen or fraudulently obtained credit card;
  • Two counts of larceny over $250 by single scheme;
  • Two counts of attempted larceny over $250;
  • One count of larceny over $250;
  • And two counts of intimidation of a witness.

Assistant District Attorney George Barker of the DA’s Special Prosecutions Unit requested bail of $20,000.  Clerk Magistrate Lisa Medeiros imposed $7,500 bail and ordered Shields to remain within Massachusetts unless he provides proof of his New Hampshire residency. more »

JOSE CEPEDA-IRIZARRY (D.O.B. 11/13/83) was arraigned yesterday in Roxbury Municipal Court on charges of assault with intent to rape and indecent assault and battery. Assistant District Attorney Anna Lusardi recommended that he be held on $50,000 cash bail and that his bail on an open Lynn case charging receiving a stolen motor vehicle be revoked. Judge Pamela Dasheill set bail at $20,000 and revoked his open bail, meaning that he will be held for 60 days. more »

BOSTON, Oct. 13, 2016— The man accused of stabbing 23-year-old Rafael Guzman to death during a fight at a party two years ago will serve almost 20 years in state prison after pleading guilty today, Suffolk County District Attorney Daniel F. Conley said.

AQUILES PEREZ (D.O.B. 9/7/81) of Hyde Park pleaded guilty to voluntary manslaughter, armed assault with intent to murder, and assault and battery with a dangerous weapon for the Dec. 21, 2014, incident that claimed the Guzman’s life and injured two others. At prosecutors’ request, Suffolk Superior Court Judge Christine Roach sentenced him to a term of 14 to 19 years in state prison for Guzman’s homicide and concurrent terms of eight to 12 years and three to five years for less serious injuries to another combatant and a minor injury to a woman who attempted to break up the fight. more »

BOSTON, Oct. 12, 2016— A homeless man has been held pending a dangerousness hearing on charges he sexually assaulted two women in their South End home early yesterday morning, Suffolk County District Attorney Daniel F. Conley said.

RONALD BROWN (D.O.B. 3/20/64), who lists the Pine Street Inn as he primary residence, was arraigned today in Boston Municipal Court on one count each of aggravated rape as a subsequent offender, kidnapping, and burglary. Additional charges are possible as the investigation continues, Conley said.

At the request of Ian Polumbaum, chief of the DA’s Domestic Violence and Sexual Assault Unit, Judge Thomas Horgan ordered Brown held without bail pending the outcome of a dangerousness hearing under Chapter 276, Section 58A, of the Massachusetts General Laws. The statute allows a judge to hold a defendant accused of certain offenses without bail for up to 120 days pending trial upon “clear and convincing evidence that no conditions of release will reasonably assure the safety of any other person or the community.”   That hearing is scheduled to take place Friday. more »

BOSTON, Oct. 11, 2016— A jury this morning convicted a Chelsea man of the 2013 murder of 88-year-old Hilda Devincenzo, Suffolk County District Attorney Daniel F. Conley announced.

A Suffolk Superior Court jury found FELIX MELENDEZ (D.O.B. 2/10/78) guilty of first-degree murder in the killing of his landlady, Devincenzo.  During his sentencing Friday morning, Suffolk Superior Court Judge Kenneth Salinger is expected to impose the mandatory term for first-degree murder of life in prison without the possibility of parole.

A jury at Melendez’s first trial last year convicted him of receiving stolen property over $250 for possessing Devincenzo’s stolen belongings but deadlocked on the charge of murder; a second trial also ended in a mistrial earlier this year after jurors were likewise unable to reach a unanimous verdict. more »

BOSTON, Oct. 7, 2016— A Dorchester man was sentenced to prison today after admitting guilt in the 2015 hit-and-run crash that killed 8-year-old Yadielys DeLeon Camacho and injured a second child, Suffolk County District Attorney Daniel F. Conley said.

JAMES J. HORTON (D.O.B. 4/10/70) today pleaded guilty to charges of manslaughter, leaving the scene of a motor vehicle accident causing death, assault and battery with a dangerous weapon causing serious bodily injury, and operating with a suspended license.  Judge Robert Gordon sentenced Horton to seven to eight years in state prison followed by four years of probation, during which time Horton may not operate a motor vehicle and must pay $10,000 restitution to the victim’s family.  Assistant District Attorney Judith M. Lyons, chief of the DA’s Major Felony Bureau, had recommended that Horton serve a term of eight to 10 years in state prison followed by four years of probation. more »

BOSTON, Oct. 5, 2016—The former bookkeeper at a Dorchester-based labor union has been ordered to pay more than $150,000 in restitution for thefts she undertook by exploiting access to their checkbook, accounting software, and credit card, Suffolk County District Attorney Daniel F. Conley said.

MARIE ESTHER LAFONTANT (D.O.B. 8/6/76) of Winchester pleaded guilty on Sept. 26 to three counts of larceny over $250 and one count of making false entry on corporate books for the theft of $154,847 from her employer, the United Association of Journeyman Plumbers and Gasfitters Local 12, between 2011 and 2013.

Yesterday, Suffolk Superior Court Judge Robert Gordon imposed a sentence of one year in the Suffolk County House of Correction followed by 10 years of probation and entered an order that she make full restitution. Lafontant is currently facing similar charges out of Middlesex County for additional thefts. more »

BOSTON, Sept. 28, 2016—A man who allegedly exploited his position within a Boston church was arraigned today on rape and related charges from the 1980s and 1990s, Suffolk County District Attorney Daniel F. Conley said.

MICHAEL WALSH (D.O.B. 9/30/36) of Pembroke was indicted Sept. 16 on two counts of rape of a child and three counts of indecent assault and battery on a child for alleged offenses against a boy who was then in the fourth, fifth, and sixth grades. At the time, Walsh was an altar boy coordinator at St. Brendan’s Church in Dorchester and a coach with the Cedar Grove Baseball League.

At the request of Assistant District Attorney Ashley Polin of the DA’s Child Protection Unit, Clerk Magistrate Anne Kaczmarek ordered Walsh to wear a GPS monitor, remain in Massachusetts, and surrender his passport while the case is pending. more »

BOSTON, Sept. 28, 2016–Revere Police and the Suffolk County State Police Detective Unit are investigating an apparent assault that left a man with serious injuries outside a Squire Road strip club, District Attorney Daniel F. Conley and Police Chief Joseph Cafarelli said.

The preliminary investigation suggests that a 29-year-old New Jersey man was escorted from The Squire at about 10:00 last night.  Said to be intoxicated inside the establishment, the man became involved in a physical altercation with several members of club staff outside.  A Revere Police officer observed a group gathered outside and stopped to investigate.  He found the victim unconscious on the ground, and the man was transported to Massachusetts General Hospital for treatment of a serious head injury.  As of early this morning, he was listed in serious but stable condition. more »

BOSTON, Sept. 21, 2016—The man who gunned down 22-year-old US Army veteran Stephen Perez during an altercation in a Theater District parking garage was found guilty of first-degree murder in his homicide, District Attorney Daniel F. Conley said.

Jurors convicted PETER CASTILLO (D.O.B. 8/6/88) of Salem about two hours after Judge Mitchell Kaplan instructed them on the law. The verdict, which rejected Castillo’s claim of self-defense, came after about four days of testimony. Castillo faces a mandatory term of life in prison without the possibility of parole when Kaplan sentences him Monday morning. more »

TAKISA MATTHEWS (D.O.B. 5/4/84) today pleaded guilty to manslaughter, armed assault with intent to murder, and assault and battery.  Suffolk Superior Court Judge Douglas Wilkins sentenced her to 12 to 13 years in state prison. High Court Cites “Effective Triangulation of Consistent Evidence” Proving Guilt

 

BOSTON, Sept. 8, 2016— A man twice convicted of murdering Joseph Bottari and Frank Chiuchiolo in the North End 30 years ago has once again been denied a new trial, Suffolk County District Attorney Daniel F. Conley said.

FRANK DiBENEDETTO will continue to serve life in prison without the possibility of parole after the Supreme Judicial Court today affirmed a decision of a judge of the Superior Court denying his motion for a new trial in the Feb. 19, 1986, killings of Bottari and Chiuchiolo. DiBenedetto and LOUIS COSTA were convicted of first-degree murder in 1988 and again after a new trial in 1994.  Costa is also serving life in prison; because he was a juvenile at the time of the murders, however, he is eligible for periodic parole hearings under a 2013 ruling by the SJC. At a hearing earlier this year, Costa unequivocally identified DiBenedetto as his confederate in the cold-blooded murders. more »

BOSTON, Sept. 2, 2016—A ride-share driver was arraigned today following his arrest for sexually assaulting a female passenger in his vehicle earlier this week, Suffolk County District Attorney Daniel F. Conley said.

MICHAEL VEDRINE (D.O.B. 1/31/84) of Brockton was arraigned today for allegedly assaulting a passenger in his Uber car in the early morning hours of Aug. 31. BOSTON, August 29, 2016—A Quincy man was arraigned on firearm charges last week after Boston Police criminalists found his fingerprint inside a handgun left on a Dorchester street – where it was discovered by two children walking to the park, Suffolk County District Attorney Daniel F. Conley said.

DANTE SINGLETON (D.O.B. 3/15/93) was arraigned Friday in Roxbury Municipal Court on charges of unlawful possession of a firearm, possession of a large capacity firearm, carrying a loaded firearm, unlawful possession of ammunition, and unlawful possession of a firearm as a third offense.  According to prosecutors, Singleton was previously convicted of firearm charges in the juvenile division of Dorchester Municipal Court and more recently convicted in Suffolk Superior Court on a 2013 indictment charging unlawful possession of a firearm and carrying a loaded firearm. Singleton was sentenced to two and a half years behind bars and is currently serving five years of probation on that conviction. more »

BOSTON, Aug. 26, 2016—The state’s highest court today affirmed the first-degree murder conviction of a man who gunned down 25-year-old Derrick Barnes – five years almost to the day since the man was shot to death on the porch of a relative’s Fayston Street home, Suffolk County District Attorney Daniel F. The Supreme Judicial Court affirmed the murder and firearms convictions of FRANKIE HERNDON (D.O.B. 4/9/84) for the Aug. 27, 2011, shooting that claimed Barnes’ life. A second man, FREDERICK HENDERSON (D.O.B. 11/25/83), was convicted at the same trial for his role in the murder; his appeal is still pending. more »

BOSTON, August 17, 2016—State Police detectives assigned to the Suffolk County District Attorney’s Office are continuing to investigate a single vehicle crash in West Roxbury that claimed the life of the driver, a 44-year-old Dedham man, District Attorney Daniel F. Conley said.

A preliminary investigation indicates that the man was operating a 2000 Chevrolet S-10 pickup truck with one passenger in the area of Enneking Parkway when the vehicle lost control during a turn and left the roadway yesterday evening.  The driver suffered fatal injuries and died at the scene.  The passenger, a 46-year-old Roslindale man, was transported to Brigham and Women’s Hospital with significant injuries. more »

JUAN AYALA-POWELL (D.O.B. 7/13/89) of was arraigned today in Roxbury Municipal Court on charges of assault with intent to murder, assault and battery with a dangerous weapon causing serious bodily injury, kidnapping and endangering a minor by a relative, possession of a firearm in the commission of a felony, unlawful possession of ammunition, discharging a firearm within 500 feet of a building, and larceny of a motor vehicle.  Judge Jonathan Tynes set bail in the amount of $150,000 bail and ordered Ayala-Powell to stay away and have no contact with the victim or witnesses, submit to GPS monitoring, and abide by a curfew in the event he is to be released on bail.  At the request of Assistant District Attorney Amy Martin, Tynes revoked Ayala-Powell’s bail in an open case out of Dorchester Municipal Court charging forgery and uttering. more »

BOSTON, Aug. 10, 2016—An off-duty Cambridge police officer has been charged with beating a man in Revere during an altercation last month outside a Broadway restaurant, Suffolk County District Attorney Daniel F. Conley said.

JONATHAN VICENTE (D.O.B. 11/5/90) was arraigned today in Chelsea District Court on charges of assault and battery, assault and battery with a dangerous weapon, and malicious destruction of property in connection with the July 10 incident. Vicente walked into court today for his first scheduled court date following his July 11 arraignment for disturbing the peace, and as a result was released without monetary bail. BOSTON, August 9, 2016—Two men were arraigned yesterday on charges of trafficking methamphetamines after an overdose at a Downtown hotel led to the discovery a large amount of drugs in their room, Suffolk County District Attorney Daniel F. Conley said.

JEFFREY BERTRAND (D.O.B. 12/30/85) of Everett and DYLAN DONAHUE (D.O.B. 8/29/92) of Granby were arraigned yesterday in Boston Municipal Court on charges of trafficking in more than 100 grams of methamphetamine.  Donahue was additionally arraigned on two counts of possession of a Class B substance.  Assistant District Attorney Daniel Nucci requested bail of $150,000 and orders that each defendant wear a GPS monitor, abide by a curfew, and stay away from the W Hotel in the event they are to be released on bail.  Judge Michael Coyne set bail in the amount of $2,000 and ordered that the men each submit to GPS monitoring and home confinement and stay away from the city of Boston in the event they are released. more »

BOSTON, August 8, 2016—An Everett man was held on high bail at his arraignment today on charges of photographing up a woman’s skirt and possessing child pornography, Suffolk County District Attorney Daniel F. Conley said.

MARK BARRY (D.O.B. 6/11/65) was arraigned today in Charlestown Municipal Court on charges of photographing sexual or intimate parts without consent and possession of child pornography as a third offense. According to prosecutors, he was previously convicted of possession of child pornography in federal court in 2002 and of possessing child pornography as a second offense in Suffolk Superior Court in 2013 for which he is currently on probation after his release from a three-year prison sentence.  Those charges stemmed from an incident in which he was arrested for photographing up the skirt of a child on the MBTA, leading to the discovery of child pornography images on his phone.

At the request of Assistant District Attorney Nicole Poirier, Judge Lawrence McCormick set bail in the amount of $100,000. Also at Poirier’s request, McCormick ordered Barry not to work, volunteer, reside, or have unsupervised contact with children under 18; not loiter within 300 feet of any location where children regularly congregate; allow the Department of Probation to search his computers, electronic devices, and photos; not use the internet unless required for his employment; wear a GPS monitor; stay away and have no contact with witnesses in the case; and not use public transportation in the event he is to be released on bail. more »

BOSTON, Aug. 5, 2016—The Massachusetts Appeals Court today affirmed the murder conviction of a man found guilty in the 2009 shooting death of 32-year-old Carl Bonnie, Suffolk County District Attorney Daniel F. Conley said.

In an unpublished decision released today, the Appellate Court denied a new trial for TREVOR “SPECIALIST” HIGGINS (D.O.B. 10/22/74), who was convicted of second-degree murder and unlawful possession of a shotgun in connection with the shooting that claimed Bonnie’s life during a drug deal.  A second man involved in the shooting, GREGORY “BUDDHA” KNIGHT (D.O.B. 5/16/82), pleaded guilty to his role in the homicide prior to the trial. more »

BOSTON, July 29, 2016—A Lynn man charged with attempting to kidnap and sexually assault a woman walking alone in Revere will be held without bail pending the outcome of a dangerousness hearing next week, Suffolk County District Attorney Daniel F. Conley said.

GERARDO PORTILLO (D.O.B. 5/23/90) was arraigned today in East Boston Municipal Court on charges of assault with intent to commit a felony, assault with intent to rape, assault and battery causing serious bodily injury, strangulation, indecent assault and battery on a person over 14, and attempt to commit a crime in connection with the June 25 assault, as well as a charge of reckless endangerment of a child for allegedly leaving a young child alone in his vehicle at the time of the assault.

At the request of Assistant District Attorney Natalia Belland, Judge John McDonald ordered Portillo held without bail pending the outcome of a dangerousness hearing under Chapter 276, Section 58A, of the Massachusetts General Laws, which allows a judge to hold a defendant accused of certain offenses without bail for up to 120 days pending trial upon “clear and convincing evidence that no conditions of release will reasonably assure the safety of any other person or the community.”   That hearing is scheduled to take place Aug. 5. more »

BOSTON, July 20, 2016—The state’s highest court has denied a new trial for the man who robbed, beat, and murdered 15-year-old Germaine Rucker but ordered that the killer be resentenced because he was a juvenile at the time of the homicide, Suffolk County District Attorney Daniel F. Conley said.

KENTEL WEAVER (D.O.B. 7/29/87), who was 16 when he shot and killed Rucker in 2003, is currently serving a sentence of life in prison without the possibility of parole after a jury in 2006 convicted him of first-degree murder and unlawful possession of a firearm.  He will continue to serve his life sentence, but will become eligible for parole as a result of the resentencing ordered by the Supreme Judicial Court. more »

BOSTON, July 13, 2016—A Chelsea man who was deported following his arrest on child rape charges 10 years ago was apprehended after he re-entered the United States yesterday, Suffolk District Attorney Daniel F. Conley, Revere Police Chief Joseph Cafarelli, and US Marshal for the District of Massachusetts John Gibbons said.

RONY VASQUEZ (D.O.B. 11/8/73) was arrested on June 18, 2006, after Revere Police found him engaged in apparent sexual activity with an 11-year-old girl known to him. The Suffolk County Grand Jury indicted Vasquez three months later after the investigation revealed additional sexual contact with the child, but he was deported by immigration authorities in the interim and never appeared at his Suffolk Superior Court arraignment. A warrant for his arrest has been in place since then. more »

The indictments, returned yesterday afternoon, charge AMARI POPE (D.O.B. 10/5/99) of Dorchester with second-degree murder and misleading a police investigator. BOSTON, June 24, 2016— Jurors in the trial of three men charged in the slaying of 25-year-old Romeo McCubbin today returned guilty verdicts on firearm charges but declared themselves hopelessly deadlocked on the charge of murder, Suffolk County District Attorney Daniel F. Conley said.

After more than two days of deliberations in the murder trial of OMAR BONNER (D.O.B. 8/2/87) of Hyde Park, OMAR DENTON (D.O.B. 5/9/84) of Milton, and ANDREW ROBERTSON (D.O.B. 06/09/1976) of Hyde Park, jurors convicted Bonner of unlawful possession of a firearm and resisting arrest and Denton of unlawful possession of a firearm.  Jurors were unable to come to a unanimous decision on the charge of first-degree murder faced by all three defendants.  As a result, Suffolk Superior Court Judge Janet Sanders declared a mistrial. more »

BOSTON, June 24, 2016—More than two years after unidentified human remains were recovered on Revere Beach, a DNA match through a national missing and unidentified persons database has provided a previously-missing man’s family with answers in his disappearance, Suffolk County District Attorney Daniel F. Conley said.

The partial remains discovered in shallow water along the shoreline in 2014 have been conclusively identified as those of a 31-year-old man with ties to Oklahoma who had most recently been living in Cambridge. Prior to his last reported sighting in 2013, he wrote a letter to his family indicating that he was “going off the grid” and that they “would not see [him] again.” more »

BOSTON, June 20, 2016—A Lynn teen has been indicted for murder in connection with the Chelsea shooting that killed 19-year-old Pablo Villeda and injured six others, while a second teen has been indicted for possessing a firearm in connection with the case, Suffolk County District Attorney Daniel F. A Suffolk County Grand Jury today returned indictments charging EMANUEL MARRERO (D.O.B. 6/3/99) with first-degree murder, unlawful possession of a firearm, five counts of aggravated assault and battery with a dangerous weapon, and six counts each of armed assault with intent to murder and assault and battery by discharging a firearm.

EFRAIN VEGA (D.O.B. 12/14/98) was indicted on a charge of unlawful possession of a firearm.  Although he is a juvenile, his indictment under the state’s youthful offender statute opens his case to the public and subjects him to the full range of both juvenile and adult repercussions. more »

CHELSEA, June 16, 2016—Nearly two weeks after Marco Salguero-Cruz suffered fatal injuries in a hit-and-run collision, Chelsea and State police are asking the public to remain on the lookout for the vehicle that fled the scene of the crash.

Chelsea Police Chief Brian Kyes and Suffolk District Attorney Daniel F. Conley said Salguero-Cruz, 25 and a resident of Chelsea, was struck in the area of 284 Washington Ave. at about 10:00 on the night of June 4. The vehicle that struck him left the scene without stopping. Salguero-Cruz was rushed to Massachusetts General Hospital, where he died of his injuries the next morning. more »

BOSTON, June 13, 2016—The state’s highest court today affirmed the first-degree murder conviction of the Mattapan man who strangled Rosanna Camilo inside her home, Suffolk County District Attorney Daniel F. Conley said.

The Supreme Judicial Court’s ruling means that ELDRICK BROOM (D.O.B. 4/7/84) will not receive a new trial after a jury in 2013 found him guilty of aggravated rape and first-degree murder under both the theories of extreme atrocity and cruelty and felony murder.  Broom is currently serving a sentence of life in prison without the possibility of parole. more »

BOSTON, June 10, 2016—A man was held without bail pending a probation hearing following his arraignment on charges of assaulting and robbing an elderly man last week, Suffolk County District Attorney Daniel F. Conley said.

MICHAEL BRUZZESE (D.O.B. 5/25/65), formerly of Hingham and more recently living in Cambridge, was arraigned in East Boston Municipal Court on charges of assault and battery on an elder, unarmed robbery of a person over 60, breaking and entering a vehicle in the daytime, and larceny over $250.  Assistant District Attorney Lynn Feigenbaum requested bail of $100,000.  Judge John MacDonald imposed $25,000 and additionally ordered that he be held without bail on a Norfolk Superior Court probation matter.  According to prosecutors, Bruzzese is currently serving three years of probation for convictions on charges of possession of burglarious tools and two counts of malicious destruction of property over $250. more »

Conley and Massachusetts State Police Colonel Richard McKeon today announced the arrest of MICHAEL BRUZZESE, 51, for the June 1 assault on a man inside the Belle Isle Marsh Reservation in East Boston. BRUZZESE most recently had a temporary residence in Cambridge and formerly lived in Hingham.

BRUZZESE is charged with the following criminal offenses:

  1. Assault and battery on a person over 60;
  2. Breaking and entering of a vehicle during the daytime;
  3. Larceny; and

RICCARDO D’ORSAINVILLE (D.O.B. 5/17/65), currently a resident of Norwood but previously of Boston, with one count of kidnapping and three counts each of poisoning, larceny over $250, and receiving stolen property. BOSTON, June 7, 2016–State Police assigned to the Revere Barracks and Suffolk County District Attorney’s office are investigating separate incidents that left two men injured, one of them fatally, at the Belle Isle Marsh last week.  The two incidents have not been conclusively linked, but State Police are advising the public of them and increasing patrols in an abundance of caution.

The first incident occurred on Sunday, May 29. An 83-year-old East Boston man was discovered at about 2:45 pm with a serious head injury and transported to Massachusetts General Hospital.  The man’s injuries prevented him from giving an account of what had happened. He succumbed to his injuries on June 1, after which State Police were notified.  The Office of the Chief Medical Examiner has not yet determined the cause or manner of his death. more »

ANTHONY DEW (D.O.B. 8/12/82) today pleaded guilty to human trafficking, assault and battery, distribution of a Class A substance, and distribution of a Class B substance.  Superior Court Judge Linda Giles sentenced Dew to eight to 10 years in state prison followed by seven years of probation. more »

BOSTON, June 1, 2016—The state Appeals Court yesterday affirmed the conviction of a Swampscott man who bit off his former business partner’s nose four years ago, Suffolk County District Attorney Daniel F. Conley said.

With its decision yesterday, a Massachusetts Appeals Court panel denied a new trial for KENNETH MICHAUD (D.O.B. 10/8/71), who was convicted of mayhem and assault and battery causing serious bodily injury for the May 2, 2012 incident outside a Revere restaurant.  He was sentenced to three to five years in prison and three years of probation at the conclusion of his 2013 trial. more »

Family Mourns Their “Angel” as Her Killer Gets Life

BOSTON, May 31, 2016—Family members and friends of 25-year-old Keosha Gilmore recalled the pain of losing “an angel” as the childhood friend who murdered her was sentenced to life in prison.

CHRISTOPHER JACKSON (D.O.B. 10/8/86) faced sentencing today after a Suffolk Superior Court jury last week convicted him of second-degree murder, unlawful possession of a firearm, unlawful possession of ammunition, and carrying a loaded firearm.  Judge Raffi Yessayan sentenced Jackson to life in prison with the possibility of parole after 15 years – the mandatory term for the offense of second-degree murder – and concurrent sentences of six to seven years on the firearm charges. more »

CHELSEA, May 30, 2016–Chelsea Police detectives and State troopers assigned to the Suffolk DA’s office are investigating the death of a 4-month old boy earlier today, Police Chief Brian Kyes and District Attorney Daniel F. Conley said.

A family member found the child unresponsive in their Washington Street apartment at about noon. He was transported to Whidden Memorial Hospital, where he was pronounced deceased. A preliminary examination of the body did not reveal immediate signs of violent trauma and the Office of the Chief Medical Examiner will conduct an autopsy to determine the cause and manner of his death.  Detectives have likewise not developed evidence of foul play but their investigation remains active. more »

BOSTON, May 25, 2016—A Boston drug trafficker was sentenced to more than a decade behind bars after Suffolk prosecutors proved that he and another defendant repeatedly sold heroin and possessed almost a pound of it in their Roslindale stash house, District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury on Friday convicted ELIEL “TONY” FIGUEROA (D.O.B. 2/9/83) of trafficking in more than 200 grams of heroin and possession of cocaine with intent to distribute after about a week of testimony stemming from his 2013 arrest. BOSTON, May 24, 2016—The brothers convicted of killing 22-year-old Christopher Borgella during a brawl outside a Dorchester hotel have been sentenced to life in prison, Suffolk County District Attorney Daniel F. Conley said.

A jury last week convicted HAROLD COLEMAN (D.O.B. 3/19/88) of Dorchester and SHAWN COLEMAN (D.O.B. 2/26/92) of Boston’s South End of second-degree murder and assault and battery with a dangerous weapon in connection with the 2014 homicide during a brawl outside a Dorchester hotel.  Harold Coleman was also found guilty of malicious destruction of property over $250.  At their sentencing this morning, Suffolk Superior Court Judge Linda Giles imposed the mandatory term of life in prison, with parole eligibility after 15 years. more »

BOSTON, May 23, 2016—A man who allegedly attempted to take control of a Boston Police officer’s service weapon while begging police to shoot him has been ordered to undergo a mental health evaluation, District Attorney Daniel F. Conley said.

ARTHUR CAMPBELL (D.O.B. 6/20/80) was arraigned today in Boston Municipal Court on charges of assault and battery on a police officer, attempted larceny, and trespassing.  Prosecutors requested bail of $50,000 and that Campbell’s bail be revoked on an open case out of the same court charging assault with a dangerous weapon and trespassing.  Judge Catherine Byrne ordered Campbell held without bail for a period of 20 days and ordered that he undergo a mental health evaluation.  Byrne declined to revoke bail on the open case. more »

BOSTON, May 20, 2016— An alleged career criminal was held on high bail at his arraignment today on charges he fired the stray bullet that struck a woman as she left church, District Attorney Daniel F. Conley said.

JAMES MARTIN Jr. (D.O.B. 3/7/94)  of Dorchester was arraigned today in Dorchester Municipal Court on charges of armed assault to murder, assault and battery with a dangerous weapon, unlawful possession of a firearm, unlawful possession of ammunition, discharging a firearm within 500 feet of a building.  He was additionally charged as a Level III armed career because of prior convictions for distribution of a Class B substance in 2014 and for assault and battery in 2013 and 2014.

Assistant District Attorney Marc Tohme requested bail of $500,000 with orders that Martin wear a GPS monitor and remain under house arrest in the event he is to be released on bail.  Tohme moved to revoke bail on Martin’s open cases in Dorchester charging trespass and in Lynn charging him with violating a restraining order.  Judge Serge Georges imposed bail of $150,000, imposed the requested conditions of release, and revoked Martin’s bail in the Lynn case.  He additionally ordered Martin held without bail on an open probation matter. more »

If passed, HD4590 – known as “An Act Protecting Rape Victims and Children Conceived in the Assault” – would create a legal presumption that it is not in the best interests of the child for the convicted rapist to have sole or shared custody of the child or visitation rights. Just shy of the three-year anniversary of 45-year-old Celestine Walker’s murder, her abusive partner was sentenced to life in prison for her homicide, Suffolk County District Attorney Daniel F. Conley said today.

After a Suffolk Superior Court jury found him guilty of second-degree murder and violating a restraining order that the victim had taken out against him, PHILLIP CARRINGTON (D.O.B. 4/6/65) today faced sentencing before Judge Frank Gaziano.  He sentenced Carrington to life in prison – the mandatory term for second-degree murder – with the possibility of parole after a period of 15 years and a concurrent term of 2 ½ years for the restraining order violation.  Assistant District Attorney Jennifer Hickman of the DA’s Homicide Unit had recommended that Gaziano use his discretion to set Carrington’s parole eligibility at 25 years, the maximum period allowed under the law. more »

The Suffolk County Grand Jury indicted SAMSON DONICK (D.O.B. 5/27/95), formerly of Boston and now a resident of Tiburon, California, on charges of aggravated rape, breaking and entering at night with the intent to commit a felony, burglary, and indecent assault and battery. A Suffolk Superior Court jury this afternoon convicted PHILLIP CARRINGTON (D.O.B. 4/6/65) of second-degree murder for strangling Walker, then 45, to death in her Heath Street home. The state’s Appeals Court yesterday declined to order a new trial for a Cambridge man convicted of firearm charges in 2014, Suffolk County District Attorney Daniel F. Conley said.

STEVEN BELIZAIRE (D.O.B. 1/27/87) appealed his 2014 conviction on charges of unlawful possession of a firearm and carrying a loaded firearm, arguing that certain evidence should not have been presented during his trial.  In an unpublished decision issued today, the justices of the Appeals Court disagreed. more »

BOSTON, May 9, 2016—A man whom prosecutors say adopted a fictitious persona as a wealthy European émigré has been indicted for a scheme in which he allegedly drugged gay men at their homes and made off with expensive clothing, jewelry, and artwork, Suffolk County District Attorney Daniel F. Conley and Boston Police Commissioner William B. Evans said.

The Suffolk County Grand Jury late Friday returned indictments charging RICCARDO D’ORSAINVILLE (D.O.B. 5/17/65), currently a resident of Norwood but previously of Boston, with one count of kidnapping and three counts each of poisoning, larceny over $250, and receiving stolen property. The indictments supersede a pending Boston Municipal Court case in which he was charged with one count of larceny over $250 after his arrest by Boston Police in February.

BOSTON, April 28, 2016—State Police detectives assigned to Suffolk County District Attorney Daniel F. Conley’s office are asking for the public’s help in identifying a man found deceased in the waters of the Charles River last month.

Investigators have exhausted the traditional methods of identifying the individual, whose body was spotted floating along the Esplanade on March 10. The body is described as that of a pale-skinned, white male approximately 60 years in age, about 5’8” tall, and about 200 lbs. He was bald except for white hair on the back and sides of his head, with white facial hair. more »

Survivor: “What Happened to Me Does Not Define Me”

Boston, April 26, 2016—As the man who assaulted her was sentenced to life in prison, a young sexual assault survivor today declared that she will “no longer be labeled a victim,” Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury on April 12 convicted ERROLL FOREMAN (D.O.B. 1/23/65) of three counts of aggravated rape of a child and single counts of assault and battery and witness intimidation.  Because Foreman was previously convicted of the rape and sexual exploitation of another child, Suffolk prosecutors sought a second trial in order to secure enhanced sentences for rape of a child as a subsequent offense.  At the conclusion of a jury-waived trial before Judge Linda Giles today, Foreman was found guilty of the subsequent offense and sentenced to life in prison. more »

BOSTON, April 26, 2016—The Massachusetts Appeals Court has rejected a serial rapist’s appeal of the Suffolk County convictions that led to his lengthy state prison sentence, District Attorney Daniel F. Conley said.

In an unpublished decision released Friday, the Appeals Court affirmed the 2013 conviction of JOSE S. CASTILLO (D.O.B. 5/17/76) in connection with four assaults on women working as prostitutes in Chelsea during 2010.  Castillo is currently serving a sentence of 17 to 19 ½ years in state prison for aggravated rape, rape, assault with a dangerous weapon, and two counts of assault with intent to rape and assault and battery with a dangerous weapon. more »

A Suffolk Superior Court jury on Friday convicted WILLIAM BERRY (D.O.B. 9/2/74) of aggravated rape, aggravated burglary, and breaking and entering with intent to commit a felony.  At his sentencing today, Assistant District Attorney Elizabeth Riley of the DA’s Sexual Assault and Domestic Violence Unit recommended a sentence of 18 to 22 years in prison followed by 10 years of probation. The Suffolk County Grand Jury on March 17 returned indictments charging GRANT HEADLEY (D.O.B 6/28/88) of Dorchester with armed assault with intent to murder, assault and battery with a dangerous weapon, assault and battery by discharging a firearm, unlawful possession of a firearm, unlawfully carrying a loaded firearm, unlawful possession of a large-capacity weapon and feeding device, unlawful possession of a firearm with a defaced serial number, distribution of a Class B substance, possession of a Class B Substance with intent to distribute, and possession of a firearm in the commission of a felony.  In light of previous convictions, Headley was additionally indicted for unlawful distribution of a Class B substance as a second or subsequent offense, unlawful possession of a firearm as a third offense, and being a Level II armed career criminal. more »

A Dorchester man has been sentenced to prison after admitting to setting fires in both Suffolk and Middlesex counties in an act of domestic violence, Suffolk County District Attorney Daniel F. Conley, Middlesex County District Attorney Marian Ryan, and State Fire Marshal Peter J. Ostroskey announced.

ALFRED JORDAN (D.O.B.4/9/81) on Thursday pleaded guilty to arson and four counts of attempted murder resulting from offenses committed in Middlesex County and arson, attempted murder, and two counts each of assault and battery with a dangerous weapon and assault and battery for offenses committed in Suffolk County on March 28, 2013.

Suffolk Superior Court Judge Laurence Pierce sentenced the defendant to eight years to eight years and one day in state prison followed by five years of probation, during which time Jordan must undergo mental health evaluation and treatment, drug abuse evaluation and treatment, be subject to random drug screening, complete a certified batterers intervention program, and stay away from the victims and the locations of the fires which he admitted to setting. Suffolk Assistant District Attorney Lynn Feigenbaum and Middlesex Assistant District Attorney Elizabeth Dunigan had jointly requested a prison term of 14 to 15 years. more »

BOSTON, April 7, 2016—A repeat violent offender was held on high bail at his arraignment today for shooting a man during a dispute yesterday, Suffolk County District Attorney Daniel F. Conley said.

SAQUAN GAUL (D.O.B. 7/25/92) of Hyde Park was arraigned this morning in Dorchester Municipal Court on charges of assault and battery with a dangerous weapon, unlawful possession of a firearm, unlawful possession of ammunition, carrying a loaded firearm, and possession of a Class B substance as a subsequent offense based on a 2015 conviction for possession of a class B substance.  Because he was previously convicted in 2014 for assault and two separate convictions in 2012 for assault and battery on a police officer, Gaul was additionally charged as a Level III armed career criminal.

Assistant District Attorney Caitlin Grasso of the DA’s Major Felony Bureau requested bail of $250,000 with orders that Gaul wear a GPS monitor, abide by a curfew, stay away and have no contact with the victim or witnesses, and stay away from the location of the shooting in the event he is to be released on bail.  Judge James Coffey set $200,000 bail and ordered Gaul to stay away and have no contact with the victim and witnesses and stay away from the location of the offense. more »

BOSTON, April 6, 2016—The man who murdered Sherry Leigh Bradley in a crime of domestic violence was sentenced to life in prison today after the victim’s daughter called him an “evil man” who “came uninvited into our lives,” Suffolk County District Attorney Daniel F. Conley said.

CHHOEUT CHIN (D.O.B. 4/12/72) of Lynn was convicted Monday of second-degree murder for choking Bradley to death in 2013. The crime comes with a mandatory term of life in prison with the possibility of parole after 15 or more years. Assistant District Attorney Edmond Zabin recommended that he remain behind bars for at least 25 years, the maximum allowed by law; Suffolk Superior Court Judge Jeffrey Locke set his parole eligibility at 20 years. more »

One Co-Defendant Pleaded Guilty, Another Remains at Large
BOSTON, April 5, 2016—A Dorchester man faces sentencing next week after a jury found him guilty of a 2014 home invasion, District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury yesterday convicted XAVIER COLON (D.O.B. 5/16/92) of home invasion but acquitted him of two counts armed robbery in connection with the 2014 incident in Mission Hill.  He faces sentencing April 12.

A second man, KEITH GLOVER (D.O.B. 12/30/76) of Dorchester, last year pleaded guilty to two counts of armed robbery and a single count of home invasion for his role.  He is currently serving a state prison sentence.  A third co-defendant, KENNETH RODRIGUEZ (D.O.B. 9/19/91), fled Massachusetts prior to his 2014 arraignment and remains at large. more »

BOSTON, April 1, 2016—Suffolk County District Attorney and Revere Police Chief Joseph Cafarelli today announced that the Everett man sought in connection with the December homicides of 66-year-old Peter Pitari and 38-year-old Cristy Johnson has been captured.

VICHETH SO (D.O.B. 10/25/79) was arrested today after Revere Police, State Police, and US Marshals received information placing So at an East Lyme, Connecticut, hotel. He was taken into custody on a warrant charging him with two counts of murder and one count of assault with a dangerous weapon.  He waived extradition during an appearance in New London Superior Court and will be returned to Massachusetts at a later date. more »

BOSTON, April 1, 2016—A Chelsea man was sentenced to prison today for pointing a loaded handgun at a police officer during a foot chase that followed shots fired, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury this morning found IGOR PEULIC (D.O.B. 1/30/83) of Chelsea guilty of unlawful possession of a firearm, carrying a loaded firearm, assault with a dangerous weapon, and discharging a firearm within 500 feet of a building.  Judge Elizabeth Fahey sentenced Peulic to four to five years in state prison followed by 2 ½ years  in the house of correction, suspended for a period of five years.  During that time, Peulic must enroll in a GED program; work or attend school full-time; complete drug, alcohol, and mental health evaluations and treatment, remain drug- and alcohol-free subject to random testing, and not possess any firearm or dangerous weapon.  Assistant District Attorney Nicole Rimar had recommended a state prison term totaling 6 ½ to 10 years. more »

BOSTON, March 30, 2016—Boston Police Commissioner William B. Evans and Suffolk County District Attorney Daniel F. Conley today released video footage depicting an individual who may have valuable information on an active homicide investigation.

At about 2:00 am on Nov. 26, 2015, 30-year-old Jephthe Chery suffered a fatal gunshot wound when he was caught in the crossfire of a gunfight on Yawkey Way.  Investigators believe that Chery was an innocent bystander and had no role in the violence. Three other men were wounded in the gunfight but survived their injuries; one of them, DOMINIQUE CARPENTER-GRADY, has been indicted on firearms charges following his arrest amid the ongoing investigation. more »

BOSTON, March 25, 2016—A Chelsea man has been sentenced to prison after he was convicted today of attacking a bouncer with a machete in 2014, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury deliberated for one day before convicting JOSE DAVID BENITEZ (D.O.B. 11/29/88) this morning of mayhem and aggravated assault and battery with a dangerous weapon.  Judge Elizabeth Fahey sentenced Benitez to 10 to 12 years in prison and a consecutive probationary term of 20 years.  Assistant District Attorney Montez Haywood of the DA’s Senior Trial Unit had recommended a term of 14 to 15 years in prison followed by five years of probation. more »

BOSTON, March 23, 2016—In recognition of April as Child Abuse Prevention Month, Suffolk County District Attorney Daniel F. Conley announced a series of events in April to raise awareness of child abuse, honor survivors, and help victims through the Children’s Advocacy Center of Suffolk County.

Among the events planned is the 3rd annual Ginormous Climb to raise funds for the CAC on April 2.  Volunteers from Conley’s office, Boston Police, and other organizations will climb the 60-story stairwell of 200 Clarendon, formerly the John Hancock Tower.  Last year’s climb raised more than $100,000, far exceeding the event’s $75,000 goal.  This year, Conley hopes to top that amount again.

The money raised will support the Children’s Advocacy Center of Suffolk County, which acts as a hub connecting children who have been abused, neglected, or exploited and their non-offending caregivers with a myriad of services in a child-centered environment.  This allows victims to meet with police, prosecutors, medical and mental health clinicians, social service providers, and others at one location, reducing the number of times a victim must disclose the abuse and limiting the number of agencies he or she must visit for services.  Last year alone, more than 1,500 reports of child physical and sexual abuse were referred to the center.

BOSTON, March 21, 2016—The woman who set the fire that killed 20-year-old Crystal Lynn Blanchard in her Chelsea apartment five years ago was sentenced to life in prison for her actions, Suffolk County District Attorney Daniel F. Conley said.

MELISSA PFEIFFER (D.O.B. 1/12/84) was convicted Feb. 10 of second-degree murder under the theory of felony murder for starting the Dec. 24, 2010, fire that engulfed her Spruce Street apartment building, trapping Blanchard on the second floor, where she died. Pfeiffer was also convicted of one count of arson and two counts of causing injury to a firefighter as a result of criminal conduct. more »

BOSTON, March 17, 2016—A Revere man has been convicted of murdering 50-year-old Ronald Russo of Winthrop and faces life in prison when he is sentenced next week, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury today found PETER DECONINCK (DOB 10/5/66) guilty of first-degree murder in Russo’s 2013 stabbing death.  At his sentencing on March 24, Judge Linda Giles is expected to impose the mandatory sentence for that offense, life in prison without the possibility of parole. more »

Case Set New Standard for Post-Conviction Claims of Incompetence

BOSTON, March 15, 2016— The state’s highest court today affirmed the first-degree murder conviction of a man who shot his estranged mother in the head, killing her, more than a decade ago, Suffolk County District Attorney Daniel F. Conley said.

DEMOND CHATMAN (D.O.B. 6/20/73) was convicted of first-degree murder in 2002 for the Feb. 10, 2000, shooting death of 41-year-old Mary Chatman in Roxbury. The Supreme Judicial Court today affirmed that conviction and an earlier lower court decision denying his motion for a new trial. The SJC found that Chatman failed to offer compelling evidence that he was unable to assist in his own defense at the time of his trial – an argument he did not raise until six years after those proceedings. more »

Suffolk prosecutors and Boston Police detectives are currently investigating incidents in which victims responded to apartment listings on web sites such as Craigslist and sent payments with the expectation that they would be leasing the apartment in the ad.  The victims would later arrive at the residence prepared to move in, only to find the property already occupied and the rightful owner unaware of any lease agreement. more »

Chelsea Police detectives and State troopers assigned to Conley’s office this evening placed the 16-year-old Lynn youth under arrest on a murder charge stemming from Villeda’s death early yesterday morning. BOSTON, March 7, 2016—The young man shot to death in a vacant apartment on Washington Avenue early yesterday morning has been identified as 19-year-old Pablo Villeda of Chelsea, Police Chief Brian Kyes and District Attorney Daniel F. Conley said.

Police and prosecutors are asking for the public’s help as they continue to investigate the early-morning shooting, which also left six other young men and women with gunshot wounds. Those victims were three males ages 15, 18, and 22, and three females ages 15, 17, and 18. BOSTON, March 1, 2016—An alleged career criminal was arraigned yesterday on charges he was drunk behind the wheel of a car with a firearm inside, Suffolk County District Attorney Daniel F. Conley said.

HAKIM JACKSON (D.O.B. 11/5/86) of Jamaica Plain was arraigned yesterday in Dorchester Municipal Court on charges of operating under the influence of alcohol, unlawful possession of a firearm, unlawful possession of ammunition, carrying a loaded firearm, unlicensed operation of a motor vehicle, failure to stop, and a marked lines violation.  He was additionally charged as a Level I armed career criminal as a result of a prior conviction for armed robbery and assault with a dangerous weapon.  Assistant District Attorney Robert Connelly requested bail of $15,000 and orders that Jackson remain alcohol free subject to random testing, wear a GPS monitor, and abide by a curfew in the event he is to be released on bail.  Prosecutors also filed a motion to revoke Jackson’s bail on an open case out of Waltham District Court charging assault and battery.  Judge Thomas Kaplanes set bail at $10,000 and revoked Jackson’s bail in the open case. more »

BOSTON, Feb. 29, 2016—Suffolk County District Attorney Daniel F. Conley today released video and audio recordings from the incident during which PETER FANFAN, 29, was fatally injured during a gunfight with police officers responding to a call for a person shot.

During a meeting with prosecutors assigned to the case, members of Fanfan’s family reviewed the recordings and asked that they be withheld from public view until after his funeral this past weekend. BOSTON, Feb. 26, 2016—The Massachusetts Appeals Court today affirmed a lower court’s ruling that a repeat drug dealer’s convictions for possessing a loaded .45 caliber semiautomatic Glock handgun were unaffected by the reversal of drug convictions compromised by a rogue former chemist at a Department of Public Health laboratory, Suffolk County District Attorney Daniel F. Conley said.

The eight-page decision by Justices Judd Carhartt, Cynthia Cohen, and Jeffrey Kinder rejected the appeal by LARRY BLUE (D.O.B. 7/14/67) of Dorchester on his 2010 conviction for unlawful possession of a firearm as a third offense. Blue is currently serving a 10-year state prison term on that conviction. more »

BOSTON, Feb. 23, 2016—An East Boston man who drove for a ride-share service was convicted of assaulting a female passenger in his vehicle, Suffolk County District Attorney Daniel F. Conley said.

Abderrahim Dakiri (D.O.B 3/29/1984) waived his right to a jury trial in the 2015 incident for which he was charged with indecent assault and battery. After a bench trial Friday, Boston Municipal Court Judge Michael Coyne found him guilty of the lesser included offense of assault and battery and sentenced him to two years of probation. Coyne ordered Dakiri to stay away from the victim, her workplace, and the campuses of her Boston-area university. If he fails to comply with that order, or if he re-offends, he could be sentenced to up to two and a half years in a house of correction. more »

BOSTON, Feb. 19, 2016— An appellate court ruled today that a Dorchester man will not receive a new trial for his role in the stabbing death of Joel Turner during a 2001 home invasion – and for another drug-related robbery he committed at the same address three weeks earlier, Suffolk County District Attorney Daniel F. Conley said.

RYAN CONWAY (D.O.B. 8/20/78) pleaded guilty in 2003 to one count of second-degree murder, four counts of home invasion, and six counts of armed assault in a dwelling.  In an unpublished decision issued today, the Massachusetts Appeals Court affirmed lower court denials of his motions to withdraw those pleas and seek a new trial.  Conway is currently serving a life sentence with the possibility of parole after 15 years, plus concurrent sentences totaling 20 to 22 years, for the Jan. 31, 2001, home invasion in which Turner was killed and an additional home invasion at the same address weeks earlier. more »

Judge Finds Defense Lawyer Had Conflict of Interest; Integrity of Verdict Not at Issue

Mendez-Baez was charged with distribution of a Class B substance, trafficking in more than 200 grams of a Class B substance, three counts of trafficking in a Class A substance, and conspiracy to violate the state’s drug laws. RANDY BROXTON (D.O.B. 5/23/85) was arraigned today in Roxbury Municipal Court on a charge of armed robbery while masked connection with the Dec. 27 robbery of a Dudley Street market.  Assistant District Attorney Alexandra Halprin requested bail of $35,000.  Judge Kenneth Fiandaca set $25,000 bail and ordered Broxton to wear a GPS monitor, remain within Massachusetts, stay away from the location of the robbery and stay away and have no contact with the victim in the event he is released on bail.  more »

BOSTON, Feb. 3, 2015—A South End man was identified as a suspect in the 2014 stabbing death of Santo Bernabel, whose body was found inside a burning building, after DNA at the scene matched his genetic profile and a GPS monitor refuted his alibi, Suffolk County District Attorney Daniel F. BOSTON, Feb. 3, 2015—A West Roxbury man was sentenced today for causing a collision that left one of his passengers in a wheelchair and the driver of a second vehicle with catastrophic injuries that left him unable to walk, talk, or even feed himself, Suffolk County District Attorney Daniel F. Conley said.

A Brighton Municipal Court jury last month convicted NIKOLAS PAPADOPOULOS (D.O.B. 4/8/95) of negligent operation of a motor vehicle for the crash that he caused by driving at almost twice the speed limit along the Arborway on Sept. 6, 2013. The Jan. 19 verdict came after about three days of trial and less than a day of deliberations. The proceedings were held in Brighton because of ongoing construction near the West Roxbury courthouse that normally has jurisdiction over the location of the crash. more »

BOSTON, Jan. 29, 2016—A Dorchester man was sentenced to life in prison today after a jury yesterday convicted him of murdering 25-year-old Mariano Malave, Suffolk County District Attorney Daniel F. Conley said.

CHARLES REDDICKS (D.O.B. 4/20/94), convicted yesterday of second-degree murder and firearm charges in Malave’s 2012 shooting death, faced sentencing this morning before Suffolk Superior Court Judge Linda Giles.  Giles imposed the mandatory sentence for murder two of life in prison with the possibility of parole after 15 years, with concurrent sentences of five years on a charge of unlawful possession of a firearm followed by one day on a count of carrying a loaded firearm.  Assistant District Attorney Greg Henning of the DA’s Senior Trial Unit had asked that the sentences be imposed consecutive to the life sentence. more »

BOSTON, Jan. 28, 2016—Three men who murdered 16-year-old Terrance Jacobs nine years ago in retaliation for an earlier stabbing will not receive a new trial, Suffolk County District Attorney Daniel F. Conley said today.

A Massachusetts Appeals Court panel today issued a decision upholding the second-degree murder convictions of PEDRO ORTIZ (D.O.B. 8/8/79) and TERRANCE PABON (D.O.B. 1/22/90), both of Dorchester, and MARKEESE MITCHELL (D.O.B. 4/9/91) of Brockton.  A fourth man, PAUL GOODE (D.O.B. 1/9/83) of Dorchester, who was also convicted of second-degree murder for his role in Jacob’s 2007 killing, was not party to the appeal.  All four men were found guilty at the conclusion of a joint trial in 2010. more »

BOSTON, Jan. 27, 2016—More than a decade after he took Julaine Jules’ life in a crime of domestic violence, the longtime suspect in her homicide pleaded guilty to murder and accepted a life sentence, Suffolk County District Attorney Daniel F. Conley said.

During a hearing this morning in Suffolk Superior Court, SHABAZZ AUGUSTINE (D.O.B. 2/19/79) waived all his appellate rights and pleaded guilty to second-degree murder for luring Jules to his home, asphyxiating her, dumping her body in the Charles River, and setting fire to her car near the Malden/Revere line. Judge Jeffrey Locke imposed the mandatory sentence for that offense, life in prison with the possibility of a parole hearing after 15 years. more »

SAMSON SCOTT (D.O.B. 4/13/55), who provided the address of a Boston homeless facility as his residence, was charged in Roxbury Municipal Court yesterday with receiving a stolen motor vehicle, operating with a suspended license, and unlawful possession of ammunition. In light of prior convictions for assault and battery on a police officer in 2005, distribution of a Class A substance in 2004, assault and battery with a dangerous weapon in 1997, and other offenses, he is charged as a Level III armed career criminal. more »

BOSTON, Jan. 21, 2015—A Dorchester man was sentenced to jail time today and a second man was placed under house arrest after a jury convicted them of an unprovoked, bias-motivated 2014 attack, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury on Tuesday convicted STEVEN SUDLER (D.O.B. 5/14/77) of assault and battery to intimidate causing injury and violating his victim’s civil rights while causing injury; jurors found him not guilty of an additional charge of assault and battery with a dangerous weapon.  The same jury found DAVID GUANTE (D.O.B. 4/17/90) guilty of assault and battery to intimidate causing injury but acquitted him of violating the victim’s civil rights. more »

BOSTON, Jan. 20, 2016—An Appeals Court panel today ruled that a man who admitted to carrying crack cocaine cannot withdraw his plea simply because a disgraced former chemist tested the drugs months after the plea was entered, Suffolk County District Attorney Daniel F. Conley said.

In an unpublished decision issued today, the Massachusetts Appeals Court ruled that a West Roxbury Municipal Court judge erred in allowing SAQUAN GORMAN (D.O.B. 5/4/91) to withdraw his 2008 plea to a charge of possession of a Class B substance based solely on the grounds that, well after Gorman pleaded guilty, the drugs were tested by Annie Dookhan, the former Department of Public Health chemist whose mishandling of drug evidence came to light in 2012. more »

BOSTON, Jan. 15, 2016— A Chelsea man pleaded guilty today to his role in the 2013 assault that ended in the shooting death of Elder Morales Aldana in Chelsea — the third of three defendants to do so and the first to offer an apology for his actions, Suffolk County District Attorney Daniel F. Conley said.

ERICK ROMERO (D.O.B. 7/2/98) of Chelsea today pleaded guilty to manslaughter and two counts of assault with a dangerous weapon for his role in the incident in which Morales was killed and a second man assaulted.  Though he was 14 years old at the time of the homicide, Suffolk prosecutors in 2013 indicted Romero as a youthful offender, opening his case to the public; he has been behind bars since that time. more »

BOSTON, Jan. 15, 2016— Members of the Suffolk County District Attorney’s Office will present an online training seminar focused on the office’s groundbreaking photo exhibit, “Now You See: A Celebration of Courageous Kids,” recognizing the courage of child abuse survivors and encouraging others to speak, District Attorney Daniel F. Conley said today.

The upcoming training webinar, hosted by the National Criminal Justice Training Center, will take place from 2:00 to 3:15 p.m. on Wednesday, Jan. 20.  Conley’s director of youth safety and outreach and forensic interviewer, Jacquelyn Lamont, who created the photo exhibit, will lead the webinar alongside Assistant District Attorney Elizabeth Keeley, chief of the DA’s Human Trafficking Unit, who prosecuted several of the cases featured in the project. more »

Leaves Intact State Court Ruling that Warrant Not Necessary for Testing on Lawfully Seized Evidence

 

BOSTON, Jan. 11, 2016—The nation’s highest court has declined to review the appeal of a Chelsea man convicted in part through DNA evidence, letting stand a Massachusetts court ruling that a warrant is not necessary for investigators to perform DNA testing of lawfully seized evidence, Suffolk County District Attorney Daniel F. Conley said today.

The Supreme Court of the United States on Friday denied a petition for review filed on behalf of MANUEL ARZOLA (D.O.B. 9/25/68), who was convicted in 2012 of stabbing another man in Chelsea. Among the evidence at trial was a bloodstain on Arzola’s shirt, which was lawfully seized at the time of his arrest; that stain was subjected to DNA testing that revealed the blood had come from the victim. more »

BOSTON, Jan. 6, 2015—The man who shot 17-year-old Evens Archer to death two summers ago admitted his guilt as his trial was set to begin, Suffolk County District attorney Daniel F. Conley said today.

JOHNNIE BONNIE (D.O.B. 6/28/92) of Jamaica Plain pleaded guilty to voluntary manslaughter for the June 29, 2014, shooting that claimed Archer’s life about three weeks later. He faces a 20-year prison term when he is sentenced tomorrow, with that term to start only after his current imprisonment on an unrelated 2015 gun conviction is complete. more »

BOSTON, Jan. 4, 2016—A Waltham man was arraigned last week on heroin trafficking and gun charges after he was arrested amid a drug investigation  at a downtown hotel, Suffolk County District Attorney Daniel F. Conley said.

WENDY JOSEPH (D.O.B. 11/14/92) was arraigned Thursday in Boston Municipal Court on charges of heroin trafficking, unlawful possession of a firearm, and unlawful possession of ammunition.  Assistant District Attorney Patrick Leeman of the DA’s Gun Prosecution Task Force requested bail of $100,000 and orders that Joseph wear a GPS monitor, remain under house arrest, surrender his passport, and remain within Massachusetts in the event he is released on bail.  Judge Robert McKenna imposed $2,500 bail and ordered Joseph to submit to GPS monitoring and a curfew if released.  He additionally ordered that Joseph be held for transport to Waltham District Court on a probation matter.  According to prosecutors, Joseph is currently on probation out of that court on a 2015 conviction for assault and battery. more »
