BOSTON, Dec. 28, 2017—A Suffolk Superior Court jury today convicted two rivals of all charges in the shooting death of 26-year-old Dawnn Jaffier as she stood along a Dorchester parade route in 2014, District Attorney Daniel F. Conley said.

Jurors convicted WESSON COLAS (D.O.B. 5/25/92) and KEITH WILLIAMS (D.O.B. 7/13/96) of first-degree murder under the theory of deliberate premeditation for their roles in Jaffier’s Aug. 23, 2014, homicide, as well as armed assault with intent to murder and assault and battery with a dangerous weapon for the non-fatal shooting of a second woman, then 20, a few blocks away. Williams was additionally convicted of unlawful possession of a firearm. more »

Three Others Charged with Related Offenses

BOSTON, December 21, 2017— The man charged in the fatal shootings of Scott M. Stevens, Jr., and Michaela Gingras has been held without bail after he, two family members, and a romantic partner were indicted in connection with the slayings, Suffolk County District Attorney Daniel F. Conley said.

LANCE HOLLOMAN (D.O.B. 1/12/87) was arraigned today in Suffolk Superior Court on two counts each of first-degree murder, unlawful possession of a firearm, and assault and battery with a dangerous weapon and a single count of armed assault with intent to murder.  At the request of Assistant District Attorney Masai King, Clerk Magistrate Lisa Medeiros ordered Holloman held without bail.

Also arraigned today were MONICKA STINSON (D.O.B. 4/3/80), a Boston Police officer who had a romantic relationship with Holloman, charged with misleading an investigator; Holloman’s sister, LATOYA HOLLOMAN (D.O.B. 10/23/81), charged with witness intimidation; and his mother, DAPHNE HOLLOMAN (D.O.B. 9/15/59) on a charge of misleading an investigator.  They were each released on their own recognizance and ordered to surrender their passports. more »

All Four in Custody on Related Charges; Investigation Still Active

BOSTON, Dec. 20, 2017—The Suffolk County Grand Jury today returned indictments charging four men with murder and related charges in the fatal shooting of 22-year-old Joshua Briggs at a Dorchester hotel this fall, District Attorney Daniel F. Conley said.

The indictments charge JAMES “SHIZZ” COLEMAN (D.O.B. 10/24/91), JOHN “SPICE” COLLINS (D.O.B. 10/16/93), ERRIN “DUBDUB” CRAWFORD, Jr., (D.O.B. 09/05/88), and MICHAEL “BATS” REYNOLDS (D.O.B. 10/10/93), and with first-degree murder for Briggs’ Oct. 17 homicide at the Holiday Inn Express on Boston Street. The indictments further charge them with three counts each of armed robbery and armed home invasion. Collins and Reynolds were additionally indicted for unlawful possession of a firearm. more »

BOSTON, Dec. 20, 2017—A Suffolk Superior Court jury today convicted a Westwood man of all charges in a 2015 sexual assault on a woman he had stalked from a nearby supermarket, Suffolk County District Attorney Daniel F. Conley said.

Jurors found MICHAEL PURPURA (D.O.B. 6/22/79) guilty of aggravated rape, indecent assault and battery, strangulation or suffocation, unarmed burglary, and larceny over $250. He faces sentencing next month.

“The evidence here was chilling,” Conley said. “The attack was terrifying and the community is safer with the perpetrator behind bars. I’d like to commend the prosecutors and police detectives who built the case step by step, from witnesses to video footage to DNA, but we would never have reached this point without the survivor, whose testimony was so critical to this verdict.” more »

Agreement Mandates Cameras, Sensors, Additional Personnel, and Charitable Donation

BOSTON, Dec. 15, 2017—Suffolk County District Attorney Daniel F. Conley today announced that he had reached a compliance agreement with Boston Duck Tours Ltd. and one of its drivers that will help to prevent collisions like the one that claimed the life of 28-year-old Allison Warmuth last year.

“The enhanced safety measures set out in this agreement reduce driver distraction and increase the safety of vulnerable road users on scooters, mopeds, and bicycles,” Conley said. “This is a fair result that incorporates significant input from Ms. Warmuth’s family and leaves all our options on the table in the event of noncompliance.” more »

BOSTON, December 14, 2017— As her killer was sentenced to life in prison today, Lena Bruce’s friends and loved ones recalled the young woman as a “diamond” whose bright future was stolen 25 years ago.

JAMES WITKOWSKI (D.O.B. 11/27/72) faced sentencing today after a Suffolk Superior Court jury on Monday found him guilty of first-degree murder in Bruce’s 1992 homicide.  Judge Mitchell Kaplan imposed the mandatory term for the offense of life in prison without the possibility of parole. more »

BOSTON, December 12, 2017— A real estate broker convicted in April of forging the verdict slip documenting an earlier larceny conviction was arraigned today on new charges of falsely claiming to hold a law degree, Suffolk County District Attorney Daniel F. Conley said today.

DAVID SCHER (D.O.B. 11/22/82), formerly of Brighton and currently residing in Newton, was arraigned today in Boston Municipal Court on a charge of falsely claiming to hold a degree.  Judge Sally Kelly did not impose monetary bail in Scher’s newest case, but he will remain in custody for violating his parole on his April conviction on offenses related to the forgery of a verdict slip returned by jurors in Scher’s 2014 trial for an earlier theft. more »

BOSTON, Dec. 12, 2017—The man accused of shooting of 21-year-old Duncan Ketter to death in East Boston was arraigned today on a murder charge and two co-defendants have also been held on high bail, Suffolk County District Attorney Daniel F. Conley said.

THORUS O’BRIEN (D.O.B. 5/16/99) of Brockton was held without bail at prosecutors’ request during a hearing at East Boston Municipal Court today. O’Brien is charged with murder, armed robbery, and unlawfully carrying a loaded firearm.

Yesterday, a 16-YEAR-OLD JUVENILE was arraigned in the Suffolk County Juvenile Court on a charge of delinquency, to wit: armed robbery and armed assault with intent to rob. His bail was set at $100,000. Another man, DEMETRIUS CAST (D.O.B. 6/2/97) of Everett, aces similar charges as an adult. He was held on $350,000 cash bail and his open bail in unrelated Middlesex County cases has been revoked. more »

BOSTON, Dec. 11, 2017—More than twenty-five years after Lena Bruce was sexually assaulted and murdered in her South End apartment, a Suffolk Superior Court jury convicted the man whose unique genetic profile matched the one in evidence recovered from the crime scene, District Attorney Daniel F. Conley said.

After about three days of deliberations, jurors convicted JAMES WITKOWSKI (D.O.B. 11/27/72) of first-degree murder under the theory of felony murder. He faces a mandatory life term at a sentencing hearing later this week. Jurors did not consider a sexual assault charge because the statute of limitations in place at the time of the offense had expired. more »

BOSTON, Dec. 6, 2017—A former day care worker convicted seven years ago of sexually assaulting a child in his care is due back in court tomorrow after another child came forward and disclosed abuse to authorities, Suffolk County District Attorney Daniel F. Conley said.

JUAN R. COLON (D.O.B. 8/13/48) of Hyde Park is accused of assaulting a young girl who attended kindergarten at the Rockwood Early Educational Academy in Dorchester about 10 years ago. He was arraigned Nov. 2 in Dorchester Municipal Court.  His next court appearance, which is expected to be administrative in nature, is scheduled to take place in tomorrow. more »

BOSTON, December 4, 2017—Two men convicted last week of murdering 21-year-old Kenny Lamour as he worked on a Jamaica Plain snow-shoveling crew were sentenced to life in prison today, Suffolk County District Attorney Daniel F. Conley said.

At the conclusion of their Suffolk Superior Court jury trial last week, DONTE HENLEY (D.O.B. 5/18/90) and JOSIAH ZACHERY (D.O.B. 7/13/96) were found guilty of second-degree murder for Lamour’s 2015 shooting death.   Today, Judge Peter Lauriat sentenced each to life in prison with the possibility of parole after a minimum of 20 years.  Zachery, who was also convicted of unlawful possession of a firearm and assault with a dangerous weapon, was ordered to serve an additional four to five years in prison, to be served after he has completed the sentence on his murder conviction. more »

BOSTON, Nov. 30, 2017—A Suffolk Superior Court jury today convicted two men of shooting 21-year-old Kenny Lamour to death as he worked as part of a snow-shoveling crew, Suffolk County District Attorney Daniel F. Conley said.

After about three days of deliberations, jurors convicted DONTE HENLEY (D.O.B. 5/18/90) and JOSIAH ZACHERY (D.O.B. 7/13/96) of second-degree murder for Lamour’s Feb. 11, 2015, homicide. Jurors also convicted Zachery of assault with a dangerous weapon for shooting at – but not hitting – a Boston Police officer who pursued him during a foot chase near the crime scene and unlawful possession of a firearm. more »

Drug Lab Employee at Amherst DPH Facility Linked to 134 Suffolk County Cases

BOSTON, Nov. 30, 2017—Suffolk County District Attorney Daniel F. Conley’s office today filed a list of 134 Suffolk County narcotics convictions that included as evidence a certificate of analysis by former civilian chemist Sonja Farak, notifying the state’s highest court that he will move to vacate and dismiss all of them.

Suffolk prosecutors provided their list of cases to the Supreme Judicial Court more than a year after providing similar data to the Committee for Public Counsel Services in a detailed, searchable spreadsheet. That data – which included defendants’ names, docket numbers, and other relevant information – was provided by Conley’s point person for the Farak cases to the CPCS attorney in charge of all drug lab litigation on Aug. 19, 2016. more »

BOSTON, November 28, 2017— The man convicted of fatally stabbing Anthony Spaulding outside a New Year’s Eve party will not receive a new trial, Suffolk County District Attorney Daniel F. Conley said.

A Massachusetts Appeals Court panel today affirmed the voluntary manslaughter conviction of BRIAN MacDONALD (D.O.B. 4/7/88), whom a Suffolk Superior Court jury found guilty of stabbing Spaulding to death outside the victim’s Allston home in the early morning hours of Jan. 1, 2013. MacDonald is currently serving a term of seven to 10 years in state prison. more »

BOSTON, Nov. 21, 2017—A Braintree man was charged with murder and other offenses today following his arrest for the homicide of 55-year-old Nelson Torres-Santa inside the victim’s home earlier this month, Suffolk County District Attorney Daniel F. Conley said.

THOMAS ISAAC, Jr., (D.O.B. 1/17/96) was arraigned in Dorchester Municipal Court, where Judge Paul McManus ordered him held without bail at the request of Assistant District Attorney Julie Higgins’ request. He was charged with murder, armed home invasion, and armed robbery. more »

BOSTON, November 17, 2017— A Revere man was arraigned this week for being an armed career criminal after Revere Police recovered a firearm, a stun gun, and drugs at his home, Suffolk District Attorney Daniel F. Conley said.

NELSON AGUILAR (D.O.B. 8/12/94) of Revere was arraigned in Chelsea District Court Tuesday on charges of unlawful possession of a firearm, unlawful possession of ammunition, possession of an electric stun gun, possession with intent to distribute a Class B substance, possession with intent to distribute a Class D substance, and being a Level II armed career criminal.  According to prosecutors, Aguilar has prior convictions for assault with a dangerous weapon and assault and battery.

Prosecutors requested that bail be set in the amount of $50,000 and that Aguilar’s open bail be revoked in two cases pending in Chelsea District Court; those cases charge assault with a dangerous weapon, threats and unlawful possession of ammunition.   Judge Jean Curran imposed $25,000 bail and revoked Aguilar’s open bail. more »

BOSTON, Nov. 16, 2017—A ride-share driver who allegedly sold heroin to an undercover State trooper this fall has been charged with drug trafficking after his arrest in Boston and the execution of a search warrant at his home in Lawrence, Suffolk County District Attorney Daniel F. Conley and Essex County District Attorney Jonathan Blodgett said.

ARIEL PIMENTAL (D.O.B. 3/4/91) was arraigned yesterday in South Boston Municipal Court on three separate dockets, two charging distribution of a Class A substance and one charging trafficking in heroin. The charges stem from two $200 heroin purchases that troopers made from Pimental in September and the recovery of more than 20 grams of heroin during his Tuesday afternoon arrest in the Seaport District. A single dose of heroin weighs approximately 1/10 of one gram. more »

BOSTON, November 15, 2017— A Roxbury man has been indicted in a months-long string of armed robberies that repeatedly targeted several Roxbury businesses, their employees, and their customers, Suffolk County District Attorney Daniel F. Conley said.

The Suffolk County Grand Jury yesterday returned indictments charging IMAURI IVERY (D.O.B. 6/15/79) with:

• 20 counts of armed and masked robbery,
• four counts of assault and battery with a dangerous weapon,
• two counts of assault with a dangerous weapon,
• two counts of unlawful possession of a firearm,
• two counts of carrying a loaded firearm,
• and one count of armed assault with intent to rob.

Ivery is additionally charged with being a Level III armed career criminal and unlawful possession of a firearm as a subsequent offense as a result of three separate drug distribution convictions and a 2003 federal conviction for being a felon in possession of a firearm or ammunition.  According to prosecutors, he was released from his 180-month federal prison sentence in January 2016.  He has remained in custody since his April arraignment on a Suffolk Superior Court case charging firearm offenses; that case charges possession of a semi-automatic pistol recovered in his home during the execution of a search warrant in connection with the robbery investigation. more »

BOSTON, Nov. 14, 2017—A Revere man remains held without bail following his arraignment on an indictment charging him with first-degree murder in the homicide of his wife, 30-year-old Vanessa MacCormack, Suffolk County District Attorney Daniel F. Conley said.

ANDREW MacCORMACK (D.O.B. 3/2/88) is accused of killing Vanessa MacCormack in their Grand View Avenue home on Sept. 23. He was arrested by Revere Police and State Police homicide detectives assigned to Conley’s office three days later and arraigned in Chelsea District Court on Sept. 27. The Oct. 31 indictment moves his case to Suffolk Superior Court, where his trial was scheduled for Nov. 5, 2018. more »

BOSTON, November 9, 2017— A Milton man was arraigned today on charges he stole a $14,000 flute from a building at Boston University, Suffolk County District Attorney Daniel F. Conley said.

NATHANIEL OLIVER (D.O.B. 11/22/48), who is currently of Milton but resided in Mattapan at the time of the theft, today appeared on a summons for arraignment in Brighton Municipal Court on two counts of larceny over $250 and one count of trespassing.  After Oliver walked into court, Judge Myoung Joun released him on his own recognizance. more »

BOSTON, November 9, 2017— An annual domestic violence awareness fundraiser organized by members of the Suffolk County District Attorney’s Office last week raised just over $4,000 – the largest amount in the event’s four-year history – in support of the city’s largest provider of services to domestic violence survivors, District Attorney Daniel F. Conley said.

The fourth annual fundraiser for Casa Myrna Vasquez, organized by Deputy Chief of Staff Catherine Rodriguez and Chief of Victim Witness Assistance Program Katherine Moran with the help of colleagues in Conley’s office, brought in $4,001, surpassing the event’s fundraising goal and nearly doubling last year’s total.  Bell in Hand Tavern once again this year provided their private event space for the fundraiser, which about 150 people attended.  The Friday evening event was bolstered by a raffle that included gift cards and other items donated by nearly 40 companies. more »

BOSTON, November 7, 2017— A Boston man arraigned yesterday for allegedly stabbing another man more than a dozen times at a cash machine was ordered held without bail pending the outcome of a dangerousness hearing, Suffolk County District Attorney Daniel F. Conley said.

LONNIE FITTS (D.O.B. 7/4/70), who lists a Boston homeless shelter as his residence, was arraigned yesterday in Boston Municipal Court on a charge of armed assault with intent to murder.  At the request of Assistant District Attorney Nina Juitt, Judge James Stanton ordered Fitts held without bail pending a dangerousness hearing under Chapter 276, Section 58A, of the Massachusetts General Laws. The statute allows a judge to hold a defendant accused of certain offenses without bail for up to 120 days pending trial upon “clear and convincing evidence that no conditions of release will reasonably assure the safety of any other person or the community.”  That hearing will be held Monday. more »

Conley today invited non-profit organizations that work with kids and teens to apply for his cash awards program that provide the young people of Boston, Chelsea, Revere, and Winthrop with constructive alternatives to crime and drug use.

The funds are disbursed from Conley’s Asset Forfeiture Community Reinvestment Grant Program. BOSTON, Nov. 2, 2017—The state’s highest court today upheld a Suffolk Superior Court jury’s murder verdict in the 2006 homicide of Yolande Danestoir by her son, District Attorney Daniel F. Conley said.

The 33-page unanimous decision affirms the conviction of NORTON CARTRIGHT for first-degree in his mother’s slaying inside the Reynolds Street home they once shared – where Cartright had continued to live in a crawlspace after being ordered to stay out of the residence. Evidence at trial established that Cartright beat her with a hammer, causing fatal injuries, after she found him inside the apartment. more »

BOSTON, Oct. 30, 2017—A man who allegedly harassed a female passenger on an MBTA bus and then flashed a handgun and assaulted the driver before fleeing through a Revere movie theater was arraigned on firearms and assault charges this week, Suffolk County District Attorney Daniel F. Conley said.

HAKEEM RICKER (D.O.B. 7/29/97) of Lynn was arraigned Monday in Chelsea District Court on charges of unlawful possession of a firearm with a defaced serial number, unlawful possession of ammunition, unlawfully carrying a loaded firearm, assault and battery with a dangerous weapon, assault with a dangerous weapon, and threats to commit a crime for the incident Friday evening onboard a bus headed through Revere to Central Square in Lynn. more »

BOSTON, Oct. 30, 2017— A Lynn man faces life in prison after a jury today found him guilty in the 2015 shooting death of 35-year-old Cristy Johnson, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury this afternoon convicted MICHAEL DeLEON (D.O.B. 4/23/79) of second-degree murder, armed assault with intent to murder, aggravated assault and battery, and unlawful possession of a firearm in connection with the Dec. 10, 2015, shooting that left Johnson dead and injured a then 38-year-old man.  Jurors acquitted DeLeon of murder in the death of 66-year-old Peter Pitari, who was also found fatally shot at the Waite Street apartment building on that date. more »

BOSTON, Oct. 30, 2017—An alleged drunk driver was arraigned today following his hospitalization for injuries he sustained crashing into two other cars, injuring three other people, in Charlestown last month, Suffolk County District Attorney Daniel F. Conley said.

JOHN McCARVILLE (D.O.B. 4/23/69) of Cambridge was arraigned in Charlestown District Court for operating under the influence of liquor as a second offense, causing serious injury while operating under the influence, negligent operation of a motor vehicle, and the civil infractions of possessing an open container of alcohol in a vehicle, failing to wear a seat belt, and speeding. The charges stem from a multi-vehicle crash in the early morning of Sept. 24. more »

Man Fatally Injured After Firing on Four Officers While Fleeing Earlier Shooting

BOSTON, Oct. 27, 2017—Suffolk County District Attorney Daniel F. Conley today released more than 700 pages of interview transcripts, investigative reports, and forensic testing results gathered during his investigation into the fatal shooting of 29-year-old Peter Fanfan, who had opened fire on Boston Police officers after committing an earlier double shooting during a home invasion.

The evidence gathered in the course of the investigation did not support charges against the officers who fired on Fanfan, killing him, near the intersection of Stanwood and Laredo streets last year. As he does with every fatal police shooting, Conley released the entire investigative file to the family of the deceased and the news media – including hundreds of photographs from the scene, recorded interviews with police personnel, 911 calls and dispatch transmissions, and video footage from private surveillance systems and public safety cameras.

“After shooting two men during an armed home invasion and then firing upon a responding Boston Police detective, Mr. Fanfan was shot and killed during an armed encounter with members of the Boston Police Department,” Conley wrote in an eight-page summary report. “The investigation establishes that Peter Fanfan used unprovoked deadly force by firing upon Detective [James] Coyne and Officers [Ellys] Lee, [Eric] MacPherson, and [Michael] Taylor, placing them in real and immediate danger of death or serious bodily injury …. Under the circumstances, the officers’ use of deadly force was a lawful and reasonable exercise of self-defense and defense of others.” more »

BOSTON, Oct. 25, 2017—The investigation into a drive-by shooting attempt earlier this month has led to charges against two men, Suffolk County District Attorney Daniel F. Conley said.

ERIC CORREIA (D.O.B. 1/13/98) was arraigned yesterday in Roxbury Municipal Court on charges of assault with a dangerous weapon, attempted assault and battery with a firearm, unlawful possession of a firearm, unlawful possession of ammunition, and carrying a loaded firearm.  The charges stem from a drive-by shooting on Harlow Street on Oct. 2.  Prosecutors requested that Correia’s bail be set in the amount of $200,000 and that he be ordered to submit to GPS monitoring, remain within Massachusetts, have no contact with the victim or witnesses, and stay away from the location of the incident if he posts that amount.  Judge David Poole set $30,000 bail and imposed the requested conditions of release.

Correia’s co-defendant, ARLINDO LOPES (D.O.B. 7/5/99), was arraigned Oct. 16 in the same court on identical charges.  Prosecutors requested bail of $100,000 and the same conditions in the event he is to be released on bail; Poole imposed $30,000 bail and all of the requested conditions of release.   more »

BOSTON, Oct. 13, 2017—State Police detectives are investigating the stabbing yesterday of a homeless man near Route 93 and Lincoln Street in Boston’s Chinatown.

State Police assigned to the Suffolk County District Attorney’s office, Crime Scene Services Section, and Tunnels Barracks responded to the area at about 7:45 pm for a report of a person stabbed. The 48-year-old victim was transported to Tufts Medical Center, where he told investigators that he was panhandling in the area when he became involved in an altercation with another man. In the course of that altercation, the assailant stabbed him twice. His injuries were not life-threatening. more »

Mother Speaks at Sentencing in Murder of 17-Year-Old Student 

BOSTON, October 10, 2017— Two men were sentenced to life in prison today for their roles in the murder of 17-year-old D’Andre King-Settles, an act the slain youth’s mother called “a senseless act of violence,” Suffolk County District Attorney Daniel F. Conley said.

ENRIQUE AUCH (D.O.B. 4/9/1997) and TSUNAMI ORTIZ (D.O.B. 12/21/1998) faced sentencing today after a Suffolk Superior Court jury last week found them guilty of second-degree murder and two counts of armed assault in the 2015 shooting that claimed King-Settles’ life.  The offense of second-degree murder carries a mandatory term of life in prison with the possibility of parole; a sentencing judge has discretion to set parole eligibility between 15 and 25 years.  Judge Mitchell Kaplan imposed a term of life in prison with the possibility of parole after 15 years for each defendant.  Assistant District Attorney Catherine Ham of the DA’s Homicide Unit had recommended that parole eligibility be set at the maximum term of 25 years. more »

BOSTON, October 6, 2017— Two men face life in prison after they were found guilty today in the murder of 17-year-old D’Andre King-Settles, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury this morning found ENRIQUE AUCH (D.O.B. 4/9/1997) and TSUNAMI ORTIZ (D.O.B. 12/21/1998) guilty of second-degree murder and two counts of armed assault in the 2015 shooting on Annunciation Road that killed King-Settles and wounded two others.  Auch and Ortiz had been indicted for first-degree murder.

Current Version of SHARE Act Would Eliminate Safeguards

BOSTON, Oct. 4, 2017—Suffolk County District Attorney Daniel F. Conley and 29 additional members of Prosecutors Against Gun Violence today announced their strong opposition to provisions in proposed legislation that would remove existing gun silencer safety regulations from federal law.

“The last thing we need is increased access to a tool that makes gun violence more deadly,” Conley said. “More silencers on the street will mean fewer 911 calls to report shots fired.  That means a less effective response by police and EMS and a greater risk that a shooting will become a homicide.  Easing the reasonable restrictions on silencers is a terrible idea for public safety, public health, and public policy.” more »

BOSTON, October 2, 2017— A woman was sentenced to prison last week for a series of thefts from school and hospital employees that began just weeks after she was released from prison for similar offenses, Suffolk County District Attorney Daniel F. Conley said.

During an appearance Friday in Suffolk Superior Court, LEILANI CHAMBERS-RAY (D.O.B. 3/3/73), formerly of Cambridge and most recently of Roxbury, pleaded guilty to 33 charges related to a string of thefts from 12 victims that spanned nearly seven months.  She admitted to eight counts of credit card over $250, 13 counts of credit card fraud under $250, five counts of larceny over $250, and seven counts of larceny under $250.

Judge William Sullivan sentenced Chambers-Ray to four to five years in state prison followed by three years of probation, during which time she must stay away from Massachusetts General Hospital and all schools, pay restitution, and undergo drug, alcohol and mental health evaluations and treatment.  more »

CHELSEA, Oct. 1, 2017–A Chelsea man who suffered gunshot wounds in an apparent drive-by shooting last week has succumbed to his injuries and his death is being investigated as a homicide, Chelsea Police Chief Brian Kyes and Suffolk District Attorney Daniel F. Conley said.

The 37-year-old man died of his injuries last night at Massachusetts General Hospital, where he was being treated. His name is being withheld until full family notifications are made. A second victim, a 19-year-old female, is recovering from injuries she sustained during the same incident on Congress Avenue near Shawmut Street.

BOSTON, Sept. 29, 2017—A third suspect in the June homicide of 19-year-old Javoni Boyd was identified in the course of a Suffolk County Grand Jury investigation and apprehended today following his Wednesday indictment, District Attorney Daniel F. Conley said.

BOSTON, September 26, 2017— A man was ordered held on high bail at his arraignment yesterday on charges he sexually assaulted two homeless women in Chelsea, Suffolk County District Attorney Daniel F. Conley said.

OSMAR FLORES (D.O.B. 1/3/94) was arraigned yesterday in Suffolk Superior Court on charges of aggravated rape, armed robbery, assault and battery with a dangerous weapon, and strangulation in connection with an assault that occurred in July, and charges of rape, assault and battery, and strangulation in connection with a 2015 case that was previously charged in Chelsea District Court.

Assistant District Attorney Myriam Feliz requested bail of $100,000 and requested that Flores be ordered to stay away and have no contact with the victims and submit to GPS monitoring and home confinement in the event he is to be released on bail.  Clerk Magistrate Edward Curley imposed $50,000 bail and the requested conditions of release. more »

BOSTON, Sept. 15, 2017—State Police Colonel Richard D. McKeon, Boston Police Commissioner William B. Evans, and Suffolk County District Attorney Daniel F. Conley said today that warrants charging a Dorchester man with the homicides of Scott M. Stevens, Jr., and Michaela Gingras have been lodged at the Suffolk County Jail, where he is currently held without bail in unrelated cases.

The warrants, obtained late last night, charge LANCE HOLLOMAN (D.O.B. 1/12/87) with murder, armed assault with intent to murder, and other offenses for allegedly shooting Stevens, 32, and a 54-year-old relative as they rode their motorcycles southbound on Route 93 near the Neponset Avenue exit at about 5:00 Sunday evening. Stevens, a resident of East Taunton, died of his injuries at Boston Medical Center on Wednesday; his relative is expected to survive.

The warrants also charge Holloman with murder for Gingras’ fatal shooting. The 24-year-old resident of Manchester, New Hampshire, was found with fatal gunshot injuries several hours later inside a residence on Santuit Street in Dorchester. She was pronounced dead at the scene late Sunday night. more »

BOSTON, Sept. 13, 2017—The younger of two men shot while riding their motorcycles on the Southeast Expressway this weekend has died of his injuries.

Scott M. Stevens, Jr., 32, of East Taunton died late yesterday afternoon at Boston Medical Center of gunshot injuries sustained Sunday afternoon as he and a family member rode southbound on Route 93 near the Neponset Avenue exit. The 54-year-old family member, who was also struck by gunfire, was transported to Tufts Medical Center and is expected to survive. more »

BOSTON, Sept. 8, 2017— An Arlington man was sentenced to prison today after his conviction for starting a fire near an alcove where two homeless men were sleeping, Suffolk County District Attorney Daniel F. Conley said.

At the conclusion of a jury-waived trial yesterday, Suffolk Superior Court Judge Peter Lauriat found MATTHEW CODY (D.O.B. 1/19/86) guilty of two counts of assault with a dangerous weapon but acquitted him of arson and attempted murder.  Prosecutors had indicted Cody for arson and attempted murder, as well; Lauriat acquitted Cody of those charges.

Lauriat today sentenced Cody to 18 to 20 months in state prison followed by three years of probation, during which time Cody must undergo a mental health evaluation and drug and alcohol treatment.  Assistant District Attorney David McGowan, the DA’s arson point prosecutor, had requested a term of up to three years in prison. more »

NAZEEB GONZALEZ (D.O.B. 10/17/79) was arraigned in Chelsea District Court on charges of manslaughter and armed assault with intent to murder for the incident at Broadway and Stockton Street just before 3:10 am. Assistant District Attorney Judith Lyons recommended that he be held on $750,000 cash bail; Judge Ina Howard-Hogan imposed $200,000 and ordered that Gonzalez wear a GPS monitor if he posts that amount. more »

BOSTON, Sept. 7, 2017—Suffolk County District Attorney Daniel F. Conley today released the file documenting his office’s investigation into the death of Antonio Corona-Razo, who suffered a fatal cardiac arrest after he broke into a Revere apartment building, twice attempted to jump through a third-story window, and then violently struggled with responding police officers, who attempted to subdue him first with empty hands and then with Tasers when he repeatedly punched and kicked them.

The Office of the Chief Medical Examiner on determined that Corona-Razo’s death was the result of “cardiac arrest in a person with acute cocaine intoxication, blunt force injuries and psychomotor agitation following an altercation with police involving the use of electronic control devices and physical restraints.” Conley determined that criminal charges were not warranted in connection with Corona-Razo’s death.

Conley provided the news media, Corona-Razo’s wife, and representatives of the Mexican and Peruvian consulates with copies of the investigative file, which includes 14 recorded interviews with police officers, firefighters, and emergency medical personnel; two transcribed interviews with civilian witnesses; more than seven hours of 911 calls and public safety dispatch transmissions; 83 photographs from the scene; and 110 pages of reports, memoranda, and Taser examination results. That wholesale release of investigative materials is standard under Conley’s policy of transparency in all police-involved fatalities in Suffolk County and is believed to be unparalleled across the country. more »

CHELSEA, Sept. 7, 2017—Chelsea Police detectives and State troopers assigned to the Suffolk County District Attorney’s office are investigating a fatal stabbing and non-fatal injuries to two other men on Broadway early this morning, Chelsea Police Chief Brian Kyes and Suffolk District Attorney Daniel F. Conley said.

Responding Chelsea officers found a 23-year-old Everett man in the area of Broadway and Stockton Street shortly before 3:10 this morning. He was rushed to CHA Everett Hospital, where he died of his injuries. A 34-year-old Chelsea man was also found injured at the scene. He was hospitalized with less serious injuries, as was a 37-year-old Revere man whom police found about a block away, also injured. more »

BOSTON, Sept. 6, 2017—A former tax preparer today admitted that he fraudulently obtained thousands of dollars in state income tax refunds for himself and others by filing false returns, District Attorney Daniel F. Conley said.

RAFAEL HUERTAS, Jr., (D.O.B. 2/27/85) of Lawrence pleaded guilty to six counts of presenting a false claim upon a public agency, six counts of delivering a fraudulent document, two counts of willfully assisting in preparation of a fraudulent return, and single counts of willful failure to file a tax return, identity fraud, and money laundering. The charges stem from actions Huertas undertook between 2011 and 2014, including a period between 2012 and 2013, when he worked for a tax preparation service in Lowell. Huertas was charged in Suffolk County because he filed the false claims with the Massachusetts Department of Revenue in Chelsea. more »

DAVONGIE STONE (D.O.B. 4/28/97) was arraigned today on charges of armed assault with intent to murder, armed robbery, and related offenses for the Sept. 3 incident near Downtown Crossing. Assistant District Attorney David McGowan of the DA’s Senior Trial Unit recommended that he be held on $1 million cash bail. Boston Municipal Court Judge Marc Hart Summerville imposed $500,000 and revoked Stone’s bail on an open shoplifting case out of Roxbury. more »

BOSTON, Sept. 5, 2017—An East Boston man was held without bail following his arraignment as a fugitive from murder charges out of New Jersey, Suffolk County District Attorney Daniel F. Conley said.

FRANCISCO CARLOS RAMIRES (D.O.B. 12/30/96), a.k.a. CARLOS CAMPOS, was arraigned in Brighton Municipal Court on a complaint charging him as a fugitive from justice in Perth Amboy, New Jersey. Assistant District Attorney Alyssa Tochka told the court that Ramires was also in default on a 2016 East Boston Municipal Court case charging him with malicious destruction of property. more »

BOSTON, Aug. 31, 2017—Suffolk County District Attorney Daniel F. Conley today released his entire investigative file on the Oct. 30, 2016, police-involved shooting death of Terrence Coleman inside a narrow South End foyer after he wielded a kitchen knife during an attack on emergency medical personnel and then on police officers who ran inside to aid them.

The file includes more than 200 photographs; over an hour and a half of dispatch transmissions, including an urgent call for help by one of the EMTs; a dozen recorded interviews, including a post-Miranda interview with the officer who discharged his firearm; and more than 400 pages of reports, transcripts, and forensic testing results documenting the exhaustive investigation overseen by Assistant District Attorney David Deakin, Senior Counsel to the District Attorney. Conley provided a copy of the file to Coleman’s family through their attorneys and additional copies to the news media. 

The evidence and the law do not support criminal charges against Officer Garrett Boyle, who discharged his service weapon only after Coleman attempted to stab and slash EMTs and as he attacked police officers using a kitchen knife with a five-inch, serrated blade inside the foyer of 245 Shawmut Ave. The EMTs were already under attack and in imminent, life-threatening danger when Boyle and his partner entered the premises. Under those circumstances, Conley said, the officer’s use of deadly force was a lawful exercise of self-defense and defense of others. more »

BOSTON, August 28, 2017— A Leominster man was arraigned today on charges he took part in the shooting of another man in Chelsea, Suffolk County District Attorney Daniel F. Conley said.

JUAN OLIVA (D.O.B. 9/13/89) of Leominster was arraigned today in Chelsea District Court on charges of armed assault in a dwelling, armed assault with intent to murder, discharging a firearm within 500 feet of a building, assault and battery, assault and battery with a dangerous weapon, unlawful possession of a firearm, unlawful possession of ammunition, and carrying a loaded firearm.  Prosecutors requested bail of $25,000 and orders that Oliva wear a GPS monitor, abide by a curfew, and stay away and have no contact with witnesses in the event he is to be released on bail.  Judge Matthew Nestor imposed bail of $5,000 and ordered Oliva to submit to GPS monitoring and stay away from the victim’s home and from the hospital where the victim is receiving treatment.  He was also ordered to stay away and have no contact with a second man sought in connection with the shooting. more »

BOSTON, Aug. 24, 2017—The man who allegedly shot and killed 28-year-old Michael Miranda was ordered held without bail at his murder arraignment today, Suffolk County District Attorney Daniel F. Conley said.

BOSTON, Aug. 22, 2017—A Hyde Park man was held without bail today following his arraignment for the shooting death of 29-year-old Jorrell Browne in Mattapan earlier this summer, Suffolk County District Attorney Daniel F. Conley said.

ANDRE HENDERSON (D.O.B. 11/19/82) was charged in Dorchester Municipal Court with murder and unlawful possession of a firearm for the June 26 shooting that claimed Browne’s life.

BOSTON, August 22, 2017— A Roxbury man was sentenced today to 20 years in prison after a jury last week convicted him of trying to murder three people when he opened fire on their car on a summer afternoon two years ago, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury on Thursday found FABIAN GONZALEZ (D.O.B. 4/9/91) guilty of aggravated assault and battery causing serious bodily injury, armed assault with intent to murder, unlawful possession of a firearm, carrying a loaded firearm, discharging a firearm within 500 feet of a building, and two counts of assault and battery with a dangerous weapon for the 2015 triple shooting that left a young man with permanently debilitating injuries and wounded two women.

During a sentencing hearing today, Judge Peter Lauriat imposed a term of 15 to 20 years in state prison. Assistant District Attorney Catherine Ham, who prosecuted the case at trial, recommended 18 to 20 years. more »

BOSTON, Aug. 21, 2017—A former police officer was sentenced today for beating a woman during an arrest and then lying in subsequent reports on the incident, Suffolk County District Attorney Daniel F. Conley said.

Suffolk Superior Court Judge Douglas Wilkins last month convicted JENNIFER GARVEY (D.O.B. 9/28/82) of two counts each of assault and battery with a dangerous weapon and filing a false report as a public employee. Suffolk prosecutors had indicted Garvey on felony charges of assault and battery with a dangerous weapon – a police baton – and causing injury while violating a person’s civil rights; Wilkins acquitted her on those charges.

“This defendant not only escalated the situation and used force far beyond what was necessary,” Conley said. “She also hijacked the criminal justice system by pursuing charges against the victim that she knew were unfounded. She injured the victim, she lied to the community, and she did a disservice to every officer who approaches the job with integrity.” more »

BOSTON, August 15, 2017— A Boston man and a 17-year-old from Malden were each arraigned today in connection with separate incidents of vandalism at the New England Holocaust Memorial, Suffolk County District Attorney Daniel F. Conley said.

A 17-year-old male from Malden was arraigned today in Boston Juvenile Court on charges of disorderly conduct malicious destruction of property over $250, and causing injury over $5,000 to a church, synagogue or memorial. After the juvenile walked in to court today, Judge Terry Craven released him on his own recognizance with orders to stay away from the memorial and comply with mental health treatment.

SAID BOUZIT (D.O.B. 3/29/80), who provided the address of a Boston mental health facility as his residence, was arraigned this afternoon in Boston Municipal Court on charges of vandalizing a grave planting and disorderly conduct. Judge Thomas Horgan set bail in the amount of $5,000 and revoked Bouzit’s open bail in a pending case charging assault and battery on a corrections officer.   more »

BOSTON, August 14, 2017—Revere Police Chief James Guido and Suffolk County District Attorney Daniel F. Conley announced that three men were held on high bail today after Revere Police responding to a 911 call yesterday discovered a cache of weapons that included a machine gun.

ROGELIO ALVARADO (D.O.B. 914/94), most recently of Huntington, New York, was arraigned today in Suffolk Superior Court on charges of assault with intent to murder, unlawful possession of a firearm, carrying a loaded firearm, and two counts of assault and battery by discharge of a firearm.  Assistant District Attorney Stacey Pichardo of the DA’s Gang Unit requested bail of $1 million bail; Alvarado was ordered held in lieu of $500,000 bail and ordered to stay away from all victims and witnesses and wear a GPS monitor in the event he posts that amount. more »

BOSTON, Aug. 8, 2017—Suffolk County District Attorney Daniel F. Conley’s office today agreed to vacate the 1981 conviction of FREDERICK CLAY for the first-degree murder of Jeffrey Boyajian and immediately filed additional paperwork ending any further prosecution in the 28-year-old cab driver’s murder in Roslindale.

“Upon review of the evidence, including that advanced by the defendant in his motion and that gathered by the Commonwealth after receiving the motion, and after extensive investigation and scrutiny by this office’s Conviction Integrity Program, the Commonwealth has concluded that the interests of justice would not be served by the prosecution of this case,” Conley’s office wrote in the nolle prosequi, filed at a hearing on a defense motion for new trial to which prosecutors assented. more »

BOSTON, August 7, 2017— An Attleboro man charged with drugged and drunk driving when he struck a child on a crosswalk is held pending a dangerousness hearing, Suffolk County District Attorney Daniel F. Conley said.

RICHARD M. HIGGINS (D.O.B. 1/21/39) of Attleboro was arraigned today in South Boston Municipal Court on charges of operating under the influence of liquor as a fifth offense, operating under the influence of drugs, operating a motor vehicle after suspension for operating under the influence, operating under the influence after suspension for operating under the influence, leaving the scene of personal injury, leaving the scene of property damage, negligent operation, and speeding.  According to prosecutors, Higgins was previously convicted of operating under the influence of alcohol in 1962, 1996, 1998, and 2007.

At the request of Assistant District Attorney Franklin Kanin, Judge Michael Bolden ordered Higgins held pending the outcome of a dangerousness hearing on Thursday to determine whether there is “clear and convincing evidence that no conditions of release will reasonably assure the safety of any other person or the community.” more »

BOSTON, Aug. 7, 2017—A former patient at Arbour Hospital in Jamaica Plain was arraigned on a murder charge today following his indictment for the physical assault that claimed the life of his roommate, 51-year-old John Duggie, two years ago, Suffolk County District Attorney Daniel F. Conley said.

HAMEEN EDWARDS (D.O.B. 2/29/76) of Boston was arraigned on an indictment returned Friday charging him with second-degree murder for the July 2, 2015, assault that led to Duggie’s death a month later. BOSTON, August 4, 2017— Two South Boston brothers were arraigned yesterday on gun and drug charges stemming from search warrants on their East 4^th Street home, Suffolk County District Attorney Daniel F. Conley said.

JOHN GEORGE (D.O.B. 6/21/78) and KENNETH GEORGE (D.O.B. 11/12/74) were arraigned yesterday in South Boston Municipal Court on charges following the execution of a search warrant at their separate apartments inside a three-family home. 

John George was arraigned on two counts of unlawful possession of a firearm and single counts of possession with intent to distribution a Class B drug, possession with intent to distribution a Class C drug, trafficking in heroin, possession of a firearm with a defaced serial number, reckless endangerment of a child. He was additionally charged as a Level II Armed Career Criminal in light of prior convictions for manslaughter, armed assault with intent to rob, and other offenses, prosecutors said.  Judge Michael Bolden imposed $500,000 bail and ordered George to submit to GPS monitoring, remain under house arrest, and surrender his passport in the event he is to be released on bail.

Kenneth George was arraigned on charges of possession with intent to distribution a Class B drug, possession with intent to distribution a Class E drug, and operating a motor vehicle with a suspend license.  Bolden imposed $50,000 bail and the same conditions of release. more »

ELVIS LEDESMA (D.O.B. 9/23/83) of Roxbury, CARLOS NIVAR (D.O.B. 8/6/95) of Dorchester, CARLOS ADEMAN-MEJIA (D.O.B. 10/16/96) of Hyde Park, and EUDOMAR AYBAR (D.O.B. 5/6/93) of East Boston were each arraigned yesterday in Dorchester Municipal Court on charges of trafficking in fentanyl and conspiracy to violate the state’s drug laws.  Prosecutors requested bail of $200,000 for each defendant, as well as conditions that each wear a GPS monitor in the event they are to be released.  Judge Jonathan Tynes imposed $75,000 bail and ordered each to be fitted with a GPS monitor and surrender his passport. more »

BOSTON, July 31, 2017— A Dorchester man was held on high bail at his arraignment today in connection with a stabbing in the Boston Common, Suffolk County District Attorney Daniel F. Conley said.

VICTOR CARRASQUILLO (DOB 8/30/98) was arraigned today in Boston Municipal Court on a charge armed assault with intent to murder in connection with the July 26 stabbing of another man inside the Boston Common.  Assistant District Attorney Anthony Rizzo requested that Carrasquillo’s bail be set in the amount of $75,000 and that he be ordered to be fitted with a GPS monitor and stay away from the victim, the Boston Common, and the Public Garden in the event he is released on bail.  Prosecutors also moved to revoke Carrasquillo’s bail on an open 2016 case out of Dorchester Municipal Court charging possession with intent to distribute a Class D drug and an open 2017 case out of Quincy District Court charging breaking and entering.  Judge Thomas Horgan set $50,000 bail, imposed the requested conditions of release, and revoked Carrasquillo’s open bail for a period of 90 days. more »

BOSTON, July 13, 2017— A Watertown woman was found guilty yesterday of driving drunk when she caused the crash that left her passenger with permanent injuries, Suffolk County District Attorney Daniel F. Conley said.

A Brighton Municipal Court jury yesterday found ROZA GRIGORYAN (D.O.B. 12/20/93) guilty of operating under the influence of alcohol in connection with the 2015 crash on Storrow Drive. BOSTON, July 13, 2017—A year and a half after 22-year-old Marquis Waithe was shot and killed on Brookledge Street, the alleged gunman and a co-defendant accused of assisting him have been indicted for his homicide, Suffolk County District Attorney Daniel F. Conley said.

The Suffolk County Grand Jury yesterday returned indictments charging JONATHAN AGUASVIVAS, 24, and CALVIN BOYKINS, 25, with first-degree murder, unlawful possession of a firearm, and three counts of assault with a dangerous weapon in Waithe’s Feb. 4, 2016, shooting death. BOSTON, July 13, 2017—The second of two men identified in the 2016 homicide of Carlos Villatoro-Nunez has been apprehended in Texas and is expected to return to Massachusetts tomorrow to face arraignment on a murder charge, Suffolk County District Attorney Daniel F. Conley said.

JORGE MELGAR FUENTES (D.O.B. 2/28/98) was arrested on June 7 by Homeland Security Investigations agents in Houston and later held on a June 30 East Boston Municipal Court murder warrant. RACHELLE DEE BOND (D.O.B. 7/25/75) pleaded guilty on Feb. 10 to the indicted charges of being an accessory after the fact to murder and larceny over $250 by false pretense. CESAR LARA AGUASVIVAS (D.O.B. 2/25/94) was arraigned today in West Roxbury Municipal Court on charges of home invasion, kidnapping while armed with a firearm, assault and battery with a dangerous weapon, and malicious destruction of property over $250.  Judge Jim Stanton granted a request by prosecutors to revoke Aguasvivas’ bail on an open case charging larceny from a building and imposed $1 million cash bail on the home invasion. BOSTON, July 3, 2017—A former police officer was convicted today of beating a woman during an arrest and then lying in subsequent reports on the incident, Suffolk County District Attorney Daniel F. Conley said.

Following a seven-day trial in which the defendant waived her right to a jury, Suffolk Superior Court Judge Douglas Wilkins convicted former MBTA Transit Police Officer JENNIFER GARVEY (D.O.B. 9/28/82) of two counts of assault and battery — one as indicted and the other as a reduction from the indicted charge of assault and battery with a dangerous weapon — as well as two counts of filing a false report as a public employee. Wilkins acquitted Garvey of injuring the woman while violating her civil rights.

BOSTON, June 29, 2017—The Suffolk County Grand Jury has returned indictments charging a Chelsea man with two counts of murder and other offenses in the stabbing deaths last month of Richard Field and Lina Bolanos, District Attorney Daniel F. Conley said.

BOSTON, June 28, 2017—The man who murdered 2-year-old Bella Bond was sentenced to life in prison today, with a judge ordering that he spend at least two decades behind bars before he is eligible for parole, Suffolk County District Attorney Daniel F. Conley said.

MICHAEL PATRICK McCARTHY (D.O.B. 5/29/80) was convicted Monday of second-degree murder for killing the girl in June of 2015 in the Maxwell Street apartment he shared with Bella and her mother, RACHELLE DEE BOND (D.O.B. 7/25/75). Evidence and testimony introduced during the three-week trial established that he caused the child’s death and placed her body in a trash bag, which he then placed in a duffle bag he weighted down and dumped into Boston Harbor. BOSTON, June 28, 2017—A Roxbury man was arraigned today on charges he vandalized the New England Holocaust Memorial in downtown Boston following an argument early this morning, Suffolk County District Attorney Daniel F. Conley said.

JAMES E. ISAAC (D.O.B. 12/30/95) was arraigned today in Boston Municipal Court on charges of malicious destruction of property over $250 and willful damage to a church, synagogue, or memorial.  Assistant District Attorney Anthony Rizzo requested that Isaac’s bail be set at $15,000 and that his bail be revoked in an unrelated assault and battery case currently pending in Chelsea District Court.  Judge Sally Kelly imposed $750 bail and revoked Isaac’s open bail. more »

BOSTON, June 26, 2017—A Roxbury man was held without bail today following his arraignment on a murder charge in the June 13 shooting death of 19-year-old Javoni Boyd on Delhi Street, Suffolk County District Attorney Daniel F. Conley said.

At the request of Assistant District Attorney Craig Iannini, Dorchester Municipal Court Judge Serge Georges ordered JAKYRES McKINNEY (D.O.B. 11/22/91) held without bail.

Based on evidence developed in the ongoing investigation into Boyd’s fatal shooting, including forensic and ballistics evidence linking McKinney to the homicide, investigators obtained a warrant for McKinney’s death last week. Conviction Comes Two Years after Discovery of “Baby Doe” on Deer Island

BOSTON, June 26, 2017— District Attorney Dan Conley today distributed more than $65,000 to non-profits dedicated to keeping Suffolk County youth away from drugs, violence, and negative choices.

During a ceremony held at his downtown office this morning, 11 non-profits received grant funds from Conley’s Asset Forfeiture Community Reinvestment Grant program.  The program draws from cash and assets seized during drug trafficking investigations to support organizations that work with young people across Suffolk County.  This year’s awards totaled $65,150, with individual grants ranging from $3,000 to $7,500. more »

Gunman Admits Guilt in Shooting Death of Beloved Family Man

BOSTON, June 21, 2017— The Dorchester man who as a teenager killed 71-year-old Geraldo Serrano was sentenced to prison today after admitting to fatally shooting the elderly store clerk during a convenience store robbery seven years ago, Suffolk County District Attorney Daniel F. Conley said.

ONYX WHITE (D.O.B. 10/6/93) today pleaded guilty to manslaughter and armed robbery in connection with the Feb. 21, 2010, shooting that claimed Serrano’s life.  Judge Edward Leibensperger sentenced White to a term of 14 to 18 years in state prison, to be followed by five years of probation. more »

BOSTON, June 21, 2017— A man was arraigned yesterday for allegedly violating the civil rights of a fellow passenger, falsely claiming she had a bomb, and breaking a window during a tirade on an Orange Line train, Suffolk County District Attorney Daniel F. Conley said.

SEAN P. DEVLIN (D.O.B. 4/1/83), who lists an address in North Reading as well as a Boston substance-abuse treatment facility, was arraigned yesterday in Boston Municipal Court on charges of violating a person’s civil rights, making a false bomb threat, and malicious destruction of property over $250.  Assistant District Attorney David Wittenberg requested bail of $50,000, an order protecting the victim’s personal information with him, and orders that Devlin stay away from the victim, witnesses, and all MBTA conveyances in the event he is released on bail.  Judge Tracy-Lee Lyons imposed bail of $10,000 and granted all of Wittenberg’s requested orders. more »

BOSTON, June 19, 2017—Three New Hampshire teens were arraigned today in the Suffolk County Juvenile Court on charges that they beat a street performer during an assault that’s also being reviewed for potential hate crimes charges, Suffolk County District Attorney Daniel F. Conley said.

A 15-YEAR-OLD MALE from Londonderry, a 16-YEAR-OLD MALE from Salem, and a 17-YEAR-OLD MALE from Manchester were arraigned on charges of delinquency, to wit: assault and battery and disorderly conduct. The 16-year-old was also charged with possession of alcohol by a minor. The Saturday afternoon incident is also being investigated by the Boston Police Civil Rights Unit and Conley’s hate crimes point prosecutor for potential civil rights violations. more »

BOSTON, June 19, 2017— Two Dorchester men face sentencing next week after separate juries convicted each of sexual offenses against children, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury convicted UMAR MUHAMMED a.k.a. PHILLIP DURANT (D.O.B. 11/20/52) of two counts each of statutory rape of a child and dissemination of matter harmful to minors and single counts of indecent assault and battery on a child under 14 and open and gross lewdness for offenses committed against two children who were known to him.  After the guilty verdicts were read on June 9, Judge Edward Leibensperger ordered Muhammed taken into custody to await sentencing next week.

Also convicted in Suffolk Superior Court was JORGE PENA (D.O.B. 10/8/74), whom a separate jury on Friday found guilty of two counts each of aggravated statutory rape of a child and indecent assault and battery on a child under 14.  At his sentencing next week, he faces at least 10 years in prison – the mandatory minimum term on the offense of aggravated rape of a child. more »

BOSTON, June 14, 2017— A Chelsea man will continue to be held without bail in the beating death of 32-year-old Melvin Cortes earlier this year, Suffolk County District Attorney Daniel F. Conley said.

KAMAYA FARIKAFI (D.O.B. 12/7/93) was arraigned today in Suffolk Superior Court on a charge of second-degree murder in connection with the Feb. 5 assault in Chelsea that claimed Cortes’ life nearly a week later.  At the request of Assistant District Attorney Lynn Feigenbaum of the DA’s Senior Trial Team, Clerk Magistrate Lisa Medeiros ordered Farikafi held without bail.  Farikafi has remained in custody since his Feb. 23 arraignment in Chelsea District Court.  more »

BOSTON, June 7, 2017—A change in the law governing the use of certain cell phone records at trial will not benefit the man convicted of murdering George “Jeffrey” Thompson in 2010 because investigators assigned to his homicide provided affidavits containing detailed information that met the new, higher threshold – even though it would not be required in Massachusetts courts for four years, Suffolk County District Attorney Daniel F. Conley said.

Suffolk Superior Court Judge Beverly Cannone denied a motion by OMAY TAVARES for a new trial in Thompson’s shooting death, for which he was convicted of first-degree murder. Tavares had argued that the cell site location information introduced at his trial was obtained improperly in light of the Supreme Judicial Court’s 2014 decision in Commonwealth v. Shabazz Augustine I, but Cannone rejected that claim and found that investigators’ affidavits for court orders under the prevailing law at the time were sufficiently detailed that they would have supported search warrants as the high court would years later require. more »

BOSTON, June 7, 2017— Moments before her jury trial was set to begin, a Dorchester woman pleaded guilty in the stabbing death of her boyfriend, 28-year-old Anthony Sinclair, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury had been seated and was slated to hear opening arguments this morning in the trial of VALERIE CIRILO-PEREZ (D.O.B. 11/18/90) on a second-degree murder charge. Rather than have a jury determine her fate, however, Cirilo-Perez instead chose to plead guilty and admitted to manslaughter in Sinclair’s 2015 stabbing death.  At the recommendation of Assistant District Attorney David Bradley of the DA’s Homicide Unit, Judge Kenneth Fishman sentenced Cirilo-Perez to nine to 14 years in state prison. more »

Three Get Life in 2013 Murder; Fourth Defendant to Face Judge Later

BOSTON, May 30, 2017— Three men convicted of murdering 25-year-old Romeo McCubbin were sentenced to life in prison today, while the fourth man found guilty in the 2013 homicide faces the same sentence at a later date, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury on Thursday convicted OMAR BONNER (D.O.B. 8/2/87) of Hyde Park, OMAR DENTON (D.O.B. 5/9/84) of Milton, ANDREW ROBERTSON (D.O.B. 06/09/1976) of Hyde Park, and a fourth man, JAVAINE WATSON (D.O.B. 10/11/90) of Dorchester, of first-degree murder in connection with McCubbin’s 2013 shooting death.  The jury also convicted Robertson of unlawful possession of a firearm.  The case was previously tried in 2016, at which time a separate jury convicted Bonner of unlawful possession of a firearm and resisting arrest and Denton of unlawful possession of a firearm but was unable to come to a unanimous decision on the remaining charges, resulting in a mistrial on those charges.  Bonner, Denton, and Robertson faced sentencing today on convictions stemming from both the 2016 trial and this month’s retrial; Watson will be sentenced at a later date.

Judge Linda Giles sentenced Bonner, Denton, and Robertson to life in prison without the possibility of parole – the mandatory term for first-degree murder – and concurrent terms of four to five years in prison for unlawful possession of a firearm.  She also sentenced Bonner to a concurrent term of two years in the house of correction for resisting arrest. more »

BOSTON, May 25, 2017— A Boston massage therapist was arraigned today on charges he assaulted a female client of a Logan Airport massage studio, Suffolk County District Attorney Daniel F. Conley said today. 

DARNELL E. WILLIAMS, 29, was arraigned this afternoon in East Boston Municipal Court on a charge of rape in connection with the May 22 assault.  Assistant District Attorney Caroline Humphrey requested bail of $15,000; a judge imposed $5,000 bail after Williams walked into court on his own accord.  In the even he posts that amount, Williams is ordered to wear a GPS monitor, remain on home confinement, stay away and have no contact with the victim, report the allegations against him to the state licensing board, surrender his massage license, and not work as a massage therapist while the case against him is pending. more »

Prosecutors Had Sought Revocation

BOSTON, May 24, 2017— The New Hampshire man currently charged with stealing more than $350,000 from romantic partners and others today saw his bail increased after prosecutors presented evidence that he had committed new, similar offenses in other jurisdictions, Suffolk County District Attorney Daniel F. Conley said.

MICHAEL J. SHIELDS Jr. (D.O.B. 4/20/91) of New Hampshire is currently facing a 45-count indictment charging 21 counts of credit card fraud, 17 counts of use of a stolen or fraudulently obtained credit card, one count of larceny over $250, and two counts each of larceny over $250 by single scheme, attempting to commit larceny over $250, and intimidation of a witness.  He has been free on $7,500 bail that was posted after his October 19, 2016 arraignment in Suffolk Superior Court.  The case returned to court today as prosecutors argued that Shields violated the conditions of his release. more »

DEONARINE GANGA (D.O.B. 7/12/87) of Dorchester was arraigned today in Dorchester Municipal Court in connection with DeBarros’ April 13 murder.  At the request of Assistant District Attorney John Verner, Judge Richard Sinnott ordered Ganga held without bail.  Ganga is already held on $50,000 bail after his April 18 arraignment in an unrelated incident in which he threatened an individual with a firearm. more »

BOSTON, May 16, 2017— A Milton man was arraigned today on charges he was drunk when he pointed a gun at a stranger in Allston, Suffolk County District Attorney Daniel F. Conley said.

ANDREW REGAN (D.O.B. 1/6/76) was arraigned today in Brighton Municipal Court on charges of carrying a firearm while intoxicated and assault with a dangerous weapon.  Assistant District Attorney Alyssa Tochka requested bail of $5,000.  Judge David Donnelly imposed $1,000 bail and ordered Regan to stay out of Allston and Brighton, stay away and have no contact with witnesses in the case, remain drug and alcohol free subject to random screening, and refrain from seeking reinstatement of his firearm license while the case is pending. more »

BOSTON, May 11, 2017—Suffolk County District Attorney Daniel F. Conley today met with the family of 7-year-old Kyzr Willis and their attorney to inform them that he found no evidence of foul play in the boy’s drowning death in the water near the Curley Community Center in South Boston last year.

The investigation had neared completion late last year but was extended after Willis’ family informed prosecutors of a tipster who claimed to have seen the boy with an unknown adult male in the waters across the harbor. After a review of her statements, prosecutors do not believe the child she saw was Kyzr.

The investigation, which included analysis of interviews conducted by Boston Police homicide detectives and follow-up interviews by District C-6 detectives and Suffolk prosecutors, did not yield evidence that any person deliberately or recklessly caused the child’s death. Prosecutors’ findings are consistent with those of the Office of the Chief Medical Examiner, which last year ruled his death an accidental drowning. more »

BOSTON, May 5, 2017—The convictions of two men for the gruesome 2011 murders of Billie Kee and Kevin Thomas, Jr., in their Hyde Park Avenue apartment were affirmed today by the state’s highest court, Suffolk County District Attorney Daniel F. Conley said.

MICHAEL CORBIN (D.O.B. 11/10/70) and EARL FULGIAM (D.O.B. 4/14/80), both of Mattapan, were convicted after a nine-day trial of two counts of first-degree murder under all three theories of murder – deliberate premeditation, extreme atrocity or cruelty, and felony murder – as well as armed robbery and various firearm offenses. They were sentenced to two consecutive life terms each after evidence established that they bound the victims in the course of a July 27, 2011, armed robbery, then repeatedly stabbed and shot them to death. more »

BOSTON, May 4, 2017— A Dorchester pastor was held on high bail yesterday after investigators recovered a large cache of powerful narcotics in his Quincy Street church, Suffolk County District Attorney Daniel F. Conley said.

WILLIE WILKERSON (DOB 8/27/58) of Dorchester was arraigned yesterday in Roxbury Municipal Court on charges of trafficking cocaine, trafficking a Class B substance, trafficking fentanyl, possession with intent to distribute a Class C substance, and possession with intent to distribute a Class B substance.  Assistant District Attorney Kristen Sullivan recommended $75,000 cash bail; Judge Debra DelVecchio set bail at $50,000 and ordered Wilkerson to wear a GPS monitor and remain within Massachusetts in the event he posts that amount.  At Sullivan’s request, DelVecchio additionally revoked Wilkerson’s open bail on a case out of the same court charging larceny over $250.  more »

“For too long, Massachusetts has been among a small handful of states that hasn’t updated its wiretap laws to reflect advances in telecommunications or the evolution of crime trends.  The statute on the books today was written almost 50 years ago, with rotary phones and La Cosa Nostra in mind. Communications technology and the landscape of criminal activity have changed since then, but the law has not.

“As the Chief Justice of our SJC noted six years ago, the wiretap statute’s efficacy is sharply limited by language that binds its use to cases involving organized crime.  This makes it available to tackle high-level drug trafficking networks, but not the loosely-knit street gangs responsible for the vast majority of homicides in Boston and across the Commonwealth.  As a result, it’s easier to get a wiretap for a drug dealer’s phone than it is for a murder suspect’s, and that just doesn’t make sense. more »

Conley today released hundreds of pages of interviews, reports, and other materials related to his independent investigation into the fatal shooting of Santos Laboy during an armed encounter with police on a narrow footbridge above Storrow Drive.

During a meeting this afternoon to discuss his findings that the shooting did not warrant criminal charges, Conley provided Mr. Laboy’s family with documentation including 273 pages of interviews with 11 civilian witnesses and nine police witnesses, 111 pages of documentary reports, more than 450 digital photo files, almost 50 minutes of dispatch recordings, multiple video clips, and additional materials gathered by Chief Trial Counsel John Pappas, who oversaw the investigation. more »

BOSTON, April 25, 2017— A Level 3 sex offender previously charged with breaking into a South End apartment and assaulting two women inside was arraigned today on new indictments charging him with an earlier series of break-ins, Suffolk County District Attorney Daniel F. Conley said.

RONALD BROWN (D.O.B. 3/20/64), who lists the Pine Street Inn as his primary residence, was arraigned today in Suffolk Superior Court on five counts each of larceny over $250 and receiving stolen property over $250, three counts each of secretly photographing a person in the nude and breaking and entering in the daytime with intent to commit a felony, two counts of breaking and entering in the nighttime with intent to commit a felony, and a single count of breaking and entering with intent to commit a misdemeanor.  He was ordered held on $200,000 bail. more »

Murder Warrant Lodged at Suffolk County Jail

BOSTON, April 20, 2017—Boston Police Commissioner William B. Evans and Suffolk County District Attorney Daniel F. Conley today announced murder charges against the Dorchester man accused of shooting Joey DeBarros to death last week.

Acting amid a Suffolk County Grand Jury investigation, Boston Police homicide detectives yesterday lodged a murder warrant charging DEONARINE GANGA (D.O.B. 7/12/87) of Dorchester at the Suffolk County Jail, where he is currently held on $50,000 cash bail following his Tuesday arraignment for assault with a dangerous weapon. In addition to the cash bail imposed on that case, in which he allegedly wielded a firearm to threaten another person, he is being held without bail pending a hearing to determine whether he violated the conditions of probation on a 2015 plea to possession of a Class B substance with intent to distribute. more »

BOSTON, April 18, 2017—The man accused of doctoring a court clerk’s copy of the verdict slip in his earlier larceny conviction pleaded guilty to forgery and other charges today, accepting at least a year behind bars rather than face trial, Suffolk County District Attorney Daniel F. Conley said.

DAVID SCHER (D.O.B. 11/22/82) of Brighton admitted to single counts of forgery and tampering with a court document, as well as two counts of perjury and three counts of uttering a false document, all in connection with his actions in the aftermath of his 2014 conviction at a jury trial in the Boston Municipal Court. more »

DA Conley to Focus Resources Only On Most Serious Cases, Defendants

BOSTON, April 18, 2017—Suffolk County District Attorney Daniel F. Conley today notified the Supreme Judicial Court that he will focus his office’s resources on approximately 1.5% of the total number of drug convictions in which former Department of Public Health chemist Annie Dookhan signed a certificate of analysis.

“The 117 defendants identified in these cases account for more than 1,700 convictions for violent crimes or weapons violations, and have amassed more than 2,800 convictions in total,” Conley said of his response to the high court’s January decision in Bridgeman v. District Attorney II.  “The average defendant has more than 60 entries on his record. When given the opportunity for rehabilitation in a community setting, these defendants have violated probation an average of seven times each.  They are neither low-level nor non-violent, and they stand at the intersection of drugs and violence.”

Conley further identified 15,570 viable drug convictions across about 7,500 Suffolk County dockets for the Trial Court to dismiss pursuant to the Bridgeman II decision.  Many of the defendants in those cases have significant criminal histories, including crimes of violence, separate from the Dookhan-related drug convictions.  Prosecutors noted that each of these convictions was based on reliable, admissible evidence that went far beyond Dookhan’s signature on a certificate of analysis.  In many of them, the drug charges were collateral to more serious convictions involving guns and violence that will remain in place.  In all of them, there were corroborating facts and evidence such as packaging materials, cutting agents, scales, ledgers, phone records, video footage, field testing results, the observations of police officers, and the statements of independent witnesses. more »

BOSTON, April 14, 2017— A Suffolk Superior Court jury this afternoon acquitted AARON HERNANDEZ (D.O.B. 11/6/89) of the 2012 shooting that claimed the lives of Daniel de Abreu and Safiro Furtado but convicted him of unlawful possession of a firearm on the night of the murders, Suffolk County District Attorney Daniel F. Conley said.

Jurors in the trial of today convicted the defendant on a charge of unlawful possession of a firearm but finding him not guilty on two counts of first-degree murder, three counts of armed assault with intent to murder, and single counts of assault and battery with a dangerous weapon, and witness intimidation. After the verdicts were returned, Suffolk Superior Court Judge Jeffrey Locke sentenced Hernandez to four to five years in state prison, to be served from and after the sentence he is currently serving of life in prison without the possibility of parole. more »

BOSTON, April 13, 2017—A West End man pleaded guilty today to his role in a 2015 boating mishap that left a young woman with severe injuries including the traumatic amputation of her right arm, Suffolk County District Attorney Daniel F. Conley said.

ALEXANDER WILLIAMS (D.O.B. 7/30/90) admitted to negligent operation of a boat, furnishing alcohol to minors, and tampering with evidence. Suffolk prosecutors recommended guilty findings on all counts, a 2½-year suspended sentence, five years of probation, and $5,000 in restitution for medical costs not covered by insurance or other compensation.

Suffolk Superior Court Linda Giles did not find Williams guilty but rather continued his case without a finding for a two-year probationary term. During that period, Giles ordered, Williams must make $5,000 restitution, complete a certified drug and alcohol awareness program, and perform 200 hours of community service at the Spaulding Rehabilitation Center or similar facility. Giles further said that she would retain jurisdiction over Williams’ case in the event that he violates any condition of her orders. more »

BOSTON, April 12, 2017— Relatives recalled Tasfa Wallace as a family man who loved his siblings as the brother who murdered him 17 years ago was sentenced to life in prison, Suffolk County District Attorney Daniel F. Conley said.

TIMI WALLACE (D.O.B. 7/22/72) faced sentencing this morning after a Suffolk Superior Court jury yesterday found him guilty of second-degree murder in his brother’s 2000 slaying.  Judge Linda Giles sentenced Wallace to life in prison with the possibility of parole after 15 years, but ordered that the sentence only begin once Wallace has completed the 25-year federal prison sentence he is currently serving on an armed robbery conviction.  He is scheduled to complete his federal incarceration on Dec. 14, 2025. more »

BOSTON, April 11, 2017—A man convicted of murder today in the shooting death of his brother, Tasfa Wallace, 17 years ago faces life in prison at his sentencing tomorrow, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury today convicted TIMI WALLACE (D.O.B. 7/22/72) of second-degree murder in connection with his brother’s March 26, 2000, shooting death on Levant Street.  He had been indicted on a charge of first-degree murder.  Judge Linda Giles is expected to impose the mandatory term of life in prison with the possibility of parole when Wallace is sentenced tomorrow morning. more »

BOSTON, April 7, 2017—Two men were held on high bail at their arraignments this week after their arrests during the course of a human trafficking investigation, Suffolk County District Attorney Daniel F. Conley said.

JOSE MARTINEZ (D.O.B. 4/9/91) of Dorchester was arraigned yesterday in Dorchester Municipal Court on charges of human trafficking, kidnapping, and threats.  Assistant District Attorney Brian LeBlanc requested that Martinez be held on bail of $75,000 and be ordered to wear a GPS monitor, abide by a curfew, and stay away and have not contact with the victim in the event he is to be released on bail.  Judge Thomas Kaplanes set bail in the amount of $25,000 and granted the requested conditions of release.  Martinez’ bail was revoked in an open case out of Newton District Court charging him with receiving a stolen motor vehicle, and he was held without bail pending a hearing regarding his open probation for three separate convictions in Boston Municipal Court for distribution of a Class B substance.

RASHID PARHAM (D.O.B. 8/28/98) of Roslindale was arraigned in the same court on charges of unlawful possession of a firearm, unlawful possession of ammunition, and carrying a loaded firearm; he was additionally charged as a Level I armed career criminal.  According to prosecutors, Parham was indicted as a youthful offender and convicted in 2015 in the Juvenile Division of West Roxbury Municipal Court of armed assault with intent to murder and aggravated assault and battery, for which he is currently serving a suspended sentence.    Although he was a juvenile at the time of this earlier offense, his indictment as a youthful offender opened the case to the public and exposed Parham to the full range of juvenile and adult consequences.

At the request of prosecutors, Kaplanes set Parham bail at $25,000 and ordered that he submit to GPS monitoring, abide by a curfew, and stay away from Martinez.  He was also held without bail pending a probation hearing in West Roxbury Municipal Court. more »

BOSTON, March 29, 2017— As part of his duties as the only service animal assigned to a Massachusetts prosecutor’s office, District Attorney Dan Conley’s facility dog Indy visited with Cub Scouts in West Roxbury yesterday.

Cub Scouts from Pack 3 at Holy Name Parish earned their Service Dog merit badges with the help of Indy and his handler, Kara Hayes, Conley’s Chief of Community Engagement.  Hayes spoke to the scouts about Indy’s role at the office helping comfort children and adults as they give interviews, prepare for court appearances, or support their loved ones who might be doing the same.  The kids were also treated to a demonstration of Indy’s commands and learned about the extensive and specialized training he and other service dogs receive. more »

BOSTON, March 28, 2017— A repeat drug offender was held on high bail at his arraignment yesterday after he was found with a loaded gun and trafficking weight cocaine immediately after shots were fired nearby, Suffolk County District Attorney Daniel F. Conley said.

RUBEN OSORIO (D.O.B. 1/2/85) of the South End, was arraigned in Roxbury Municipal Court yesterday on charges of unlawful possession of ammunition, unlawful possession of a firearm, carrying a loaded firearm, possession of a firearm in the commission of a felony, and trafficking in cocaine.  He was additionally charged with being a Level III armed career criminal based on prior convictions out of West Roxbury Municipal Court in 2012 and 2015 for distribution of a Class A substance and a 2010 conviction in Brookline for assault with a dangerous weapon, prosecutors said.

“Drug trafficking represents the intersection of guns, narcotics, and violent crime,” Conley said. “While the underlying shots-fired incident remains under investigation, this case takes a loaded handgun and a large quantity of apparent cocaine off the street immediately.”

Assistant District Attorney Brandon Tower requested bail of $50,000 and orders that Osorio wear a GPS monitor, remain within Massachusetts, stay away from the area of his arrest, and abide by a curfew in the event he is to be released on bail.  Judge David Weingarten set bail at $20,000 and ordered Osorio to be fitted with a GPS monitor, stay away from the area of his arrest, and abide by a curfew.  He also granted a motion by prosecutors to have Osorio transported to West Roxbury Municipal Court today on a probation matter. more »

BOSTON, March 27, 2017— Eleven days after an arrest warrant issued for his failure to appear in court, a former tax preparer faced arraignment on charges he filed false tax returns that cost Massachusetts taxpayers thousands of dollars, Suffolk County District Attorney Daniel F. Conley said.

RAFAEL HUERTAS, Jr., (D.O.B. 2/27/85) of Lawrence was arraigned in Suffolk Superior Court this afternoon on six counts of presenting a false claim upon a public agency, six counts of delivering a fraudulent document, two counts of willfully assisting in preparation of a fraudulent return, and single counts of willful failure to file a tax return, identity fraud, and money laundering.  Huertas had been summoned to appear for arraignment on March 16 but failed to show up in court.  As a result, a default warrant issued for his arrest. 

Upon his appearance in Suffolk Superior Court today, Huertas was taken into custody.  Assistant District Attorney George Barker of the DA’s Special Prosecutions Unit requested bail of $10,000; Clerk Magistrate Edward Curley released Huertas on his own recognizance. more »

The Massachusetts Appeals Court today reversed lower court judge’s decision suppressing evidence in the case against JARRIS CHARLEY (D.O.B. 4/30/93) of Roxbury, who is charged with armed robbery while masked as a subsequent offense, armed assault with intent to murder, assault and battery with a dangerous weapon, unlawful possession of a firearm as a second offense, and carrying a loaded firearm in connection with the 2014 shooting that seriously injured a store clerk. more »

BOSTON, March 23, 2017—As his jury was about to begin deliberating, a Hyde Park man yesterday pleaded guilty to beating two women with what appeared to be a firearm during an armed robbery less than two weeks shy of his 18^th birthday, Suffolk County District Attorney Daniel F. Conley said.

NICODEM POYAU (D.O.B. 1/15/97) yesterday pleaded guilty to two counts of armed robbery and two counts of assault and battery with a dangerous weapon in connection with an incident that occurred on January 4, 2015.  Although Poyau was a juvenile at the time he committed these crimes, he was indicted under the state’s youthful offender statute, opening him to the full range of juvenile and adult consequences. more »

BOSTON, March 20, 2017— The Natick man convicted of murdering nightclub security chief Craig Viera in 2006 will not receive a new trial, Suffolk County District Attorney Daniel F. Conley said today.

In an unpublished decision released today, the Massachusetts Appeals Court declined to grant a new trial to OSCAR ROSA (D.O.B. 10/22/86), who was convicted in 2008 of second-degree murder for stabbing 32-year-old Viera, who later died of medical complications resulting from his injuries.  Rosa had been indicted on a charge of first-degree murder. more »

BOSTON, March 16, 2017—An Everett man was arraigned today on charges he was driving drunk when he struck and killed 25-year-old Marco Salguero-Cruz in Chelsea and then fled the scene and the country, Suffolk County District Attorney Daniel F. Conley said.

JOSE DANIEL AREVALO (D.O.B. 8/20/82) was arraigned today in Suffolk Superior Court on charges of motor vehicle homicide while operating under the influence of alcohol and leaving the scene of an accident causing death in connection with the June 4, 2016, hit-and-run crash that claimed Salguero-Cruz’s life.  At the request of Assistant District Attorney Michael Glennon, Clerk Magistrate Edward Curley set bail at $150,000 and ordered Arevalo to submit to GPS monitoring, home confinement, and surrender his passport in the event he is to be released on bail.  Arevalo has remained in custody since he was arrested in Dallas, Texas, on Dec. 1. more »

BOSTON, March 15, 2017—A former tax preparer faces arraignment tomorrow after an investigation by the Massachusetts Department of Revenue and the Suffolk County Grand Jury revealed evidence that he fraudulently obtained thousands of dollars in state income tax refunds for himself and others by filing false returns, District Attorney Daniel F. Conley said.

RAFAEL HUERTAS, Jr., (D.O.B. 2/27/85) of Lawrence was named in a 17-count indictment returned March 2 charging him with six counts of presenting a false claim upon a public agency, six counts of delivering a fraudulent document, two counts of willfully assisting in preparation of a fraudulent return, and single counts of willful failure to file a tax return, identity fraud, and money laundering. The charges stem from actions Huertas allegedly undertook between 2011 and 2014, including a period between 2012 and 2013, when he worked for a tax preparation service in Lowell. Huertas is charged in Suffolk County because he allegedly filed the false claims with the Department of Revenue in Chelsea. more »

BOSTON, March 9, 2017— An Everett man has been indicted for motor vehicle homicide in the hit-and-run crash that killed Marco Salguero-Cruz in Chelsea last year, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk County grand jury yesterday returned indictments charging JOSE DANIEL AREVALO (D.O.B. 8/20/82) with motor vehicle homicide while operating under the influence of alcohol and leaving the scene of an accident causing death. The indictments stem from the June 4, 2016, crash that claimed Salguero-Cruz’s life.  Arevalo has been held in lieu of bail since his arrest in Texas on Dec. 2.  A date for his Superior Court arraignment has not yet been scheduled. more »

BOSTON, March 7, 2017—The gunman who shot and killed 44-year-old Jose Maldonado three years ago was convicted of murder and sentenced to life in prison today, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury today found RAYMOND ARROYO (D.O.B. 3/22/92) guilty of unlawful possession of a firearm and first-degree murder under the theory of deliberate premeditation in the Mission Hill shooting that claimed Maldonado’s life. BOSTON, February 23, 2017— Just as pretrial motions were about to be heard in his pending child sexual assault case, a Hyde Park man yesterday pleaded guilty to all charges related to the abuse of two young girls more than two decades ago, Suffolk County District Attorney Daniel F. Conley said.

BOSTON, Feb. 23, 2017—The individual and corporate defendants in the deaths of Robert Higgins and Kelvin Mattocks in a South End trench collapse were arraigned today and their trial has been scheduled for early next year, Suffolk County District Attorney Daniel F. Conley said.

The Boston-based ATLANTIC DRAIN SERVICES, INC., and its owner and sole officer, KEVIN OTTO (D.O.B. 3/17/74) of Blackstone, are scheduled for trial in Suffolk Superior Court on Feb. 5, 2018, on indictments charging them each with two counts of manslaughter, one count of misleading an investigator under the state’s witness intimidation statute, and six counts of concealing a record under the evidence tampering statute. BOSTON, February 16, 2017—The drunk driver who crashed into another vehicle, killing 34-year-old Luz Puentes-Sheets and 44-year-old Maria Hernandez, was sentenced today following her conviction earlier this month, Suffolk County District Attorney Daniel F. Conley said.

JENNIFER GUZMAN (D.O.B. 7/5/1988) waived her right to a jury trial on two counts each of manslaughter, motor vehicle homicide, and assault and battery with a dangerous weapon causing serious bodily injury in connection with the 2014 collision on the Jamaicaway that claimed her passengers’ lives. Suffolk Superior Court Judge Kenneth Salinger on Feb. 6 found her guilty of two counts of motor vehicle homicide and acquitted her of additional charges of manslaughter and assault and battery with a dangerous weapon.  more »

BOSTON, Feb. 16, 2017—The victim of a beating earlier this month in Chelsea has died of his injuries and his alleged assailant was apprehended in Ohio on murder charges yesterday, Suffolk County District Attorney Daniel F. Conley, Chelsea Police Chief Brian Kyes, State Police Colonel Richard McKeon, and US Marshal for the Southern District of Ohio Peter C. Tobin said.

District Attorney Conley and Chief Kyes identified the victim as Melvin Cortes, 32, of Everett. Authorities say he was beaten by a man wielding a baseball bat on Congress Avenue in the evening hours of Feb. 5, suffering life-threatening injuries. The investigation into that beating led Chelsea Police and State troopers assigned to Conley’s office to seek and obtain a warrant for the arrest of Chelsea resident KAMAYA FARIKAFI (D.O.B. 12/7/93) in the days that followed. more »

BOSTON, Feb. 10, 2017—A Dorchester woman today admitted helping to cover up the murder of her daughter, 2-year-old Bella Bond, in 2015 and will be sentenced after the child’s alleged killer goes to trial, Suffolk County District Attorney Daniel F. Conley said.

RACHELLE DEE BOND (D.O.B. 7/25/75) pleaded guilty to the indicted charges of being an accessory after the fact to murder and larceny over $250 by false pretense. BOSTON, Feb. 10, 2017—A Jamaica Plain man accused in the October shooting that left a 9-year-old girl paralyzed was held on high bail at his arraignment today, Suffolk County District Attorney Daniel F. Conley said.

DOMINIQUE FINCH (D.O.B. 6/21/89) of Jamaica Plain was arraigned today in Roxbury Municipal Court on charges of assault to murder, assault and battery with a dangerous weapon causing serious bodily injury, unlawful possession of a firearm, possession of a firearm in the commission of a felony, unlawful possession of ammunition, carrying a loaded firearm, and discharging a firearm within 500 feet of a building.  Assistant District Attorney Catherine Ham of the DA’s Senior Trial Unit requested bail of $500,000 with orders that Finch stay away and have no contact with the victim and her family, stay away from the Annunciation Road housing development where the shooting occurred, GPS monitoring, and abide by a curfew in the event he is to be released on bail.  Ham also asked that Finch’s bail in an open 2016 case be revoked. more »

“On Oct. 21, 2016, 47-year-old Robert Higgins and 53-year-old Kelvin Mattocks were part of a work crew run by Atlantic Drain Services, Inc., excavating a trench below Dartmouth Street.  At about 12:30 pm, dirt within the trench gave way and a nearby fire hydrant collapsed into the hole, suddenly filling it with water.  The flood mixed with dirt and clay, trapping the men within seconds below the rising waterline, and ultimately claiming their lives.  more »

BOSTON, Jan. 31, 2017— Boston Police Commissioner William B. Evans and Suffolk County District Attorney Daniel F. Conley today announced the arrest of a Dedham man in the June murder of 31-year-old Marcus Hall inside a Mattapan barber shop.

Early this morning members of the Boston Police Fugitive Unit, along with US Marshals and New York City Police Department, arrested WILLIAM SHAKESPEARE (D.O.B. 10/12/87) of Dedham for Hall’s June 14 murder. Conley’s office had secured a four-count indictment against Shakespeare late last year following an extensive presentation to the Suffolk County Grand Jury.  Shakespeare was taken into custody in the Bronx, New York, without incident and will face extradition back to Boston in the coming days. more »

BOSTON, Jan. 19, 2017—A Revere Police officer was arraigned today on charges of physically abusing a young child, Suffolk County District Attorney Daniel F. Conley said.

MARCOS R. GARCIA (DOB 12/4/84) of Saugus was arraigned in Chelsea District Court on charges of assault and battery on a child causing injury and assault and battery with a dangerous weapon.  At the request of Assistant District Attorney Alissa Goldhaber, Judge Michael Patten set bail in the amount of $5,000 and ordered Garcia to stay away from and have no contact with the victims and witnesses in the case and have no contact with children under the age of 18, except his own child, without the knowledge of a parent or guardian.  more »

CHELSEA, Jan. 17, 2017—The youth shot and killed in Chelsea on Friday has been identified as 15-year-old Jimmy Vasquez, Suffolk County District Attorney Daniel F. Conley and Chelsea Police Chief Brian Kyes said today.

Vasquez, a resident of Chelsea, suffered a fatal gunshot wound during an incident on Shurtleff Street at approximately 5:35 Friday evening. He was rushed to CHA Everett Hospital, where he was pronounced deceased. A second youth, also 15, suffered a nonfatal gunshot injury and is expected to survive. more »

CHELSEA, Jan. 14, 2017–State Police assigned to the Suffolk DA’s office and Chelsea Police detectives continue to investigate a double shooting yesterday evening that claimed one teen’s life and injured another, District Attorney Daniel F. Conley and Chelsea Police Chief Brian Kyes said today.

The shooting at approximately 5:35 pm on Shurtleff Street left the 15-year-old homicide victim with mortal injuries. He was rushed to Whidden Memorial Hospital, where he was pronounced deceased. His name is not currently being released pending full family notifications. A second youth, also 15, suffered less serious injuries and is expected to survive. more »

BOSTON, Jan. 12, 2017—A West Roxbury couple were ordered held on high bail at their arraignment today on human trafficking charges for allegedly running a house of prostitution in Allston, Suffolk County District Attorney Daniel F. Conley said.

During their arraignment today in Suffolk Superior Court, Clerk Magistrate Edward Curley ordered YUET CHOW (D.O.B. 9/9/63) and KIM CHOW (D.O.B. 9/18/48) each held on $500,000 bail – an amount previously set in Brighton Municipal Court.  more »

BOSTON, Jan. 11, 2017—A Georgia man who worked with underage performers was sentenced to prison today after pleading guilty to secretly recording them in hotel rooms, Suffolk County District Attorney Daniel F. Conley said.

WILLIAM H. ALLEN (D.O.B. 9/8/52) of Athens, Georgia, appeared in Suffolk Superior Court for sentencing today after pleading guilty to two counts each of secretly photographing sexual or intimate parts of a child and possession of child pornography.  Judge Mary Ames sentenced Allen to two years in state prison followed by 10 years of probation.  During that time, Allen is barred from residing or having unsupervised contact with anyone under 18 and from taking part in any employment or volunteer activity that would put him in contact with anyone under age 18.  He must also stay away and have no contact with his victims, undergo a psychiatric evaluation, and complete any treatment deemed necessary, including sex offender treatment. more »

BOSTON, January 10, 2017—A Level 3 sex offender was ordered held without bail pending a dangerousness hearing at his arraignment today on charges he assaulted two women during a break-in, Suffolk County District Attorney Daniel F. Conley said.

RONALD BROWN (D.O.B. 3/20/64), who lists the Pine Street Inn as he primary residence, was arraigned today in Suffolk Superior Court on charges of indecent assault and battery, evidence tampering, assault for the purposes of racial intimidation, burglary with assault, and two counts each of aggravated rape, robbery, kidnapping, and witness intimidation.

Brown is additionally charged as a habitual offender and with aggravated rape as a second offense as a result of his prior convictions. According to prosecutors, Brown was convicted in Suffolk Superior Court in 1986 of aggravated rape, burglary, and other offenses for attacking a woman during a similar incident; he was sentenced to 18 to 25 years in state prison for those offenses.  In 2013, prosecutors said, he was convicted of multiple counts of juror intimidation for an incident that occurred during a separate trial at Worcester Superior Court.

At the request of Assistant District Attorney Ian Polumbaum, chief of the DA’s Sexual Assault and Domestic Violence Unit, Clerk Magistrate Anne Kaczmarek ordered that Brown continue to be held without bail pending a dangerousness hearing under Chapter 276, Section 58A, of the Massachusetts General Laws. The statute allows a judge to hold a defendant accused of certain offenses without bail for up to 120 days pending trial upon “clear and convincing evidence that no conditions of release will reasonably assure the safety of any other person or the community.” That hearing is scheduled to take place Jan. 17. more »
