A robbery suspect inadvertently set the stage for his own arrest when he allegedly stole a delivery driver’s GPS-enabled iPhone during the second of two robberies, then sold it to an electronics store with a video surveillance camera, Suffolk County District Attorney Daniel F. Conley said.

DEONTE P. CURRY (D.O.B. 5/6/91) of Everett was arraigned yesterday in Dorchester District Court on two separate dockets charging him with armed robbery. Both robberies targeted pizza deliverymen called to the area of 110 Monsignor Lydon Way earlier this month. more »

A Chelsea man is behind bars today for allegedly kicking a pregnant woman and stabbing another rival so badly that the man needed more than 93 staples to close a wound on his back, Suffolk County District Attorney Daniel F. Conley said.

A Roslindale man was today sentenced to serve five years in jail after he admitted that he was under the influence of alcohol when he struck and killed 23-year-old Andrew Prior in a collision on Tremont Street before fleeing the scene, Suffolk County District Attorney Daniel F. Conley announced.

COLIN RATIU (D.O.B. 11/27/87) pleaded guilty to one count each of motor vehicle homicide while operating under the influence of alcohol, and leaving the scene of an accident causing death for his role in the Nov. 14, 2010 collision. more »

A former director of the Revere Public Library and a former administrative clerk for the City of Boston’s Veterans’ Services Department both admitted to stealing from their employers in separate proceedings today in the Suffolk Superior Court, and were each ordered to pay restitution to the respective cities of Revere and Boston, District Attorney Daniel F. Conley said.

ROBERT RICE (D.O.B. 5/5/65) of Rowley pleaded guilty to three counts of embezzlement and 15 counts of procurement fraud for using city funds to purchase items he kept himself or sold online from 2005 until his resignation in 2009. During that time, he was alleged to have stolen in excess of $200K. more »

The Suffolk County Grand Jury late yesterday returned indictments charging five Dorchester men in connection with the Sept. 25, 2011 shooting death of a 16-year-old boy and the non-fatal shooting of his 14-year-old friend on Geneva Avenue, District Attorney Daniel F. Conley said.

The indictments each charge SHELDON MATTIS (D.O.B. 1/22/93) and NYASANI WATT (D.O.B. 10/5/93), with first-degree murder, armed assault with intent to murder, assault and battery with a dangerous weapon causing serious bodily injury, unlawful possession of a firearm, and carrying a loaded firearm. Watt was additionally indicted on a second charge of unlawful possession of a firearm, unlawfully carrying a loaded firearm, and possession of a large capacity feeding device for a handgun he had on him at the time of his arrest on November 3. more »

The Suffolk County Grand Jury this afternoon returned indictments charging two Mattapan men with the July homicides of 24-year-old Billie Kee and her boyfriend, 32-year-old Kevin Thomas, in their Hyde Park apartment, District Attorney Daniel F. Conley said.

The indictments charge MICHAEL T. CORBIN (D.O.B. 11/10/78) and EARL FULGIAM (D.O.B. 4/14/80), with two counts each of first-degree murder and armed robbery, and one count each of unlawful possession of a firearm, carrying a loaded weapon, and unlawful possession of a large capacity feeding device, all in connection with the July 26 shooting deaths. more »

The Suffolk County Grand Jury late today returned a nine-count indictment charging a Dorchester youth with the October homicide of 36-year-old Ciaran Conneely on Nahant Avenue, District Attorney Daniel F. Conley said.

The indictments charge JOHN GRAHAM, 17, with first-degree murder, armed assault with intent to rob, and unlawful possession of a firearm in connection with Conneely’s Oct. 10 shooting death.

The indictments additionally charge Graham with two counts of armed assault with intent to rob and single counts of armed assault with intent to murder, aggravated assault and battery with a dangerous weapon, assault and battery with a dangerous weapon, and unlawful possession of a firearm for an Oct. 30 incident in which Graham allegedly shot two adult men during the course of an attempted robbery on Monsignor Lydon Way.

Boston Police arrested Graham on Nov. 6 for the later incident; he is currently held on $100,000 cash bail on that case. In light of evidence developed during the non-fatal shooting investigation, Boston Police homicide detectives continued to gather information – including information presented to the grand jury in the days and weeks that followed – leading to today’s indictments.

Graham has not been formally arrested for Conneely’s slaying, but a warrant has been entered and he will remain in custody until he is arraigned in Suffolk Superior Court. An arraignment date has not yet been scheduled. No further information will be released this evening.

An Allston man’s frustration over vermin in his Franklin Street apartment building landed him in Brighton District Court today on charges that he fired an unlicensed rifle at the rats in the halls, Suffolk County District Attorney Daniel F. Conley said.

WILLIAM McABEE (D.O.B. 8/16/54) was arraigned for unlawful possession of a firearm, unlawful possession of ammunition, and unlawfully discharging a firearm within 500 feet of a dwelling. Judge Kenneth V. Desmond set his bail at $2,500. more »

A Roxbury woman will serve at least 15 months behind bars for lying to the Suffolk County Grand Jury as it investigated the 2007 shooting death of 13-year-old Luis Gerena, Jr., District Attorney Daniel F. Conley said today.

Conley’s office recommended that DESTINY GUNN (D.O.B. 9/2/89) serve five years in state prison following her Nov. 8 admission to the crime of perjury. Today, Suffolk Superior Court Judge Raymond Brassard sentenced her to two and a half years in a house of correction, with 15 months to serve up front and the balance suspended for a three-year probationary term. more »

A Tewksbury man remains hospitalized today after his alleged assailant was arraigned on attempted murder charges stemming from the weekend incident in Revere, Suffolk County District Attorney Daniel F. Conley said.

Suffolk County District Attorney Daniel F. Conley is asking lawmakers to close a loophole in the statute that currently forbids sexual contact between inmates and corrections officers but places no restrictions on court officers and other officials.

Conley took that step today after securing the indictment of MICHAEL J. RUBINO, 35, of Braintree on a list of charges related to sexual activity between himself and two female defendants at the Boston Municipal Court between 2010 and 2011. Rubino was additionally charged with lying to Boston Police detectives investigating that alleged misconduct. more »

A teacher’s assistant has been ordered to stay away from the Harbor Pilot Middle School in Dorchester after his arraignment for alleged improper activity with a child there this week, Suffolk County District Attorney Daniel F. Conley said.

LaSHAWN HILL (D.O.B. 3/10/78) of Dorchester was formally charged today with lewd and lascivious conduct, a misdemeanor punishable by up to six months in a house of correction. The charge stems from an incident Monday afternoon at the school. more »

Victim-witness advocates from Suffolk County District Attorney Daniel F. Conley’s office will bring a bounty of toys to the families of crime victims this holiday season after amassing a record number of donations to their annual toy drive.

Victim-witness advocates Tim Munzert and Anne Kelley-McCarthy prepare dozens of toys, games, and other gifts to be delivered to families affected by homicide and other violent crimes. The goodies were donated by members of Suffolk County District Attorney Daniel F. Conley’s office as part of their annual toy drive.

The East Boston man who summoned Luis Raul Rodriguez out of his Central Avenue home for a fistfight, only to shoot him dead, was convicted of second-degree murder and sentenced to life in prison today, Suffolk County District Attorney Daniel F. Conley said.

Jurors convicted JONATHAN CARVALHO (D.O.B. 10/29/89) after about a day and a half of deliberations following seven days of testimony about Rodriguez’ Aug. 10, 2010, shooting death. Under the mandatory sentence imposed by Judge Regina Quinlan, he will be eligible for parole after 15 years. more »

After a comprehensive review of the evidence, Suffolk County prosecutors today terminated the criminal case against JULIAN EDELMAN, arrested outside a downtown nightclub in the early morning hours of Nov. 1.

“After a thorough investigation of this case by the Boston Police Department’s Sexual Assault Unit … the Commonwealth has concluded that it would not be able to meet its burden at trial of proving each of the elements of indecent assault and battery beyond a reasonable doubt,” prosecutors wrote in a nolle prosequi – a legal document withdrawing prosecution – filed in court this morning, well in advance of Edelman’s first scheduled court date on Jan. 10. more »

The region’s largest utility workers’ union is teaming up with Suffolk County District Attorney Daniel F. Conley to make the holiday season a little brighter for the surviving family members of homicide victims.

Utility Workers Union of America Local 369 will deliver about 30 turkeys and hams to Conley’s annual breakfast for homicide survivors this morning. The annual breakfast brings survivors together with prosecutors, victim advocates, investigators, and others who worked on their cases.
“Each year we host an informal gathering of parents, siblings, spouses and others affected by homicide,” Conley said. “These are folks we’ve built a relationship with over a period of many years. So when Local 369 reached out to see how they could help the families who need it most, we knew exactly who to connect them with.” more »

The Dorchester man convicted of gunning down 17-year-old Thomas Webb was sentenced to life in prison today, but not before the slain youth’s family mourned his loss in Suffolk Superior Court, District Attorney Daniel F. Conley said.

A jury convicted ELBERT NEWSON (D.O.B. 12/9/88) of first-degree murder and unlawful firearm possession today, just over a week after his trial on those charges began. Judge Christine McEvoy imposed the mandatory sentence of life in prison without the possibility of parole. more »

Sixteen men and women arrested at Dewey Square early Saturday morning accepted Suffolk County prosecutors’ offers of pre-trial probation today, with an additional group of eight individuals demanding criminal proceedings in the Boston Municipal Court.

Of those 16 defendants, a dozen were charged with trespassing and resisting arrest. All were male and most were residents of Boston, with one man being homeless and three residing in Brookline, Hanson, and Whitman. In light of their acceptance of responsibility and the passive nature of their resistance to Boston Police, the resisting arrest charges were dismissed and their arraignments were continued for one year. more »

A Boston University student from Canada was ordered to surrender his passport to Massachusetts authorities after allegedly sexually assaulting a female student at a university dormitory this weekend, Suffolk county District Attorney Daniel F. Conley said.

Rosanna Camilo, who came to Boston to seek medical care for her young child, was sexually assaulted and strangled to death by a neighbor at her Mattapan apartment building, Suffolk County District Attorney Daniel F. Conley said today.

ELDRICK D. BROOM (D.O.B. 4/7/84) of Roxbury was arraigned today on charges of murder and aggravated rape for Camilo’s Nov. 21 homicide. Prosecutors recommended that he be held without bail on the murder charge and that his open bail on an unrelated assault and battery charge be revoked; Judge Robert Baylor granted the former request but delayed action on the latter until Jan. 31. more »

A Dorchester teen is behind bars today after allegedly robbing a disabled woman of her iPad at gunpoint last month while out on bail for an unrelated offense, Suffolk County District Attorney Daniel F. Conley said.

The 16-YEAR-OLD MALE, who is not being identified because he is a juvenile, was arraigned Friday in West Roxbury District Court on an armed robbery charge stemming from the Nov. 19 incident in Hyde Park. Assistant District Attorney Caitlin Grasso recommended $10,000 cash bail and asked that his open bail on a Cambridge larceny case be revoked. Suffolk County District Attorney Daniel F. Conley’s office yesterday convinced a judge that a seven-time drunk driver recently arrested for the same offense is too dangerous to release on bail.

Acting under Ch. 276, Sect. 58A, of the Massachusetts General Laws, Chelsea District Court Judge James Wexler ordered ALBERT DIAZ (D.O.B. 8/16/59) of East Boston held without bail for up to 90 days pending trial. The state’s so-called “dangerousness statute” allows a judge to detain defendants accused of certain crimes upon “clear and convincing evidence that no conditions of release will reasonably assure the safety of any other person or the community.” more »

Two Hungarian nationals were held without bail at their arraignments today on larceny charges stemming from an online scam in which vehicles – some fictitious and some belonging to unwitting victims – were put up for auction without their knowledge or permission, Suffolk County District Attorney Daniel F. The $75,000 cash bail imposed at a Utah man’s arraignment for possessing child pornography will remain in place for now, Suffolk County District Attorney Daniel F. Conley said today.

GRANT D. SMITH (D.O.B. 5/28/64) of Cottonwood Heights sought to have that amount lowered at a bail review in Suffolk Superior Court this afternoon. Wearing orange scrubs, Smith appeared via videolink from the Nashua Street Jail, where he has been held since his arraignment Monday in East Boston District Court.
Smith’s attorney, Patrick Murphy, asked Judge Carol Ball to reduce his bail under Chapter 276, Sect. 58A(7), of the Massachusetts General Laws. That statute allows a defendant held on bail in district court to petition a superior court judge to reduce his or her bail. more »

The family of slain mechanic Charles Cantave watched through tears today as one of his killers pleaded guilty to murdering him after a small claims court hearing over auto parts, Suffolk County District Attorney Daniel F. Conley said.

Two former officials in an MBTA employees union have been indicted for larceny and related offenses for allegedly overpaying themselves from union funds, with one additionally accused of failing to pay taxes on his inflated income, Suffolk County District Attorney Daniel F. Conley announced.

A Boston Municipal Court judge today barred a Framingham woman from Dewey Square after she allegedly interfered with a domestic violence investigation at the Occupy Boston encampment, failed to appear in court, and assaulted Boston Police officers as they arrested her on a default warrant.

A Beverly woman was arraigned today on attempted murder charges for allegedly pouring gasoline on an apartment building’s porch and setting it alight earlier this year, Suffolk County District Attorney Daniel F. Conley said.

SYRETTA COPELAND (D.O.B. 7/9/80) is also charged with arson and causing injury to a firefighter for the Sept. 10 blaze at 130 Devon St., which caused about $185,000 in damages to that building, an adjacent building, and two parked cars. more »

One of two men charged with a serious 2006 stabbing pleaded guilty yesterday rather than face trial for the incident that nearly killed a 25-year-old South Boston man, Suffolk County District Attorney Daniel F. Conley said.

ROBERT GLAVIN (D.O.B. 7/16/82) of Boston admitted to aggravated assault and battery for his role in the Sept. 11, 2006, incident near the corner of I Street and East 7th Street. Assistant District Attorney Philip O’Brien recommended that he serve four to five years in state prison; Suffolk Superior Court Judge Carol Ball sentenced him to a term of two to three and a half years. more »

A Woburn man with multiple drunk driving convictions and a suspended license is being held without bail pending a hearing tomorrow that could keep him behind bars until trial, Suffolk County District Attorney Daniel F. Conley said.

At the time of his Boston Municipal Court arraignment last week, THOMAS D. McCUE (D.O.B. 7/11/69) had four convictions for operating under the influence of alcohol in Woburn, Roxbury, and Charlestown dating back to 1992. When he was charged Friday with a fifth, Assistant District Attorney Janine D’Amico moved to have him held without bail pending a hearing tomorrow under the state’s so-called “dangerousness statute.” Judge Annette Forde imposed that order. more »

Conley submitted key provisions of the legislation, including a presumption that minors arrested in prostitution cases should be treated as victims, not offenders.

The Massachusetts Appeals Court today affirmed a Mattapan man’s 11 convictions for trying to kill four Boston Police officers on New Year’s Day 2003, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury in 2005 convicted JERMAINE JABBAR BERRY (D.O.B. 5/7/82) of four counts of assault with intent to kill, three counts of assault and battery with a dangerous weapon, three counts of assault with a dangerous weapon, and gun and ammunition offenses. He is currently serving an aggregate term of 31 to 43 years in state prison for pointing a .357 caliber revolver at a friend of his mother’s inside his house, then firing at four Boston Police officers, hitting two of them, when they responded to the residence at about 5:30 a.m. more »

A Brockton woman was arraigned this morning on gun possession charges after Boston Police stopped her car in close proximity to a shooting in the city’s Theater District, Suffolk County District Attorney Daniel F. Conley said.

MIKAYLA ALFORD (D.O.B. 5/26/91) was charged in the Boston Municipal Court with unlawful possession of a firearm and unlawful possession of ammunition for the loaded handgun recovered from her handbag during a traffic stop just before 2:15 this morning. The Suffolk County Grand Jury yesterday returned an indictment charging a South Boston man with first-degree murder for the beating death of 65-year-old Barbara Tagen in her Andrew Square apartment, Suffolk County District Attorney Daniel F. Conley said.

ADAM CASSINO (DOB 5/9/86), who lived across the street from Tagen, is expected to face arraignment on that charge on Dec. 1 in the Magistrate’s Session of Suffolk Superior Court. He has been held without bail since his district court arraignment on Sept. 22. more »

A homeless man will serve up to five years in prison for jumping into a cab last year, robbing its passenger of her smart phone, and then slamming her friend’s face into the pavement after demanding money to get it back, Suffolk County District Attorney Daniel F. Conley said today.

GERALD HAMILTON (D.O.B. 2/10/66), who has no fixed address, pleaded guilty yesterday as his trial was set to begin on charges of unarmed robbery and assault and battery with a dangerous weapon. Suffolk Superior Court Judge Christine McEvoy sentenced him to 4 to 5 years in state prison followed by 18 months of probation upon his release. A Suffolk Superior Court jury late this afternoon convicted a Dorchester man of all charges for his role in a 2007 Maynard Street shooting that resulted in the death of 21-year-old Fausto Sanchez and serious injuries to two of Sanchez’ friends, Suffolk County District Attorney Daniel F. A man who renounced his Pakistani citizenship while living in the United Kingdom only to be expelled from that nation for a string of larcenies was convicted of similar offenses in Boston this week and sentenced to five years in prison, Suffolk County District Attorney Daniel F. Conley said.

ASAD REZVI (D.O.B. 5/30/55) of Salem was convicted yesterday of two counts of larceny over $250 and one count of larceny under $250 for the thefts of computer equipment from Massachusetts General Hospital in February and April 2008. In light of a nine-page record with convictions for other theft-related offenses, Assistant District Attorney Megan O’Rourke recommended that he be sentenced as a common and notorious thief under Ch. 266, Sect. 40, of the Massachusetts General Laws, which would expose him to sentences up to 20 years in state prison. more »

Several members of the public contacted State Police General Headquarters and members of the Suffolk County State Police Detective Unit yesterday after seeing media reports describing the appearance and clothing of the deceased. Members of the State Police Underwater Recovery Unit and uniformed troopers assigned to Troop H responded to the Harvard Bridge, which traverses the Charles River along Massachusetts Avenue, following a 6:20 a.m. eyewitness report of a woman who had jumped into the water. A preliminary autopsy has revealed no signs of physical trauma or sexual assault on a Chelsea woman whose remains were found near a highway onramp this weekend, Suffolk County District Attorney Daniel F. Conley and Chelsea Police Chief Brian Kyes said today.

State Police homicide detectives assigned to Conley’s office and Chelsea Police detectives continue to investigate the 48-year-old woman’s death. A Suffolk Superior Court jury today convicted a Dorchester man of murder for the shooting death of George “Jeffrey” Thompson last year, reaching its verdict just a few hours into deliberations, Suffolk County District Attorney Daniel F. Conley said.

Jurors found OMAY TAVARES (D.O.B. 4/24/89) guilty of first-degree murder under the theories of deliberate premeditation and extreme atrocity or cruelty. Tavares faces a mandatory life term without the possibility of parole at a sentencing hearing tomorrow at 9:00 a.m. in courtroom 808.

In his closing argument this afternoon, a Suffolk County homicide prosecutor said the two defendants charged with murdering a rival and an innocent bystander during a Dorchester shootout acted together and contributed equally to the two victims’ deaths.

The Massachusetts Appeals Court today allowed Suffolk prosecutors the opportunity to use as evidence a handgun recovered after a tipster said it was going to be used in a crime, reversing a district court judge’s decision and reaffirming that police can search for and seize a firearm without a warrant under certain circumstances, Suffolk County District Attorney Daniel F. Conley announced.

“The Appeals Court made clear once again that police may execute warrantless searches under exigent circumstances,” Conley said, hailing the unanimous decision. “Clearly, those circumstances existed here: A loaded gun was known to be in a certain place and believed to be intended for use in a violent crime. A killer free on parole for one shop clerk’s slaying was convicted today of another after a Suffolk Superior Court jury found him guilty of all charges in the 2009 shooting death of 39-year-old Surendra Dangol at a Jamaica Plain convenience store, Suffolk County District Attorney Daniel F. Jurors convicted EDWARD CORLISS (D.O.B. 2/7/46) of first-degree murder under the theories of deliberate premeditation and felony murder – homicide committed during the commission of a felony. Jurors additionally convicted him of armed robbery while masked and unlawful possession of a firearm for the Dec. 26, 2009, incident that claimed the Somerville man’s life.

“Surendra Dangol did everything we ask and recommend of a robbery victim,” Conley said. “He didn’t resist. He gave up everything he could. He kept his hands in the air and presented no threat. On Oct. 22, 2010, Boston Police and Department of Youth Services officers arrested a 16-year-old male wanted for escaping DYS custody and other unrelated offenses. That arrest took place on the campus of Roxbury Community College, and portions of it were recorded by civilians. As each of you is well aware, those video clips were uploaded to the internet and distributed online and in the news media.

After viewing those clips, I directed senior prosecutors within my office to investigate the level of force used by police during that arrest to determine whether it was excessive and subject to criminal prosecution. Toward that end, we reviewed not only the video clips themselves but also the statements of some 30 civilian and police witnesses; all of the reports and transmissions associated with the arrest; the juvenile arrestee’s medical records; Boston Police rules, regulations, and training materials; and the findings of the Boston Police Internal Investigations Unit. more »

A Roxbury man pleaded guilty today as his trial was scheduled to begin on charges that he murdered 13-year-old Luis Gerena, Jr., as part of a gang rivalry in which the slain boy had no part, Suffolk County District Attorney Daniel F. Conley said.

NURUDEEN ALABI (D.O.B. 11/6/89) pleaded guilty to the crime of manslaughter, accepting a prison term of 17 years rather than face trial on the murder charge. He also pleaded guilty to related counts of unlawful possession of a firearm, assault with a dangerous weapon, and intimidation of a witness for which he received five years of probation upon his release. He was ordered to stay away from and have no contact with the Gerena family, the intimidation victim, or any witnesses in the case during that time.
If he does not comply with those orders, or if he reoffends in those five years, he faces up to 15 additional years in prison, Conley said. more »

TYRE WADE (D.O.B. 10/27/91) was arraigned in Roxbury District Court on a nine-count complaint charging him with unlawful possession of a .22 caliber Ruger MK II semiautomatic handgun, unlawful possession of ammunition, unlawfully carrying a loaded firearm, assault with a dangerous weapon, unlawfully discharging a firearm, and other offenses. Suffolk County District Attorney Daniel F. Conley and Chelsea Police Chief Brian Kyes today asked for the public’s help in identifying a motor vehicle that struck and killed 39-year-old Israel Sanchez early Sunday morning.

Investigators believe Sanchez was walking north along Route 16 in Chelsea just before 12:30 a.m. when he crossed the roadway in the area of Washington Avenue. He crossed the eastbound lane without incident; he was struck by an unknown vehicle in the westbound lane, however, suffering mortal injuries. He was pronounced deceased at Massachusetts General Hospital. The vehicle continued travelling west without stopping. more »

The preliminary investigation suggests that Sothany Pen, 22, was crossing Lee Burbank Highway from east to west when she was struck by a motor vehicle travelling northbound at about 5:50 this morning. Pen suffered grievous injuries in the collision; the motor vehicle left the scene. more »

State Police assigned to Suffolk County District Attorney Daniel F. Conley’s office and the Brighton barracks are investigating a single-vehicle crash that left two men with grievous injuries this morning.

At about 4:15 a.m., State troopers responded to the area of Storrow Drive eastbound near the off-ramp to Kenmore Square to find a white Infinity engulfed in flames on the median strip, where it had collided with a tree. Troopers attempted to remove its occupants – a 27-year-old driver and his 29-year-old brother, both North Andover men – but were unable to do so. more »

A 54-year-old man who was arraigned today in the Boston Municipal Court and held on high bail on charges that he robbed a Beacon Street bank yesterday evening, allegedly paid his hotel bill in cash following the robbery, Suffolk County District Attorney Daniel F. Conley said.

PATRICK CANNON (D.O.B. 10/29/56) was charged with masked and armed robbery for his alleged role in yesterday’s heist from the Cambridge Trust Bank. Assistant District Attorney Ryan Mingo told the court that there is a federal detainer for Cannon, who was out on parole for a prior armed bank robbery conviction when he committed the most recent offense. A Roxbury man was arraigned for drunk driving today, more than 20 years after he was arrested by Metropolitan Police for allegedly drifting across three lanes of traffic in what was then known as the Dewey Square Tunnel, Suffolk County District Attorney Daniel F. Conley said.

RICHARD MATTHEWS (D.O.B. 9/12/42) was charged in Charlestown District Court with operating under the influence, operating without a license, concealing the identity of his vehicle by attaching another car’s plates to it, and operating an unregistered and uninsured vehicle, all for actions in the early morning hours of Jan. 12, 1989. At 2:52 a.m. today Boston University Police requested State Police respond to Commonwealth Avenue at Deerfield Street, where a man reported to a BU officer that he believed a woman had been sexually assaulted on the Esplanade earlier in the night. All patrols from the State Police Barracks at Leverett Circle in Boston responded.

The man told troopers that he came across a woman in the general area of Massachusetts Avenue who told him she had been sexually assaulted on the Esplanade and thrown into the Charles River. The woman, later identified as a 20-year-old student at a local college, was no longer with the man when troopers arrived, but the man still had her purse; troopers used its contents to obtain her current address. more »

A Mission Hill woman who allegedly shook her 3-year-old daughter violently at a bus stop and then pushed her to the ground was arraigned on an assault and battery charge in the Boston Municipal Court today.
Prosecutors recommended $2000 cash bail be set for YAN FAN ZHU (D.O.B. 12/4/66), further recommending that she be ordered to comply with whatever parenting plans or instructions are provided by the Department of Children and Families and check in weekly with the Department of Probation.

Judge Raymond Dougan, Jr., released Zhu on her own recognizance, declining to order Zhu to abide by any instructions from DCF and declining to order her to check in with Probation. Dougan did order Zhu not to abuse her daughter. more »

JIANFU HUANG (D.O.B. 10/8/54), formerly of Quincy but now a resident of Corona, New York, was arraigned Friday on charges of distributing a counterfeit mark – the same offense to which he pleaded guilty earlier this year. South Boston District Court Judge Michael Bolden set bail at $500 cash, the amount recommended by Assistant District Attorney Kate Clayman. Winthrop Police and State Police homicide detectives assigned to Suffolk County District Attorney Daniel F. Conley’s office are investigating an unattended death near a Winthrop Street residence this evening.

Winthrop Police responded to the area of 429 Winthrop St. at about 2:30 this afternoon for a report of a strong odor. On arrival, they observed what appeared to be human remains. Winthrop Police then notified the Suffolk County State Police Detective Unit, which investigates all unattended deaths in Chelsea, Revere, Winthrop, and parts of Boston. more »

The state’s highest courts today affirmed the convictions of an East Boston man who killed and set fire to a neighborhood cat and a Dorchester man who stored an unregistered handgun in a secret compartment within his girlfriend’s car, Suffolk County District Attorney Daniel F. Conley said.

The Massachusetts Appeals Court today affirmed the convictions of a Hyde Park man who may have shot himself shot himself in the leg but, when interviewed by Boston Police, blamed an unknown assailant, Suffolk County District Attorney Daniel F. Conley said.

The Appeals Court upheld PATRICK FORTUNA’s convictions for misleading a police officer with the intent to impede an investigation and making a false report of a crime, offenses of which he was found guilty at a 2009 jury trial in West Roxbury District Court. He received a one-year suspended sentence. The decision makes clear that a defendant has no reasonable expectation of privacy with regard to clothing cut off of him in a hospital emergency room and clarifies the laws surrounding false statements to police investigators. more »

State Police detectives assigned to Suffolk County District Attorney Daniel F. Conley’s office are investigating a fatal single-vehicle crash early this morning on Storrow Drive in Boston.

Detectives responded at about 1:20 this morning to the westbound portion of the roadway near the Bowker Overpass, where two men were ejected from a GMC Sierra. The passenger in that vehicle, a 22-year-old Needham man, was pronounced dead at the scene. The operator, also 22 of Needham, was transported to Beth Israel Deaconess Medical Center, where he remains in the Intensive Care Unit with life-threatening injuries. more »

A sightless, mentally ill Brighton man was committed to a secure psychiatric facility today after a judge agreed with prosecution and defense experts that he was not criminally responsible for the fatal stabbing of 56-year-old Terri Werner, a teacher he knew through a local school for the blind.

Suffolk Superior Court Judge Geraldine Hines ordered LUIS MARQUEZ (D.O.B. 9/15/81) to a 40-day observation period at Bridgewater State Hospital after finding him not criminally responsible on a single count of second-degree murder. The charge arose out of Werner’s June 10, 2008, homicide inside Marquez’ Nonantum Street apartment. An East Boston murder defendant duct taped the face and wrists of an older family friend, strangled him to death with a chain, and doused him with charcoal lighter fluid, then stole an television and electronics from the man’s house before returning and setting his remains on fire in the basement of a fully-occupied residential building, a Suffolk County prosecutor said at the suspect’s arraignment today.

MARCO TULIO FLORES (D.O.B. 10/3/93) allegedly told homicide detectives that he killed 27-year-old Jaime Galdamez because Galdamez had sexually molested him for years. JOSEPH DOWNEY (D.O.B. 4/18/65) of Quincy was arraigned today in South Boston District Court on charges of assault and battery, assault and battery with a dangerous weapon, and attempted unarmed robbery for the July 23 incident inside a family member’s residence.

Assistant District Attorney Luke Goldworm recommended that Downey be held on $10,000 cash bail and that he be ordered to wear a GPS monitoring device, stay away from the victim and witnesses, and stay out of South Boston while the case is open. Goldworm also recommended that Downey’s open bail on his pending murder case be revoked. DARYL PULLEN (D.O.B. 6/20/88) pleaded guilty to manslaughter, assault, and weapons charges for taking part in the Jan. 7, 2009, shooting that left Smith dead in the foyer of a relative’s home. State Police detectives assigned to Suffolk County District Attorney Daniel F. Conley’s office are investigating a collision that claimed the life of a motorcycle rider in Hyde Park this afternoon.

State Police and emergency medical technicians responded to the four-way intersection of Dedham, Enneking, and Turtle Pond parkways at about 4:30 p.m. for a report of a motor vehicle collision. A 45-year-old Hyde Park man who had been riding a motorcycle on Turtle Pond Parkway was suffering from life-threatening injuries. He was transported to Faulkner Hospital, where he was pronounced dead of his injuries. more »

A Dorchester man was held without bail on a murder charge stemming from the shooting death last month of 25-year-old Aaron Wornum in Dorchester, Suffolk County District Attorney Daniel F. Conley said today.
Assistant District Attorney David Fredette of Conley’s Homicide Unit today recommended that ANTHONY ROBERTSON (D.O.B. 5/19/91) be held without bail pending trial; Dorchester District Court Judge Rosalind Miller granted that request.

Fredette told the court that the victim and defendant were known to one another. Phone records obtained by investigators suggest the victim was on his cell phone just before the June 26 shooting, Fredette said, and additional investigation has linked the other phone to the defendant. more »

A Dorchester man admitted his role the deadly ambush that killed 36-year-old Tyrone Smith, permanently injured his female cousin, and could have killed her 8-year-old son in the foyer of a Stanwood Street building two years ago, Suffolk County District Attorney Daniel F. Conley said today.

TREVON MASON (D.O.B. 12/30/87) pleaded guilty to second-degree murder, assault and battery with a dangerous weapon, and firearms offenses for the Jan. 7, 2009, incident. The Roslindale man charged with running down 23-year-old Andrew Prior was so drunk after attending a rock concert that he later said he couldn’t believe a valet gave him back his keys, a Suffolk County prosecutor said today at his arraignment on motor vehicle homicide charges.

Suffolk County District Attorney Daniel F. Conley today invited non-profit organizations that work with kids and teens to apply for his annual series of cash awards that provide the young people of Boston, Chelsea, Revere, and Winthrop with constructive alternatives to crime and drug use.

The annual funds, which total $50,000 this year, are disbursed from Conley’s Asset Forfeiture Reinvestment Program. The program takes cash and assets seized from drug dealers and awards them to Suffolk County organizations that help young people avoid drugs, gangs, and other risky activity. more »

The Suffolk County Grand Jury on June 27 returned indictments charging COLIN RATIU (D.O.B. 11/27/87) with motor vehicle homicide while operating under the influence of alcohol and leaving the scene of an accident causing death. The Suffolk County Grand Jury today returned an indictment charging MICHAEL COKER (D.O.B. 7/3/62), a former Hyde Park resident, with first-degree murder for Phinney’s 1988 death. MARIO CRUZADO (D.O.B. 7/10/73), who has no permanent address, was arraigned and charged with first-degree murder for the homicide of Frederick Allen. Chelsea Police officers discovered Allen’s body on Nov. 26, 2010 in the victim’s Bellingham Street home after receiving a 911 call. A Medical Examiner determined that the victim died of blunt force trauma to the head and strangulation. more »

Suffolk County District Attorney Daniel F. Conley’s office has convinced a Superior Court judge that a man charged with mutilating his girlfriend is too dangerous to be released pending trial – even though that girlfriend now claims that she cut her own fingers off.

Suffolk Superior Court Judge Patrick Brady today sided with Suffolk prosecutors, who had moved to hold JOSE GONZALEZ (D.O.B. 12/16/78) of Somerville under the state’s so-called “dangerousness statute.” Gonzalez was indicted June 6 on charges of mayhem and assault and battery with a dangerous weapon for the attack on his 30-year-old girlfriend earlier this year. more »

Suffolk County District Attorney Daniel F. Conley today determined that a Boston Police officer and a State trooper acted appropriately when they returned fire against Manuel DaVeiga in Dorchester last year. DaVeiga shot himself during that encounter and died of a self-inflicted gunshot wound to the head.

Under Massachusetts law, the Suffolk County District Attorney oversees all death investigations in Boston, Chelsea, Revere, and Winthrop. An East Boston man will serve up to five years in state prison for beating another man unconscious outside a Financial District bar hosting a bikini contest two years ago, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury yesterday convicted KEVIN COLON, Jr. (D.O.B. 4/9/86) of aggravated assault and battery on a 47-year-old West Roxbury man in the early morning hours of June 4, 2009. Assistant District Attorney Philip O’Brien of Conley’s Senior Trial Unit recommended that he serve four to five years in state prison; Suffolk Superior Court Judge Judith Fabricant sentenced him to three to five years. more »

State Police detectives assigned to Suffolk County District Attorney Daniel F. Conley’s office are investigating a collision on VFW Parkway in West Roxbury last night that claimed a young man’s life.

State Police responded to the area of Gardner Street shortly after 10:00 p.m. for a report of a pedestrian struck by a motor vehicle. That pedestrian, later identified as 17-year-old Francis McInerney of West Roxbury, was transported to Brigham and Women’s Hospital with extensive injuries. He was pronounced deceased just before 1:00 a.m. more »

A Suffolk Superior Court jury today acquitted a Dorchester man of murdering 21-year-old John Paul Torres outside a party on Dudley Street two years ago.

RAFAEL LARA (D.O.B. 3/11/91) had been charged with second-degree murder for allegedly plunging a knife into Torres’ chest at about 3:45 on the morning of May 3, 2009, causing his death in a hospital bed three days later. more »

The Supreme Judicial Court today upheld a former Chelsea man’s first-degree murder conviction for strangling his estranged wife, 40-year-old Alicia Lao, to death more than a decade ago – the second time the state’s highest court has done so, Suffolk County District Attorney Daniel F. Conley said.

Today’s decision ensures that AGAPITO LAO (D.O.B. 7/10/58) will continue to serve out his sentence of life in prison without the possibility of parole for Alicia Lao’s May 2, 2000, death at his hands inside her Bellingham Street home. Suffolk County District Attorney Daniel F. Conley this week promoted Assistant District Attorney David Deakin to the new position of senior counsel to the district attorney and named two experienced lawyers to oversee drug prosecutions in Boston, Chelsea, Revere, and Winthrop.

Deakin, a Suffolk prosecutor since 1996 and an assistant district attorney in Norfolk County before that, will maintain his current title as chief of the DA’s Family Protection and Sexual Assault Bureau but will also work directly with the district attorney to chart the overall legal operation of the office, Conley said. more »

Suffolk County District Attorney Daniel F. Conley today hailed a decision by the Supreme Judicial Court to uphold a gun-toting drug dealer’s conviction based on evidence recovered in a hotel room from which he’d been evicted, bringing Massachusetts in line with other jurisdictions nationwide.

The state’s highest court yesterday upheld the 2007 conviction of MARK MOLINA (D.O.B. 6/19/83), a former Fenway resident kicked out of the Colonnade Hotel after a series of run-ins with its staff on the night of June 17 and morning of June 18, 2005. Molina was found guilty of trafficking in cocaine, possession of Class C and Class D substances with intent to distribute, and unlawful possession of a firearm and ammunition; he was sentenced to three years in state prison followed by two years of probation. more »

Conley today urged Massachusetts lawmakers to adopt statewide his policy of dismissing charges against minors arrested in prostitution cases, even as a South End man was being arraigned across town for trying to solicit sex from a 14-year-old girl in exchange for money.

In a six-count indictment returned May 6, SERGIO LARA (D.O.B. 7/10/57) is charged with rape of that 5-year-old child, indecent assault and battery on a second 5-year-old child, and two counts each of disseminating matter harmful to minors and open and gross lewdness for incidents involving two boys, ages 8 and 9. Conley, Massachusetts Attorney General Martha Coakley, other law enforcement officials, and service providers for those victimized by the commercial sex trade will brief House lawmakers tomorrow in support of proposed legislation targeting human trafficking.

Representatives Elizabeth Malia and Martin Walsh, who called for the discussion, will host the event in Room B-1 of the State House beginning at 10:30 tomorrow morning.

In 2004, Conley and the Children’s Advocacy Center of Suffolk County launched the Teen Prostitution Prevention Project – now known as Support to End Exploitation Now (SEEN) – and implemented a policy of terminating the prosecution of minors arrested in sex-for-fee cases to divert those exploited youth away from pimps and johns. In January, he filed a bill that would expand that “safe harbor” policy of treating prostituted youth as victims, rather than offenders, statewide. more »

A pair of alleged gang members shot 13-year-old Luis Gerena, Jr., dead after plotting to shoot the first person they saw who looked like a member of a rival group, a Suffolk County homicide prosecutor said in opening statements today.

A Quincy man was held without bail pending a probation surrender hearing following his arraignment for allegedly bringing a loaded handgun to the parking lot of Roxbury District Court yesterday, Suffolk County District Attorney Daniel F. Conley said.

At his arraignment today in the very same courthouse, JAQUAN BENNETT (D.O.B. 6/6/91) was held on $25,000 cash bail on the new arrest, which charges him as a second or subsequent gun offender. He was also held without bail as authorities seek an additional hearing for his alleged violation of probation. A 37-year-old man charged with killing a 56-year-old man in the victim’s Bellingham Street apartment last year was today ordered held without bail, Suffolk County District Attorney Daniel F. Conley said.

MARIO CRUZADO (D.O.B. 7/10/73), who has no permanent address, was charged with one count of murder for the Nov. 26, 2010 homicide of Frederick Allen. A Medical Examiner determined that the victim died of blunt force trauma to the head. Cruzado was arrested last night by members of the Massachusetts State Police Violent Fugitive Apprehension Section, State Police detectives assigned to DA Conley’s office, and Chelsea Police Department officers in the South End on a homicide warrant that was issued on April 13. more »

State Police, Boston Police, and Suffolk County prosecutors are reminding residents and local colleges to use caution along the Charles River Esplanade in light of a sexual assault reported in that area last night.

The reminder comes after a student at an area college reported being assaulted as she sat on a park bench near Massachusetts Avenue at about 11:30 p.m. The assailant is described as a black male about 25 to 30 years old, 6’1” to 6’2”, about 230 lbs, with short hair and a missing front tooth. He was wearing black sweatpants and a green top. The man is said to have engaged the student in a lengthy conversation before assaulting her. She fled the area on foot and reported the assault after going to a friend’s residence to call Boston Police. more »

A Suffolk Superior Court jury today convicted a 37-year-old Boston man of multiple counts of larceny for using fake checks and purchase orders to get companies around the country to send him merchandise without paying for it, Suffolk County District Attorney Daniel F. Conley announced.

KERR CARRINGTON (D.O.B. 1/10/74) was convicted of 13 counts of larceny, nine counts of attempted larceny, and 13 counts of uttering a false check, for offenses that occurred from May 2005 until his arrest in February of 2006. Judge Patrick Brady sentenced Carrington to eight-years in prison. That sentence is to be served consecutively following his completion of a 12- to 15-year sentence he is currently serving for convictions out of Middlesex and Essex Counties for similar offenses. more »

The Massachusetts Appeals Court today upheld a Dorchester man’s conviction for stabbing a co-worker to death at a Copley Place restaurant kitchen, Suffolk County District Attorney Daniel F. Conley said.

The Appeals Court affirmed IVAN LORENZO SOSA’s involuntary manslaughter conviction stemming from the Sept. 15, 2006, stabbing death of 39-year-old Carlos Borrero, Jr., in the Turner Fisheries Restaurant at Copley Square’s Westin Hotel, where both men worked. State Police detectives assigned to Suffolk County District Attorney Daniel F. Conley’s office and Chelsea Police detectives are seeking a vehicle in connection with a violent physical assault early this morning on Parker Street.

The vehicle is described as a four-door, gray car, possibly a Nissan Altima or an Audi and possibly manufactured in the early 2000s, with red numbered license plates. Authorities believe the driver of the vehicle, a dark-haired adult male between 5’7” and 5’10” with a medium build, may have information helpful to investigators. more »

A Suffolk Superior Court jury today acquitted a Roxbury man of murder in connection with the March 30, 2007, shooting death of 18-year-old Dwayne Graham as Graham rode a crowded MBTA bus.

JONATHAN SANDERS (D.O.B. 7/8/89) had been charged with murder for the incident, in which Graham was shot in the head as his Route 23 bus was stopped near the intersection of Normandy and Washington streets. Sanders died of his injury the next day. more »

A district court judge today ordered that a Roslindale man who allegedly struck and killed a scooter operator in Roxbury and then fled the scene not drive during the pendency of the case, Suffolk County District Attorney Daniel F. Conley said.

COLIN RATIU (D.O.B. 11/27/87) was arraigned at the Roxbury District Court and charged with one count of motor vehicle homicide and leaving the scene of an accident causing death. Assistant District Attorney David Bradley of Conley’s Major Felony Bureau requested that Ratiu be held on $25,000 cash bail, and, should he make bail, that he surrender his passport and that he not drive during the pendency of the case. A Hyde Park man acquitted of murder was sentenced to the maximum penalty for possessing a firearm in the vicinity of a fatal 2008 shootout, Suffolk County District Attorney Daniel F. Conley said.

An “ongoing, intense hatred between two gangs” led to angry words and then a gunshot that left 18-year-old Dwayne Graham dead on the floor of an MBTA bus, a senior Suffolk County homicide prosecutor said today.

A Suffolk Superior Court jury today acquitted a Hyde Park man of murder charges stemming from the fatal shooting of 17-year-old Roniel Marc but convicted him of three gun crime he committed during the fatal 2008 gun battle.

A Dorchester teen was committed to the Department of Youth Services today following his admission to a stabbing spree last year that left his mother near death, three other female relatives with stab wounds, and two others with serious injuries.

Suffolk County District Attorney Daniel F. Conley took the oath of office for the fourth time this evening, entering his third full term as the chief law enforcement officer for Boston Chelsea, Revere, and Winthrop at his alma mater, Suffolk University School of Law. 

“It’s no accident that district attorneys are the only members of the criminal justice system who are elected to office and stand directly accountable to the people they serve,” Conley said in remarks after leading 138 assistant district attorneys in their own oaths. “It is necessary and right that we prove ourselves worthy, in character and conduct, of the enormous powers we wield.”  more »

An East Boston man wanted for allegedly beating, slashing, and robbing a woman last summer was arrested this weekend and held on high bail at his arraignment yesterday, Suffolk County District Attorney Daniel F. Conley said.

PAUL A. MORANI (D.O.B. 7/13/87) was formally charged yesterday with multiple counts of assault and battery with a dangerous weapon, as well as a single count of armed robbery and related offenses for the July 30 incident at the 20-year-old victim’s Revere home. Suffolk prosecutors recommended that he be held on $75,000 cash bail; Judge D. Dunbar Livingston set bail at $10,000. more »
