$100k Bail For Probationer Charged With Gun, Drugs

A Hyde Park man was held on high bail yesterday after a probation check-in turned up a handgun, ammunition, and substances believed to be marijuana and cocaine, Suffolk County District Attorney Daniel F. Conley said today.

West Roxbury District Court Judge Michael J. Coyne ordered DULIERE LEMAIRE (D.O.B. 2/1/78) held on $100,000 cash bail on charges of unlawful possession of a firearm, unlawful possession of ammunition, possession of a Class B substance with intent to distribute, and unlawful possession of a Class D substance with intent to distribute.

“Once again we see guns and drugs in a nexus that can only lead to violence,” Conley said. “This was a solid arrest based on good work by the probation officers and police.”

Lemaire had been arraigned on those charges Jan. 7 but, at his attorney’s request, bail arguments were postponed until yesterday so he could gather additional information on his client’s behalf.

Lemaire was taken into custody on Jan. 6 after Boston Police and probation officers assigned to West Roxbury District Court checked in on him at his Westminster Street home. Lemaire was on probation following a 2009 conviction for possession of a Class D substance with intent to distribute.

After granting the officers access to his home and learning that they wanted to see his bedroom, Lemaire allegedly sprinted upstairs. The officers briefly lost sight of him but soon found him in the attic where he was allegedly placing several items in a cardboard box.

The probation officers allegedly saw next to the box two plastic bags containing a white, powdery substance. Inside the box they saw several plastic bags and an open backpack. The backpack contained a plastic bag containing a green, leafy substance and gave off the strong scent of marijuana.

Based on these observations, the officers froze the apartment and obtained a search warrant. The execution of that warrant turned up a Charter Arms .38 caliber revolver with five rounds of ammunition, additional 9mm ammunition, two baggies of white powder believed to be cocaine, two bags of marijuana and several empty gallon-size plastic bags containing marijuana residue, $405 in cash, and personal papers in Lemaire’s name.

Lemaire was represented by attorney Irving Rachland. He will return to court on Feb. 1.
