Alleged Drunk Driver Charged in Crash that Injured Three Others

BOSTON, Oct. 30, 2017—An alleged drunk driver was arraigned today following his hospitalization for injuries he sustained crashing into two other cars, injuring three other people, in Charlestown last month, Suffolk County District Attorney Daniel F. Conley said.

JOHN McCARVILLE (D.O.B. 4/23/69) of Cambridge was arraigned in Charlestown District Court for operating under the influence of liquor as a second offense, causing serious injury while operating under the influence, negligent operation of a motor vehicle, and the civil infractions of possessing an open container of alcohol in a vehicle, failing to wear a seat belt, and speeding. The charges stem from a multi-vehicle crash in the early morning of Sept. 24.

Assistant District Attorney Paul Lewis recommended $7,000 cash bail and orders that McCarville not drive. Judge Lawrence E. McCormick released McCarville on his own recognizance without monetary bail but imposed the no-driving order.

Independent witnesses told State Police that McCarville crashed his 2002 Ford Explorer into a 2014 Honda Accord and a 2012 Toyota Camry after the latter two vehicles were involved in a low-speed collision on the Charlestown side of the Gilmore Bridge shortly before 2:00 a.m. Neither vehicle sustained any damage in that collision. McCarville allegedly drove into the Honda at a high rate of speed, however, colliding with such force that the Honda crashed into the Toyota.

The Honda was occupied by a 27-year-old ride-share service driver, who was transported to Massachusetts General Hospital with head, neck, and chest injuries, and her 22-year-old passenger, who was outfitted with a brace for a neck injury. The woman’s vehicle sustained heavy front end and rear end damage in the crash. The Toyota was occupied by a 58-year-old male taxi driver who was transported to MGH for a leg injury. His vehicle sustained heavy rear end damage.

McCarville was also transported to MGH with head and neck injuries. His vehicle sustained heavy front end damage.

Responding State Police immediately detected the odor of alcohol on McCarville’s breath and observed three open Bud Light cans in and around the vehicle – one in the cup holder that was still cold to the touch, one on the center console, and one outside near the left rear tire. Troopers also observed a cooler in the vehicle. During an inventory incident to its removal from the scene, troopers recovered a total of 22 empty Bud Light cans; 12 unopened Bud Light cans; 10 Smirnoff vodka “nip” bottles, two of which were empty; a partially-consumed Romana Sambuca “nip” bottle; and an empty flask.

State Police submitted an immediate threat license suspension request with the Registry of Motor Vehicles. Troopers charged McCarville with OUI as a second offense in light of a 1988 conviction in Dedham District Court.

McCarville was represented by attorney John Sullivan. His case returns to court on Dec. 18.
