Alleged Gunmen Charged in Separate Weekend Offenses

BOSTON, May 14, 2013—Two men were arraigned yesterday on charges they fired off a handgun after being turned away from a house party and then led police on a chase through Mattapan, and a third was arraigned on weekend gun charges after an illegal firearm fell from his car right in front of police, Suffolk County District Attorney Daniel F. Conley said today.

CHRISTOPHER AJENE (D.O.B. 8/28/90) and GERALD URBY JR. (D.O.B. 6/26/82), both of Mattapan, appeared in Dorchester District Court yesterday on charges stemming from the Saturday night incident in which shots were fired outside an Evans Street home.

Ajene is charged with unlawful possession of a firearm, unlawful possession of ammunition as a subsequent offense, carrying a loaded firearm without a license, and discharging a firearm within 500 feet of a building.  He is additionally charged as a Level II armed career criminal, based on 2010 conviction for distributing a Class B substance and a 2011 conviction for possession of ammunition.

Urby was arraigned on charges of unlawful possession of a firearm as a subsequent offense, unlawful possession of ammunition as a subsequent offense, carrying a loaded firearm without a license, discharging a firearm within 500 feet of a building, failure to stop for police, negligent operation of a motor vehicle, and operating a motor vehicle with a suspended license as a subsequent offense.  He was also charged as a Level III armed career criminal as a result of two separate 2012 convictions for distribution of a Class B drug and possession with intent to distribute a class B drug. He also has a 2007 conviction for unlawful possession of a firearm and unlawful possession of ammunition for which he served two and a half years.

Assistant District Attorney Darcy Kofol requested bail for Ajene and Urby be set at $500,000 each, along with orders that each defendant wear a GPS monitoring device, abide by a curfew, and stay away from all witnesses and each other if they post that amount.  Judge James Coffey set bail at $200,000 for each and additionally ordered Urby held without bail pending a hearing to determine whether he violated his probation on a 2010 conviction for possession of a Class B substance with intent to distribute.

According to prosecutors, Boston Police officers arrived on Evans Street after shots were fired in the area shortly before midnight Saturday.  Witnesses told police that two men had been denied entry to a house party and one of them, later identified as Ajene, responded by pulling a gun and firing it repeatedly, prosecutors said.  Area residents and partygoers provided a description of the men and of the gold Chrysler in which they fled.

Officers quickly spotted the vehicle nearby at the intersection of Morton and Norfolk streets.  Once police changed direction in order to follow the vehicle, the driver, later identified as Urby, sped up to approximately 50 miles per hour and began weaving across lanes, forcing other vehicles to swerve to avoid a collision, prosecutors said.

The vehicle took an abrupt left turn onto Mildred Avenue.  Rather than making a similarly abrupt turn through oncoming traffic, police took the next left turn and were able to catch up to the defendants, prosecutors said.  The defendants pulled onto Duxbury Road – a dead end street – and were apprehended after attempting to escape on foot, according to prosecutors.

A search of the path of flight revealed a Ruger .380 semiautomatic handgun on Mildred Avenue.

Also arraigned yesterday was TYREEK SESAY (D.O.B. 7/14/92) of Randolph, who appeared in Roxbury District Court on charges of possession with intent to distribute a Class D substance, possession of a Class B substance, unlawful possession of a firearm, unlawful possession of ammunition, and carrying a loaded firearm without a license.  Assistant District Attorney Thomas Costello requested $10,000 bail.  Judge Pamela Dashiell imposed $7,500 bail and ordered Sesay to wear a GPS monitor and stay out of Boston except between the hours of 7:30 a.m. and 2:30 p.m. on weekdays.

Officers responding to a report of shots fired inside the Lenox Street housing development shortly before 11:00 Friday morning had their attention drawn to Sesay as he made numerous, unsuccessful attempts to parallel park on Dewitt Drive, prosecutors said.  Rather than focusing on the task of parking, Sesay’s attention and gaze were fixed in the direction of police, prosecutors said.

Officers exited their cruiser and had a brief conversation with Sesay, who appeared to shake nervously as he sat in the vehicle, prosecutors said.  As he stepped out of the car, he dropped an object from his right side, which made a thud on the ground, according to prosecutors. Sesay quickly retrieved the item and slipped it in his jacket pocket. For their safety, officers searched Sesay and found a Jennings J-22 .22 caliber handgun inside a sock in Sesay’s pocket, which he allegedly told police he had just found, prosecutors said.

Also found on Sesay were four bags of marijuana, a stack of cash totaling $2,420, and two Percocet tablets inside his wallet, and two large plastic bags of marijuana were found during an inventory of the vehicle, prosecutors said.

Sesay is represented by Steven Kim.  He will return to court on June 11.  Ajene and Urby will return to court on June 3.  Urby is also expected to appear in Dorchester District Court on May 29 for a final surrender hearing on his probation matter.
