Bail Revoked for Juvenile Caught with 2nd Gun

BOSTON, Sept. 30, 2015—A Dorchester teen out on bail in a pending gun case had that bail revoked after he was arrested on new firearm charges Monday, Suffolk County District Attorney Daniel F. Conley said.

The 17-year-old male from Dorchester was arraigned yesterday in the juvenile division of Dorchester Municipal Court on charges of unlawful possession of a firearm, unlawful possession of ammunition, and carrying a loaded firearm.  At the request of Assistant District Attorney Adam Foss, Judge Peter Coyne set bail in the amount of $20,000 and revoked the juvenile’s open bail in a January gun case. 

According to prosecutors, the defendant had been released on bail in the pending case after the $100,000 bail imposed in January was reduced to $20,000.  The juvenile’s mother posted the reduced bail; she was allowed to surrender the juvenile and retrieve the bail money.

Foss told the court that Boston Police officers inside an unmarked cruiser observed the 17-year-old in the area Rozzella Street at approximately 12:30 p.m. yesterday and stopped to ask if he had school that day.  The juvenile allegedly made statements that he had just left court, where he claimed to have just “beaten” a firearm case, prosecutors said.  That case – which involved the recovery of a loaded 9mm semiautomatic Ruger P95 handgun during his Jan. 6 arrest on Catbird Court – remains pending, however.

As their conversation continued, prosecutors said, the defendant repeatedly reached his hand to the right side of his waist and appeared to attempt to secure something in his waistband, despite police commands to keep his hands visible.  The officers recognized this from their training as a characteristic of an armed gunman and exited the cruiser to pat frisk him.  As they did so, the defendant hunched over and attempted to conceal his right side from police while resisting attempts by officers to perform a pat frisk.

During the struggle, officers recovered a Taurus PT-22 caliber firearm loaded with eight rounds in the magazine and one in the chamber from the right side of the juvenile’s waistband, prosecutors said.

The defendant returns to court Oct. 26.  He is represented by attorney Christopher Belezos.
