Domestic Violence Suspect Held After Dangerousness Hearing

A Suffolk County prosecutor today convinced a Boston Municipal Court judge that a 32-year-old Somerville man was so dangerous as to warrant being held without bail pending trial, District Attorney Daniel F. Conley said.

JOSE GONZALEZ (D.O.B. 12/16/78) was arraigned yesterday and charged with mayhem for allegedly severing two of his girlfriend’s fingers with a knife. He was held pending this afternoon’s hearing under the state’s so-called “dangerousness statute.”

Under Ch. 276, Sect. 58A, of the Massachusetts General Laws, a judge may hold a defendant accused of certain violent crimes without bail for up to 90 days pending trial upon “clear and convincing evidence that no conditions of release will reasonably assure the safety of any other person or the community.”

At today’s hearing, Assistant District Attorney Patrick Devlin introduced the testimony of a Boston Police detective who testified that he responded to the Boston Medical Center in the early morning hours of April 2, after receiving a report that a 30-year-old victim was in the emergency receiving treatment for trauma to three fingers, which had been severed.

According to the testimony of another Boston Police officer, the defendant and victim appeared to be arguing in a vehicle in the area of 1679 Washington St. When the officer approached the tearful victim to ask if anything was wrong, she indicated that she was alright. About 15 minutes after this interaction, the defendant was captured on a surveillance video dropping the victim off at the Boston Medical Center. When police detectives spoke with Gonzalez, he allegedly denied seeing the victim injured.

Detectives then went to the area of Washington Street where the officer had seen the victim and defendant earlier. Investigators found a trail of blood, a blood-stained foldout knife, and the victim’s severed pinky finger on the street.

At today’s hearing, Devlin told the court that Gonzalez had been previously convicted in Suffolk Superior Court of charges of assault and battery with a dangerous weapon and possession of a firearm.

Based on that testimony, Boston Municipal Court Judge Patricia Bernstein ordered Gonzalez held without bail pending trial.
