First-Degree Murder Indictment in February Slaying

BOSTON, May 23, 2012—The Suffolk County Grand Jury today returned indictments charging a Dorchester man with first-degree murder for the shooting death of 23-year-old Anthony Depina in Roxbury earlier this year, Suffolk County District attorney Daniel F. Conley said.

The indictments also charge JASON BARBOSA (D.O.B. 1/8/89) with unlawful possession of a firearm as an armed career criminal in light of prior convictions for assault with a dangerous weapon.

Barbosa is currently held without bail on a Roxbury District Court complaint charging him with Depina’s Feb. 23 murder on Burrell Street. The indictments move Barbosa’s case to Suffolk Superior Court, where he will be arraigned on June 4.

Prosecutors say Depina was out socializing the night he was killed. At some point, Barbosa – who knew the victim prior to his death – allegedly approached the Depina and chastised him, saying he wasn’t “supposed to be around here.”

Later that night, prosecutors say, Barbosa approached Depina on Burrell Street and shot him. Depina suffered gunshot wounds to his head and chest, either one of which would have been fatal.

Boston Police homicide detectives developed witness accounts that assisted in determining Barbosa’s whereabouts before, during, and after Depina’s slaying. They also recovered video surveillance images that captured him in the area around the time of the shooting. Moreover, Barbosa was wearing a GPS monitoring device that put him on Burrell Street when Depina was killed.
