Five Indicted in Two 2015 Homicides

BOSTON, April 2, 2015—Suffolk prosecutors today indicted five men charged with the separate murders of Kenneth Lamour and Ryan Morrissey earlier this year, District Attorney Daniel F. Conley announced.

The Suffolk County Grand Jury today returned indictments charging DONTE HENLEY (D.O.B. 5/18/90) of South Boston and JOSIAH ZACHERY (D.O.B. 7/13/96) of Hyde Park with first-degree murder for Lamour’s shooting death as he shoveled snow in Jamaica Plain following a February storm. Zachery was additionally indicted for armed assault with intent to murder and unlawful possession of a firearm for allegedly firing at a Boston Police officer while fleeing the scene.

The same grand jury indicted DANILO SOTO (D.O.B. 7/10/93) of Dorchester, ALEXANDER SOTO (D.O.B. 9/6/97) of Charlestown, and JULIO BAEZ (D.O.B. 2/28/91) of Charlestown with first-degree murder for Morrissey’s homicide and armed assault with intent to murder for fatally and assault and battery with a dangerous weapon causing serious bodily injury for the non-fatal shooting of a second victim in the same incident.  Danilo Soto and Alexander Soto were additionally charged with unlawful possession of a firearm and carrying a loaded firearm.

All five men are currently held without bail following their municipal court arraignments.  Dates have not yet been set for their Superior Court arraignments.

An investigation led on the street by Boston Police homicide detectives and continued by Suffolk prosecutors behind the doors of the grand jury revealed that Henley was working alongside Lamour on a shoveling crew organized by a non-profit agency on Feb. 11 when Henley allegedly contacted Zachery by text message to arrange Lamour’s murder.

Zachery allegedly approached Lamour on Centre Street in Jamaica Plain and shot Lamour in the head before fleeing on foot, firing once at a pursuing Boston Police officer as he ran.  He was apprehended on Centre Street a short time later, and Henley was taken into custody about two weeks later as the investigation unfolded.

In the latter case, Danilo Soto and Alexander Soto, who are not related, allegedly walked past a convenience store on Main Street in Charlestown on Nov. 5 and observed a group standing outside.  Minutes later, the two returned to the location and opened fire; by that time, however, the group they had seen had entered the store and the gunmen instead shot and killed Morrissey and wounded another teen, both of whom had just exited the store.  Danilo Soto and Alexander Soto allegedly fled on foot to a waiting vehicle operated by Baez and left the area, striking a parked vehicle as they fled.

The grand jury proceedings resulting in indictments against Zachery and Henley were led by Assistant District Attorney Ian Polumbaum.  The proceedings leading to the indictments against Danilo Soto, Alexander Soto, and Baez were led by Assistant District Attorney Mark Hallal with the assistance of Assistant District Attorney Mark Hallal. The defendants’ Superior Court arraignments have not yet been scheduled.
