Four Guilty in Deadly Mob Attack

A Suffolk Superior Court jury today convicted three men of beating 22-year-old Jose “Danny” Alicea to death outside a downtown nightclub two summers ago, Suffolk County District Attorney Daniel F. Conley said.

Jurors returned their verdicts this morning, convicting DANIEL EK (D.O.B. 7/13/86) and JOHAN GARCIA (D.O.B. 11/24/80), both of Lynn, and ANTHONY VILLALOBOS (D.O.B. 12/29/87) of Revere of involuntary manslaughter. On Feb. 4, the fifth day of trial, JASON BENALFEW (D.O.B. 11/13/82) of Lynn pleaded guilty to the same offense.

Each defendant was additionally charged with multiple assault-related offenses for kicking and beating three of Alicea’s friends during the same incident. Jurors convicted Ek of one count of assault and battery with a dangerous weapon and two counts of assault and battery; Garcia of one count of assault and battery with a dangerous weapon and two counts of assault and battery; and Villalobos of two counts of assault and battery.

The verdicts came on the fifth day of deliberations and followed a trial that began on Jan. 24.

“This was an extremely complex case,” Conley said. “The jurors clearly gave great thought to a large amount of evidence over an extended period of time. We hope Mr. Alicea’s family finds some satisfaction that these assailants were held accountable, and we’re ready to move forward on the remaining defendants.”

Judge Patrick Brady will sentence Ek, Garcia, and Villalobos at 9:00 a.m. on March 14. Benalfew is expected to be sentenced in April. Four additional defendants are expected to face trial in mid-March.

Assistant District Attorneys David Fredette and Amy Galatis of the DA’s Homicide Unit tried the case. Katherine Moran was the assigned victim-witness advocate. Ek, Garcia, Villalobos, and Benalfew were represented by attorneys William White, Timothy Bradl, Francisco Napolitano, and Hank Brennan.
