Grand Jury Indicts Mother Who Allegedly Threw Newborn

A Suffolk County grand jury yesterday returned indictments against an East Boston teen who allegedly threw her baby boy out a second floor window moments after giving birth, District Attorney Daniel F. Conley said.

The indictments charge EVA FLORES (D.O.B. 5/5/92) with one count each of assault and battery on a child causing serious injury and wanton and reckless endangerment of a child. The charges stem from a Sept. 20 incident at Flores’ Saratoga Street home.

The newborn was found at about 11:00 p.m. in a fenced-off alleyway between 443 and 445 Saratoga St. A neighbor heard his cries, jumped the fence, and called for help upon finding the baby lying face down.

When first admitted to Massachusetts General Hospital, the infant was suffering from abrasions and hypothermia. Additional tests soon showed that he was also suffering from skull fractures, bleeding in the brain, and seizure disorder.

Flores allegedly later gave statements to Boston Police and social workers indicating that she had thrown the baby from the window after giving birth. Evidence at the scene – including a portion of the umbilical cord found inside the drain of her bathtub – corroborated those statements. The baby is now in the custody of the state’s Department of Children and Families.

Flores has been held on $1500 cash bail since her district court arraignment on Oct. 12. The indictments move her case to Suffolk Superior Court, where she is expected to be arraigned again on Monday morning.
