GRAND JURY RETURNS INDICTMENTS IN TEEN’S SLAYING

Suffolk County District Attorney Daniel F. Conley today announced a pair of murder indictments for the May 30 shooting death of 14-year-old Nicholas Fomby-Davis in Dorchester.

The indictments charge JOSHUA FERNANDES (D.O.B. 8/8/93 and CRISOSTOMO LOPES (D.O.B. 2/27/90), both of Dorchester, with one count each of first-degree murder. Lopes allegedly held Fomby-Davis as Fernandes shot him on Olney Street in Dorchester; Fernandes is additionally charged with unlawful possession of a firearm.

Though a juvenile, Fernandes will be tried as an adult. Under Massachusetts law, defendants 14 and older who are charged with murder are treated as adults and tried in Superior Court. Today’s indictments are the legal mechanism moving the case from district court to Superior Court, where the case will be adjudicated.

Conley’s chief trial counsel, Assistant District Attorney Patrick Haggan, led the grand jury investigation that began shortly after Fomby-Davis was slain. Kara Hayes, chief of the DA’s Victim-Witness Assistance Program, is the assigned victim-witness advocate.

Fernandes is represented by attorney John Palmer and Lopes by attorney Christopher Belezos. Both defendants are expected to return to Dorchester District Court on July 9; a Superior Court arraignment date has not yet been scheduled.
