HIGH BAIL IN ALLEGED ASSAULT ON MBTA INSPECTOR

A Lynn man was held on $10,000 cash bail today and may enter a substance abuse clinic following his arrest for assaulting an MBTA employee while shouting ethnic slurs at him earlier this month, Suffolk County District Attorney Daniel F. Conley said.

DANIEL JOURDET (D.O.B. 5/2/52) was arraigned in the Boston Municipal Court this morning on charges of assault and battery, violation of civil rights, disorderly conduct, and trespassing, all incurred on the evening of April 1 on the inbound platform of Copley station.

Citing Jourdet’s open cases in East Boston District Court and criminal convictions in at least three other states, Assistant District Attorney Kate Clayman recommended that he be held on $50,000 cash bail; Judge Mark Hart Summerville set bail in the lower amount but did allow her motion for a protective order on the victim’s personal information and ordered Jourdet to stay away from the victim.

Clayman told the court that Jourdet had been identified by MBTA Transit Police as the individual depicted on civilian and surveillance footage assaulting an MBTA inspector near the fare gates and throwing a punch that appears to hit the victim, knocking him off balance and causing his hat to fall to the ground.

Clayman said that inspector and a female inspector had observed Jourdet and another man yelling and “shadowboxing” on the platform. Both were intimidating other passengers, Clayman said, and both appeared to be intoxicated.

The victim asked Jourdet and his associate to stop their disorderly behavior or leave the station. Instead, Jourdet allegedly poured forth a stream of invective based upon the victim’s ethnicity and the other inspector’s gender. He then allegedly threw a punch at the victim before leaving the station.

After hearing from a court clinician, Summerville indicated that he would allow Jourdet to be placed at the Massachusetts Alcohol and Substance Abuse Clinic at Bridgewater if the clinic would accept him as an inpatient client.

Jourdet was represented by attorney Lucy Rivera. He will return to court on May 21.
