BOSTON, March 6, 2015—A Suffolk Superior Court jury today convicted a heroin trafficker who stocked his Allston apartment with three handguns and more than 350 rounds of ammunition, Suffolk County District Attorney Daniel F. Conley said.

Jurors deliberated for about five hours before convicting MARCO OVIEDO (D.O.B. 2/5/74) of three counts of unlawful possession of a firearm, four counts of unlawful possession of a large-capacity feeding device, and single counts of trafficking in more than 100 grams of heroin and unlawful possession of ammunition.

“With such a large quantity of illicit drugs and an arsenal of illegal weapons in a crowded residential apartment building, someone was going to get hurt,” Conley said. “Fortunately, Boston Police got there first.”

Assistant District Attorney Ben Megrian of the DA’s Gang Unit proved that Oviedo had custody and control over the three handguns, hundreds of rounds of ammunition, and large quantity of heroin that were in his bedroom on Sept. 17, 2013.

The weapons recovered from Oviedo’s room were a Heckler & Koch USP .45 caliber semiautomatic handgun with an obliterated serial number, a Smith & Wesson SW40VE .40 caliber semiautomatic handgun, and a Glock 22 .40 caliber semiautomatic handgun with its serial number plate removed. Also recovered were 36 rounds of .45 caliber ammunition, 174 rounds of .40 caliber ammunition, 100 rounds of 9mm ammunition, 50 rounds of .22 caliber ammunition, with some of those rounds loose, others in 50-round boxes, and still others in high-capacity magazines.

Members of the Boston Police District 14 Drug Control Unit executed a search warrant on the 1387 Commonwealth Ave. apartment at about 5:00 that morning. They also recovered more than 200 grams of cocaine in another bedroom inside the same apartment; Oviedo’s co-defendant, GABRIEL NUNEZ (D.O.B. 1/27/88), is also charged with drug trafficking, but defaulted on the case and is the subject of an active arrest warrant.

Oviedo faces sentencing on Tuesday before Judge Christopher Muse.
