Manslaughter Indictment in Collision that Killed Girl, 7

BOSTON, March 13, 2014—The driver who allegedly struck and killed 7-year-old Brianna Rosales and seriously injured the girl’s mother has been indicted for manslaughter in connection with the collision on Olney Street late last year, Suffolk County District Attorney Daniel F. Conley said.

The indictments, returned yesterday, charge OLIVIA MORA (D.O.B. 7/19/77) with manslaughter by motor vehicle, motor vehicle homicide while operating under the influence, assault and battery with a dangerous weapon, operating under the influence causing serious bodily injury, and leaving the scene of an accident causing personal injury.

The indictments move Mora’s case from Dorchester Municipal Court to Suffolk Superior Court, where she faces at least five and up to 20 years in state prison if convicted on the manslaughter charge.

Mora is accused of driving drunk and at a high rate of speed on the afternoon of Nov. 26. The victims were walking on Olney Street when they were struck by Mora’s Chevrolet Tahoe. Evidence suggests the sport-utility vehicle was going over the speed limit when it struck a parked car, jumped the curb, hit a fire hydrant, then collided with the victims. Rosales was mortally injured and succumbed to her injuries at Boston Medical Center. Her mother, 26 and a resident of Dorchester, suffered life-threatening injuries but survived.

Responding Boston Police officers detected the odor of alcohol when speaking to Mora, who allegedly failed a series of field sobriety tests and refused a Breathalyzer test.

Mora was believed to be living in Dorchester at the time of the collision but was carrying a California driver’s license and operating a vehicle registered in New Hampshire. She is represented by attorney John Pavlos. Her arraignment in Superior Court has not yet been scheduled.
