Motor Vehicle Homicide Suspect Arraigned in Hospital Bed

A Dedham man charged with killing his 26-year-old female passenger in a weekend car crash was arraigned yesterday in a hospital bed just blocks from the crash site, Suffolk County District Attorney Daniel F. Conley said.

ROBINSON AVENDANO (D.O.B. 11/7/72), currently an inpatient at Beth Israel Deaconess Medical Center, was formally charged yesterday with motor vehicle homicide, operating under the influence of alcohol, and negligent operation of a motor vehicle. Assistant District Attorney Edward Curley recommended that Avendano be held on $250,000 cash bail. Roxbury District Court Judge Pamela Dashiell set bail at $100,000 cash, ordering Avendano to live with his mother, abide by a 7:30 p.m. to 6:00 a.m. curfew, submit to random alcohol testing, and report weekly to a probation officer if he posts that amount.

Avendano is charged with the death of Diana Sanchez, a Dorchester woman killed when Avendano crashed his BMW on the Riverway near Brookline Avenue at about 1:00 Saturday morning. The car rolled over in the collision, trapping Sanchez – the front seat passenger – between the roof and the road and causing fatal injuries. Boston firefighters had to extricate her remains from the wreckage.

Curley said Massachusetts State Police responded to the scene to find Avendano being loaded into an ambulance for transport to Beth Israel. His eyes were said to be red and glassy and smelled of alcohol. A second woman, who had been riding in the back seat, was injured less seriously and treated at Brigham and Women’s Hospital.

Curley said the woman told investigators that she, Sanchez, and Avendano had been drinking at an Allston bar that night and that Avendano was driving at a high rate of speed and lost control.

Those statements are borne out by the preliminary investigation, Curley said: troopers found three empty bottles of Mojo, an alcoholic beverage, in the debris field surrounding the BMW; a receipt dated the night of Oct. 21 and listing numerous alcoholic drinks was recovered from Avendano’s property; and collision reconstruction experts made an early estimate that he was driving in excess of 20 mph over the speed limit at the time of the crash.

Avendano was represented by attorney William Keefe. He will return to court on Nov. 23.
