NO BAIL FOR SUSPECT IN VIOLENT RAPE ATTEMPT

A Level III sex offender was held without bail at his arraignment this morning on charges that he violently tried to rape a stranger in a women’s restroom at Massachusetts General Hospital yesterday, Suffolk County District Attorney Daniel F. Conley said today.

DAVID FLAVELL (D.O.B. 6/22/69) is charged with assault with intent to rape and assault and battery with a dangerous weapon for beating the 27-year-old victim’s head against the floor during the attack. Acting on a request by Assistant District Attorney David Deakin, Judge Edward Redd denied Flavell bail and ordered him held until he can be evaluated by a court clinician on Tuesday.

“It was a brazen attack and a very violent attack,” Conley said. “We’re using every tool at our disposal to keep this man off the streets.”

Conley said the victim suffered facial injuries during the incident that, while serious, are not life threatening.

“That in no way diminishes the violence of this attack or the terror she endured,” Conley said. “This was extremely serious and she put up a very strong fight.”

Deakin, the chief of Conley’s Family Protection and Sexual Assault Bureau, told the court that Flavell was apprehended by MGH Police moments after the victim escaped, bloody and screaming, from the women’s room in which he allegedly attacked her.

Boston Police sexual assault detectives, who are leading the investigation, also responded to the hospital to seal the crime scene and interview the victim and suspect. That victim positively identified Flavell as the attacker, Deakin said.

Flavell was represented today by attorney Neil Madden. He will return to the Boston Municipal Court on Tuesday.
