Prosecutor: Drunk Motorcyclist Didn’t Slow Before Hitting Trooper

BOSTON, June 7, 2016—A Lynn man was arraigned in his hospital bed today on charges he struck a State Trooper with his motorcycle, Suffolk County District Attorney Daniel F. Conley said.

DANILO DiROCHE (D.O.B. 12/17/89) was arraigned this afternoon in his hospital room at Beth Israel Deaconess Medical Center in Boston on charges issued out of Chelsea District Court of operating under the influence, assault and battery with a dangerous weapon, resisting arrest, reckless operation, failure to stop, speeding, leaving the scene of an accident causing personal injury, marked lanes violation, number plate violation, operating an unregistered vehicle, passing violation, and a learner’s permit violation.  Chelsea District Court Judge James Wexler imposed bail of $10,000 and ordered DiRoche to remain drug- and alcohol-free subject to random screenings and not drive unless properly licensed while the case is pending.

Assistant District Attorney Vincent DeMore told the court that State Police patrolling in the area of Revere Beach Boulevard observed a Yamaha motorcycle approaching at a high rate of speed.  Troopers entered the roadway and shouted commands for the operator, later identified as DiRoche, to stop.  DiRoche allegedly ignored the commands and maneuvered around troopers at approximately 60 miles per hour; the posted speed limit on the roadway in the pedestrian-heavy area is 30 mph.

DiRoche allegedly traveled approximately a half-mile before encountering another trooper who standing outside his cruiser while conducting a traffic stop, prosecutors said.  The trooper, observing DiRoche’s high rate of speed, gave both verbal commands and hand signals ordering him to stop.  DiRoche allegedly made no attempt to slow down or maneuver around the trooper and instead struck the trooper, knocking him to the ground.

The motorcycle then struck another vehicle on the opposite side of the roadway and came to a rest on its side.  DiRoche allegedly fled on foot.  He was captured as he ran through a field between Revere Beach Boulevard and Ocean Avenue.

In a post-Miranda interview with police, DiRoche allegedly made statements that he drank three to four beers before operating his motorcycle and made additional statements incriminating himself, prosecutors said.  Troopers observed that a moderate odor of alcohol emanated from DiRoche, his eyes were glassy and bloodshot, and his speech was slurred.

Police discovered that DiRoche’s motorcycle was unregistered.

DiRoche was transported to Whidden Hospital in Everett and then to Beth Israel Deaconess Medical Center for treatment of injuries suffered in the motorcycle crash; the injured trooper was transported to Massachusetts General Hospital with non-life threatening injuries.

DiRoche was represented by Brad Bailey.  He returns to court July 7.
