PROSECUTORS DROP SOME CHARGES IN VANDALISM CASE

Suffolk County prosecutors affirmatively terminated 14 vandalism charges against a Los Angeles man today but left open the door for continued prosecution of an additional 13 similar offenses.

Prosecutors today filed a nolle prosequi formally ending the prosecution of FRANK SHEPARD FAIREY, 39, for a series of stickers placed on signposts and other public property within the jurisdiction of the Roxbury Division of the Boston Municipal Court Department.

“The Commonwealth has reviewed the police investigation and evaluated the evidence supporting these charges,” prosecutors said in today’s filing. “There is insufficient evidence to prove beyond a reasonable doubt that the defendant himself placed these stickers.”

Prosecutors did not file similar documents in Fairey’s 10 open cases in the BMC’s Central Division or his three open cases in the BMC’s Brighton Division, stating their intention to continue with any cases in which they can meet their burden of proof.

Fairey was arraigned Feb. 9 in Brighton for a case in which Boston Police observed him pasting a poster onto a Brighton avenue electrical box in the early morning hours of Sept. 16, 2000. He did not appear at his scheduled arraignment later that morning and remained in default until his arrest on Feb. 6 of this year.

Assistant District Attorney Adam Foss is prosecuting the case. Attorney Jeffrey Wiesner represents the defendant. Fairey’s case will next be heard in the Boston Municipal Court on June 15 and in Brighton court on July 9.
