ROSLINDALE MAN CHARGED WITH ORANGE LINE EXPOSURE

A Roslindale man was charged with open and gross lewdness last week after multiple passengers on his subway car reported to Transit Police that he was masturbating while en route to Forest Hills.

MIL DELACRUZ (D.O.B. 2/19/82) was arraigned Friday in West Roxbury District Court following his arrest by Transit Police on Thursday afternoon. Suffolk prosecutors recommended that he be held on $5000 cash bail; Judge Kathleen Coffey set bail at $300 and ordered him to stay off the MBTA during the pendency of his case, undergo alcohol abuse treatment, report to the Department of Probation weekly, and attend Alcoholics Anonymous meetings.

Shortly before 5:00 p.m. on Feb. 4, MBTA Transit Police on directed patrol at Forest Hills station began receiving reports of a man who had been masturbating on an Orange Line car. One witness described him as wearing a black and gray jacket, blue jeans, and short hair pulled back.

In short order, officers located a man matching that description. They observed his fly to be open and his genitals to be exposed. As the officers spoke to this man, later identified as Delacruz, another witness approached them and said he had seen Delacruz stand up and begin openly masturbating on the train. The officers took Delacruz into custody at that time.

Delacruz was represented at arraignment by attorney Jose Vincenty. He will return to court on Feb. 25.
