Scooter-Riding Road Rage Defendant Now a Victim

A scooter operator charged with smashing a motorist’s window is now also a victim after the motorist’s husband allegedly beat him with his own helmet, Suffolk County District Attorney Daniel F. Conley said.

NATHANIEL FREEDBERG (D.O.B. 10/28/59) of Allston was arraigned in Brighton District Court yesterday on a malicious destruction of property charge for allegedly smashing the window of a 36-year-old Brighton woman’s sport-utility with his helmet Sunday afternoon.

In that case, Freedberg allegedly believed the woman had cut him off on Allston Street as he rode his Vespa PX150 scooter, so he followed her to Commonwealth Avenue, removed his helmet, and repeatedly struck her driver’s side window until it smashed, showering her with broken glass and cutting her arm. The woman’s 4-month-old son was in the vehicle at the time.

Emergency medical technicians treated the woman for minor injuries at the scene. An independent witness told responding Boston Police that Freedberg was yelling throughout the incident, “You [expletive] bitch, you ran me off the road.”

Freedberg posted $200 cash bail, was ordered to stay away from the victim, and will return to court on Aug. 24.

As Freedberg left court following his arraignment, however, the woman’s husband, FERNANDO CASTRO-LABOY (D.O.B. 2/27/77) of Jamaica Plain, attacked him. After a brief struggle on the sidewalk outside the courthouse, Castro-Laboy allegedly grabbed Freedberg’s helmet and struck him in the head with it.

Court officers assigned to the Academy Hill Road courthouse responded to the fight and separated the parties. At that point, Castro-Laboy reached around the officer and struck Freedberg once more in the face. The court officers notified Boston Police, who responded and took Castro-Laboy into custody.

“I [expletive] him up,” he allegedly told the officers. “You don’t mess with someone else’s family.”
Freedberg was transported to St. Elizabeth’s Hospital for injuries not deemed life-threatening.

At his arraignment today, Castro-Laboy was held on $500 cash bail and ordered to stay out of Allston and away from Freedberg. He was represented by attorney Kathy Campbell. His next scheduled court date is Aug. 24, but prosecutors will seek to change that date in light of Freedberg’s pre-trial hearing that same day.
