SECOND DEFENDANT CHARGED IN OXYCONTIN PROBE

A Charlestown woman today became the second person charged in an extensive investigation into OxyContin distribution in East Boston last year, Suffolk County District Attorney Daniel F. Conley said.

Arrested yesterday by State Police narcotics detectives assigned to Conley’s office, MICHELLE KELLY (D.O.B. 11/3/83) was arraigned today on a single count of distributing a Class B substance – OxyContin – within 1,000 feet of a school and within 100 feet of a park. Suffolk Superior Court Clerk Magistrate Robin Vaughan set her bail at $1,000 cash.

Assistant District Attorney Brian Fahy of Conley’s Narcotics Unit told Vaughan that Kelly was charged amid a long-term investigation that also resulted in her boyfriend’s indictment on 12 counts of distributing OxyContin and one count of trafficking in more than 14 grams of the same powerful prescription painkiller. As with Kelly, each of those charges comes with a school zone and/or a park zone enhancement.

The boyfriend, PAUL J. DOHERTY (D.O.B. 5/29/81) of East Boston, was arraigned yesterday and ordered held on $250,000 cash bail. Prosecutors say that Doherty sold about 100 OxyContin tablets to undercover State troopers on various dates throughout the latter half of 2008, and they further allege that Kelly was present for many of those deals.

On one occasion, an undercover trooper visited Doherty’s Lexington Street home to purchase OxyContin tablets. Doherty was not home, and Kelly allegedly called him before selling the trooper two tablets. That Dec. 22, 2008, sale was the foundation for Kelly’s arraignment today.

Kelly, represented by attorney Joseph Perullo, and Doherty, represented by attorney Joseph Keegan, will return to court on Jan. 20. Their trial has been tentatively scheduled for Aug. 20, 2010.
