SECOND GUNMAN INDICTED IN KA’-CARLOS MURDERS

Suffolk County District Attorney Daniel F. Conley today announced the indictments of three men, including one who was shot in the leg, for a Dorchester shooting that left two dead on Hancock Street this summer.

The Suffolk County Special Grand Jury today indicted EMMANUEL PINA, a.k.a. EMMANUEL DePINA (D.O.B. 4/25/83), and SANDRO TAVARES (D.O.B. 12/25/83), both of Dorchester, for the murders of 20-year-old Jovany Eason and 47-year-old Manuel Monteiro in the early morning hours of Aug. 2. Eason had been involved in earlier altercations at the restaurant, while Monteiro was an employee who had tried to defuse the confrontation.

The Special Grand Jury additionally indicted Pina and TIMOTHY SANTOS (D.O.B. 6/26/85) for armed assault with intent to murder for allegedly shooting at one another during the conflict outside Ka’-Carlos Bar and Grill. Santos was wounded during that exchange; DePina was not.

All three defendants are also charged with unlawful possession of a firearm.

Boston Police homicide detectives and Suffolk County homicide prosecutors worked together for almost three months to build the case, developing extensive evidence behind the closed doors of the Special Grand Jury. Conley credited assistance from witnesses as playing a “major role” in the investigation.

Evidence suggests that Pina and Tavares arrived at the restaurant around the time of its last call and that Tavares was one of several people who argued with Eason and Eason’s friends. Tavares left the restaurant after one of those arguments. After a physical fight broke out in the men’s room, Eason also left the establishment and Pina and a friend were escorted out.

Throughout these altercations, Monteiro – a cook who remained at Ka’-Carlos to help clear the establishment at the end of the evening – attempted to defuse the conflicts and ensure the safety of other patrons.

Outside the restaurant, prosecutors allege, Pina, Tavares, and another man confronted Eason as Eason was opening his car door. Tavares allegedly produced a semiautomatic handgun and attempted to rack the slide, but could not do so; Pina then allegedly approached Tavares and took the gun.

Armed with Tavares’ gun, Pina allegedly chased Eason back towards Ka’-Carlos, where Monteiro was positioned near the front door. Pina allegedly fired once, sending a bullet through the window and into Monteiro’s chest, mortally wounding him.

Pina allegedly pursued Eason while continuing to fire, and Eason fell to the ground on nearby Bird Street suffering from multiple gunshot wounds. He, too, was mortally wounded.

Prosecutors also allege that Pina and Santos traded shots a short distance away near the intersection of Jerome Street and Cushing Avenue, with Pina striking Santos in the leg. Prosecutors allege that Santos handed his weapon to a confederate and applied to Boston Medical Center to seek treatment for his injuries.

Assistant District Attorney John Pappas of Conley’s Homicide Unit led the grand jury investigation. Cat Yuan is the victim-witness advocate assigned to the case.

Pina is represented by attorney James Budreau. He, Tavares, and Santos are expected to be arraigned in the near future in the Magistrate’s Session of Suffolk Superior Court.
