BOSTON, Nov. 19, 2012—Two former Roxbury men already detained on other matters have been indicted for the 2010 daytime murder of 18-year-old Terrence Kelley in the Grove Hall neighborhood, Suffolk County District Attorney Daniel F. Conley said.

The Suffolk County Grand Jury on Nov. 14 returned indictments charging DARIUS GIBSON (D.O.B. 8/16/90) with murder, unlawful possession of a firearm, and witness intimidation. JAMES AUSTIN (D.O.B. 3/14/88) was indicted Oct. 17 for misleading Boston Police investigating the case and being an accessory after the fact to Kelley’s murder.  He was held on $100,000 bail at his arraignment.

Kelley had just left a friend’s house on the sunny Friday afternoon of May 28, 2010, when a gunman chased him down Creston Street and shot him multiple times.  Kelley was transported to Boston Medical Center, where he died of his injuries. Witnesses, corroborated by area surveillance video, eventually implicated Gibson as the killer.  He is also accused of threatening a potential witness.

Prosecutors say Austin witnessed the shooting from his front steps but told Boston Police homicide detectives he did not know Kelley or Kelley’s assailant. Evidence presented during the two-year grand jury probe indicated that Austin and Gibson knew each other well and both had motives to harm the victim.

Gibson is now held on separate charges that he shot three men in Brockton in September 2010. He has also pleaded guilty to, but not yet begun his sentence for, federal firearms offenses. Austin, meanwhile, has been held since July 2010 on charges that he and a female accomplice robbed two men after setting them up through a Craigslist escort advertisement.

Both defendants are expected in Suffolk Superior Court on Nov. 29, when Gibson will be arraigned and Austin has a previously-scheduled court date.
