TWO CHARGED IN GUNPLAY OUTSIDE DOWNTOWN LOUNGE

Two Hyde Park men were arraigned today after their early-morning arrests for firing a stolen handgun near a crowd outside a downtown lounge, Suffolk County District Attorney Daniel F. Conley said.

FELIX MACHADO (D.O.B. 11/12/81) and CESAR GUZMAN (D.O.B. 9/10/86) were both charged with unlawful possession of a firearm and ammunition, receiving stolen property, and discharging a firearm within 500’ of a building. Machado, who allegedly drove the vehicle in which they fled the scene, was also charged with failure to stop for police.

Assistant District Attorney Benjamin Goldberger recommended that Machado, the alleged shooter, be held on $25,000 cash bail and that Guzman be held on $2,500; Boston Municipal Court Judge Robert J. McKenna set their bails at $10,000 and $5,000 respectively.

Goldberger told the court that Boston Police observed a large, confrontational crowd outside the 33 Restaurant and Lounge on Stanhope Street early this morning as bars and clubs were letting out. Guzman was allegedly arguing with another man in this confrontation.

The officers and civilians at this point heard shots fired, and the Boston Police ShotSpotter system also detected gunshots. Bystanders alerted officers that the gunman was fleeing the scene in a black Infiniti traveling southwest on Columbus Avenue.

Boston Police alerted to the incident and the suspect vehicle observed an Infiniti matching the bystanders’ description and a partial plate number they had provided. When pursuing officers attempted to stop the vehicle, it sped the wrong way down a one-way street before being stopped.

Recovered in an alley along the vehicle’s path of flight was a 9mm semiautomatic handgun loaded with nine rounds of ammunition. Investigators soon learned that it had been reported stolen from its registered owner, a Massachusetts resident, in the mid-1990s. An additional six spent shell casings were also recovered in the vicinity of the initial altercation.

“We aim to find out how these two managed to get their hands on a stolen firearm,” Conley said.

At the time of their arrests, Machado was on probation for possession of a Class D substance with intent to distribute and Guzman had just completed his probation for the same offense. If convicted of possessing the firearm, both face a minimum of 18 months behind bars.

Both defendants will return to court in Sept.
