BOSTON, June 28, 2013—The Norfolk County Grand Jury has indicted a Stoughton man for killing his passenger, 20-year-old Evan Bard, in a single-vehicle crash in Canton last month, Suffolk County District Attorney Daniel F. Conley said.

The indictments, returned yesterday, charge SEAN JACKMAN (D.O.B. 1/18/89) with motor vehicle homicide and manslaughter by motor vehicle under Ch. 265, Sect. 13½, popularly known as Melanie’s Law. They move Jackman’s case from Stoughton District Court to Norfolk Superior Court, where it will be adjudicated. His arraignment date in that venue has not yet been scheduled but is expected next month. more »

BOSTON, June 27, 2013—Two men were held without bail today following their murder arraignments for separate slayings of Melissa Hardy, 33, recently in South Boston and Dinorris Alston, 30, in Roxbury last year, Suffolk County District Attorney Daniel F. Conley said today.

MARTIN JIMINEZ (D.O.B. 3/9/70) was arraigned in South Boston District court following his arrest yesterday in connection with Hardy’s death, while MAURICE JONES (D.O.B. 12/29/93) was arraigned in Suffolk Superior Court following his indictment yesterday in connection with Alston’s death. more »

BOSTON, June 27, 2013–Suffolk County District Attorney Daniel F. Conley today joined US Attorney Carmen Ortiz and other local, state, and federal law enforcement officials to announce federal indictments against Dzokhar Tsarnaev in the fatal bombings at the Boston Marathon, the shooting death of an MIT Police officer, and other offenses, delivering the following remarks: 

“First and foremost, I want to extend once again my thoughts and prayers to the families of Martin Richard, Krystle Campbell, Lingzi Lu, and Officer Sean Collier, and to the hundreds more whose lives were changed on April 15.

“I also want to extend my most sincere appreciation to the men and women of the Boston Police Department, Boston EMS, and Boston Fire for their bravery and rapid action in the aftermath of the Marathon bombings.  I want to recognize the doctors, nurses, and clinical staff of Boston’s hospitals, and the many civilians at the scene whose efforts saved so many more lives.

“And I want to commend the police, prosecutors, and federal agents assigned to this case for preserving, collecting, and marshaling the evidence that brought us to this point.  I was at the scene that day, first as a spectator at the Marathon and later to take control of a multiple homicide investigation.  I saw first-hand just how complex a scene it was, and how massive an undertaking it was to build this case.  And over the course of the past two months, the Suffolk prosecutors assigned to our end of the investigation have briefed me on the extensive progress they’ve made in reaching this point.

“Given the facts, the circumstances, and the various statutes available at the state and federal level, the most appropriate venue for Dzokhar Tsarnaev’s trial is a federal court.  This is analogous to the Oklahoma City bombing 18 years ago.  Timothy McVeigh’s federal conviction, and the punishment he received, made any potential state prosecution purely symbolic.  In the absence of some major change to the current posture of this case, state-level indictments for the crimes in Boston would only drag out a process that will already be grueling for the victims, their families, and our city.

“Unlike District Attorney Ryan’s case, which alleges a homicide separate and apart from the Boston bombings, there is almost 100% overlap between a potential Suffolk County case and today’s federal indictments.  The US Attorney and I agree – the most effective avenue for holding this defendant accountable for the lives he took in our city is a federal prosecution under federal statutes.

“Tamerlan Tsarnaev’s justice will come in the next world.  But for his brother, the road to accountability begins here.  Thank you.”

BOSTON, June 26, 2013—A repeat firearm offender has been sentenced to state prison after his conviction on gun charges by Suffolk County District Attorney Daniel F. Conley’s Gang Unit.

A Suffolk Superior Court jury deliberated for less than two hours yesterday before convicting AARON POWELL (D.O.B. 10/17/89) of Randolph on charges of unlawful firearm possession and carrying a loaded firearm.

Based on his 2009 conviction on similar charges in the Suffolk County Gun Court, Powell was additionally charged with unlawful possession of a firearm as a second or subsequent offense.  At a second trial held after the jury’s verdict, Judge Patrick Brady found him guilty of that offense.  more »

BOSTON, June 25, 2013—A Mattapan man was arraigned last week on charges he attempted to rob a man who gave him a ride home but ended up leaving behind his own bank card when he fled, Suffolk County District Attorney Daniel F. Conley said today.

JERRY BURNETT (D.O.B. 9/12/89) was arraigned in Dorchester District Court on June 18 after his arrest that morning on a warrant charging him with unlawful possession of a firearm, unlawful possession of ammunition, assault with a dangerous weapon, armed assault with intent to rob, discharging a firearm within 500 feet of a building, and carrying a loaded firearm.  more »

BOSTON, June 25, 2013 — An alleged career criminal who crashed his car after leading police on a chase was arraigned last week on firearm and other charges, Suffolk County District Attorney Daniel F. Conley said.

JASON COBB (D.O.B. 9/14/86) of Boston was arraigned Friday in Dorchester District Court on charges of unlawful possession of a firearm, unlawful possession of ammunition, possessing a firearm with a defaced serial number, carrying a loaded firearm, operating with a suspended license, and failure to stop for police.  He was also charged as a Level 3 Armed Career Criminal based on a 2008 conviction for assault and battery on a police officer and two separate convictions in 2011 for distribution of a Class B substance and  possession with intent to distribute a Class B substance. more »

BOSTON, June 24, 2013—A Roxbury man was arraigned Friday for allegedly stealing a fellow MBTA passenger’s shopping bag, only to cross paths with a nearby Boston Police officer as he attempted to flee, Suffolk County District Attorney Daniel F. Conley said today.

RICHARD WILLIAMS (D.O.B. 5/15/55) was arraigned Friday in Roxbury District Court on a single count of unarmed robbery.  Assistant District Attorney Teresa K. Jauregui requested bail be set at $500.  Judge David Weingarten released Williams on his own recognizance. more »

BOSTON, June 21, 2013—A Fall River man who allegedly opened fire on a rival outside a West End nightclub has been identified and held on high bail at his arraignment just a few blocks from the crime scene, Suffolk County District Attorney Daniel F. Conley said.

RUBEN PINA (D.O.B. 11/11/83) was arraigned this afternoon in the Boston Municipal Court on charges of armed assault with intent to murder, assault and battery with a dangerous weapon, and unlawful possession of a firearm as a second offense, all in connection with the Dec. 2, 2012, incident on Friend Street. more »

BOSTON, June 19, 2013—With his retrial in the stabbing death of 29-year-old Andrew Wyman underway, the Randolph man accused in the killing yesterday pleaded guilty, Suffolk County District Attorney Daniel F. Conley said.

DARRYL MITCHELL (D.O.B. 3/13/87) yesterday pleaded guilty to manslaughter in the May 15, 2011, stabbing that left Wyman dead.  Assistant District Attorney Dana Pierce of the DA’s Senior Trial Unit recommended that Mitchell serve a sentence of 11 to 13 years in prison.  Judge Raymond Brassard imposed a sentence of six to eight years. more »

BOSTON, June 19, 2013—A Medford man who had been living in the Mission Hill area was arraigned today for the second of two sexual assaults within an hour of one another early Saturday morning, Suffolk County District Attorney Daniel F. Conley said.

PATRICK BARRY (D.O.B. 5/26/92) was arraigned in West Roxbury District Court on charges of assault with intent to rape and assault and battery with a dangerous weapon.  Assistant District Attorney Courtney Doherty recommended that Barry be held on $100,000 bail.  Judge Kathleen Coffey set bail at $20,000. more »

BOSTON, June 18, 2013—Two men were sentenced to life in prison without the possibility of parole today following their convictions for the 2011 murder of 25-year-old Derrick Barnes, Suffolk County District Attorney Daniel F. Conley said.

FREDERICK HENDERSON (D.O.B. 11/25/83) and FRANKIE HERNDON (D.O.B. 4/9/84) were convicted Friday of first-degree murder and unlawful possession of a firearm for shooting Barnes to death on Fayston Street on the night of Aug. 27, 2011. Today, Suffolk Superior Court Judge Patrick Brady imposed the mandatory punishment for that offense. more »

BOSTON, June 18, 2013—A former personal banker from Chelsea yesterday pleaded guilty to stealing more than $100,000 from an elderly man and concealing her income in order to receive rent subsidies, Suffolk County District Attorney Daniel F. Conley said today.

EDEN CATO (D.O.B. 8/30/83) of Chelsea yesterday admitted to charges of bank embezzlement and larceny from a person over 60 for stealing funds from a 73-year-old bank customer, as well as two counts each of larceny by false pretense, larceny over $250 by a single scheme, and perjury for providing the Department of Housing and Urban Development with false information regarding her income and assets in order to receive rental subsidies. more »

BOSTON, June 18, 2013—The Suffolk County Grand Jury has indicted two former attorneys on more than 20 counts each for allegedly scheming to obtain more than one million dollars from various finance companies by fraudulent means, with one additionally accused of stealing money owed to his clients, Suffolk County District Attorney Daniel F. Conley said.

The indictments, returned on Friday, charge MICHAEL GERMANO (D.O.B. 9/29/63) of Wilmington with five counts of larceny, one count of conspiracy to commit larceny, one count of attempted larceny, two counts of embezzlement by a fiduciary, and 17 counts of uttering a false document. The indictments also charge PETER LAGORIO (D.O.B. 8/22/55) of Lynnfield with three counts of larceny, one count of conspiracy to commit larceny, one count of attempted larceny, and 17 counts of uttering a false document. more »

BOSTON, June 17, 2013—A Mission Hill man was today on charges he robbed and assaulted a woman at knifepoint early Saturday, and investigators are trying to determine whether he is responsible for a second attack less than an hour later, Suffolk County District Attorney Daniel F. Conley said.

PATRICK BARRY (D.O.B. 5/26/92) was arraigned in Roxbury District Court on charges of armed robbery, assault with intent to rape, and assault and battery with a dangerous weapon.  Assistant District Attorney Elizabeth Riley recommended that Barry be held on $250,000 bail.  Judge David Poole set bail at $30,000. more »

BOSTON, June 17, 2013 —A Dorchester woman and her 15-year-old friend were arraigned today after several people identified them as being among the group that robbed and threw bleach on a man on an MBTA bus last weekend, Suffolk County District Attorney Daniel F. Conley said.

LAI LAWNNIE DOUGLAS (D.O.B. 7/19/90) of Dorchester was arraigned in Roxbury District Court on charges of unarmed robbery, mayhem, willful and malicious destruction of property under $250, and indecent assault and battery.  Assistant District Attorney Elizabeth Riley recommended Douglas be held on $50,000 bail.  Judge David Poole imposed $20,000 bail and ordered Douglas held on a probation detainer for violating the terms of her probation on a 2008 case out of Roxbury District Court charging her with larceny from a person, witness intimidation, carrying a dangerous weapon, and assault and battery.  more »

BOSTON, June 14, 2013—A South Boston man was arraigned from his hospital bed today on charges that he pointed a pellet gun at Boston and State police who believed it to be a real firearm, Suffolk County District Attorney Daniel F. Conley said.

KENNETH CONNOLLY (D.O.B. 12/16/59) was arraigned on the single count of assault with a dangerous weapon from his hospital bed at Boston Medical Center, where he is receiving treatment for a gunshot wound sustained Wednesday night.  more »

BOSTON, June 14, 2013—A Suffolk Superior Court jury today convicted two Roxbury men of murdering 25-year-old Derrick Barnes as he stood on the porch of a Fayston Street home two years ago, Suffolk County District Attorney Daniel F. Conley said.

After about two and a half weeks of trial and about three days of deliberations, jurors convicted both FREDERICK HENDERSON (D.O.B. 11/25/83) and FRANKIE HERNDON (D.O.B. 4/9/84) of first-degree murder and unlawful possession of a firearm. more »

BOSTON, June 13, 2013—A Roslindale man was charged with possessing and distributing child pornography after Boston Police executed a search warrant based on a tip from an online file storage service, Suffolk County District Attorney Daniel F. Conley said.

JOEL VAN IDERSTINE (D.O.B. 9/20/75) was arraigned today in West Roxbury District Court, where Assistant District Attorney Courtney Doherty recommended $50,000 cash bail and a variety of orders that he stay away from children under 16. Judge Ernest Sarason imposed $5,000 cash bail. more »

BOSTON, June 13, 2013—A Chelsea man will spend at least 17 years in state prison for attacks on four women who were working as prostitutes during the fall of 2010, Suffolk County District Attorney Daniel F. Conley announced.

The sentence of 17 to 19½ years imposed by Judge Judith Fabricant was shorter than the 24-year term recommended by prosecutors, but ensures that JOSE S. CASTILLO (D.O.B. 5/17/76) will serve a lengthy state prison term for two rapes and two additional attempts in September and October 2010. more »

BOSTON, June 12, 2013—A Mattapan man remains held without bail today following his indictment and arraignment for first-degree murder in the shooting death last year of 25-year-old Keosha Gilmore, a childhood friend who did not share his romantic feelings, District Attorney Daniel F. Conley said.

The Suffolk County Grand Jury on May 30 handed down an indictment charging CHRISTOPHER JACKSON (D.O.B. 10/8/86) with that offense, along with unlawful possession of a firearm, unlawful possession of ammunition, and carrying a loaded firearm in connection with the Feb. 19, 2012, incident that claimed Gilmore’s life. Jackson was arraigned on those charges today in Suffolk Superior Court. more »

BOSTON, June 12, 2013—Suffolk County District Attorney Daniel F. Conley this week recognized three fifth-graders from Boston’s John Marshall Elementary School for their outstanding essays on the topic of “How My Dream Will Change the World.”

First place winner Kiann wrote about her desire to be a kindergarten teacher, a goal she says will require “studying hard, taking advantage of different opportunities given to me, making good choices, and not getting involved in drugs or violence.” Kiann’s dream will allow her to “impact the world by molding the young minds of my students. BOSTON, June 10, 2013—A rash of break-ins targeting parked cars ended after a Chelsea man was arrested for the second time by Chelsea Police and convicted at his Suffolk County trial, District Attorney Daniel F. Conley said.

KIRK CROWLEY (D.O.B. 3/16/68) was convicted May 20 of breaking and entering into a motor vehicle, larceny over $250, and malicious destruction of property. Shortly after the Chelsea District Court jury returned its verdict, Crowley pleaded guilty to a second set of charges alleging breaking and entering into a motor vehicle, malicious destruction of property, and carrying a dangerous weapon. more »

BOSTON, June 5, 2013—A Brighton woman admitted yesterday to stealing thousands of dollars from illegal immigrants in return for promises of driver’s licenses and legal assistance she never provided, Suffolk County District Attorney Daniel F. Conley said.

ADRIANA FERREIRA (D.O.B. 6/28/64) pleaded guilty to seven counts of accepting a gratuity as a public employee, five counts of larceny over $250 by false pretense, and four counts of attempted larceny.  more »

BOSTON, June 4, 2013—A Marblehead man was sentenced to three months in a house of correction this week for head-butting an MBTA bus driver last year, Suffolk County District Attorney Daniel F. Conley said today.

JOHN KERIVAN (D.O.B. 12/10/64) pleaded guilty to assault and battery on a public employee yesterday as his trial was scheduled to begin in Chelsea District Court. Assistant District Attorney Thomas Ozbolt recommended that he serve a year and a half behind bars; Judge Benjamin Barnes imposed the lower amount, which was greater than the suspended sentence that the defendant requested. more »

BOSTON, June 4, 2013—A tour bus driver from Philadelphia was arraigned today on charges that he was driving negligently when his vehicle collided with a highway overpass, leaving several passengers injured and one paralyzed, Suffolk County District Attorney Daniel F. Conley said.

SAMUEL J. JACKSON (D.O.B. 1/10/46) was arraigned today on one count of negligent operation of a motor vehicle, a misdemeanor, as well as the civil infractions of failing to obey a sign on a Department of Conservation and Recreation roadway and operating a bus on a DCR roadway. more »

BOSTON, June 4, 2013—Maiqi Hernandez, a 35-year-old father of two and a security guard at Harvard University, was shot dead by a man angry over their earlier exchange of words, Suffolk County District Attorney Daniel F. Conley’s office said today.

DEVONE SUBER (D.O.B. 2/4/86) was arraigned on a murder charge today, almost exactly one month after he allegedly shot Hernandez to death from the hallway of the Prentiss Street apartment building in which the victim lived. more »

BOSTON, June 3, 2013—Two Dorchester men were held on high bail today after police obtained separate search warrants and recovered firearms from their residences, Suffolk County District Attorney Daniel F. Conley said today.

SEAN GOODE (D.O.B. 6/5/81) is charged with two counts of unlawful possession of a firearm, three counts of unlawful possession of ammunition, and a single charge of possessing a firearm with a defaced serial number.  JEMEL LOVE (D.O.B. 2/10/79) was arraigned on charges of unlawful possession of a firearm, unlawful possession of ammunition, and improper storage of a firearm.  He was also issued a citation for possession of a Class D substance.  more »

BOSTON, June 3, 2013—The nation’s highest court today affirmed the constitutionality of taking a DNA swab from suspects at the time of their arrests, calling them akin to the traditional identification methods of booking photos and fingerprint exemplars – a decision lauded by Suffolk County District Attorney Daniel F. Conley.

“In the 21st century, DNA evidence is the gold standard for identification,” Conley said. “As the high court rightly notes, it can be gathered quickly, painlessly, and with minimal intrusion. It’s the natural extension of identification measures like booking photos and fingerprint cards. Each was cutting edge in its day, and no one can deny the justification for taking them at the time of arrest. The DNA swabs we take for law enforcement purposes have one purpose: to identify the subject to the exclusion of any other person. They carry no private or medical information, nor are we interested in that information.” more »

BOSTON, June 2, 2013—Suffolk County District Attorney Daniel F. Conley today pledged a full and impartial review of this morning’s police-involved shooting, a standard procedure for the fatal use of force in Boston, Chelsea, Revere, and Winthrop.

Assistant District Attorney Edmond Zabin, chief of the DA’s Homicide Unit, responded to Willowwood Street shortly after the incident, relayed the unfolding evidence to Conley, and remained through the morning. Because the Suffolk DA’s office has a statutory authority to investigate deaths unattended by medical personnel, Conley directed Zabin to undertake a comprehensive review of the facts and law surrounding the incident. more »
