BOSTON, Aug. 31, 2017—Suffolk County District Attorney Daniel F. Conley today released his entire investigative file on the Oct. 30, 2016, police-involved shooting death of Terrence Coleman inside a narrow South End foyer after he wielded a kitchen knife during an attack on emergency medical personnel and then on police officers who ran inside to aid them.

The file includes more than 200 photographs; over an hour and a half of dispatch transmissions, including an urgent call for help by one of the EMTs; a dozen recorded interviews, including a post-Miranda interview with the officer who discharged his firearm; and more than 400 pages of reports, transcripts, and forensic testing results documenting the exhaustive investigation overseen by Assistant District Attorney David Deakin, Senior Counsel to the District Attorney. Conley provided a copy of the file to Coleman’s family through their attorneys and additional copies to the news media. 

The evidence and the law do not support criminal charges against Officer Garrett Boyle, who discharged his service weapon only after Coleman attempted to stab and slash EMTs and as he attacked police officers using a kitchen knife with a five-inch, serrated blade inside the foyer of 245 Shawmut Ave. The EMTs were already under attack and in imminent, life-threatening danger when Boyle and his partner entered the premises. Under those circumstances, Conley said, the officer’s use of deadly force was a lawful exercise of self-defense and defense of others. more »

BOSTON, August 28, 2017— A Leominster man was arraigned today on charges he took part in the shooting of another man in Chelsea, Suffolk County District Attorney Daniel F. Conley said.

JUAN OLIVA (D.O.B. 9/13/89) of Leominster was arraigned today in Chelsea District Court on charges of armed assault in a dwelling, armed assault with intent to murder, discharging a firearm within 500 feet of a building, assault and battery, assault and battery with a dangerous weapon, unlawful possession of a firearm, unlawful possession of ammunition, and carrying a loaded firearm.  Prosecutors requested bail of $25,000 and orders that Oliva wear a GPS monitor, abide by a curfew, and stay away and have no contact with witnesses in the event he is to be released on bail.  Judge Matthew Nestor imposed bail of $5,000 and ordered Oliva to submit to GPS monitoring and stay away from the victim’s home and from the hospital where the victim is receiving treatment.  He was also ordered to stay away and have no contact with a second man sought in connection with the shooting. more »

BOSTON, Aug. 24, 2017—The man who allegedly shot and killed 28-year-old Michael Miranda was ordered held without bail at his murder arraignment today, Suffolk County District Attorney Daniel F. Conley said.

KIEWANN WATSON (D.O.B. 6/6/88) of Mattapan was also charged with assault and battery with a dangerous weapon and unlawful possession of a firearm for the incident that also left a 21-year-old man injured with nonfatal gunshot injuries. more »

BOSTON, August 25, 2017— The Dorchester man convicted of murdering of his childhood friend, 24-year-old Anthony Depina, will not receive a new trial, Suffolk County District Attorney Daniel F. Conley said.

The Massachusetts Supreme Judicial Court this morning affirmed the conviction of JASON “LITTLE J” BARBOSA (D.O.B. 1/8/89), whom a Suffolk Superior Court jury found guilty of first-degree murder in 2013 for the slaying outside a Roxbury night club. more »

BOSTON, Aug. 22, 2017—A Hyde Park man was held without bail today following his arraignment for the shooting death of 29-year-old Jorrell Browne in Mattapan earlier this summer, Suffolk County District Attorney Daniel F. Conley said.

ANDRE HENDERSON (D.O.B. 11/19/82) was charged in Dorchester Municipal Court with murder and unlawful possession of a firearm for the June 26 shooting that claimed Browne’s life.

“Thanks to witness statements, video footage, and methodical work by investigators, we’re one step closer to delivering justice for Mr. Browne and his loved ones,” Conley said. “Some cases can be built in days and others take weeks or even years, but we will never give up until the truth is spoken in a Suffolk County courtroom.” more »

BOSTON, August 22, 2017— A Roxbury man was sentenced today to 20 years in prison after a jury last week convicted him of trying to murder three people when he opened fire on their car on a summer afternoon two years ago, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury on Thursday found FABIAN GONZALEZ (D.O.B. 4/9/91) guilty of aggravated assault and battery causing serious bodily injury, armed assault with intent to murder, unlawful possession of a firearm, carrying a loaded firearm, discharging a firearm within 500 feet of a building, and two counts of assault and battery with a dangerous weapon for the 2015 triple shooting that left a young man with permanently debilitating injuries and wounded two women.

During a sentencing hearing today, Judge Peter Lauriat imposed a term of 15 to 20 years in state prison. Assistant District Attorney Catherine Ham, who prosecuted the case at trial, recommended 18 to 20 years. more »

BOSTON, Aug. 21, 2017—A former police officer was sentenced today for beating a woman during an arrest and then lying in subsequent reports on the incident, Suffolk County District Attorney Daniel F. Conley said.

Suffolk Superior Court Judge Douglas Wilkins last month convicted JENNIFER GARVEY (D.O.B. 9/28/82) of two counts each of assault and battery with a dangerous weapon and filing a false report as a public employee. Suffolk prosecutors had indicted Garvey on felony charges of assault and battery with a dangerous weapon – a police baton – and causing injury while violating a person’s civil rights; Wilkins acquitted her on those charges.

“This defendant not only escalated the situation and used force far beyond what was necessary,” Conley said. “She also hijacked the criminal justice system by pursuing charges against the victim that she knew were unfounded. She injured the victim, she lied to the community, and she did a disservice to every officer who approaches the job with integrity.” more »

BOSTON, August 15, 2017— A Boston man and a 17-year-old from Malden were each arraigned today in connection with separate incidents of vandalism at the New England Holocaust Memorial, Suffolk County District Attorney Daniel F. Conley said.

A 17-year-old male from Malden was arraigned today in Boston Juvenile Court on charges of disorderly conduct malicious destruction of property over $250, and causing injury over $5,000 to a church, synagogue or memorial. After the juvenile walked in to court today, Judge Terry Craven released him on his own recognizance with orders to stay away from the memorial and comply with mental health treatment.

SAID BOUZIT (D.O.B. 3/29/80), who provided the address of a Boston mental health facility as his residence, was arraigned this afternoon in Boston Municipal Court on charges of vandalizing a grave planting and disorderly conduct. Judge Thomas Horgan set bail in the amount of $5,000 and revoked Bouzit’s open bail in a pending case charging assault and battery on a corrections officer.   more »

BOSTON, August 14, 2017—Revere Police Chief James Guido and Suffolk County District Attorney Daniel F. Conley announced that three men were held on high bail today after Revere Police responding to a 911 call yesterday discovered a cache of weapons that included a machine gun.

BOSTON, August 8, 2017— A New York man was held on high bail at his arraignment today in a 2016 double shooting at an East Boston MBTA station, Suffolk County District Attorney Daniel F. Conley said.

ROGELIO ALVARADO (D.O.B. 914/94), most recently of Huntington, New York, was arraigned today in Suffolk Superior Court on charges of assault with intent to murder, unlawful possession of a firearm, carrying a loaded firearm, and two counts of assault and battery by discharge of a firearm.  Assistant District Attorney Stacey Pichardo of the DA’s Gang Unit requested bail of $1 million bail; Alvarado was ordered held in lieu of $500,000 bail and ordered to stay away from all victims and witnesses and wear a GPS monitor in the event he posts that amount. more »

BOSTON, Aug. 8, 2017—Suffolk County District Attorney Daniel F. Conley’s office today agreed to vacate the 1981 conviction of FREDERICK CLAY for the first-degree murder of Jeffrey Boyajian and immediately filed additional paperwork ending any further prosecution in the 28-year-old cab driver’s murder in Roslindale.

“Upon review of the evidence, including that advanced by the defendant in his motion and that gathered by the Commonwealth after receiving the motion, and after extensive investigation and scrutiny by this office’s Conviction Integrity Program, the Commonwealth has concluded that the interests of justice would not be served by the prosecution of this case,” Conley’s office wrote in the nolle prosequi, filed at a hearing on a defense motion for new trial to which prosecutors assented. more »

BOSTON, August 7, 2017— An Attleboro man charged with drugged and drunk driving when he struck a child on a crosswalk is held pending a dangerousness hearing, Suffolk County District Attorney Daniel F. Conley said.

RICHARD M. HIGGINS (D.O.B. 1/21/39) of Attleboro was arraigned today in South Boston Municipal Court on charges of operating under the influence of liquor as a fifth offense, operating under the influence of drugs, operating a motor vehicle after suspension for operating under the influence, operating under the influence after suspension for operating under the influence, leaving the scene of personal injury, leaving the scene of property damage, negligent operation, and speeding.  According to prosecutors, Higgins was previously convicted of operating under the influence of alcohol in 1962, 1996, 1998, and 2007.

At the request of Assistant District Attorney Franklin Kanin, Judge Michael Bolden ordered Higgins held pending the outcome of a dangerousness hearing on Thursday to determine whether there is “clear and convincing evidence that no conditions of release will reasonably assure the safety of any other person or the community.” more »

BOSTON, Aug. 7, 2017—A former patient at Arbour Hospital in Jamaica Plain was arraigned on a murder charge today following his indictment for the physical assault that claimed the life of his roommate, 51-year-old John Duggie, two years ago, Suffolk County District Attorney Daniel F. Conley said.

HAMEEN EDWARDS (D.O.B. 2/29/76) of Boston was arraigned on an indictment returned Friday charging him with second-degree murder for the July 2, 2015, assault that led to Duggie’s death a month later. Suffolk Superior Court Clerk Magistrate Edward Curley ordered Edwards held without bail; Edwards’ attorney deferred argument on bail until the next court date. more »

BOSTON, Aug. 6, 2017—The man who allegedly beat 50-year-old John Duggie two years ago, causing injuries that claimed his life, has been indicted for murder, Suffolk County District Attorney Daniel F. Conley  said.

After almost two years of investigation by Suffolk prosecutors and Boston Police homicide detectives, the Suffolk County Grand Jury on Friday returned an indictment charging HAMEEN EDWARDS (D.O.B. 2/29/76) with second-degree murder. Boston Police later arrested Edwards on a warrant stemming from the indictment. more »

BOSTON, August 4, 2017— Two South Boston brothers were arraigned yesterday on gun and drug charges stemming from search warrants on their East 4th Street home, Suffolk County District Attorney Daniel F. Conley said.

JOHN GEORGE (D.O.B. 6/21/78) and KENNETH GEORGE (D.O.B. 11/12/74) were arraigned yesterday in South Boston Municipal Court on charges following the execution of a search warrant at their separate apartments inside a three-family home. 

John George was arraigned on two counts of unlawful possession of a firearm and single counts of possession with intent to distribution a Class B drug, possession with intent to distribution a Class C drug, trafficking in heroin, possession of a firearm with a defaced serial number, reckless endangerment of a child. He was additionally charged as a Level II Armed Career Criminal in light of prior convictions for manslaughter, armed assault with intent to rob, and other offenses, prosecutors said.  Judge Michael Bolden imposed $500,000 bail and ordered George to submit to GPS monitoring, remain under house arrest, and surrender his passport in the event he is to be released on bail.

Kenneth George was arraigned on charges of possession with intent to distribution a Class B drug, possession with intent to distribution a Class E drug, and operating a motor vehicle with a suspend license.  Bolden imposed $50,000 bail and the same conditions of release. more »

BOSTON, August 4, 2017— Four men were arraigned yesterday on charges of trafficking fentanyl after police seized a large quantity of the powerful narcotic at a Dorchester barber shop, Suffolk County District Attorney Daniel F. Conley said.

ELVIS LEDESMA (D.O.B. 9/23/83) of Roxbury, CARLOS NIVAR (D.O.B. 8/6/95) of Dorchester, CARLOS ADEMAN-MEJIA (D.O.B. 10/16/96) of Hyde Park, and EUDOMAR AYBAR (D.O.B. 5/6/93) of East Boston were each arraigned yesterday in Dorchester Municipal Court on charges of trafficking in fentanyl and conspiracy to violate the state’s drug laws.  Prosecutors requested bail of $200,000 for each defendant, as well as conditions that each wear a GPS monitor in the event they are to be released.  Judge Jonathan Tynes imposed $75,000 bail and ordered each to be fitted with a GPS monitor and surrender his passport. more »

BOSTON, Aug. 2, 2017—A Malden man was arraigned today for drunk driving and other charges in connection with the early morning Chelsea crash that left his passenger critically injured and a second motorist hospitalized, Suffolk County District Attorney Daniel F. Conley said.

HECTOR JIMENEZ-VALEZ (D.O.B. 10/13/97) was arraigned today in Chelsea District Court on charges of operating under the influence of alcohol causing serious bodily injury, leaving the scene of a collision causing personal injury, negligent operation of a motor vehicle, and unlicensed operation of a motor vehicle.  Assistant District Attorney Breanna Arsenault requested bail of $10,000 and orders that Jimenez-Valez refrain from drinking alcohol or driving in the event he is to be released on bail.  A judge set bail at $7,500 and imposed the requested conditions of release. more »

BOSTON, August 1, 2017— A Suffolk County jury today convicted a man of stabbing another man during a 2015 armed robbery, Suffolk County District Attorney Daniel F. Conley said.

KAHLI CONSTANT (D.O.B. 1/26/97) was found guilty today of armed robbery and assault and battery with a dangerous weapon in connection with the attack in Roxbury.  Jurors acquitted Constant of armed assault with intent to murder.  Constant, who had remained in custody while awaiting trial, faces sentencing Sept. 5. more »
