BOSTON, Oct. 31, 2014—An Allston man was arraigned today on charges he drove drunk onto the commuter rail tracks approaching North Station and didn’t stop until he was at the transit hub’s train platform, Suffolk County District Attorney Daniel F. Conley said.

MATTHIAS GRENON (D.O.B. 9/27/92) was arraigned in Boston Municipal Court today on charges of operating under the influence of alcohol and negligent operation of a motor vehicle.  Special Assistant District Attorney Sophie Wang requested bail of $1,000.  Judge Thomas Horgan released Grenon on his own recognizance with orders that he not consume alcohol and not drive without a valid license. more »

BOSTON, Oct. 31, 2014—The drunk driver who killed cyclist Doan Bui as Bui rode home from a night of fishing will serve 18 months in a house of correction rather than the state prison term recommended by Suffolk County District Attorney Daniel F. Conley’s office.

Assistant District Attorney Gregory Henning of the DA’s Major Felony Bureau today recommended a term of six to eight years in state prison for MICHAEL AHERN (D.O.B. 12/23/65) of Dorchester following Ahern’s Oct. 14 conviction for felony motor vehicle homicide. That recommendation exceeded the sentencing guidelines of 40 to 60 months, Henning said, because Ahern was travelling about 20 miles above the speed limit when he killed Bui, had been drinking for hours before doing so, and had a lengthy driving record: his license has been suspended 12 times, he has incurred more than 30 moving violations, and was deemed a habitual traffic offender. more »

BOSTON, Oct. 29, 2014—Four Massport employees who had been suspended without pay since 2013 pleaded guilty today to felony charges that they accepted cash and other items of substantial value from cab drivers in exchange for letting them cut ahead of other taxis at Logan Airport, Suffolk County District Attorney Daniel F. Conley said.

KENNETH CLEMENT (D.O.B. 1/24/46) of New Hampshire and VADIM MKRTYCHEV (D.O.B. 2/20/75) of West Roxbury pleaded guilty to two counts of accepting an illegal gift, while MICHAEL GARVEY (D.O.B. 5/18/61) of Melrose and DONALD POTTS (D.O.B. 7/24/65) of Roxbury pleaded guilty of four counts of accepting an illegal gift. They and a fifth man were indicted last May after an extensive investigation by State Police assigned to the Logan barracks, assisted by Massport. more »

BOSTON, Oct. 27, 2014—A Chelsea man will spend up to 15 years in prison for fatally shooting 35-year-old Christopher Powell during a drug deal gone bad, Suffolk County District Attorney Daniel F. Conley said.

MIGUEL FANTAUZZI (D.O.B. 7/89) was convicted Oct. 14 of voluntary manslaughter and unlawful possession of a firearm for Powell’s 2012 slaying.  At his sentencing hearing today, Assistant District Attorney Amy Galatis of the DA’s Homicide Unit requested a sentence of 17 to 20 years, and relatives of Powell implored the court to impose the maximum, a 20-year term. Judge Christine Roach imposed a prison term of 12 to 15 years for the conviction of manslaughter and a concurrent sentence of three to five years for unlawfully possessing the firearm used to kill the Dedham man.  more »

BOSTON, Oct. 28, 2014—A child enticement investigation that began in Winthrop this summer has led to a Malden man’s indictment for child rape and human trafficking of a minor, Suffolk County District Attorney Daniel F. Conley and Winthrop Police Chief Terence Delehanty announced.

The indictments, returned on Oct. 22, charge THOMAS VINCENT ROSE (D.O.B. 2/9/52) with two counts of enticement of a child, two counts of human trafficking of a minor, and single counts of rape of a child and aggravated rape of a child. Because of prior convictions in Norfolk and Suffolk counties for which he is a Level III sex offender, Rose was additionally indicted as a habitual offender. more »

BOSTON, Oct. 27, 2014—A child predator could spend the rest of his life at a secure facility after a Suffolk Superior Court jury found him to be a sexually dangerous person this afternoon, District Attorney Daniel F. Conley said.

After three days of testimony and about two hours of deliberations, jurors found WILLIAM BRADSHAW (D.O.B. 4/19/82) of Roxbury to be sexually dangerous under Ch. 123A of the Massachusetts General Laws. Judge Brian A. Davis ordered Bradshaw to the Massachusetts Treatment Center in Bridgewater for a period of one day to life after Assistant District Attorney Nicole Poirier proved that he is “likely to engage in further sexual offenses if not confined to a secure facility.” more »

BOSTON, Oct. 22, 2014—A gunman bested by a 50-year-old man with a cane will serve at least five years in prison following his conviction in Suffolk Superior Court today, District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury found WILLIAM RIVERA (D.O.B. 8/18/70) of Mattapan guilty of unlawful possession of a firearm, unlawfully carrying a loaded firearm, discharging a firearm within 500’ of a dwelling, assault with a dangerous weapon, and assault and battery with a dangerous weapon, all in connection with an incident last year on Dudley Street in Roxbury. more »

BOSTON, Oct. 22, 2014—A bouncer who allegedly knocked a club goer unconscious was arraigned on assault charges yesterday, Suffolk County District Attorney Daniel F. Conley said.

KEVIN BLACKMORE (D.O.B. 7/10/77) of Wellesley was arraigned in Boston Municipal Court on charges of assault and battery causing serious bodily injury and assault and battery with a dangerous weapon in connection with a July incident at The Place nightclub. A BMC clerk summonsed Blackmore into court after hearing evidence from the victim and witnesses. more »

BOSTON, Oct. 22, 2014—The man charged with fatally shooting 36-year-old Juan Carlos Rodriguez during an altercation early Saturday was ordered held without bail at his arraignment today, Suffolk County District Attorney Daniel F. Conley said.

ANTONIO RIVERA (D.O.B. 10/2/91) of East Boston was arraigned this morning in Chelsea District Court on charges of murder and unlawful possession of a firearm.  At the request of Assistant District Attorney Tara Burdman, Judge Matthew Nestor ordered Rivera held without bail and additionally ordered him held for violating the terms of his probation for a May conviction in an unrelated drug case. more »

Oct. 22, 2014—Suffolk County District Attorney Daniel F. Conley and Chelsea Police Chief Brian Kyes announced an arrest in the shooting death of 36-year-old Juan Carlos Rodriguez this weekend.

ANTONIO RIVERA (D.O.B. 10/2/91) surrendered himself this afternoon on a warrant charging him with murder and unlawful possession of a firearm. He is accused of shooting Rodriguez during an altercation inside the French Naturalization Club on Spencer Avenue at about 1:20 a.m. Saturday.  Rodriguez died of his injuries at Massachusetts General Hospital. more »

BOSTON, Oct. 21, 2014—A former Dorchester resident will serve up to two decades in state prison for raping a woman more than 20 years ago in a case that might have gone unsolved if not for a recent DNA match linking him to the crime, Suffolk County District Attorney Daniel F. Conley said.

TERRY ABERCROMBIE (D.O.B. 9/3/62) pleaded guilty to aggravated rape just as his trial on that charge was set to begin. Suffolk Superior Court Judge Jeffrey Locke sentenced him to a term of 18 to 20 years in state prison. more »

BOSTON, Oct. 21, 2014—A Chelsea man was ordered held without bail in the fatal shooting of 35-year-old Katerin “Catherine” Gomez, and a Quincy man was similarly held in the stabbing death of 31-year-old Gerald Williamson, Suffolk County District Attorney Daniel F. Conley said.

HECTOR RAMIRES (D.O.B. 10/23/93) was arraigned in Chelsea District Court on a murder charge stemming from Gomez’ homicide this weekend. At the request of Assistant District Attorney David Fredette, Judge Matthew Nestor also revoked Ramires’ bail on two unrelated street robberies he allegedly committed with others earlier this year.

Also today, EDGARDO CLARK (D.O.B. 5/25/85) was arraigned in Dorchester Municipal Court on a murder charge for Williamson’s Oct. 16 homicide.  At the request of Assistant District Attorney Ian Polumbaum, Judge James Coffey ordered Clark held without bail. more »

BOSTON, Oct. 20, 2014—A Fall River man was held on $10,000 cash bail today after his arrest on sexual assault charges by Boston Police detectives investigating an incident in the North End early on Saturday morning, Suffolk County District Attorney Daniel F. Conley said.

WAGNER NIETO (D.O.B. 8/10/78) was arraigned in the Boston Municipal Court on charges of assault with intent to rape and indecent assault and battery. Assistant District Attorney Erica Brody requested bail of $15,000; Judge Tracey-Lee Lyons imposed the lower amount but ordered that Nieto wear a GPS monitoring device if he posts it. more »

BOSTON, Oct. 20, 2014—A Domestic Violence Awareness Month event raised more than $2,000 to support the city’s largest provider of services to survivors of domestic violence, Suffolk County District Attorney Daniel F. Conley said.

Wednesday night’s benefit for Casa Myrna Vazquez generated $2,272 in ticket sales and raffle purchases. The event was organized by Christine Berardino and Kerry Kolditz of the DA’s Victim Witness Assistance Program to ensure that survivors have access to Casa Myrna’s lifesaving services, which include shelter, housing assistance, financial literacy education, counseling, and legal advocacy to help them escape abusive households and achieve self-sufficiency.  more »

BOSTON, Oct. 20, 2014—A former Dorchester funeral director was held on high bail at his Superior Court arraignment today on charges he stole nearly $150,000 from clients – and kept the remains of 12 human bodies in a storage facility for years after he had been entrusted to fulfill their final wishes, Suffolk County District Attorney Daniel F. Conley said.

BOSTON, Oct. 20, 2014—Suffolk County District Attorney Daniel F. Conley and Chelsea Police Chief Brian Kyes today identified the victims in this weekend’s homicides and renewed their call for the public’s assistance in both investigations.

Catherine Gomez, 35, was inside a Shawmut Street residence when she was struck by a bullet fired outside the building at about 12:05 on Saturday morning. She died at the scene. Based on the evidence developed thus far, investigators do not believe she was the intended target but was struck by an errant round fired during an altercation between two groups on the street. more »

BOSTON, Oct. 17, 2014—A Roxbury man was arraigned yesterday on firearm charges after his arrest in Mozart Park by Boston Police officers on patrol in the wake of a non-fatal shooting, Suffolk County District Attorney Daniel F. Conley said.

EMMANUEL PENA (D.O.B. 3/26/96) was arraigned in Roxbury Municipal Court on charges of unlawful possession of a firearm, unlawful possession of ammunition, and carrying a loaded firearm.  Assistant District Attorney Caitlin Fitzgerald requested bail of $10,000 and that Pena be ordered to wear a GPS monitoring device, abide by a curfew, and stay away from the area where the offense occurred.  Judge Kenneth Fiandaca imposed $5,000 bail and all the requested conditions.  more »

BOSTON, Oct. 16, 2014—A Suffolk Superior Court jury today convicted a drunk driver in the 2012 death of Doan Bui in Dorchester, District Attorney Daniel F. Conley said.

Jurors convicted MICHAEL AHERN (D.O.B. 12/23/65) of felony motor vehicle homicide for the Sept. 14, 2012, collision that killed Bui, 63, as Bui rode his bicycle home from a late night fishing trip. In reaching that verdict, jurors found that Ahern was impaired and negligent when he struck and killed Bui, rejecting the opportunity to convict the defendant of the lesser offense of misdemeanor motor vehicle homicide or find him guilty of driving drunk but not guilty of causing Bui’s death. more »

Tonight’s event benefiting Casa Myrna Vazquez has been organized by members of the DA’s Victim Witness Assistance Program in order to ensure that victims in Boston, Chelsea, Revere, and Winthrop have access to lifesaving services offered by Casa Myrna – including shelter, education, counseling, and legal advocacy to help victims escape abusive households and achieve self-sufficiency.  In addition, Casa Myrna operates the SafeLink Hotline, the state’s only toll-free domestic violence hotline, which responds to nearly 30,000 calls each year. more »

BOSTON, Oct. 15, 2014— Two Brighton women appeared in court today on charges they stole nearly $200,000 in public benefits using the same “identity shifting” scheme that led to prior indictments for elder exploitation and doctor shopping, Suffolk County District Attorney Daniel F. Conley said.

RANDI BERKOWITZ (D.O.B. 12/11/50) and PATRICIA DiGIACOMO (D.O.B. 1/18/56) were arraigned this morning in Suffolk Superior Court on two counts each of larceny by continuing scheme over $250 and one count each of receiving stolen property by continuing scheme.  Assistant District Attorney Michele Granda of the DA’s Special Prosecutions Unit requested bail of $1,000 and orders that the women refrain from using aliases in the event they are released on bail.  Clerk Magistrate Gary Wilson released both defendants on their own recognizance and imposed the same conditions of release that were imposed in the women’s prior cases – that they report weekly to probation and stay away and have no contact with the elderly victim of the earlier case. more »

BOSTON, Oct. 15, 2014—The man who allegedly stabbed two park rangers in the Boston Common yesterday was held on $1 million cash bail at his arraignment on attempted murder and related charges, Suffolk County District Attorney Daniel F. Conley said.

Boston Municipal Court Judge Robert McKenna imposed that bail on BODIO HUTCHINSON (D.O.B. 8/6/80) at the request of Assistant District Attorney Lynn Feigenbaum. McKenna additionally ordered Hutchinson held without bail on warrants sought by probation officers when the defendant allegedly violated probationary terms imposed along with incarceration on prior convictions. more »

BOSTON, Oct. 14, 2014—Two dozen men and women have been charged with drug distribution offenses after a months-long undercover operation by Chelsea Police and State troopers targeting drug activity in Bellingham Square, Suffolk County District Attorney Daniel F. Conley said.

The charges came as the result of Operation Crackdown – a three-month undercover investigation conducted by Chelsea Police, Everett Police, and State Police assigned to the Suffolk County District Attorney’s Office on the street and by Suffolk prosecutors in the Grand Jury to address residents’ concerns over street-level drug dealing and associated quality-of-life issues.  Prosecutors assigned to the DA’s Narcotics Unit continued the investigation in the Grand Jury, securing indictments last week against several of the defendants. more »

BOSTON, Oct. 14, 2014—Six-year-old Destin Marcelin died after he was forcibly asphyxiated and the evidence points to his father, who committed suicide two days later, as the sole perpetrator, Boston Police Commissioner William B. Evans and Suffolk County District Attorney Daniel F. Conley said today.

The Office of the Chief Medical Examiner has declared the child’s Sept. 4 death to be the result of “homicidal asphyxia” by smothering, pressure on his neck or chest, or some combination of the two. After a thorough review of the evidence gathered since that time, police and prosecutors believe his father, Patrick Marcelin, 49, of Mattapan was responsible. BOSTON, Oct. 14, 2014—Two Brighton women already charged with stealing more than $450,000 from a disabled, elderly neighbor have now been indicted for the theft of nearly $200,000 in Social Security and Medicare benefits, Suffolk County District Attorney Daniel F. Conley said.

The indictments, returned late last month, charge RANDI BERKOWITZ (D.O.B. 12/11/50) and PATRICIA DiGIACOMO (D.O.B. 1/18/56) with two counts each of larceny by continuing scheme over $250 and one count each of receiving stolen property by continuing scheme.  The charges reflect the payment of Social Security Disability Insurance and Medicare benefits based upon a false application filed by the two women in one of their names.  It also reflects the payment of Supplemental Security Income benefits to both women for periods when neither was eligible. more »

BOSTON, Oct. 14, 2014—A Suffolk Superior Court jury today convicted the man who shot and killed 35-year-old Christopher Powell during a Chelsea drug robbery two years ago, Suffolk County District Attorney Daniel F. Conley said.

Jurors convicted MIGUEL FANTAUZZI (D.O.B. 7/89) of voluntary manslaughter and unlawful possession of a firearm for shooting Powell repeatedly inside a vehicle on Clark Avenue just after 6:30 p.m. on Oct. 27, 2012. Fantauzzi had been indicted for second-degree murder; jurors acquitted him of shooting at a second man, causing only a minor injury to that victim. more »

BOSTON, Oct. 14, 2014—The Dorchester man charged in the fatal June shooting of Craig Marriro was held without bail at his arraignment today, Suffolk County District Attorney Daniel F. Conley said.

DERRICK WOOD (D.O.B. 1/10/82) of Dorchester was arraigned in Suffolk Superior Court on charges of first-degree murder, unlawful possession of a firearm, and unlawful possession of ammunition.  Wood has been held on $250,000 bail since his June 9 arraignment in Roxbury District Court on firearm charges; the firearm he was charged with possessing later proved to be a ballistic match to the one used to kill Marriro.  Wood was ordered held without bail at the request of Assistant District Attorney David Bradley. more »

DA Alleges $150k Theft, Forgery of Vital Records, Improper Storage of 12 Human Bodies

BOSTON, Oct. 8, 2014—Suffolk County District Attorney Daniel F. Conley today announced a sweeping, 278-count indictment charging a former funeral director from Mattapan with keeping a dozen decomposed human bodies in a storage facility, stealing almost $150,000 in funeral pre-payments, acting without a license in more than 200 funerals and cremations, and forging related records. more »

BOSTON, Oct. 6, 2014—A suspect in the June shooting death of Craig Marriro is expected to be arraigned next week after his indictment by the Suffolk County Grand Jury, District Attorney Daniel F. Conley and Boston Police Commissioner William B. Evans said.

DERRICK WOOD (D.O.B. 1/10/82) of Dorchester is charged with first-degree murder, unlawful possession of a firearm, and unlawful possession of ammunition. The indictments were returned on Aug. 26 and Wood is expected to be arraigned on Oct. 14. more »

BOSTON, Oct. 2, 2014—A Chicago man was sentenced to a year behind bars and must pay restitution to the MBTA after he was convicted yesterday of more than a dozen counts of vandalism targeting MBTA property, Suffolk County District Attorney Daniel F. Conley said.

A Brighton Municipal Court jury yesterday convicted JOHN BIESIOT (D.O.B. 6/17/78) of 15 counts of vandalism in the three tagging incidents, which occurred in 2008 and 2010 at Codman Yard in Dorchester, Reservoir Yard in Brighton, and Alewife in Cambridge. He was found not guilty of vandalism charges stemming from additional incidents at Forest Hills and Orient Heights stations. Though the incidents occurred in various locations in Boston and surrounding cities, the cases were joined and tried together in Brighton court. more »

BOSTON, Oct. 2, 2014—A man was arraigned today after Boston Police observed him driving his Maserati 100 miles per hour near the scene where two pedestrians died in a crash caused by another negligent driver, Suffolk County District Attorney Daniel F. Conley said.

ZEGUANG XU (D.O.B. 9/1/95) of Boston’s South End was arraigned this morning in Boston Municipal Court on charges of operating without a license, providing a false name to police, speeding, failure to stop, and negligent operation.  He was released on $1,000 bail that he had posted after his arrest. more »
