BOSTON, March 29, 2017— As part of his duties as the only service animal assigned to a Massachusetts prosecutor’s office, District Attorney Dan Conley’s facility dog Indy visited with Cub Scouts in West Roxbury yesterday.

Cub Scouts from Pack 3 at Holy Name Parish earned their Service Dog merit badges with the help of Indy and his handler, Kara Hayes, Conley’s Chief of Community Engagement.  Hayes spoke to the scouts about Indy’s role at the office helping comfort children and adults as they give interviews, prepare for court appearances, or support their loved ones who might be doing the same.  The kids were also treated to a demonstration of Indy’s commands and learned about the extensive and specialized training he and other service dogs receive. more »

BOSTON, March 28, 2017—Three people were held on high bail and two more will be arraigned tomorrow in connection with a major seizure of the opiate fentanyl and other drugs at a Charlestown restaurant, Suffolk County District Attorney Daniel F. Conley said.

Assistant District Attorney Caroline Merck recommended bail of $200,000 for the following defendants, all charged with trafficking in fentanyl, trafficking in cocaine, possession with intent to distribute cocaine, and possession with intent to distribute heroin: more »

BOSTON, March 28, 2017—A former guard at the South Bay House of Correction was arraigned today alongside an inmate with whom he allegedly engaged in a conspiracy to bring drugs and other contraband into the facility, Suffolk County District Attorney Daniel F. Conley said.

MARLON JUBA (D.O.B. 3/21/87) of Lynn and ZENON “DOUGHBOY” RODRIGUEZ (D.O.B. 11/7/90) of Chelsea were both indicted March 13 and arraigned today on charges of conspiracy to violate the state’s drug laws. more »

BOSTON, March 28, 2017— A repeat drug offender was held on high bail at his arraignment yesterday after he was found with a loaded gun and trafficking weight cocaine immediately after shots were fired nearby, Suffolk County District Attorney Daniel F. Conley said.

RUBEN OSORIO (D.O.B. 1/2/85) of the South End, was arraigned in Roxbury Municipal Court yesterday on charges of unlawful possession of ammunition, unlawful possession of a firearm, carrying a loaded firearm, possession of a firearm in the commission of a felony, and trafficking in cocaine.  He was additionally charged with being a Level III armed career criminal based on prior convictions out of West Roxbury Municipal Court in 2012 and 2015 for distribution of a Class A substance and a 2010 conviction in Brookline for assault with a dangerous weapon, prosecutors said.

“Drug trafficking represents the intersection of guns, narcotics, and violent crime,” Conley said. “While the underlying shots-fired incident remains under investigation, this case takes a loaded handgun and a large quantity of apparent cocaine off the street immediately.”

Assistant District Attorney Brandon Tower requested bail of $50,000 and orders that Osorio wear a GPS monitor, remain within Massachusetts, stay away from the area of his arrest, and abide by a curfew in the event he is to be released on bail.  Judge David Weingarten set bail at $20,000 and ordered Osorio to be fitted with a GPS monitor, stay away from the area of his arrest, and abide by a curfew.  He also granted a motion by prosecutors to have Osorio transported to West Roxbury Municipal Court today on a probation matter. more »

BOSTON, March 27, 2017— Eleven days after an arrest warrant issued for his failure to appear in court, a former tax preparer faced arraignment on charges he filed false tax returns that cost Massachusetts taxpayers thousands of dollars, Suffolk County District Attorney Daniel F. Conley said.

RAFAEL HUERTAS, Jr., (D.O.B. 2/27/85) of Lawrence was arraigned in Suffolk Superior Court this afternoon on six counts of presenting a false claim upon a public agency, six counts of delivering a fraudulent document, two counts of willfully assisting in preparation of a fraudulent return, and single counts of willful failure to file a tax return, identity fraud, and money laundering.  Huertas had been summoned to appear for arraignment on March 16 but failed to show up in court.  As a result, a default warrant issued for his arrest. 

Upon his appearance in Suffolk Superior Court today, Huertas was taken into custody.  Assistant District Attorney George Barker of the DA’s Special Prosecutions Unit requested bail of $10,000; Clerk Magistrate Edward Curley released Huertas on his own recognizance. more »

BOSTON, March 24, 2017— A Roxbury teen was ordered held without bail at his arraignment today in the fatal shooting of 19-year-old Khisean Desvarieux in Roxbury, Suffolk County District Attorney Daniel F. Conley said.

TYKORIE EVELYN (D.O.B. 12/2/99) of Roxbury was ordered held without bail at his arraignment today in Suffolk Superior Court on charges of first-degree murder, unlawful possession of a firearm, and unlawful possession of ammunition. At the request of Assistant District Attorney David Bradley of the DA’s Homicide Unit, Clerk Magistrate Lisa Medeiros ordered Evelyn held without bail. more »

BOSTON, March 24, 2017— A jury will be allowed to consider previously excluded evidence in the case against a Roxbury man charged with shooting a store clerk during an armed robbery, Suffolk County District Attorney Daniel F. Conley said today.

The Massachusetts Appeals Court today reversed lower court judge’s decision suppressing evidence in the case against JARRIS CHARLEY (D.O.B. 4/30/93) of Roxbury, who is charged with armed robbery while masked as a subsequent offense, armed assault with intent to murder, assault and battery with a dangerous weapon, unlawful possession of a firearm as a second offense, and carrying a loaded firearm in connection with the 2014 shooting that seriously injured a store clerk. more »

BOSTON, March 23, 2017—As his jury was about to begin deliberating, a Hyde Park man yesterday pleaded guilty to beating two women with what appeared to be a firearm during an armed robbery less than two weeks shy of his 18th birthday, Suffolk County District Attorney Daniel F. Conley said.

NICODEM POYAU (D.O.B. 1/15/97) yesterday pleaded guilty to two counts of armed robbery and two counts of assault and battery with a dangerous weapon in connection with an incident that occurred on January 4, 2015.  Although Poyau was a juvenile at the time he committed these crimes, he was indicted under the state’s youthful offender statute, opening him to the full range of juvenile and adult consequences. more »

BOSTON, March 20, 2017—The Suffolk County Grand Jury today returned murder and related indictments in connection with the shooting death of 19-year-old Khisean Desvarieux in Roxbury, Suffolk County District Attorney Daniel F. Conley and Boston Police Commissioner William B. Evans said.

The indictments charge TYKORIE EVELYN (D.O.B. 12/2/99) of Roxbury with first-degree murder, unlawful possession of a firearm, and unlawful possession of ammunition for the Jan. 9 shooting near Dearborn and Eustis streets that claimed Desvarieux’s life. Under Massachusetts law, juveniles charged with murder are tried as adults. more »

BOSTON, March 20, 2017— The Natick man convicted of murdering nightclub security chief Craig Viera in 2006 will not receive a new trial, Suffolk County District Attorney Daniel F. Conley said today.

In an unpublished decision released today, the Massachusetts Appeals Court declined to grant a new trial to OSCAR ROSA (D.O.B. 10/22/86), who was convicted in 2008 of second-degree murder for stabbing 32-year-old Viera, who later died of medical complications resulting from his injuries.  Rosa had been indicted on a charge of first-degree murder. more »

BOSTON, March 17, 2017—Prosecutors today filed paperwork temporarily withdrawing charges against a Jamaica Plain man amid the investigation into a shooting last year that seriously injured a 9-year-old girl, Suffolk County District Attorney Daniel F. Conley said.

BOSTON, March 16, 2017— An arrest warrant has issued for a former tax preparer who failed to appear in court today on charges he filed false returns for himself and others, Suffolk County District Attorney Daniel F. Conley said.

RAFAEL HUERTAS, Jr., (D.O.B. 2/27/85) of Lawrence had been summoned to appear in Suffolk Superior Court today for arraignment on a 17-count indictment charging him with six counts of presenting a false claim upon a public agency, six counts of delivering a fraudulent document, two counts of willfully assisting in preparation of a fraudulent return, and single counts of willful failure to file a tax return, identity fraud, and money laundering.  Huertas, however, failed to appear in court and Assistant Clerk Magistrate Edward Curley issued a default warrant for his arrest.  more »

BOSTON, March 16, 2017—An Everett man was arraigned today on charges he was driving drunk when he struck and killed 25-year-old Marco Salguero-Cruz in Chelsea and then fled the scene and the country, Suffolk County District Attorney Daniel F. Conley said.

JOSE DANIEL AREVALO (D.O.B. 8/20/82) was arraigned today in Suffolk Superior Court on charges of motor vehicle homicide while operating under the influence of alcohol and leaving the scene of an accident causing death in connection with the June 4, 2016, hit-and-run crash that claimed Salguero-Cruz’s life.  At the request of Assistant District Attorney Michael Glennon, Clerk Magistrate Edward Curley set bail at $150,000 and ordered Arevalo to submit to GPS monitoring, home confinement, and surrender his passport in the event he is to be released on bail.  Arevalo has remained in custody since he was arrested in Dallas, Texas, on Dec. 1. more »

BOSTON, March 15, 2017—A former tax preparer faces arraignment tomorrow after an investigation by the Massachusetts Department of Revenue and the Suffolk County Grand Jury revealed evidence that he fraudulently obtained thousands of dollars in state income tax refunds for himself and others by filing false returns, District Attorney Daniel F. Conley said.

RAFAEL HUERTAS, Jr., (D.O.B. 2/27/85) of Lawrence was named in a 17-count indictment returned March 2 charging him with six counts of presenting a false claim upon a public agency, six counts of delivering a fraudulent document, two counts of willfully assisting in preparation of a fraudulent return, and single counts of willful failure to file a tax return, identity fraud, and money laundering. The charges stem from actions Huertas allegedly undertook between 2011 and 2014, including a period between 2012 and 2013, when he worked for a tax preparation service in Lowell. Huertas is charged in Suffolk County because he allegedly filed the false claims with the Department of Revenue in Chelsea. more »

BOSTON, March 10, 2017—Suffolk County District Attorney Daniel F. Conley last night lent his support to a fund that provides financial assistance to women of color who want to become prosecutors after law school.

Conley was invited to speak as a special guest of the Sarita and Claire Wright Lucas Foundation, named for Delaware Deputy Attorney General Sarita Wright Lucas, 33, and her unborn daughter, Claire, who died tragically and unexpectedly in 2014. He addressed family members, foundation administrators and donors, lawyers, and others at the University of Massachusetts Club in downtown Boston. more »

BOSTON, March 9, 2017— An Everett man has been indicted for motor vehicle homicide in the hit-and-run crash that killed Marco Salguero-Cruz in Chelsea last year, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk County grand jury yesterday returned indictments charging JOSE DANIEL AREVALO (D.O.B. 8/20/82) with motor vehicle homicide while operating under the influence of alcohol and leaving the scene of an accident causing death. The indictments stem from the June 4, 2016, crash that claimed Salguero-Cruz’s life.  Arevalo has been held in lieu of bail since his arrest in Texas on Dec. 2.  A date for his Superior Court arraignment has not yet been scheduled. more »

BOSTON, March 7, 2017—The gunman who shot and killed 44-year-old Jose Maldonado three years ago was convicted of murder and sentenced to life in prison today, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury today found RAYMOND ARROYO (D.O.B. 3/22/92) guilty of unlawful possession of a firearm and first-degree murder under the theory of deliberate premeditation in the Mission Hill shooting that claimed Maldonado’s life. The verdict followed about one day of deliberations. more »
