BOSTON, Dec. 30, 2014— Seven teenagers ranging from 13 to 19 years old were arraigned today for allegedly attacking two Boston Police officers attempting to serve arrest warrants on one of them, Suffolk County District Attorney Daniel F. Conley said today.

LORCEN MORISSET (D.O.B. 11/9/96) and WOOBENSON MORISSET (D.O.B. 2/1/95), both of Roxbury, were arraigned in Roxbury Municipal Court on two counts each of assault and battery on a police officer. Woobenson Morisset was additionally charged with resisting arrest. A Roxbury court clerk declined to issue complaints charging both men with assault and battery with a dangerous weapon – a shod foot – and Lorcen Morisset with resisting arrest; authorities will re-apply for those complaints at a later date. more »

BOSTON, Dec. 29, 2014—A Hyde Park man was held without bail today at his arraignment on a murder charge for allegedly stabbing Rafael Guzman to death at a party on Blue Hill Avenue, Suffolk County District Attorney Daniel F. Conley said.

AQUILES PEREZ (D.O.B. 9/7/81) was arrested late this morning by Boston Police homicide detectives investigating Guzman’s death early on Dec. 21. He was arraigned today in Roxbury Municipal Court. more »

BOSTON, Dec. 29, 2014—A Dorchester man on probation for unlawfully possessing a firearm was held on high bail after his arraignment on a new gun case, Suffolk County District Attorney Daniel F. Conley said.

DAQUANE MITCHELL (D.O.B. 4/6/90) was arraigned today in Roxbury Municipal Court on charges of unlawful possession of a firearm as a second offense, unlawful possession of ammunition as a second offense, and trespassing. Mitchell was additionally charged as an armed career criminal in light of his conviction in a 2011 shooting on Humboldt Avenue. He served a three-year state prison sentence for armed assault with intent to murder in that case and is currently on probation for unlawful possession of a firearm.

Assistant District Attorney Caitlin Fitzgerald recommended that he be held on $50,000 cash bail and be ordered to stay away from Homestead Street. Judge David Weingarten set bail at $25,000 and ordered that he stay away from 115 Homestead St., the scene of his arrest. more »

BOSTON, Dec. 26, 2014—The state’s highest court today affirmed a murder conviction against the man who beat 18-year-old Elsie “Yolanda” Hernandes to death 30 years ago almost to the day, Suffolk County District Attorney Daniel F. Conley said.

The Supreme Judicial Court rejected an appeal by SULTAN OMAR CHEZULU (D.O.B. 10/2/48), ruling that his 2010 trial was fair. Chezulu, who changed his name from ROBERT LOUIS SCOTT in 1997, was found guilty of Hernandes’ Dec. 28, 1984, murder under all three theories of first-degree murder – deliberate premeditation, extreme atrocity or cruelty, and felony murder. Chezulu’s homicide conviction is at least the 12th in Suffolk County to be affirmed by the SJC this year. more »

BOSTON, Dec. 23, 2014—The man who murdered Shakora Gaines, Chantal Palmer, and Anthony Peoples five years ago was sentenced to three life sentences today, with two of those terms to be served back-to-back, Suffolk County District Attorney Daniel F. Conley said.

At today’s sentencing for KERON PIERRE (D.O.B. 11/26/85), Assistant District Attorney Mark T. Lee recommended a 19- to 20-year prison term for the attempted murder of a 23-year-old who miraculously survived the defendant’s unprovoked attack, followed by three consecutive life terms for the murder victims who, he said, were “far closer to children than to adults.” more »

Jurors convicted KERON PIERRE (D.O.B. 11/26/85) of three counts of first-degree murder, finding that he acted with extreme atrocity or cruelty in all three slayings and with deliberate premeditation in Palmer’s killing. BOSTON, Dec. 19, 2014—A man was arraigned yesterday on charges he violated the civil rights of a Green Line passenger he harassed, punched, and attempted to rob at an MBTA station, Suffolk County District Attorney Daniel F. Conley said.

MATTHEW FRANKLIN (D.O.B. 12/30/86), who claimed a downtown homeless shelter as his address, was arraigned yesterday in Boston Municipal Court on charges of unarmed assault with intent to rob, assault and battery, and violating his victim’s civil rights.  Assistant District Attorney Matthew Fitzgerald requested bail of $2,000; Judge Thomas Horgan imposed $1,000 bail. more »

BOSTON, Dec. 18, 2014—A Dorchester man was convicted yesterday of possessing child pornography and trading it using an online file-sharing service, Suffolk County District Attorney Daniel F. Conley said.

A West Roxbury Municipal Court jury found FRANCISCO RIVERA-YORRO (D.O.B. 3/3/62) guilty of possession of child pornography and dissemination of obscene images.  At the request of Assistant District Attorney Christina Miller, Conley’s Chief of District Courts, Judge Mary Ann Driscoll sentenced Rivera-Yorro to two and a half years in the house of correction. more »

BOSTON, Dec. 8, 2014—The state’s highest court has ruled that a man who took part in the 1991 murder of Timothy Bond in Jamaica Plain will not receive a new trial, Suffolk County District Attorney Daniel F. Conley said today.

The Supreme Judicial Court in a decision authored by Justice Robert Cordy today affirmed a lower court’s order denying PEDRO VALENTIN a new trial more than two decades after he was convicted of first-degree murder for his role as a joint venturer in Bond’s July 15, 1991, murder.  The same court affirmed Valentin’s conviction in 1995; today’s decision came in response to Valentin’s appeal of a Suffolk Superior Court judge’s denial of his 2012 motion for a new trial. more »

BOSTON, Dec. 3, 2014—Two years and a day after 25-year-old Alexander Callahan was brutally beaten to death inside the Suffolk County House of Correction, his killer was sentenced to spend the next 20 years in prison, Suffolk County District Attorney Daniel F. Conley said today.

A Suffolk Superior Court jury last month convicted LESLEY JURCZUK (D.O.B. 10/15/61) of voluntary manslaughter in Callahan’s beating death.  Judge Charles Hely today imposed sentenced Jurczuk to 18 to 20 years in prison – the maximum sentence allowed under the law and that recommended by First Assistant District Attorney Patrick Haggan.  Jurczuk’s attorney sought a sentence of four to seven years. more »

BOSTON, Dec. 2, 2014—A Hyde Park man was arraigned yesterday for human trafficking and other charges after he allegedly threatened a woman he advertised on a web site linked to prostitution, Suffolk County District Attorney Daniel F. Conley said.

RICHARD HOLMES (D.O.B. 1/3/91) was arraigned in West Roxbury Municipal Court on charges of trafficking of a person for sexual servitude, deriving support from prostitution, maintaining a house of prostitution, and making threats to commit a crime.  Assistant District Attorney Michelle Slade requested that Holmes be held on $30,000 bail and be ordered to stay away and have no contact with the 25-year-old victim and be fitted for a GPS monitor in the event that he were to be released on bail.  Judge Kathleen Coffey imposed $10,000 bail and the requested conditions of release but denied a motion to revoke Holmes’ bail in an open case charging him with operating a motor vehicle with a suspended license. more »

BOSTON, Nov. 28, 2014— The Suffolk County Grand Jury this week indicted a Quincy man has for first-degree murder for fatally stabbing 31-year-old Gerald Williamson as he attempted to walk away from their verbal confrontation, District Attorney Daniel F. Conley announced today.

The first-degree murder indictment was returned Wednesday against EDGARDO CLARK (D.O.B. 5/25/85). Clark has been held without bail since his Oct. 21 arraignment in Dorchester Municipal Court in connection with Williamson’s murder. more »

BOSTON, Nov. 26, 2014—About 40 men and women arrested during overnight protests in Boston had their criminal charges converted to civil infractions and resolved today, meaning that the low-level offenses will not appear on their records, Suffolk County District Attorney Daniel F. Conley said.

In the Central Division of the Boston Municipal Court, Suffolk prosecutors affirmatively moved to amend criminal complaints against 18 arrestees to civil infractions prior to arraignment, then dismissed them.  Those individuals ranged in age from 19 to 32.  Twelve were from Boston and the remaining six were from Cambridge, Los Angeles, Newton, Quincy, and Somerville. Twelve were charged with disorderly conduct, four were charged with disturbing the peace, and two were charged with disorderly conduct and trespassing. more »

BOSTON, Nov. 24, 2014— The man who fatally shot 21-year-old Steven Jones in the course of a fistfight Jones was trying to break up pleaded guilty today as his trial was set to begin, Suffolk County District Attorney Daniel F. Conley said.

PABLO FLORES, Jr. (D.O.B. 2/17/93) of Charlestown today pleaded guilty to voluntary manslaughter, unlawful possession of a firearm, carrying a loaded firearm, and two counts of assault with a dangerous weapon.  He was initially charged with second-degree murder. At the recommendation of Assistant District Attorney Nicholas Walsh, Suffolk Superior Court Judge Charles Hely sentenced Flores to eight to 12 years in prison followed by three years of probation. more »

BOSTON, Nov. 20, 2014—A Roslindale man who represented himself as a pastor will serve up to 12 years in state prison for sexual assaults on a girl in her young teens, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury on Nov. 5 convicted EPIPHANE LAZARRE (D.O.B. 5/27/73) of two counts of aggravated rape of a child under 14 and one count of indecent assault and battery on a child under 14 for the 2012 assaults. At a sentencing hearing yesterday, Assistant District Attorney Laura Montgomery recommended that he serve a term of 15 to 20 years in state prison followed by 10 years of probation. Judge Christopher Muse sentenced him to 10 to 12 years in prison and the recommended probationary term upon his release. more »

BOSTON, Nov. 18, 2014—Boston Police and Suffolk prosecutors have identified suspects in two open homicide cases from this year, gathering evidence that led to their indictments Friday by the Suffolk County Grand Jury, District Attorney Daniel F. Conley and Police Commissioner William B. Evans said.

Members of the Boston Police Fugitive Unit today arrested ROGER MORRIS (D.O.B. 6/23/61), who is homeless, on a warrant stemming from his indictment for manslaughter, aggravated assault and battery, and assault with a dangerous weapon in the death of Edward Lawn. Authorities say Morris and Lawn were engaged in an altercation downtown on the afternoon of June 20 when Morris punched Lawn so hard that Lawn fell backward and hit his head on the sidewalk. He died of that injury on June 24. more »

BOSTON, Nov. 17, 2014—A Suffolk Superior Court jury today convicted the man who beat 25-year-old Alexander Callahan to death at the Suffolk County House of Correction, Suffolk County District Attorney Daniel F. Conley said.

BOSTON, Nov. 17, 2014—The woman who stabbed her abusive boyfriend to death this summer was acting in self-defense and will not face criminal charges, Suffolk County District Attorney Daniel F. Conley announced today.

Prosecutors’ decision not to charge the 26-year-old Dorchester resident came after a three-month investigation into the July 31 stabbing of Emmanuel Jeudi inside the victim’s Washington Street apartment. That investigation – which included witness interviews, forensic analysis of evidence at the scene, the opinion of state pathologists, a review of prior allegations of domestic violence involving Jeudi, and legal analysis by Suffolk homicide prosecutors – revealed that the woman acted reasonably and lawfully to defend herself, Conley said. The preliminary investigation suggests that a 35-year-old East Boston man driving a 2001 GMC sport-utility vehicle on 4th Street at a high rate of speed when he hit a signpost at the corner of Cherry Street and then collided with the exterior of a building. more »

West Roxbury Municipal Court Judge Mary Ann Driscoll scheduled the trial of NIKOLAS PAPADOPOULOS (D.O.B. 4/8/95) for March 3, 2015. Papadopoulos is charged with negligent operation of a motor vehicle in connection with the Sept. 6, 2013, crash on the Arborway. BOSTON, Nov. 14, 2014—Suffolk County District Attorney Daniel F. Conley said today that investigators had conclusively identified all 12 of the bodies recovered from a Weymouth storage facility this year and appealed to the public for help locating the next of kin for three of the deceased.

JOSUE GONZALEZ (D.O.B. 9/8/88) of Brockton was arraigned on one count of larceny over $250. Noting that he turned himself in and walked into court for arraignment, Assistant District Attorney Erica Brody recommended that he be released on his own recognizance with orders to abide by a curfew, check in weekly with a probation officer, and stray out of downtown Boston. JARRIS CHARLEY (D.O.B. 4/30/93) of Roxbury was arraigned in Dorchester Municipal Court today on charges of armed robbery while masked, assault with intent to murder, assault and battery with a dangerous weapon, unlawful possession of a firearm, and unlawful possession of ammunition.  Assistant District Attorney William Kettlewell requested bail of $250,000 and that Charley be ordered to remain under house arrest, wear a GPS monitor, stay away from the location of the crime, and stay away and have no contact with the victim or witnesses in the event he is released on bail.  Judge Debra DelVecchio set bail at $100,000 and imposed the requested conditions of release but granted the defendant permission to leave his house for employment purposes while under house arrest. more »

Ten years later, in partnership with UMass Boston, the Suffolk County Sheriff’s Department, and the City of Boston, we’ve updated and modernized the program with a new name and a new goal: Overcoming Violence.

Overcoming Violence includes video interviews with criminal justice professionals, survivors of violent crime, incarcerated offenders, and others to show the long-term consequences of positive and negative choices, and an educational component facilitates discussion on strategies for success aimed directly at today’s youth. Two men have been identified and held in connection with the attempted murder of a Chelsea teen in September, Suffolk County District Attorney Daniel F. Conley and Chelsea Police Chief Brian Kyes said.

BOSTON, Oct. 31, 2014—The drunk driver who killed cyclist Doan Bui as Bui rode home from a night of fishing will serve 18 months in a house of correction rather than the state prison term recommended by Suffolk County District Attorney Daniel F. Conley’s office.

Assistant District Attorney Gregory Henning of the DA’s Major Felony Bureau today recommended a term of six to eight years in state prison for MICHAEL AHERN (D.O.B. 12/23/65) of Dorchester following Ahern’s Oct. 14 conviction for felony motor vehicle homicide. That recommendation exceeded the sentencing guidelines of 40 to 60 months, Henning said, because Ahern was travelling about 20 miles above the speed limit when he killed Bui, had been drinking for hours before doing so, and had a lengthy driving record: his license has been suspended 12 times, he has incurred more than 30 moving violations, and was deemed a habitual traffic offender. more »

KENNETH CLEMENT (D.O.B. 1/24/46) of New Hampshire and VADIM MKRTYCHEV (D.O.B. 2/20/75) of West Roxbury pleaded guilty to two counts of accepting an illegal gift, while MICHAEL GARVEY (D.O.B. 5/18/61) of Melrose and DONALD POTTS (D.O.B. 7/24/65) of Roxbury pleaded guilty of four counts of accepting an illegal gift. BOSTON, Oct. 27, 2014—A Chelsea man will spend up to 15 years in prison for fatally shooting 35-year-old Christopher Powell during a drug deal gone bad, Suffolk County District Attorney Daniel F. Conley said.

MIGUEL FANTAUZZI (D.O.B. 7/89) was convicted Oct. 14 of voluntary manslaughter and unlawful possession of a firearm for Powell’s 2012 slaying.  At his sentencing hearing today, Assistant District Attorney Amy Galatis of the DA’s Homicide Unit requested a sentence of 17 to 20 years, and relatives of Powell implored the court to impose the maximum, a 20-year term. Judge Christine Roach imposed a prison term of 12 to 15 years for the conviction of manslaughter and a concurrent sentence of three to five years for unlawfully possessing the firearm used to kill the Dedham man.  more »

BOSTON, Oct. 28, 2014—A child enticement investigation that began in Winthrop this summer has led to a Malden man’s indictment for child rape and human trafficking of a minor, Suffolk County District Attorney Daniel F. Conley and Winthrop Police Chief Terence Delehanty announced.

The indictments, returned on Oct. 22, charge THOMAS VINCENT ROSE (D.O.B. 2/9/52) with two counts of enticement of a child, two counts of human trafficking of a minor, and single counts of rape of a child and aggravated rape of a child. Because of prior convictions in Norfolk and Suffolk counties for which he is a Level III sex offender, Rose was additionally indicted as a habitual offender. more »

BOSTON, Oct. 27, 2014—A child predator could spend the rest of his life at a secure facility after a Suffolk Superior Court jury found him to be a sexually dangerous person this afternoon, District Attorney Daniel F. Conley said.

After three days of testimony and about two hours of deliberations, jurors found WILLIAM BRADSHAW (D.O.B. 4/19/82) of Roxbury to be sexually dangerous under Ch. 123A of the Massachusetts General Laws. Judge Brian A. Davis ordered Bradshaw to the Massachusetts Treatment Center in Bridgewater for a period of one day to life after Assistant District Attorney Nicole Poirier proved that he is “likely to engage in further sexual offenses if not confined to a secure facility.” more »

ANTONIO RIVERA (D.O.B. 10/2/91) surrendered himself this afternoon on a warrant charging him with murder and unlawful possession of a firearm. He is accused of shooting Rodriguez during an altercation inside the French Naturalization Club on Spencer Avenue at about 1:20 a.m. Saturday.  Rodriguez died of his injuries at Massachusetts General Hospital. more »

BOSTON, Oct. 21, 2014—A Chelsea man was ordered held without bail in the fatal shooting of 35-year-old Katerin “Catherine” Gomez, and a Quincy man was similarly held in the stabbing death of 31-year-old Gerald Williamson, Suffolk County District Attorney Daniel F. Conley said.

HECTOR RAMIRES (D.O.B. 10/23/93) was arraigned in Chelsea District Court on a murder charge stemming from Gomez’ homicide this weekend. At the request of Assistant District Attorney David Fredette, Judge Matthew Nestor also revoked Ramires’ bail on two unrelated street robberies he allegedly committed with others earlier this year.

Also today, EDGARDO CLARK (D.O.B. 5/25/85) was arraigned in Dorchester Municipal Court on a murder charge for Williamson’s Oct. 16 homicide.  At the request of Assistant District Attorney Ian Polumbaum, Judge James Coffey ordered Clark held without bail. more »

Catherine Gomez, 35, was inside a Shawmut Street residence when she was struck by a bullet fired outside the building at about 12:05 on Saturday morning. She died at the scene. Based on the evidence developed thus far, investigators do not believe she was the intended target but was struck by an errant round fired during an altercation between two groups on the street. more »

Jurors convicted MICHAEL AHERN (D.O.B. 12/23/65) of felony motor vehicle homicide for the Sept. 14, 2012, collision that killed Bui, 63, as Bui rode his bicycle home from a late night fishing trip. In reaching that verdict, jurors found that Ahern was impaired and negligent when he struck and killed Bui, rejecting the opportunity to convict the defendant of the lesser offense of misdemeanor motor vehicle homicide or find him guilty of driving drunk but not guilty of causing Bui’s death. more »

BOSTON, Oct. 15, 2014— Two Brighton women appeared in court today on charges they stole nearly $200,000 in public benefits using the same “identity shifting” scheme that led to prior indictments for elder exploitation and doctor shopping, Suffolk County District Attorney Daniel F. Conley said.

RANDI BERKOWITZ (D.O.B. 12/11/50) and PATRICIA DiGIACOMO (D.O.B. 1/18/56) were arraigned this morning in Suffolk Superior Court on two counts each of larceny by continuing scheme over $250 and one count each of receiving stolen property by continuing scheme.  Assistant District Attorney Michele Granda of the DA’s Special Prosecutions Unit requested bail of $1,000 and orders that the women refrain from using aliases in the event they are released on bail.  Clerk Magistrate Gary Wilson released both defendants on their own recognizance and imposed the same conditions of release that were imposed in the women’s prior cases – that they report weekly to probation and stay away and have no contact with the elderly victim of the earlier case. more »

BOSTON, Oct. 15, 2014—The man who allegedly stabbed two park rangers in the Boston Common yesterday was held on $1 million cash bail at his arraignment on attempted murder and related charges, Suffolk County District Attorney Daniel F. Conley said.

Boston Municipal Court Judge Robert McKenna imposed that bail on BODIO HUTCHINSON (D.O.B. 8/6/80) at the request of Assistant District Attorney Lynn Feigenbaum. BOSTON, Oct. 14, 2014—Two dozen men and women have been charged with drug distribution offenses after a months-long undercover operation by Chelsea Police and State troopers targeting drug activity in Bellingham Square, Suffolk County District Attorney Daniel F. Conley said.

The charges came as the result of Operation Crackdown – a three-month undercover investigation conducted by Chelsea Police, Everett Police, and State Police assigned to the Suffolk County District Attorney’s Office on the street and by Suffolk prosecutors in the Grand Jury to address residents’ concerns over street-level drug dealing and associated quality-of-life issues.  Prosecutors assigned to the DA’s Narcotics Unit continued the investigation in the Grand Jury, securing indictments last week against several of the defendants. more »

BOSTON, Oct. 14, 2014—Six-year-old Destin Marcelin died after he was forcibly asphyxiated and the evidence points to his father, who committed suicide two days later, as the sole perpetrator, Boston Police Commissioner William B. Evans and Suffolk County District Attorney Daniel F. Conley said today.

The Office of the Chief Medical Examiner has declared the child’s Sept. 4 death to be the result of “homicidal asphyxia” by smothering, pressure on his neck or chest, or some combination of the two. After a thorough review of the evidence gathered since that time, police and prosecutors believe his father, Patrick Marcelin, 49, of Mattapan was responsible. BOSTON, Oct. 14, 2014—Two Brighton women already charged with stealing more than $450,000 from a disabled, elderly neighbor have now been indicted for the theft of nearly $200,000 in Social Security and Medicare benefits, Suffolk County District Attorney Daniel F. Conley said.

The indictments, returned late last month, charge RANDI BERKOWITZ (D.O.B. 12/11/50) and PATRICIA DiGIACOMO (D.O.B. 1/18/56) with two counts each of larceny by continuing scheme over $250 and one count each of receiving stolen property by continuing scheme.  The charges reflect the payment of Social Security Disability Insurance and Medicare benefits based upon a false application filed by the two women in one of their names.  It also reflects the payment of Supplemental Security Income benefits to both women for periods when neither was eligible. more »

BOSTON, Oct. 14, 2014—A Suffolk Superior Court jury today convicted the man who shot and killed 35-year-old Christopher Powell during a Chelsea drug robbery two years ago, Suffolk County District Attorney Daniel F. Conley said.

Jurors convicted MIGUEL FANTAUZZI (D.O.B. 7/89) of voluntary manslaughter and unlawful possession of a firearm for shooting Powell repeatedly inside a vehicle on Clark Avenue just after 6:30 p.m. on Oct. 27, 2012. Fantauzzi had been indicted for second-degree murder; jurors acquitted him of shooting at a second man, causing only a minor injury to that victim. more »

DERRICK WOOD (D.O.B. 1/10/82) of Dorchester was arraigned in Suffolk Superior Court on charges of first-degree murder, unlawful possession of a firearm, and unlawful possession of ammunition.  Wood has been held on $250,000 bail since his June 9 arraignment in Roxbury District Court on firearm charges; the firearm he was charged with possessing later proved to be a ballistic match to the one used to kill Marriro.  Wood was ordered held without bail at the request of Assistant District Attorney David Bradley. more »

BOSTON, Oct. 2, 2014—A Chicago man was sentenced to a year behind bars and must pay restitution to the MBTA after he was convicted yesterday of more than a dozen counts of vandalism targeting MBTA property, Suffolk County District Attorney Daniel F. Conley said.

A Brighton Municipal Court jury yesterday convicted JOHN BIESIOT (D.O.B. 6/17/78) of 15 counts of vandalism in the three tagging incidents, which occurred in 2008 and 2010 at Codman Yard in Dorchester, Reservoir Yard in Brighton, and Alewife in Cambridge. He was found not guilty of vandalism charges stemming from additional incidents at Forest Hills and Orient Heights stations. Though the incidents occurred in various locations in Boston and surrounding cities, the cases were joined and tried together in Brighton court. more »

ALEXANDER GALLETT (D.O.B. 4/28/92) of Hyde Park, MICHEL ST. JEAN (D.O.B. 8/3/90) of Hyde Park, and  YAMILEY MATHURIN (D.O.B. 2/25/93) of Mattapan were sentenced today in Suffolk Superior Court, one day after a jury found Gallett and St. Jean guilty of first-degree murder, armed robbery, and breaking and entering with intent to commit a felony.  Mathurin, who was 17 and thus a juvenile at the time of the murder, pleaded guilty to the crime of manslaughter for her role in setting up the crime, as well as armed robbery and breaking and entering with intent to commit a felony on Sept. 8 as jury selection for their trial was underway. more »

TANYA SINGLETON (D.O.B. 11/17/75) of Bristol, Connecticut, admitted that she refused to testify when called before the grand jury in September of 2013. In 2004, the Suffolk County District Attorney’s office launched Understanding Violence, a reality-based curriculum teaching the importance of education and direction in keeping teens and young adults away from gangs and violence. Ten years later, in partnership with UMass Boston, the Suffolk County Sheriff’s Department, and the City of Boston, the program was updated and modernized with a new name and a new goal: Overcoming Violence.

Overcoming Violence includes video interviews with criminal justice professionals, survivors of violent crime, incarcerated offenders, and others to show the long-term consequences of positive and negative choices, and an educational component facilitates discussion on strategies for success aimed directly at today’s youth. JACKMAN (D.O.B. 1/18/89) pleaded guilty to a charge of motor vehicle homicide while operating under the influence of alcohol during an appearance today in Norfolk Superior Court.  At the recommendation of Assistant District Attorney Melissa Brooks of the DA’s Major Felony Bureau, Norfolk Superior Court Judge Kenneth J. BOSTON, Sept. 12, 2014—A Dorchester man will spend at least the next 15 years in prison for shooting 28-year-old Shawnray Taylor to death during a fistfight, Suffolk County District Attorney Daniel F. Conley said.

ANDREW BRITT (D.O.B. 3/24/94) today admitted to manslaughter and unlawfully possessing the firearm used in Taylor’s fatal shooting.  Judge Thomas Connors imposed the sentence recommended by Assistant District Attorney Tonya Platt of 15 to 18 years in prison for manslaughter and a concurrent sentence of four to five years on the firearm charge. more »

BOSTON, Sept. 3, 2014—A Chelsea man has been sentenced to life in prison after he admitted to murdering 21-year-old Elder Morales, whom he wrongly believed to be a gang rival, Suffolk County District Attorney Daniel F. Conley said today.

JONATHAN CASTRO (D.O.B. 7/30/90), a.k.a. JONATHAN CASTRO SOLA, a.k.a. MANUEL JONATHAN CASTRO MENJIVAR, today pleaded guilty to second-degree murder in Morales’ March 5, 2013, shooting death; armed assault with intent to murder for firing upon a second man in the same incident; unlawful possession of a firearm, and carrying a loaded firearm.  At the recommendation of Assistant District Attorney Mark Zanini, Suffolk Superior Court Judge Thomas Connors imposed the mandatory term for second-degree murder of life in prison with the eligibility for parole after 15 years, with concurrent sentences of 10 to 12 years for armed assault with intent to murder, four to five years for unlawfully possessing the firearm he used in the murder, and 2 ½ years in the house of correction for carrying a loaded firearm. more »

BOSTON, Aug. 29, 2014—A year and a half after the Massachusetts Appeals Court affirmed a murder conviction in the 2006 slaying of Dominique Samuels, the Supreme Judicial Court reached the same conclusion and denied her killer’s efforts to reverse it, Suffolk County District Attorney Daniel F. Conley said today.

The 26-page decision authored by Justice Barbara Lenk is expected to end any further appeals by RODRICK JAMES TAYLOR (D.O.B. 5/15/71), who was found guilty of second-degree murder for strangling the 19-year-old Milton High School graduate to death in the early morning hours of April 28, 2006, then setting her remains on fire in Franklin Park to destroy any forensic evidence that might incriminate him. His 2008 trial was one of the longest homicide trials in Suffolk County history, with some 30 witnesses offering testimony over the course of almost seven weeks. more »

BOSTON, Aug. 8, 2014—State Police are investigating a sexual assault on the Esplanade shortly before 12:30 this morning.

Uniformed troopers, detectives from Troop H, and the Suffolk County State Police Detective Unit responded to the area of the Harvard Bridge spanning the Charles River at Massachusetts Avenue and spoke with a 22-year-old woman who reported that a man on a bicycle had assaulted her after a brief verbal encounter. The woman ran and sought help from another cyclist who called 911. A search of the area by numerous State Police assets did not turn up the suspect. more »

BOSTON, Aug. 6, 2014—A Dorchester man has been found guilty of murder for gunning down 22-year-old DeAndre Russ in a dispute outside an after-hours party on Tremont Street two years ago, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury late today convicted DAVID YARDE (D.O.B. 9/16/90) of second-degree murder and unlawful possession of a firearm in connection with Russ’ fatal shooting.  Yarde faces a mandatory term of life in prison when he is sentenced on Aug. 22. more »

BOSTON, Aug. 6, 2014—A 72-year-old man will spend the next 10 years in prison for sexually assaulting a young girl who years later found the strength to come forward and testify against him, Suffolk County District Attorney Daniel F. Conley said.

HENRY PEARL BROWN, Jr. (D.O.B. 1/26/42), formerly of Boston and more recently of Westbrook, Maine, pleaded guilty yesterday to rape of a child and indecent assault and battery on a child under 14.  Suffolk Superior Court Judge Garry Inge sentenced him to eight to 10 years in prison. Brown was additionally sentenced to 10 years of probation upon his release and may be held even longer under the state’s Sexually Dangerous Person statute. more »

BOSTON, Aug. 4, 2014—The operator of a Boston Department of Public Works truck was arraigned today on charges he sold drugs out of the vehicle, Suffolk County District Attorney Daniel F. Conley said.

KENNETH CLARK (D.O.B. 7/14/65) of Dorchester was arraigned today in Dorchester District Court on a charge of distribution of a Class A substance as a subsequent offense.  That charge was brought in light of a 1999 Suffolk Superior Court conviction for distributing a Class A substance and possession with intent to distribute a Class A substance. Judge Serge Georges imposed $15,000 bail but declined prosecutors’ request that he revoke Clark’s open bail on a case out of Wrentham District Court charging possession of a Class A substance and operating after suspension.  more »

BOSTON, Aug. 1, 2014—A Malden man has been arrested and held on high bail for allegedly trying to lure a 15-year-old child into sexual activity, Winthrop Police Chief Terence Delehanty and Suffolk County District Attorney Daniel F. Conley said.

THOMAS VINCENT ROSE (D.O.B. 2/9/52) was arrested on one count of enticement of a child last night by Winthrop Police and arraigned today in East Boston Municipal Court. Assistant District Attorney Kaushal Rana recommended that he be held on $150,000 cash bail. Judge John McDonald imposed $50,000. Rana recommended orders that Rose wear a GPS device and have no contact with any witnesses in the case if he posts that amount; McDonald imposed those conditions. more »

MARQUIS SMITH (D.O.B. 9/27/90) was formally charged in South Boston Municipal Court today with Taylor’s Feb. 23 homicide near the intersection of Boston and Howell streets. It’s a familiar scene in movies and television: Homicide detectives handcuff a suspect and clear the case. But in many major cities, almost 20 percent of those “cleared” cases are later dismissed and the suspects are never tried or convicted. So how does Boston compare?

In most major cities, homicide investigations are conducted only by police, who make an arrest and hand the case off to the district attorney. Unfortunately, many of these cases are dropped when prosecutors see the evidence is insufficient to bring before a jury. In fact, the U.S. Department of Justice reported recently that 17 percent of “cleared” homicide cases in the nation’s largest counties were dismissed before adjudication. In one major city, the suspects in hundreds of “cleared” cases were never prosecuted, arrested, or even charged. more »

BOSTON, July 26, 2014—State and Revere Police are investigating a shooting that left two people injured near Revere Beach early this morning, Suffolk County District Attorney Daniel F. Conley said.

Revere Police, the Suffolk County State Police Detective Unit, uniformed State troopers, and specialized State Police units responded to Revere Beach Boulevard following an incident shortly before 2:15 a.m. A 33-year-old man and 36-year-old woman sustained gunshot injuries that were not deemed life-threatening. BOSTON, July 25, 2014—An appellate court today found that the twin brother of a man charged with killing 67-year-old Barbara Coyne must comply with a judge’s order to provide a DNA sample that could help prove that only one of the two could have left behind DNA found at the murder scene, Suffolk County District Attorney Daniel F. Conley said.

In a decision authored by Justice Mark V. Green, the Massachusetts Appeals Court affirmed a Suffolk Superior Court judge’s finding that the twin brother of TIMOTHY KOSTKA (D.O.B.4/28/85) was in contempt of an order to produce a DNA sample.  He had been ordered to provide a DNA sample that would be used to prove conclusively whether Kostka and his brother are fraternal twins – each of whom has a unique DNA profile – or identical twins with matching DNA.  more »

BOSTON, July 25, 2014—The driver of a sport-utility vehicle that struck and killed 48-year-old Walter Harris in Mattapan last year was arraigned in Suffolk Superior Court today following his indictment for manslaughter, Suffolk County District Attorney Daniel F. Conley said.

The Suffolk County Grand Jury on July 1 returned indictments charging DERVIN HIBBERT (D.O.B. 1/6/61) of Mattapan with manslaughter by motor vehicle and motor vehicle homicide while operating under the influence. BOSTON, July 25, 2014—The Suffolk County District Attorney’s independent review of the fatal shooting of Ross Batista by Boston Police revealed that Batista possessed two handguns, had earlier exchanged shots with a rival, and had just fired on responding officers during the encounter on Willowwood Street.

District Attorney Daniel F. Conley notified Boston Police Commissioner William Evans and the public of his findings after prosecutors met with Batista’s family to explain the results of the investigation and inform them that the evidence did not support criminal charges against either of the involved officers. BOSTON, July 22, 2014—A Cambridge man has been sentenced to a year and a half behind bars after a jury found him guilty of possessing a loaded firearm in Boston’s Theater District, Suffolk County District Attorney Daniel F. Conley said.

STEVEN BELIZAIRE (D.O.B. 1/27/87) of Cambridge was convicted Thursday of unlawful possession of a firearm and carrying a loaded firearm after a jury trial in the Suffolk County Gun Court.  Assistant District Attorney Caitlin Grasso of the DA’s Gun Prosecution Task Force recommended a sentence of two years in the house of correction for unlawfully possessing the firearm. Granting a request by the defendant, Judge Tracy-Lee Lyons imposed the minimum mandatory term of 18 months in the house of correction. more »

JOHN ROGARIS (D.O.B. 5/13/70), who lists addresses in New York and Weston, was arraigned in Suffolk Superior Court today on charges of withholding evidence during the course of a criminal investigation, witness intimidation, and two counts of misleading an investigator. Prosecutors, who sought but were denied an arrest warrant after his July 3 indictment, did not request monetary bail after Rogaris walked into court this morning but did ask that the defendant be ordered to provide the Probation Department with a Massachusetts address.  Clerk Magistrate Gary Wilson granted the request and released Rogaris on his own recognizance. more »

BOSTON, June 26, 2014—A Suffolk Superior Court jury today acquitted a man of murdering Brenda Pawlowski in Jamaica Plain three years ago, but found him guilty of possessing the weapon with which she was killed.

After about eight days of testimony and two days of deliberations, jurors found LARRY PACK (D.O.B. 5/3/82) of Mattapan not guilty of murder in Pawlowski’s Feb. 8, 2011, shooting death but convicted him of unlawful possession of a .45 caliber semiautomatic handgun ballistically matched to the slaying. Jurors also convicted Pack of possessing a silencer for that handgun, possessing Class A and Class B substances – cocaine and heroin – with intent to distribute, and possessing a firearm in the commission of a felony. more »

BOSTON, June 25, 2014—A Norwood man is the first person in Suffolk County to be charged under the state’s updated “upskirting” statute after a woman gave police photographs she’d taken of a man who pointed his iPad’s camera up her skirt, Suffolk County District Attorney Daniel F. Conley said.

JOSHUA GONSALVES (9/19/90) was arraigned in West Roxbury Municipal Court on a charge of photographing an unsuspecting person in the nude.  The statute was updated earlier this year after the Supreme Judicial Court’s ruled against Suffolk prosecutors and found that the previous version of the statute on the books in Massachusetts did not provide protection against the act of photographing intimate parts of a person’s body otherwise covered by clothing.  The current iteration of the statute, signed into law March 7 at Conley’s urging, closed that loophole. more »

The annual funds, which total $50,000 this year, are disbursed from Conley’s Asset Forfeiture Community Reinvestment Program. Boston, May 29, 2014— An habitual offender has been sentenced to more than 22 years in prison for a racially-based assault that left one of his victims permanently disfigured, Suffolk County District Attorney Daniel F. Conley said today.

ROBERT O’CONNOR (D.O.B. 11/21/67) of South Boston was convicted in March of mayhem, a civil rights violation with injuries, and two counts of assault and battery in connection with a 2012 bar fight. Jurors in that trial were not allowed to hear of his extensive criminal history.  more »

BOSTON, May 19, 2014—A Beacon Hill man was arraigned late last week for possession of child pornography after allegedly leaving a thumb drive containing explicit images in a co-worker’s car, Suffolk County District Attorney Daniel F. Conley said.

PAUL FEST (D.O.B. 12/12/70) was arraigned Friday in the Boston Municipal Court on one count of possession of child pornography after a month long investigation by Boston Police and Suffolk prosecutors.  Assistant District Attorney Gerry Cahill of the DA’s Child Protection Unit requested that bail be set in the amount of $25,000 and that Fest be ordered to wear a GPS monitor, have no unsupervised contact with children under 16, not reside with children under 16, neither work nor volunteer where he would have contact with children unless approved in advance by the Department of Probation, not remain within 1,000 feet of schools or other locations where children regularly congregate, not allow any other person access to his computer or other devices, not use the internet, and undergo random searches of his computers, electronic devices, and other digital media in the event he is released on bail.  more »

BOSTON, May 14, 2014—A Dorchester teen convicted as a youthful offender in the shootings of two men during a botched robbery was sentenced to state prison today, Suffolk County District Attorney Daniel F. Conley said.

A Suffolk Superior Court jury in March convicted JOHN GRAHAM (D.O.B. 12/15/94) as a youthful offender on two counts of armed assault with intent to rob and single counts of armed assault with intent to murder, aggravated assault and battery with a dangerous weapon, and firearm offenses for shooting two men on Oct. 30, 2011, but acquitted him of first-degree murder and armed assault with intent to rob in the fatal shooting of 36-year-old Ciaran Conneely three weeks prior to the non-fatal shooting. more »

JOSE MERCADO (D.O.B. 11/11/93) of Jamaica Plain and PRINCE DENIS (D.O.B. 11/7/90) of Dorchester pleaded guilty to charges of manslaughter, unlawful possession of a firearm, and witness intimidation.  The defendants changed their pleas just as they were scheduled to begin selecting a jury for their trial on charges of first-degree murder. Judge Dianne Kottmyer sentenced Mercado to 19 to 20 years in state prison followed by four years of probation and Denis to 15 years in prison followed by four years of probation. more »

BOSTON, May 5, 2014—State Police detectives assigned to Suffolk County District Attorney Daniel F. Conley’s office are seeking the public’s help in identifying a man whose remains washed up on Revere Beach last week.

The conditions of the remains have thus far hindered investigators’ efforts to identify the man or determine his ethnicity, but forensic anthropologists consulted by the Suffolk County State Police Detective Unit have opined that he was an adult between 20 and 40 years old – and likely on the younger end of that range. more »

BOSTON, April 30, 2014—Alfonso “Itto” Rivas was remembered as caring and generous by his heartbroken siblings this morning as the two men convicted of murdering him were sentenced to life in prison, Suffolk County District Attorney Daniel F. Conley said today.

REGINALD HOLLEY (D.O.B. 11/22/89) of Dorchester and OASIS PRITCHETT (D.O.B. 10/5/90) of Roxbury were convicted yesterday of first-degree murder under the theory of felony murder in 23-year-old Rivas’ slaying and this morning appeared before Suffolk Superior Court Judge Patrick Brady to receive the mandatory sentence of life in prison with no possibility of parole.  Brady also sentenced the two to four to five years in prison to be served concurrent to their life sentences on their convictions for unlawful possession of the firearm used to kill Rivas and placed on file the duos convictions for armed robbery – the requisite felony for the felony murder conviction. more »

After about three days of deliberations, a Suffolk Superior Court jury today found REGINALD HOLLEY (D.O.B. 11/22/89) of Dorchester and OASIS PRITCHETT (D.O.B. 10/5/90) of Roxbury guilty of first-degree murder, armed robbery, and unlawful possession of a firearm in connection with Rivas’ Oct. 17, 2012, murder in a Lyndhurst Street apartment.  Both men face the mandatory sentence for first-degree murder of life in prison without the possibility of parole when they are sentenced tomorrow by Judge Patrick Brady. more »

ANTHONY PEPPE (D.O.B. 6/16/45), who listed a homeless shelter as his address, was charged yesterday with indecent assault and battery for allegedly groping a woman at Park Street station on April 8.  Assistant District Attorney Erica Brody requested bail be set at $10,000 and orders that Peppe stay away and have no contact with the victim, stay away from the location of the offense, and wear a GPS monitoring device in the event that he posts bail.  Judge Thomas Horgan imposed $5,000 bail and ordered Peppe to stay away from the location of the offense and GPS monitoring. more »

BOSTON, April 14, 2014—Suffolk County District Attorney Daniel F. Conley today announced the region’s largest known state-level restitution order against a child pornography defendant.

ANDREW MCKINNON (D.O.B. 5/26/68) of Boston’s South End was ordered Friday to pay $30,000 in restitution to the now-adult victim, who had previously been identified by law enforcement officials, after admitting to possessing and distributing images of her abuse. McKinnon did not create the images: rather, he shared them after obtaining them and is not accused of sexual contact with her or any other children. more »

BOSTON, April 10, 2014—A Brockton man was arraigned yesterday for allegedly kicking, punching, and using slurs against a man with cerebral palsy on a subway train after the victim was able to identify him on MBTA surveillance footage, Suffolk County District Attorney Daniel F. Conley said today.

THOMAS KENNEDY (D.O.B. 4/18/51) was arraigned in South Boston Municipal Court on charges of assault and battery on a disabled person, assault and battery with a dangerous weapon, and a civil rights violation.  Assistant District Attorney Elizabeth Burke requested bail be set in the amount of $7,500 and orders that Kennedy undergo an alcohol and mental health evaluations, undergo any treatment deemed necessary, stay away from and have no contact with the victim, and stay away from MBTA property.  Burke also requested that Kennedy’s bail be revoked on an open case out of West Roxbury Municipal Court charging indecent exposure and disorderly conduct.  Judge Michael Bolden set bail at $5,000 and ordered Kennedy to remain alcohol free, submit to an alcohol evaluation and undergo any necessary treatment, and to stay away from the MBTA.  He allowed the motion to revoke Kennedy’s bail. more »

BOSTON, April 9, 2014—Suffolk County prosecutors today terminated the case against a North End man arrested last month in connection with a February sexual assault on Unity Street, citing a continued investigation that developed evidence to suggest he was not the assailant.

The filing, known as a nolle prosequi, ends the prosecution of ROSS CURRIER, 26, three weeks before his first scheduled court date. BOSTON, April 4, 2014—The driver of a garbage truck was charged today with leaving the scene of a collision that killed a cyclist in Charlestown, Suffolk County District Attorney Daniel F. Conley said.

RICKY PREZIOSO (D.O.B. 4/13/72) of Swampscott was arrested last night by Boston Police detectives and formally charged this morning with one count of leaving the scene of an accident causing death. It’s a long way to the top of the John Hancock Tower—61 stories, to be precise—but 200 volunteers are willing to make the trek to the highest point of New England’s tallest building all in the name of charity and public awareness.

On March 29, at 8:30 a.m., Suffolk County District Attorney Dan Conley and hundreds of others will take it “step-by-step” as they ascend to the tip of the tower during the “Ginormous Climb,” a fundraiser and campaign that calls attention to the victims of child abuse, neglect, and exploitation. Thirty-five Suffolk prosecutors and 164 other brave volunteers will join Conley during the “first-of-its-kind” vertical charity run to raise money for the Children’s Advocacy Center of Suffolk County, or CAC.

Metropolitan Police Department, and retired FBI Special Agent Gregg McCrary, formerly of the National Center for the Analysis of Violent Crime, for the seminar, entitled “Witness Interviews: Investigative Processes, Practices, and Pitfalls.” Trainum, who received the 2009 Champion of Justice Award from the Innocence Project, is a frequent presenter on police work, including the causes of false confessions. More than two dozen pairs of eyes stare out from photographs hanging in the second-floor lobby of the Edward W. Brooke Courthouse in downtown Boston.

These eyes are brave. These eyes are unbreakable. These eyes are strong and proud. These eyes belong to children who have been sexually abused or assaulted. The eyes of some caregivers are there as well.

Each pair of eyes has a name and a story. Each pair of eyes is there because they are not ashamed.

It’s called the “Now You See” exhibit, and it is presented by the office of Suffolk district attorney Daniel F. Conley, Suffolk County Juvenile Court, and the Children’s Advocacy Center of Suffolk County. The goal is simple yet profound: remove the shame from sexual assault and encourage others to come forward.

“Thank you, First Justice Craven.  You know, we’re here tonight to recognize some truly courageous children – children who did one of the toughest things anyone can do.  These kids disclosed physical, sexual, and emotional abuse, defying social pressures, their own fears, and sometimes even perpetrators who said no one would believe them.  As everyone here knows, that can be difficult, sometimes impossible, even for grown men and women.  And when we were looking for an appropriate spot to honor that bravery, Justice Craven didn’t just agree to support it – she enthusiastically volunteered this venue  Hosting this exhibit in the Suffolk Juvenile Court will maximize its visibility to kids in crisis and their loving caregivers.  You know, I spent about 18 months as a Juvenile Court prosecutor early in my career.  I got to know many of the defendants and their backgrounds quite well.  We all know there’s a link between childhood trauma and behavioral difficulties.  We all know that many more children are abused than are able to reveal it.  The pictures and words on display here will send a powerful message to kids who see them that they’re not alone – and that it’s safe to come forward.  So please join me in thanking First Justice Craven for her generosity and her support. more »

City leaders hope a new ad campaign going up on Boston’s MBTA transit system will discourage women from carrying and purchasing illegal guns for boyfriends, husbands and other men who can’t legally obtain the firearms.

Operation LIPSTICK – Ladies Involved in Putting a Stop to Inner-City Killings – today kicked off the first ad campaign of its kind in the nation, according to organizers, which encourages women against buying, hiding and carrying the illegal guns that law enforcement officials say often end up being used in crimes.

The ad banners show a woman in handcuffs with the headline, “His Crime, Your Time – Holding his gun can land you in jail.”

Suffolk District Attorney Daniel Conley recounted two recent incidents in which women were caught carrying firearms for male criminals. One involved an 18-year-old woman who was discovered to be in possession of crack cocaine and a semiautomatic gun with 14 rounds of ammunition. Her male companion, 28, had $1,900 in cash, and police believed the gun and drugs to be his.

“He took all the money, she took all the risk,” Conley said.

Police say Tyrone Battle forced a 14-year-old girl into sex trafficking

The 14-year-old runaway was at the Dudley Square MBTA station when she met Tyrone Battle. The older man approached her, prosecutors said, and chatted her up. How old was she? What did she do for fun? Did she want to be friends? Battle then took the girl home, where he allegedly raped her at gunpoint.

Battle, 33, is accused of raping the girl during three years and forcing her to work as a prostitute. He is being charged under the state’s new human trafficking law.

“This case involves a runaway whom we believe was coerced into prostitution at the age of 14,” Suffolk District Attorney Daniel F. Conley said in a statement. “Sadly, it’s not an exception to the rule. It’s an illustration of the rule: the average age of entry into the sex trade is the young teens. This is not a victimless crime.”

BOSTON, Feb. 18, 2014— Two men were arraigned in Roxbury Municipal Court on gun charges today after the police response to a double shooting turned up the alleged gunman and another individual allegedly packing a second unlicensed firearm, Suffolk County District Attorney Daniel F. Conley said.

TERRELL HARRIS (D.O.B. 8/25/94) was arraigned on two counts of assault and battery with a dangerous weapon and a single count each of unlawful possession of a firearm, unlawful possession of ammunition, unlawfully carrying a loaded firearm, and discharging a firearm within 500 feet of a building. Assistant District Attorney Thomas Costello recommended that he be held on $500,000 cash bail, that he be ordered to stay away from the victims, and that he wear a GPS tracking device if he posts bail. At about 1:00 on Sunday morning, Chelsea Police responded to the area of 115 Washington St. at for a report of a possible stabbing. Officers found Dominguez suffering from a life-threatening injury for which he was being treated by emergency medical technicians. CHARLES LEE BUFFORD (D.O.B. 2/18/55) was arrested Jan. 25 at the Pine Street Inn by Boston Police and US Marshals who took him into custody for failure to register as a sex offender as a subsequent offense. A decade ago, Suffolk County District Attorney Daniel F. Conley joined the then-commissioner of the Boston Police Department to overhaul the way eyewitness evidence was gathered and used.  Police, prosecutors, defense attorneys, and academics came together to examine prior miscarriages of justice, identify the threads that linked them, and establish protocols that would prevent their recurrence.  The result was a sweeping set of reforms that made history in Massachusetts and the nation, prompting defense attorney Barry Scheck of the Innocence Project to cite Boston and Suffolk County as being “at the forefront of the country” in averting wrongful convictions.  The nation’s leading academic expert on eyewitness identifications called Suffolk County’s policies the “Gold Standard” to which other jurisdictions should aspire.  On the ten-year anniversary of these reforms, we present the original text of the Report of the Task Force on Eyewitness Evidence.

I. EXECUTIVE SUMMARY

On March 8, 2004, the Suffolk County District Attorney, Daniel F. Conley, and the Boston Police Commissioner, Kathleen M. O’Toole, announced the formation of a Task Force on Eyewitness Evidence. The Task Force was charged with reviewing the investigative process for cases in which eyewitness identification was a significant issue, and recommending any appropriate changes in the means and manner of investigation. The Task Force was born of the concern, as evidenced by a series of recently overturned convictions, that better practices in such cases would yield more reliable results and significantly reduce the potential for error.

The Task Force offers 25 separate recommendations. A number of these are, to our knowledge, without precedent in any major city police department and prosecutor’s office. Taken together, these 25 recommendations represent a dramatic leap forward in the manner in which police and prosecutors investigate and prosecute cases and would place Boston and Suffolk County in the forefront in comprehensively addressing an issue of both local and national concern.

The Task Force was co-chaired by Boston Police Superintendent John Gallagher and Suffolk County First Assistant District Attorney Josh Wall. It included three members of Boston’s defense bar: Willie Davis, Esq. of Davis, Robinson and White; Michael Doolin, Esq.; and James Doyle, Esq. of Carney and Bassil. The Task Force also included Gary Wells, Ph.D from Iowa State University, Mary Jo Harris, Legal Advisor to the Boston Police Department and Boston Police Superintendent Paul Joyce.

Professor Wells and James Doyle brought to the Task Force particular expertise in the area of eyewitness evidence. Professor Wells is the internationally recognized academic expert on eyewitness observations, human memory, and identification procedures. He has, for two decades, been the leader of efforts to advance scientific knowledge and integrate scientific procedures with actual police investigative work. James Doyle has taught, written and lectured extensively on eyewitness evidence, identification procedures, and the impact of related scientific research.

Throughout its work, the Task Force was cognizant of the high stakes involved in investigating identification cases and the serious responsibilities the Task Force owes to certain groups. Specifically, the Task Force believed its greatest responsibilities were owed to (1) the victims of crimes who deserve effective prosecution of the actual perpetrator; (2) the eyewitnesses whose honest effort to accurately identify suspects should be made under the best conditions; (3) the investigators and prosecutors who rely on their agencies to provide the most effective and updated procedures; and (4) most importantly, those innocent suspects who pay the penalty for inaccurate identifications.

After an initial review of erroneous conviction cases, the Task Force concluded that improving identification procedures is one of many things that can and should be done to reduce the risks of misidentifications, prosecution of innocent suspects and erroneous convictions. In recognition, however, of the high stakes involved in identification cases as demonstrated by the erroneous conviction cases, the Task Force decided that its initial focus on identification procedures (e.g., photo lineups) needed to expand to include other aspects of investigations and prosecutions. The Task Force recommendations reflect a comprehensive approach that encompasses not only identification procedures, but also investigative and prosecution practices, forensic scientific evidence, training, and post-conviction practices.

The Task Force makes the following recommendations:

Identification Procedures.

The Task Force recommends adoption of the identification protocols described in the Department of Justice’s Eyewitness Evidence Guide. Using the DOJ protocols is an important step forward for fair and reliable identification procedures, but the Task Force concluded that there were significant steps that go beyond the DOJ Guide that need to be taken to insure the highest standards for Boston. Scientific research strongly supports sequential identification procedures and blind administration procedures as the best tools available to combat misidentifications. Historically, law enforcement in this country has not used either sequential or blind administration procedures. Research conducted in the 1980s and 1990s built academic support among psychological scientists for these new procedures. Despite the best efforts of some of its members, the DOJ national working group that produced the DOJ Guide could not agree to recommend the two biggest changes: sequential and blind administration procedures. After reviewing the scientific evidence, the Task Force concluded that sequential and blind administration procedures should, in conjunction with the DOJ protocols, be used in Boston as the most effective way to reduce misidentifications. Adopting this level of reform will set a new standard. Task Force member James Doyle, also a member of the DOJ national working group, described for the Task Force that, “this amount of reform has never before been voluntarily undertaken by a major metropolitan police department.”

Prosecution Practices.

The Task Force is confident that reform in identification procedures will significantly reduce misidentifications, but also recognizes that even the best procedures cannot eliminate all misidentifications. The human memory, as reliable as it can be, cannot achieve perfection. In response to that reality, the Task Force proposes an approach that, to the best of our knowledge, has never been done before. Specifically, the Task Force recommends that the District Attorney’s office adopt written policies for identification cases. Reform efforts in other jurisdictions have not included written reforms for the prosecutor’s office. Our recommendations for prosecution practices are designed to give prosecutors greater abilities to investigate cases in a manner that will expose misidentifications and prevent those cases from proceeding. With that goal in mind, the Task Force recommends (a) specific, written instructions for prosecutors to use in investigating and prosecuting identification cases, (b) obtaining an attorney for every suspect who participates in a live lineup, (c) establishing an Eyewitness Evidence Committee of senior prosecutors to review identification cases, (d) require that every identification case brought in Superior Court be approved for prosecution by either the First Assistant or the Chief of Homicide, (e) continue the policy of the District Attorney’s office not to oppose post-conviction requests for DNA testing of relevant evidence, and (f) continue the District Attorney’s DNA Committee of senior prosecutors to review and make decisions on post-conviction motions that involve requests for DNA testing.

The following list, assembled in categories, includes each specific recommendation made by the Task Force.

Identification Procedures

1. Adopt in full the recommendations on eyewitness evidence set forth by the United States Department of Justice.

2. Use sequential presentation of photographs in photo lineups.

3. Use sequential presentation of persons in live lineups.

4. Blind administration of photo lineups, which requires that the photo lineup be shown by an investigator who has no knowledge of which photograph is the suspect’s.

5. Blind administration of live lineups, which requires that the live lineup be administered by an investigator who does not know which person is the suspect.

6. Use a standard printed form which provides eyewitnesses essential instructions for viewing a photo lineup or a live lineup.

7. Require detailed documentation, by means of a separate report, of every identification procedure conducted by the Boston Police.

8. Adopt as policy that every photo lineup shall consist of 8 photographs (7 fillers and 1 suspect) and that every live lineup shall consist of 6 persons (5 fillers and 1 suspect).

9. Use a live lineup subsequent to a photographic array in certain cases where testing the witness’ ability to make an in-person identification could be of significant evidentiary value.

10. Use booking photograph compilations (“mug books”) of scores of people as a possible source of identification only when all other investigative leads have been exhausted.

Investigative Practices

11. Ensure that the Boston Police Crime Laboratory at all times be maintained with excellent equipment and resources, and a full staff of trained and experienced scientists.

12. Ensure that the forensic technology units of the Bureau of Investigative Services — Identification (fingerprint) and Photography and Ballistics — receive certification from national associations.

13. Adopt a policy requiring the electronic recording of statements made by consenting suspects in custodial settings, and for that purpose providing professional quality recording equipment throughout the police department.

Prosecution Practices

14. Adopt instructions for prosecutors for investigating and prosecuting identification cases.

15. Adopt a policy that an attorney be provided for each suspect who participates in a live lineup.

16. Establish in the District Attorney’s office an Eyewitness Evidence Committee of senior prosecutors to review investigations of identification cases and charging decisions, and to direct training efforts.

17. Require by formal policy that every identification case brought in Superior Court be approved for prosecution by either the First Assistant or the Chief of Homicide.

18. Continue the policy of the District Attorney’s office not to oppose post-conviction requests for DNA testing of relevant evidence.

19. Continue the District Attorney’s DNA Committee, an existing committee of the office’s senior prosecutors to review, monitor, and make decisions on post-conviction motions that involve requests for DNA testing.

Joint Policies of the Agencies

20. Adoption by both agencies of formal policies supporting extensive and thorough use of the Grand Jury to develop and document evidence in indictable cases.

21. Adoption by both agencies of formal policies supporting extensive cooperation and collaboration between police and prosecutors from the outset of a felony investigation.

22. Adoption by both agencies of practices of extensive and thorough supervision of investigators and prosecutors by experienced supervisors in their respective agencies.

Training and Review

23. Initial and ongoing training of police officers, detectives, and prosecutors on identification procedures, investigation of identification cases, and prosecution of identification cases, including joint training where appropriate.

24. Annual internal review, for at least the next two years, of these recommendations to evaluate the implementation and the effectiveness of new procedures and policies.

25. Continuation of this Task Force for the purposes of (a) monitoring the adoption of these recommendations and (b) suggesting any revisions or additional recommendations that would improve the investigation and prosecution of identification cases.

II. Erroneous Conviction Cases

The Task Force reviewed the misidentification cases that have resulted in erroneous (or unfair) convictions in Boston in the past 15 years. The number of erroneous convictions has been disturbing and unacceptable for anyone interested in the fair administration of justice in Boston. There has not, however, been an investigation leading to an erroneous conviction since 1997 (Stephen Cowans). The Task Force reviewed the erroneous conviction cases and compared the practices used in those cases with the current practices of the Boston Police and the Suffolk District Attorney. In reviewing the erroneous conviction cases, therefore, the Task Force had two questions: (1) were there reasons that the rate of erroneous conviction cases has declined and can those reasons, once identified, contribute to our recommendations? (2) Were there actions, events, or mistakes in the erroneous conviction cases that would suggest or compel certain reforms?

a. DNA Cases. It is important to know that the erroneous conviction cases fall into two categories: DNA and non-DNA. The DNA cases are primarily sexual assault cases (Marvin Mitchell, Anthony Powell and Neil Miller) with biological evidence left by the perpetrator. When the cases were investigated up to 15 years ago, DNA was not available and admissible in court. Once DNA became available and admissible, the preserved biological evidence underwent DNA testing and the results were used in post-conviction proceedings to exonerate Marvin Mitchell, Anthony Powell and Neil Miller.

The advances in DNA science mean that defendants in recent and future sexual assault cases will not be convicted for lack of forensic scientific testing. Current investigative practices include testing of biological evidence as part of the investigation. Since the mid-1990s, DNA testing has been a feature of the investigation rather that just the post-conviction proceedings.

The Boston Police Crime Laboratory is fully accredited and nationally recognized for its accuracy, efficiency and professionalism. Significant improvements made in the last ten years have brought the Crime Lab to this level of competence and reliability. The Crime Lab’s work with DNA and other types of physical evidence will continue to be a critical piece in the investigation of identification cases. For that reason, the Task Force recommends that the Crime Laboratory at all times be maintained with excellent equipment and resources, and a full staff of trained and experienced scientists. Nearly half of the erroneous conviction cases have not involved DNA testing. In these “non-DNA cases,” it was additional investigation, brought on by new information, that led to vacating the convictions. The post-conviction investigation that freed the wrongly-convicted defendants in non-DNA cases was done primarily, and in some cases entirely, by police and prosecutors. In reviewing the erroneous conviction cases, both DNA and non-DNA, the Task Force concluded that all the forensic sciences are critically important. In any given case, it might be the fingerprint evidence or the ballistics evidence that provides the most probative evidence implicating or clearing a suspect.

The Boston Police Crime Lab is the model of excellence for the department’s other forensic units. Supervisors in the Crime Lab set national certification as their goal and improved all aspects of the Lab’s operation in order to meet that goal. Certification would serve the same purpose for the other forensic units. The Task Force, therefore, recommends that the forensic technology units of the Bureau of Investigative Services – (a) Identification (fingerprint) and Photography, and (b) Ballistics – receive certification from national associations.

b. Lessons Since 1997. The Task Force compared current investigative procedures with the investigations conducted in the older exoneration cases to determine if there were changes that, in combination with the availability of forensic DNA testing, have lessened significantly the pace of erroneous convictions. The Task Force identified procedures, implemented by the Boston Police and the Suffolk District Attorney in the mid to late 1990s, that significantly improved investigations and prosecutions. The Task Force also found, however, that these changes have been widely but not uniformly implemented, and the Task Force recommends the following practices – essential for fair and reliable investigations – be adopted as formal policy throughout the Police Department and the District Attorney’s office:

1. extensive cooperation and collaboration between police and prosecutors from the outset of the investigation;

2. extensive and thorough use of the Grand Jury to develop, preserve, and document evidence;

3. extensive and thorough supervision of investigators and prosecutors by experienced supervisors.

The case of Tiffany Moore’s murder in 1988 is the textbook example of what can happen when the investigation includes little communication between police and prosecutors, vague or distant supervision, and minimal Grand Jury work. Shawn Drumgold was arrested, indicted and convicted for the murder of the 12-year old girl. Drumgold’s motion for new trial led to an extensive evidentiary hearing in 2003, 4 years after the trial. At the hearing, police and prosecutors testified that they had little or no communication and collaboration during the investigation of the case and there was little or no meaningful supervision or case review (even in this high profile case) that would assist or direct the assigned investigator or prosecutor. Additionally, rather than using Grand Jury as means of presenting the important civilian witnesses (including several identification witnesses), the prosecutor presented only two witnesses (one being a police detective who presented abundant hearsay as a substitute for live witnesses).

The Task Force concluded that the inadequate practices in the 1988 investigation significantly contributed to a trial which convicted the defendant but was determined years later to have been conducted unfairly. The motion for new trial was allowed in 2003 and the District Attorney, in the interests of justice, decided not to retry the case. The Drumgold case is but one example of what the Task Force observed as routine practice in the earlier era that produced numerous erroneous convictions: the police investigated the case without communication and input from the prosecutor; the prosecutor used the Grand Jury merely to secure an indictment rather than to develop and document evidence, and both the police investigator and the prosecutor operated without adequate supervision and direction.

Beginning in the mid-1990s and emerging through the late-1990s, the Boston Police Department and the District Attorney’s office developed investigative practices that included cooperation, communication, collaboration, supervision and review, and thorough Grand Jury presentations. The Task Force believes that these improved practices, in combination with DNA forensic testing, are two significant reasons for the decline in erroneous conviction cases since 1997. To build on these improvements, the Task Force recommends that these practices be expanded and adopted as policy so that they are used consistently and uniformly in all cases by all investigators and prosecutors.

Supervision and communication lead to the same desired effect: more professionals involved in more discussion and review of cases. The opportunity for a greater exchange of ideas by investigators and prosecutors with different perspectives will produce more objective and more thorough investigations. An investigation that is objective and thorough will reduce the chances of an erroneous conviction based on misidentification.

The importance of Grand Jury work cannot be overstated. The presentation of witnesses to the Grand Jury has become an essential part of investigating, preserving, and documenting the facts of the case. Witnesses testifying under oath and on the record is an excellent method of making accurate and reliable information available to defendants, defense counsel, judges and jurors. A thorough Grand Jury presentation gives every person with an interest in the case the opportunity to review, analyze and critique the credibility and accuracy of the witnesses, the thoroughness and professionalism of the investigation, and the strengths and weaknesses of the case. Presenting the critical eyewitnesses and investigating police officers to the Grand Jury is a remarkably important guard against misidentifications and erroneous convictions.

The Task Force recommends that these three practices, effective in their use in recent years, become more consistent, uniform and permanent through policies and training. In short, it should not be an option to avoid cooperation between agencies, communicating with supervisors, or using the Grand Jury.

c. Lessons From Erroneous Conviction Cases. The Task Force examined the misidentifications made in the erroneous conviction cases with the expectation that there would be patterns that connected the identification errors. There was, however, no widespread characteristic or pattern that appeared in or explained a bulk of the cases. For example, a pattern of cross-racial misidentifications might be expected. There was, however, no such pattern as most identifications involved eyewitnesses identifying suspects of their own race. As another example, some might expect a pattern of admissions by the defendant that were not electronically recorded. Not one erroneous conviction case included an unrecorded interview containing admissions by the defendant.

The Task Force recognized, however, the significance of suspect interviews. Whenever a suspect decides to make a statement in a custodial interview, the suspect’s statement is likely to be of critical importance in the investigation. The interview should be recorded. Recording requires (a) the consent of the suspect, as required by statute, and (b) the investigator’s judgment, based on training and experience, on when to seek the defendant’s consent and begin recording. Investigators describe and common sense teaches that many suspects will not speak freely while being recorded. For those suspects, investigators must develop rapport, encourage communication and obtain information before recording can commence. The objectives are to develop as much information as possible and document that information. Both objectives must be met without sacrificing one for the other. The Task Force recommends required electronic recording of statements made by consenting suspects in custodial interviews, and for that purpose professional quality recording equipment should be provided throughout the police department. Without a pattern that explained several cases, the Task Force concluded that the issues were more complicated and that a comprehensive approach and set of recommendations for identification cases were necessary. The lack of a pattern is one of the factors that led the Task Force to expand its focus beyond a set of identification procedures to include more comprehensive recommendations.

III. The Scientific Approach to Eyewitness Evidence

In studying eyewitness evidence, Professor Wells uses an analogy that assisted the Task Force in its analysis and recommendations. Professor Wells likens eyewitness evidence to physical trace evidence. Physical trace evidence, such as fingerprints, fibers or blood, can help determine the facts of a crime and the identity of the perpetrator. The observations of an eyewitness are items of trace evidence contained in the witness’ memory. Like physical evidence, memory trace evidence can be contaminated, lost, destroyed or otherwise made to produce inaccurate results. Like physical trace evidence, the manner in which memory trace evidence is collected can have important consequences for the accuracy of the results.

The Task Force concluded that a more scientific approach to collecting and analyzing eyewitness evidence should be the guiding principle for our recommendations. Police protocols for the collection, preservation and interpretation of physical evidence are dictated largely by forensic scientists, and the practice of physical evidence collection and examination has tried to borrow as much as possible from science. The analysis of physical evidence, especially biological traces, has advanced rapidly in the past decade. In fact, it is the advancement in DNA forensic science that has made evident the weaknesses in eyewitness evidence. These recommendations for eyewitness evidence are based on a scientific model. All members of the Task Force — representing police, prosecutors, the defense bar, and psychological scientists — agree that the recommendations will improve the justice system’s ability to collect, preserve and analyze eyewitness evidence. Our goals are to (1) make it less likely that an eyewitness will make a mistaken identification, (2) give police and prosecutors investigative practices that will expose mistaken identifications, and (3) increase the reliability and strength of cases that are based on accurate identifications.

IV. Collecting and Preserving Eyewitness Evidence

The failure of the criminal justice system to adopt a scientific model for eyewitness evidence is attributable, in part, to a lack of understanding of how human memory works. Many assume that information stored in memory remains largely unchanged over time, is impervious to suggestion, and that memory failures are primarily failures to retrieve information. In fact, however, memory can be influenced by post-event information, is susceptible to suggestion, and can fail or err in many different ways. Although research established that mistaken identification rates increase under certain conditions, research also established that many of these conditions could actually be avoided by the use of more scientific procedures for photo lineups and live lineups. The Task Force makes the following recommendations for the scientific collection and preservation of eyewitness evidence:

1. Adopt the recommendations of the Eyewitness Evidence Guide developed by the Department of Justice;

2. Adopt a sequential procedure for photo lineups and live lineups; and

3. Adopt blind administration procedures for photo lineups and live lineups.

In recommending these new procedures, the Task Force is not criticizing the current identification procedures of the Boston Police Department. The current procedures have been used objectively and fairly by Boston detectives for many years. The procedures fully comport with federal and state constitutional requirements. The current procedures have produced countless reliable and accurate eyewitness identifications. As Professor Gary Wells has stated, “Boston’s previous procedures were already at or above the national level and there is no reason to think that Boston’s old procedures placed innocent suspects at a unique level of risk.” The Task Force in no way intends that these recommendations be used to undermine reliable identifications and reliable cases built on current procedures. The Task Force does intend that these recommendations be used to improve on the current constitutionally-sound practices.

DOJ Guide.

The Task Force recommends that the Boston Police Department adopt the recommendations of the Eyewitness Evidence Guide developed in 1999 by the United States Department of Justice’s Technical Working Group for Eyewitness Evidence. The DOJ procedures are based on scientific research. The DOJ Guide gives procedures for the 911 operator, the responding officer, and the investigating detective. The procedures include the best methods for getting accurate information from eyewitnesses about the incident and the suspect’s description, and also provide specific steps for identification procedures.

Many of the steps described in the DOJ Guide are currently in use by some detectives and some units of the Boston Police. The steps are not, however, in use in their entirety throughout the department. The DOJ recommendations need to be the focus of training and implementation department-wide. Superintendent John Gallagher of the Task Force has drafted a departmental Rule that incorporates the recommendations. Adoption of the Rule will implement the protocols described in the DOJ Guide. Some of the more significant recommendations are described in the remainder of this section.

(a) The manner of questioning the witness at the scene and in the follow-up interview will affect how much accurate information is obtained. Information should be gathered through open-ended questions (e.g., “What can you tell me about the car?); augmented by closed-end questions (e.g., “What color was the car?”); avoiding suggestive or leading questions (e.g., “Was the car red?”). All information obtained from the witness is documented in a written report.

(b) The DOJ Guide also describes instructions that the lineup administrator should give to each eyewitness who views a photo or live lineup. The Task Force recommends that the Boston Police use a printed set of instructions for every lineup identification procedure; and toward that end Superintendent Gallagher developed a standard printed form. The standard form will include those instructions developed from scientific research that create the optimal conditions for the eyewitness. By using a standard form, signed by the witness, the Boston Police will have procedures that ensure that every eyewitness is given the identical set of effective instructions.

(c) By adopting the DOJ recommendations, the Boston Police will also be taking the significant step of asking for and recording the witness’ own statement about his level of confidence in an identification if one is made. Because research demonstrates that a witness’ confidence can be increased over time by extraneous factors, it is important to ascertain and document the certainty level at the time of the identification, before other factors intervene.

(d) The DOJ Guide also includes detailed procedures for conducting showup identifications, which are conducted with witnesses by presenting a suspect in person shortly after the incident. The opportunity to see a suspect in person within minutes of the event can lead to important evidence, but procedures are necessary for fairness and reliability given that there are no fillers. The Task Force notes that no erroneous conviction case in Boston was based on an inaccurate showup identification, which provides some anecdotal evidence for the reliability of showup identifications.

(e) Mug books (collections of photos of previously arrested persons) should be viewed only if all other reliable sources and leads have been exhausted. Viewing repeated images has a tendency to blur the witness’ memory of the actual perpetrator’s face. Results of a mugbook identification should be evaluated with caution.

(f) In selecting fillers for a photo lineup or live lineup, complete uniformity of features is not required. Avoid using fillers who so closely resemble the suspect that a person familiar with the suspect might find it difficult to distinguish the suspect from the fillers. Selecting a filler whose appearance is nearly identical to the suspect’s focuses the witness’ attention on the similar photos or persons, thus creating a suggestibility factor.

In summary, the DOJ recommendations adopted by the Boston Police will mean that investigators are developing and documenting reliable information from eyewitnesses, preparing fair and effective photo and live lineups and, through standard printed forms, providing optimal, scientific conditions for eyewitnesses involved in an identification procedure.

Sequential Photo Lineups and Live Lineups.

The common current practice for photo lineups and live lineups is to present to the eyewitness all photographs or lineup members at one time. This practice is known as a simultaneous array. Scientific research has demonstrated that, under simultaneous conditions, eyewitnesses tend to compare photographs and lineup members with each other to determine which one most closely resembles the perpetrator relative to others, a process called relative judgment. Professor Wells devised an alternative procedure — a sequential presentation — that would reduce the tendency of eyewitnesses to rely on relative judgments. In the sequential procedure, the eyewitness is presented with one photograph or one lineup member at a time, and the eyewitness must decide on each photograph or person before viewing the next photograph or person. Research demonstrates that sequential procedures would result in significantly fewer misidentifications. The Task Force recommends that photo lineups and live lineups be conducted using the sequential procedure.

Blind Administration of Arrays and Lineups.

With blind administration of identification procedures, the person conducting the photo lineup or live lineup is not aware of which photograph or person is the suspect. The importance of blind administration procedures stems from what researchers call the confidence malleability of the eyewitness. Confidence malleability describes an effect that has been repeatedly demonstrated in scientific research – that the eyewitness’ confidence in his lineup pick can increase in a variety of different ways. For example, increased confidence can come from confirmation (“You picked the right suspect”), repeated questioning about the incident or the identification, or any number of non-verbal and inadvertent cues.

There is significant research demonstrating confidence malleability, and the confidence of the eyewitness is often an important factor at trial. The eyewitness often will testify about his degree of confidence, and judges specifically instruct jurors to consider the degree of confidence expressed by the eyewitness. An eyewitness’ confidence, therefore, should be based on his own memory rather than on external information.

The importance of blind administration is well-accepted in psychological scientific research of all types. It is standard scientific practice to conduct scientific research using administrators who do not know specific information about the test they administer. The scientific technique should be used for actual identification procedures to eliminate the possibility that a witness’ confidence will be influenced inadvertently by the administrator. After nearly 25 years in eyewitness scientific research, Professor Wells describes blind administration as the single most important step a department can take to improve its identification procedures.

V. Analyzing Eyewitness Evidence

The reforms recommended in the previous section will remove many conditions that lead to eyewitness misidentifications. Those reforms will not, however, eliminate all eyewitness error. As demonstrated by scientific research and erroneous conviction cases, some eyewitness misidentifications will occur even when the best procedures have been followed. The Task Force, therefore, devoted considerable thought to the following question: Are there new ways of analyzing identification evidence that would give prosecutors greater ability to expose misidentifications? Answering that question led the Task Force into uncharted territory; eyewitness evidence reform undertaken in other jurisdictions and in the DOJ Guide has not included prosecution practices.

The Task Force concluded that charting this territory for prosecutors was critically important. As one Task Force member described it, “How do we ask police to accept important levels of change without asking the same thing of prosecutors? In this era of erroneous convictions, if any serious prosecutor does not think that lawyers can do a better job with identification cases, then we have a problem, caused by naivete or arrogance, that has to be addressed.” Having made the decision to expand its focus to include prosecutors, the Task Force makes the following recommendations:

1. Adopt instructions for prosecutors for investigating and prosecuting identification cases.

2. Adopt a policy that an attorney be provided for each suspect who participates in a live lineup.

3. Establish in the District Attorney’s office an Eyewitness Evidence Committee of senior prosecutors to review investigations of identification cases and charging decisions, and to direct training efforts.

4. Continue the practice and require as written policy that every identification case brought in Superior Court be approved for prosecution by either the First Assistant or the Chief of Homicide.

5. Continue the policy of the District Attorney’s office not to oppose post-conviction requests for DNA testing of relevant evidence.

6. Continue the District Attorney’s DNA Committee, an existing committee of the office’s senior prosecutors to review, monitor, and make decisions on post-conviction motions that involve requests for DNA testing.

Instructions for Prosecutors.

Investigators and prosecutors need training and experience to analyze an eyewitness identification. The traditional analysis focuses and ends on the ability of the witness to observe and perceive the perpetrator and includes the following factors: the duration of the assault, the witness’ focus on the perpetrator’s face, the lighting conditions, the confidence of the witness, and any aspect or condition of the victim that might affect his or her ability to make observations (such as age, intoxication, or eyesight). These factors continue to be important for investigators and prosecutors, and jurors are instructed that these are the factors they should consider in evaluating eyewitness identification. In addition, however, police and prosecutors need to perform a broader analysis that includes more than the conditions under which the observations were made.

The need for proper analysis is sufficiently critical that the Task Force recommends instructions for the prosecutors who, through their work with the police, assist in the investigation and, through their work in the Grand Jury, develop and document the investigation. It is not sufficient to change the way police conduct identification procedures without also setting instructions for prosecutors to analyze the resulting identifications and integrate the eyewitness identification with the other facts of the investigation. It is expected that these instructions will be used in training, supervision and, most importantly, the daily work of prosecutors who are investigating identification cases. The recommended instructions are as follows:

 

INSTRUCTIONS FOR PROSECUTORS:
INVESTIGATING AN IDENTIFICATION CASE

The police investigator is responsible for the investigation of a case. The prosecutor, however, has ultimate responsibility for the cases that are prosecuted. The prosecutor, therefore, should participate in the investigation in every way that is productive. These instructions are designed to assist prosecutors in developing facts in identification cases, analyzing the facts, and making decisions on which suspects to charge.

1. First and foremost, approach each case objectively and with a critical view of the evidence. Historically, if a witness says he is confident in an identification, the investigators and the prosecutor have adopted a similar confidence in the strength of the case. The confidence of the witness should not be the primary reason for the prosecutor’s confidence in the case. Always be open to the possibility that an identification is mistaken, and develop the evidence with that possibility in mind. The witness’ identification is only one fact in the investigation; it must be weighed and considered with and against all the other facts. The value of the identification is determined by the other facts and circumstances established in the investigation.

2. The prosecutor must be vigilant and adhere to the strictest standards in the following six areas: (1) definitively establish the description which is initially given by the witness; (2) definitely establish every fact concerning the identification procedure; (3) know the crime scene and physical evidence inside and out; (4) thoroughly develop and investigate all circumstances — positive and negative — which are relevant to the perpetrator’s identity; (5) establish and document all this information as early as possible in the investigation; and (6) use the Grand Jury to develop and document all the evidence concerning the description, the ID procedure, the crime scene, and the circumstantial evidence relevant to the identity of the perpetrator. At all stages, remember that you are working not to build a case against a particular suspect, but to develop facts that identify the actual perpetrator.

To accomplish these goals, take the following steps:

  1. A.    It is essential to speak as soon as possible with any police officer who had contact with the identification witness. Examine, but do not rely solely on, the Incident Reports and Supplemental Reports. Make it a priority to interview all officers who spoke with the witness, including those officers who did not identify their involvement by filing reports. The goal is to know everything about what happened at the scene, the description given and the ID procedure (including the exact words used by the investigator and the witness).
  2. B.     In establishing the description given by the witness, be careful to talk to both uniformed officers and detectives. Both will probably have relevant information.
  3. C.    With a show-up identification, assume that several officers participated. For example: two officers met the witness at the scene, two different officers transported her to the show-up site, and three other officers conducted the show-up. From those seven officers, there exists a single Incident Report. It is up to you to work with all the officers involved to get all the information in an accurate and documented form. A critical part of the information is the actual words used by the officer and the witness (and the suspect).
  4. D.    With a photo lineup identification, it is often not immediately apparent (and sometimes not documented) how the suspect’s photograph got into the array. You must know the answer to that question. The decision to include a suspect’s photo is often based on good circumstantial evidence, and sometimes based on something less probative. Including a photo without articulable reasons for doing so can be the key point in turning an identification case into a misidentification case.
  5. E.     Get the 911 tape and turret tape immediately. Make sure the turret tape includes all channels that the officers used in communicating with each other. (The specific information on channels needs to be obtained directly from the officers involved.) These recorded conversations are frequently the most accurate source for the initial description, especially when the identification witness made the 911 call.
  6. F.     Interview the identification witness as soon as possible. Open-ended questions are critical. Do not try to lead the witness into echoing what the police report states. After the witness provides a narrative, focus the witness on specific areas in order to get the important and necessary details.
  7. G.    The initial interview is the time to examine the variables that affect the witness’ ability to perceive the perpetrator. These variables — time, distance, positioning, focus, lighting, etc. — must be established.
  8. H.    Go to the scene.
  9. I.       Pay close attention to the crime scene (and the physical evidence contained therein) as described by witnesses and police and as documented by reports and photographs. Get photographs developed as soon as possible. If no scene photos were taken, get some taken. Review Crime Lab evidence receipt. Discuss the evidence with the criminalist at the Crime Lab. Know the scene inside and out.
  10. J.      Consider what evidence needs to be tested for the presence of DNA. Consult with the investigator and criminalist concerning testing of physical evidence.
  11. K.    Consider what evidence needs to be fingerprinted.
  12. L.      Evaluate all ballistics evidence for possible testing.
  13. M.   Take good notes of all your interviews, observations, and impressions. Notes will be invaluable in your Grand Jury and trial preparation.
  14. N.    Corroborate the identification as thoroughly as possible through circumstantial evidence. This can take many forms — too many to describe specifically — but its importance cannot be overestimated. The strengths and weaknesses of the circumstantial evidence are key factors in assessing the accuracy of the identification. The circumstantial evidence always informs, and sometimes directs, the charging decision.
  15. O.    Consider whether an investigation would benefit from having a witness who identified a suspect in a photo lineup also view a live lineup containing the suspect. This additional step would be taken when a second identification procedure might yield critical information about the witness’ ability to make an in-person identification.
  16. P.     Consider what information a “non-identifying eyewitness” (one who fails to pick the suspect or picks a filler) is providing. The non-identification may mean that the witness did not have a sufficient opportunity to observe, but it might also mean that the suspect is not the perpetrator.
  17. Q.    Follow up on all alibi information: interview witnesses, put them before the Grand Jury, obtain documents, evaluate circumstantial evidence. If defendant is represented by counsel, ask counsel for all information concerning the alibi so it can be evaluated and presented to the Grand Jury. Be aware of the possibility that a witness who is biased (e.g., suspect’s mother or girlfriend) may be telling the truth.
  18. R.    If he’s not yet charged, make sure suspect gets interviewed.
  19. S.      Establish the facts, don’t try to change the facts.
  20. T.     Follow alternative paths and investigate alternative suspects as far as the evidence leads.
  21. U.    In going through the process of gathering and documenting information and evidence, continually evaluate and analyze the facts. Consider different scenarios, including ones consistent with misidentification. Try to poke holes in your own theories about the case. Compare each witness statement to the statements made by others and the physical evidence.

 

When it is time to make final charging decisions, accept the evidence you have developed and give the evidence the weight it merits. If the investigation has established no circumstantial evidence to support a one witness photo identification in a stranger situation, you must proceed with extreme caution given what we now know about the possibility of misidentification. If the prosecutor thoroughly investigates the case, thinks critically about the facts, and bases charging decisions solely on the facts, the prosecutor will have taken the most important steps to reduce the risk of an identification case becoming a misidentification case.

Attorney For Live Lineup.
Because the live lineup requires the suspect to participate, the Task Force concluded that the suspect would benefit from the presence and advice of an attorney. The suspect’s attorney, of course, would have no authority to direct investigators and prosecutors in the performance of their duties. The attorney would, however, be able to give the suspect information and advice, and would be able to make observations that might be of value when filing a motion to suppress the identification or cross-examining witnesses at hearing and trial.

Applying Consistent Standards.
The Task Force considered whether, in addition to giving instructions for use by individual prosecutors, there could also be changes in management and supervision that would ensure that uniformly high standards were met in every identification case. Toward that goal, the Task Force recommends that the District Attorney establish an Eyewitness Evidence Committee of senior prosecutors to review investigations of identification cases. The Eyewitness Evidence Committee would review identification cases that involved complex investigations, difficult issues and close calls on charging decisions. The Committee will combine the skills and experience of several prosecutors and apply that expertise to the most challenging cases.

As a complement to the Eyewitness Evidence Committee, the Task Force also recommends, as a management policy, that every identification case brought in Superior Court be approved for prosecution by either the First Assistant District Attorney or the Chief of Homicide. Centralized approval will mean that every identification investigation and every decision to charge a suspect will have to meet certain high standards. Given what is at stake in identification cases, the District Attorney should require that cases are reviewed and approved at the highest level.

Post-Conviction Practices.
A prosecutor’s pursuit of justice does not end with a conviction. Erroneous conviction cases around the country have shown prosecutors using a variety of approaches to post-conviction cases involving untested evidence. These practices run from adamant opposition, to willful inaction, to cooperation and pursuit of possible exculpatory evidence. The Suffolk District Attorney’s office has conducted its post-conviction work ethically and professionally in the erroneous conviction cases. Two practices from recent years have been particularly effective and should be adopted as permanent, written policies.

First, the District Attorney’s policy not to oppose post-conviction requests for DNA testing of relevant evidence gives every convicted defendant the chance to use DNA testing when it might have a chance of yielding exculpatory results. This policy should be permanent and uniformly applied.

Second, the District Attorney’s DNA Committee, comprised of senior prosecutors with significant experience in DNA issues and post-conviction cases, should be made permanent and continue to review, monitor and make decisions in post-conviction motions that involve requests for DNA testing. The DNA Committee has provided in recent years an important internal forum for analyzing challenging issues, evaluating new evidence, and determining the fairness of a conviction in light of new information. Its work is of sufficient important that the DNA Committee should be a permanent part of the agency.

VI. Training and Accountability

The Task Force recommendations will be most effective if implemented through proper training and monitored with meaningful oversight. The Task Force, therefore, makes the following recommendations directed towards implementation and accountability.

1. Initial and ongoing training of police officers, detectives, and prosecutors on identification procedures, investigation of identification cases, and prosecution of identification cases, including joint training where appropriate.

2. Annual internal review, for at least the next two years, of these recommendations to evaluate the implementation and the effectiveness of new procedures and policies.

3. Continuation of this Task Force for the purposes of (a) monitoring the adoption of these recommendations and (b) suggesting any revisions or additional recommendations that would improve the investigation and prosecution of identification cases.

BOSTON, Jan. 29, 2014—Shawn Flores’ mother embraced the father of the man who killed her son at an emotionally-charged sentencing hearing in Suffolk Superior Court today, District Attorney Daniel F. Conley said.

Flores, 29, was shot dead on Sept. 22, 2011, by KENDRICK CLARK (D.O.B. 3/19/74) on the porch of their Dorchester rooming house. No one saw the shooting, but Flores identified his killer in a dying declaration to residents who came running and relayed his last words to Boston Police homicide detectives. They were arraigned the next day in Chelsea District Court, where Suffolk prosecutors recommended that they be held on $10,000 cash bail each. Judge D. Dunbar Livingston imposed $5,000 each. CEDRICK SLAYDEN (DOB 12/11/95) was arraigned this morning in Dorchester Municipal Court on charges of unlawful possession of a firearm, unlawful possession of ammunition, and carrying a loaded firearm.  At the request of Assistant District Attorney Michael Callahan, Judge James Coffey set bail in the amount of $50,000 and ordered Slayden to wear a GPS monitoring device, abide by a curfew, and stay away from Mattapan in the event that he is released on bail.  Coffey also granted Callahan’s motion to revoke Slayden’s open bail on a 2013 case out of Boston Municipal Court charging him with larceny from a person. more »

MIGUEL VELASQUEZ-MENDOZA (D.O.B. 5/30/93) was arraigned in South Boston District Court on charges of unarmed robbery, assault and battery with a dangerous weapon, and assault and battery on a disabled person.  Assistant District Attorney Elizabeth Burke requested that bail be set at $10,000 and that Velasquez-Mendoza’s bail be revoked in an open case out of Concord District Court charging him with larceny over $250.  Judge Tracy-Lee Lyons imposed $1,500 bail and ordered that he undergo mental health evaluation and any treatment deemed necessary, stay away from South Boston, remain drug-free, and undergo random drug screens.  Lyons declined to revoke the defendant’s open bail. more »

JESSICA LUCIA (D.O.B. 11/20/80) was arraigned today on charges of mayhem, assault with a dangerous weapon, and assault and battery on a public employee for the Sept. 30 incident. The decision by Justices Peter Agnes, Jr., Judd Carhart, and Ariane Vuono affirms the convictions of NICOLE CHUMINSKI (D.O.B. 5/19/82) on two counts of second-degree murder for the April 6, 2008, homicides of 14-year-old Acia Johnson and her 2-year-old sister, Sophia, in their West 6th Street home. After 10 days of testimony elicited by Suffolk prosecutors, a jury convicted Chuminski of those offenses, as well as one count of arson for setting the blaze and two counts of assault and battery with a dangerous weapon – smoke and flames – for injuries sustained by the girls’ mother and brother, who survived. more »
